10 331 Meeting of the Johnston County Board of Commissioners June 9 , 2003 The Johnston County Board of Commissioners met in regular session Monday , June 9 , 2003 , at 7 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , The following members were present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Jeffrey P Carver , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , and Mark Payne , County Attorney The Chairman called the meeting to order and the following business was transacted Public Comments - No one spoke at this time 1 Rezoning Case 03 - 9 Continued from May 12 , 2003 Case 03 - 09 Petition to rezone five parcels totaling approximately 1715 acres located off US 701 South and Devil’s Racetrack Road SR 1009 in Ingrams Township from Interstate Highway Interchange District Overlay District to Agricultural Residential Owners and Applicants Jeanette Allen Massengill , Dianne Massengill Wilkinson , Clifford Bailey Massengill and Robert Craig Massengill A public hearing was held on M ay 12 , 2003 for rezoning Case 03 - 09 Following the hearing , the case was discussed and continued until this meeting to give Commissioners time to check with the Tax Administrator and further study the matter Planning Director , Steven Finn , again pointed out on the GIS map the five parcels which are within the I - 95 Interstate Overlay District IOD Other than the IOD designation , the predominate zoning in the area is Agricultural Residential A R with some satellite commercial zoning by the Town of Four Oaks The Planning Board recommended approval by unanimous vote Chairman Langdon noted this case is unique in that it is based on tax value and will affect many similar cases in the County Commissioner Allen L Mims , Jr posed the question of whether IOD is a district or a zoning designation He pointed out the permitted IOD uses outlined in the County Code indicate they are in addition to the uses of an underlying zone He questioned how the tax value was determined in these cases Attorney Mark Payne explained the IOD designation began in 1991 when the County adopted countywide zoning and established an official zoning map The properties within all similar Interstate Overlay Districts went from no zoning to IOD , and since zoning was initiated by assuming all property in the County was A R prior to zoning , the underlying designation in these cases would be A R The County adopted subsequent zoning maps in 1997 and 2000 Tax Administrator , Pat Goddard , pointed out this is the first revaluation in which the Tax Department had the technology available to incorporate zoning as a criteria in valuing property All properties in these districts were picked up as IOD zoning , which carried commercial pricing as established in the Schedule of Values adopted by the Board of Commissioners Therefore , comparable commercial sales were used in determining the values , even if the property was currently not being used at its highest and best use Ms Goddard stressed that zoning was only one criteria used in determining value Each property was considered individually , and the value was adjusted according to all the factors involved In looking at the values of the properties in question in this case , two were valued low because they were landlocked and were primarily wetlands Those properties would see little change if they were downzoned to AR Another 906 acre tract would be reduced approximately 38 if downzoned Commissioner Wade M Stewart suggested the purpose of the overlay district when it was established was to encourage commercial growth in the areas around Interstate intersections , and was a means to allow commercial development without having to go through the rezoning process He questioned whether it wasPage332 June 9 , 2003 Continued ever the Board’s intention to actually rezone the property , and if that is the case , in his opinion , the people should not be penalized At the same time , he pointed out that should the Board approve this request , there would be many others wanting to do the same thing , which would defeat the purpose of the overlay district , and defeat the County’s authority to direct growth Commissioner Cookie Pope pointed out the Board recently lifted an overlay on the US 70 corridor and gave the property owners the option of changing their zoning back to AR She stated , in her opinion , these property owners should have the same opportunity County Manager , Rick Hester , noted that if the Board were to rezone the property , it would not affect st the taxes for the current year since the values were determined based on the zoning as of January 1 , which was IOD He also pointed out that any property in the County , regardless of zoning , would be eligible for farm use value , if it meets the criteria set out by the State Unfortunately , none of these tracts are large enough to qualify for farm use Commissioner Thomas M Moore pointed out there are a number of properties in the County that are zoned commercial or industrial that are currently being farmed He asked Ms Goddard if the use was taken into consideration for those properties Ms Goddard responded that for tax purposes , the value of property is based on its highest and best use according to its zoning Current use is not a consideration Commissioner Moore then stated , in his opinion , the approval of this case would create a problem for the County If multiple properties are rezoned , the tax rate for all the citizens would be affected He noted the Board adopted the Schedule of Values and if a property owner disagrees with his value , the Board has appointed a Board of Equalization and Review to hear those appeals Commissioner Jeffrey P Carver noted the IOD zoning designation has been in place for many years and no one has had a problem Approximately 1000 acres of under - developed land is located at I - 40 42 To open this up for rezoning would create a huge hole in the tax base Commissioner Wade M Stewart remarked that his focus is to assist the