10 281 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS May 5 , 2003 The Johnston County Board of Commissioners met in regular session Monday , May 5 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Jeffrey P Carver , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the April 7 , 14 , 16 , 28 , 30 , 2003 board meetings as presented Public Comment 2 Request for Sewer Connection Exemption Rev Larry Hunt from Wilson’s Mills Church of God asked the Board to exempt his new church from the mandatory sewer connection policy The new facility will be on a 172 acre site , and it would cost the church members approximately 47,000 to 50,000 to hook onto the County system Larry McCoy , contractor for the Church , stated in his opinion , a conventional septic system would be sufficient , based on the anticipated usage of the facility Basically , the church would be open three times a week with an estimated use of 900 gallons per week He noted if they have to connect to the County’s system , they would have to run a considerable amount of sewer line just to get to the Church facility Chairman James H Langdon , Jr stated the Board would look at the different options and make a decision at next Monday’s meeting 3 Inspections Department Complimented Mike McLamb of Spectrum Realty and McLamb Development complimented the County Inspections Department for helping him with the necessary permitting for locating two new clients in facilities in the County Both projects had challenging issues , and the Inspections Department , along with the Smithfield Fire Department , quickly and professionally found solutions that allowed the process to go smoothly He noted in the past he has been vocal about his concerns and questions about the future of economic development in the County due to what he perceived as problems from the County agencies Now , after this experience , he stated he would have to say he has a more positive attitude about the future of economic expansion in the County 4 Commuter Rail Service - Feasibility Study Mayor Jeanne Bonds of Knightdale spoke to the Board about the feasibility of a commuter rail system between Wake County and Goldsboro and Wilson , that would go through Johnston County Mayor Bonds noted her town began thinking about this last year when they were updating their comprehensive plan The Capital Area Metropolitan Planning Organization CAMPO and the NC Department of Transportation are providing funding for a feasibility study , which should be done within the next few months Most of the counties and municipalities , including Johnston County , have been involved in the preliminary meetings , and she voiced her hope that Johnston County will continue to support the project Commissioner Allen L Mims , Jr noted that if this can be done to include buses or some means of getting people to their offices , it would be great He applauded Knightdale for their innovative planning for the future Page282 May 5 , 2003 Continued Commissioner Thomas M Moore agreed and noted this would be a long - term project for the future , which , in his opinion , is the type of thing the Commissioners need to focus on 5 Fireworks Display - Archer Lodge Community Center Commissioner Cookie Pope moved the Board approve a fireworks display for the Archer Lodge Community for July 4 , 2003 rain date July 5 , 2003 at the Recreation Park , subject to compliance with NCGS 14 - 410 , 14 - 415 and Chapter 20 of the Standard Fire Prevention Code , along with necessary permits from the applicable Inspections Department , and authorize the Chairman to approve future similar requests Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote 6 Surplus Property - Health Department Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board declared surplus a Leisegang Colposcope from the Health Department and authorized the equipment be sold to another government entity , as allowed by the NC General Statutes 7 Juvenile Crime Prevention Council JCPC - Budget for 2003 - 04 Judge Addie Rawls , JCPC Chairperson , presented the program funding proposals for FY2003 - 04 The State Department of Juvenile Justice has allocated 251,007 to Johnston County to address the needs of youth at risk and provide sentencing alternatives for judges who deal with delinquent youth The Council met to review the programs that applied for funding The following are recommended for the upcoming year Hillcrest Youth Shelter 12,000 Health Choices , Health Relationships 37,500 Restitution Community Service 67,565 Court Psychologist 6,500 Johnston County Youth Services 122,442 Requires matching funds Administrative Budget 5,000 251,007 Judge Rawls explained the Youth Services Program does require a local match in the amount of 47,679 , of which 22,830 can be in - kind services The remaining 24,849 is requested as a County allocation She requested the Board approve the proposed programs for funding allocation and commit to a local match in the amount of 24,849 from the FY 2003 - 04 County budget Commissioner Jeffrey P Carver stated he serves on this Board and fully supports the request He noted he would be working with the group in the future about possibly flattening out the administration somewhat Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the JCPC program funding allocation for FY 2003 - 04 and agreed to appropriate the local match in the amount of 24,849 in the upcoming budget Judge Rawls thanked the Board and noted a facility is badly needed for the structured day program The Council is exploring ideas and would like the County to keep this in mind 8 Public Hearing - Establishment of Little River Water District Advertised The Smithfield Herald April 18 , 25 , May 2 , 2003 The Kenly News - April 14 , 2003 The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed Little River Water District Engineer Tim Broome showed a map of the proposed district , which would extend from Pine Level and Selma north to Kenly and the Stancil’s Chapel Community He noted , in his opinion , there is sufficient interest to make this a successful district In response to a question from Commissioner Cookie Pope , Mr Broome noted the district boundaries would be contiguous with other districts and should have between 800 and 1200 customers Page283 May 5 , 2003 Continued County Manager Rick Hester noted the creation of this district would leave only one area of the County without public water , and that area could become a final water district in the future There being no further comments , the Chairman closed the public hearing Resolution Establishing the Little River Water District Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution RESOLUTION CREATING THE LITTLE RIVER WATER DISTRICT OF JOHNSTON COUNTY WHEREAS , the Johnston County Board of Commissioners hereinafter the Board at its regular meeting on April 7 , 2003 , resolved that a Public Hearing be held , pursuant to NC General Statutes Chapter 162A - 88 et seq , to consider creation of the Little River Water District of Johnston County ; and , WHEREAS , the Board further resolved that the Public Hearing should be held on Monday , May 5 , 2003 , and directed the appropriate representative of the County to take the necessary actions to hold the Public Hearing ; and WHEREAS , the Board further resolved that the appropriate representatives of the County take the necessary actions to properly notice the Public Hearing as provided by law ; and WHEREAS , pursuant to NC General Statutes Chapter 162A - 86 , a Notice of Public Hearing was prepared stating the date , hour and place of the hearing and its subject and setting forth a description of the territory to be included within the proposed Little River Water District of Johnston County ; and , WHEREAS , pursuant to NC General Statutes Chapter 162A - 86 , the Notice of Public Hearing was published once a week for three weeks in newspapers that circulate in the proposed district and posted in at least three public places in the district The Notices of Public Hearing were posted and published the first time not less than twenty days before the hearing ; and , WHEREAS , a Public Hearing was held at 10 30 am on May 5 , 2003 , in the Commissioners Room , Courthouse Annex , Smithfield , North Carolina at which time taxpayers and all other interested persons appeared and were heard concerning the question of creating the Little River Water District of Johnston County ; and , WHEREAS , the Board , following the Public Hearing , finds that 1 There is a demonstrable need for providing water services in the district ; 2 The residents of all the territory to be included in the district will benefit from the districts creation ; and 3 It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies ; and WHEREAS , the Board recognizes that vital matters to be considered in creating the district are the availability of federal funding and the successful issuance of bonds and or notes for the purpose of providing funding to provide water to the district , or portions thereof , and the number of users who contract to purchase water ; and , WHEREAS , the Board finds that the district shall be defined as set forth in the Notices of Public Hearing ; and , WHEREAS , the Board now desires to create the Little River Water District of Johnston County NOW , THEREFORE , BE IT RESOLVED by the Johnston County Board of Commissioners , as follows 1 It is hereby found that a There is a demonstrable need for providing water services in the district ; b The residents of all the territory to be included in the district will benefit from the districts creation ; and c It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies ; and 2 The Little River Water District of Johnston County is thereby created as provided above and the said District is hereby described as follows Beginning at the point , said point being the common point between Johnston County , Wilson County , and a point 500 feet north of the northern right - of - way of