taxpayers if possible He suggested that since this is such a big issue , and any decision would not affect the Massengills ’ tax bill for this year , it might be a good idea to take some additional time to discuss this with the Attorney and Tax Administrator Board members agreed this issue needs further study Commissioner Cookie Pope moved the Board continue the case until a later date Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote Chairman Langdon stated he would at a later date appoint a committee to study this issue 2 Public Hearing - Rezoning Cases & Special Use Permit Request Advertised - In the Smithfield Herald - May 30 , 2003 and June 6 , 2003 Certified letters were mailed to adjoining property owners on May 29 , 2003 and notices posted at the locations on May 27 , 2003 The Chairman opened the rezoning public hearing and invited anyone who wished to comment on the following advertised rezoning and special use cases Case 03 - 13 CASE TABLED until next month at the request of the applicant Petition to rezone approximately 20 acres located on Banner Elk Road SR 1304 in Banner Township from Agricultural Residential to Agricultural Residential - Special Use District Owner Jean M McGranahan Applicant Dora L Turner Case 03 - 14 Petition to rezone approximately 154 acres located on Little Creek Church Road SR 1563 in Smithfield Township from Agricultural Residential to Industrial 1 - Special Use District Owners and Applicants Herbert H Fannin and Sandra Fannin Mr Finn indicated the property on the GIS Map and noted it is located on Little Creek Church Road with several subdivisions in the area The surrounding zoning is predominately Agricultural Residential Page333 June 9 , 2003 Continued Herbert Fannin , applicant , 1714 Little Creek Church Road , stated he has operated his sheet metal business at this location since 1988 and wishes to expand his facility He noted there would be no changes other than the size of the building Mr Finn stated the Planning Board recommended approval by unanimous vote The Chairman Closed the Rezoning Public Hearing for Case 03 - 14 Decision on Rezoning Case 03 - 14 Case 03 - 14 Petition to rezone approximately 154 acres located on Little Creek Church Road SR 1563 in Smithfield Township from Agricultural Residential to Industrial 1 - Special Use District Owners and Applicants Herbert H Fannin and Sandra Fannin Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board approved rezoning case 03 - 14 for owners and applicants , Herbert H Fannin and Sandra Fannin of approximately 154 acres located on Little Creek Church Road SR 1563 in Smithfield Township from Agricultural Residential to Industrial I - Special Use District The Chairman opened the Special Use Permit Hearing for Case 03 - 14 Case 03 - 14 Special Use Permit application for an office , sheet metal fabrication shop on approximately 154 acres located on Little Creek Church Road SR 1563 in Smithfield Township Owners and Applicants Herbert H Fannin and Sandra Fannin Those wishing to speak on special use permit case 03 - 14 were sworn in by the Clerk to Board Mr Finn entered the following summary of evidence on Case 03 - 14 into the record A pre - application hearing was held with the applicant on March 17 , 2003 At that time , the applicant was informed of the following ? If approved , applicant must provide to the Planning Office a Site Plan for their review and approval ? Applicant must comply with the requirements of the Johnston County Development Ordinance regarding landscaping , buffering and fencing or any additional requirements as approved by this Board ? Applicant will be notified in writing of the Board’s decision ? If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of Commissioners ? Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within that time period ? When necessary , staff informed the applicant of further Planning Office requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements ? Subsequent to the pre - application conference , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On April 15 , 2003 , the Johnston County Planning Board held a public meeting regarding this case They recommended approval of rezoning by a unanimous vote of 8 - 0 to Industrial I - Special Use District and recommended a special use permit for an office and sheet metal fabrication shop based on the following findings of fact and special conditions Findings of Fact 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; 2 That the use of development appears to comply with all required use and intensity regulations of Articles II and VI of the Development Ordinance , and the applicable specific standards contained in section 14 - 257 and with all applicable regulations Note Applicable regulations not in the landuse chapter may include and are not limited to other provisions of this Code , other ordinances and resolutions , and state and federal regulations ; 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; 4 That the use or development conforms with general plans for the physical development of the County’s planning jurisdiction as embodied in the Development Ordinance , the County Strategic Plan , or other development policies as adopted by the Board of Commissioners ; and 5 The use as proposed complies with all required use and intensity regulations of the Johnston County Development Code ; andPage334 June 9 , 2003 Continued 6 Rezoning would avoid unreasonable invasion of established private property right section 14 - 551 7 The use will serve the community and County Special Conditions 1 Existing landscape around the zoning parcel shall not be removed 2 Days of Operation Monday - Sunday 3 Hours of Operation 6 00 am to 10 00 pm 4 Additional Buffer B required shown on site plan be in place prior to the issuance of a Certificate of Occupancy Commissioner Allen L Mims , Jr asked Mr Fannin why he is requesting the permit allow him to work on Sundays Mr Fannin responded that his operation is entirely done inside the