NC 42 thence in a westward direction along a long 500 feet parallel to the northern right - of - way of NC 42 approximately 29,300 feet to the intersection with the Buffalo Water District Boundary , thence in a southward direction approximately 70,200 feet along the Buffalo Water District Boundary to the intersection with the Town of Selma ETJ , thence in a southward direction along the Town of Selma’s ETJ approximately 14,110 feet to the intersection with the Town of Pine Level’s ETJ , thence in an eastward direction along Town of Pine Level’s ETJ approximately 14,020 feet to a point 50 feet north of the northern right - of - way of SR 2320 Rains Road , thence in a westward direction 50 feet parallel to the northern right - of – way of SR 2320 approximately 3,740 feet a point 50 feet west of the intersection with between the northern right - of way of SR 2320 and the western right - of - way of SR 2324 Pinecrest Road , thence in a southward right - of - way of SR 2142 Watson Road , thence westward in a line 500 feet parallel to the south of the southern right - of - way of SR 2142 approximately 2,480 feet to a point 500 feet east of the eastern right - of - way of SR 2141 Oak Grove Inn Road , thence in a southward direction along a line 500 feet parallel to the eastern right - of way of SR 2141 approximately 1,450 feet to the intersection with the centerline of Berna Branch Creek , a tributary of the Little River , thence along Berna Branch Creek in an westward direction approximately 9,850 feet to the intersection with the western Town of Micro’s ETJ , thence along the Town of Micro’s ETJ in a southward direction approximately 9,910 feet to the intersection with the southern right - of - way of Interstate 95 , thence along the southern right - of - way of Interstate 95 in an eastward direction approximately 11,710 feet the said point of beginning 3 The Clerk to the Board is hereby authorized and directed to cause the Resolution to be published once in each of two successive weeks in the newspapers in which the Notices of Public Hearing were published , and in addition thereto cause to be published with the resolution a notice as provided in NC General Statutes Chapter 162A - 87 b The County , and its officers , agents and attorneys are hereby directed to take any further actions as may be required by the laws of the State of North Carolina to perform the matters and things directed by this Resolution th Duly adopted this 5 day of May , 2003 9 Resolution Providing for Uniform Policy and Schedule - Little River Water District Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board recessed regular session to meet as the Little River Water District Board Commissioner W Ray Woodall moved the Board adopt the following resolution Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote RESOLUTION PROVIDING FOR ADOPTION OF UNIFORM POLICY AND SCHEDULE FOR THE LITTLE RIVER WATER DISTRICT WHEREAS , The Board of Commissioners of Johnston County has adopted uniform policies and fee schedules for customers of all water districts within Johnston County , as well as all retail water service areas of Johnston County the “ Uniform Policy ” ; and WHEREAS , The Board of Commissioners of Johnston County acting as the governing body the “ Board ” of the Little River Water District “ the District ” has expressed its desire to adopt the Uniform Policy for the District , together with any and all existing and future amendments thereto ; and WHEREAS , The Board desires to adopt a regular meeting schedule for the District ; BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY ACTING AS THE GOVERNING BODY OF THE LITTLE RIVER WATER DISTRICT 1 The District hereby adopts the Uniform Policy for the District 2 The District hereby approves and adopts any amendments to the Uniform Policy , including all rules and regulations , adopted in the future by the Johnston County Board of Commissioners which are designated to be a part of the Uniform Policy for all water districts within the County , and agrees that such amendments will apply within the District as if specifically approved and adopted by the Board of Commissioners of Johnston County sitting as the governing body of the same dates as the regularly scheduled meetings of the Board of Commissioners of Johnston County 4 This resolution shall take effect immediately Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Little River Water District Board was adjourned and regular session resumed 10 Johnston County Animal Protection League - Animal Shelter Concerns Ulli Mattern , president of the Johnston County Animal Protection League JCAPL , spoke with the Board about concerns the League has with the operation of the County’s Animal Shelter Ms Mattern outlined four major areas of concern lt; Adoption practices - Anyone can adopt an animal for 5 with no screening or counseling Often these animals are abandoned when the owner finds out the costs related to having a pet , or when the pet has behavioral problems Outreach , training and education is needed lt; Animals leaving are unaltered - This worsens the problem of over population lt; Practice of Euthanasia - Although it is understood that some animals have to be euthanized , the use of gas is not recommended for puppies , kittens or older animals lt; Vaccinations - The league has offered to provide vaccinations for all animals , but were turned down Ms Mattern noted the Johnston County Shelter itself is very good , however , in her opinion , a good shelter goes beyond a good facility She suggested the League would like to help by taking over the management of the shelter Recently she spoke with the Manager and Sheriff about doing this , and was under the impression the negotiations were ongoing , however , she has now been informed the County does not wish to make any changes at this time She noted if the League ran the shelter , they would want to raise the adoption fees , but would provide information and counseling to make sure the animal received at least basic care She would enlist the volunteer assistance of local vets and others to make sure that no sick animals left the facility She asked the Board to consider letting the community help with the growth of the shelter Alex Harding , treasurer of the JCAPL , stated he has tried to get some of the statistics about the Shelter operation , but was informed the data was lost in a computer crash Julia West voiced concern that all animals are not given the full five adoptable days before being euthanized She called the treatment inhumane and a disgrace She noted she had tried to volunteer her services , but had been turned down Lisa Wheaton with Hemlock Bluffs Animal Hospital in Cary stated , in her opinion , gas should not be used on puppies and kittens She offered to come in and perform the euthanasia by injections , but was not allowed to do so She noted several veterinarians were in attendance who would volunteer their services She noted the Sheriff’s department does a great job of protecting humans , but suggested they were uneducated in the care of animals ; they don’t have the manpower and have not been trained to do this type of work She voiced her support for the JCAPL to take over the program Martha McGee stated she has recently moved to Johnston County from Massachusetts where , in her opinion , the animal shelters are well managed , very much like what is being proposed by the Animal Protection League for Johnston County’s shelter She noted in Massachusetts , the shelters have a spay and neuter program and a foster program that has virtually eliminated the over population of animals She stated she was appalled to find out about , what she considers , utter inhumane treatment of animals in Johnston County , and noted animals have feelings and emotions just like humans She suggested the adoption fee for any animal should be at least 100 , and noted if a person couldn’t afford that , then they couldn’t afford the shots to keep the animal well Connie Sorenson stated she runs an independent shelter , and noted this is a tremendous responsibility She is licensed by the Department of Agriculture , and has to meet certain standards now , and will have to meet more stringent standards in the future The County’s shelter facility already meets the upcoming standards , and in her opinion , the County should let the JCAPL , who are trained , run the facility Chairman Langdon thanked everyone for their comments and stated the Board would take this under advisement PagePage pageNumber6286 May 5 , 2003 Continued 11 Board of Education - Amendments to Project Ordinances and Request to Use ADM Funds Dan Jones , Schools Finance Officer , referenced requests forwarded to the Commissioners from School Superintendent Jim Causby for amendments to the capital project ordinances for school projects to reallocate bond funds among several school building projects , and for approval to use State ADM funds for capital projects He noted that State ADM funding has been frozen , but the Schools are using existing funds from overages to cover project variances In response to a comment from Commissioner Mims concerning complaints about late payments to some of the contractors , Mr Jones stated payment requests have only been held up twice , both times by the Architect because of corrections that needed to be made In all other cases , payment has been made within 30 days , as stipulated Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the following project ordinance amendments and use of State ADM funds for the Schools Capital Project Ordinance Amendments on school projects South Johnston High School - increase 925,000 Wilson’s Mills Elementary - decrease 100,000 Cooper Elementary - decrease 25,000 New West Smithfield Elementary School - decrease 100,000 Clayton High School - decrease 300,000 Meadow Elementary School - decrease 400,000 Use of State ADM funds for the following projects Smithfield - Selma High Renovation -