building and creates virtually no noise In response to a question from Commissioner Cookie Pope , Mr Fannin stated he does all the work himself and has no employees There being no further comments , the Chairman closed the Special Use Permit Hearing for Case 03 - 14 Decision on Application for Special Use Permit for Case 03 - 14 Case 03 - 14 Special Use Permit application for an office , sheet metal fabrication shop on approximately 154 acres located on Little Creek Church Road SR 1563 in Smithfield Township Owners and Applicants Herbert H Fannin and Sandra Fannin Based on the following findings of fact and conditions attached , Commissioner W Ray Woodall moved the Board authorize the Planning Department to issue a special use permit to owners and applicants Herbert H Fannin and Sandra Fannin for an office , sheet metal fabrication shop on approximately 154 acres located on Little Creek Church Road SR 1563 in Smithfield Township Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Findings of Fact 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; 2 That the use of development appears to comply with all required use and intensity regulations of Articles II and VI of the Development Ordinance , and the applicable specific standards contained in section 14 - 257 and with all applicable regulations Note Applicable regulations not in the landuse chapter may include and are not limited to other provisions of this Code , other ordinances and resolutions , and state and federal regulations ; and 5 The use as proposed complies with all required use and intensity regulations of the Johnston County Development Code ; and 6 Rezoning would avoid unreasonable invasion of established private property right section 14 - 551 7 The use will serve the community and County Special Conditions 1 Existing landscape around the zoning parcel shall not be removed 2 Days of Operation Monday - Sunday 3 Hours of Operation 6 00 am to 10 00 pm 4 Additional Buffer B required shown on site plan be in place prior to the issuance of a Certificate of Occupancy The Chairman re - opened the Special Use Permit Hearing for Case 03 - 7 Case 03 - 7 Petition seeking a Special Use Permit for a Sand Mining Operation on approximately 1074 acres located on Devil’s Racetrack Road SR 1009 in Bentonville Township Owner Johnston Community College Applicant Herman Kight Jamie Sasser Those wishing to speak on Case 03 - 07 were sworn in by the Clerk to Board PagePage pageNumber5335 June 9 , 2003 Continued Mr Finn explained this property was rezoned I - 2 , Special Use District on March 12 , 2001 and the special use permit request was postponed until the applicant was ready to move forward The applicants are now ready to proceed and the permit request is for a sand mining operation on 1074 acres in Bentonville Township He indicated the property on the GIS map and showed its proximity to the Neuse River Commissioner Allen L Mims , Jr asked Robert Massengill with Southwind Engineering and Surveying if there is a new proposed access road for the project Mr Massengill explained the initial plan was to enter the project by the Environmental Learning Center and use the existing road back to the site , which is located on the back of the property When this option was determined to be unsatisfactory , a new access road was proposed from Devil’s Racetrack along the northern property line to the site Unfortunately , there was too much wetland to go over to make this option feasible The plan now is to enter the property and use the existing single lane access road The road would be improved with pull offs so that traffic could meet and pass He noted this is not a preferred option , and in his opinion , will limit the industrial interest in the site It is estimated that not having a good two lane road to the site will make it appealing to small operations , but not large industrial concerns , which will mean that mining the area will take longer and it will not be as deep as the Community College would have liked In response to questions from Commissioner Allen L Mims , Jr , Mr Massengill stated the entrance now would line up directly across from the entrance to Deer Run Subdivision This was presented to the Planning Board as an option , but at the time it was thought that the new road could be built With the current plan , an easement will have to be obtained Commissioner Wade M Stewart stated he would like to see the Community College do this ; however , he would want an additional condition on the permit that stipulates that this be monitored carefully He noted he is concerned about a runoff of silt from dredging , and the permanency of improvements on the path He noted sometimes improvements don’t last , and upstream land can be adversely affected Monitoring needs to be done regularly at the local level because it would take too long for the State to check on a situation if a person’s land upstream is overcome by water Commissioner Thomas M Moore agreed and noted the County’s Stormwater Management and or the proposed Public Utilities Sedimentation and Erosion Control Division personnel should monitor this operation One of the problems would be beavers creating a dam that would back water up on other properties Mr Massengill stated if this is a condition to the permit , he will solicit bids stating the mining operator will be responsible for monitoring beaver activity Mr Finn entered the following summary of evidence into the record A pre - application hearing was held with the applicant on January 17 , 2003 At that time , the applicant was informed of the following lt; If approved , applicant must provide to the Planning Office a Site Plan for their review and approval lt; Applicant must comply with the requirements of the Johnston County Development Ordinance regarding landscaping , buffering and fencing or any additional requirements as approved by this Board lt; thence in a southwesterly direction to a point 2 at the intersection of SR 1735 Jordan - Narron Road and SR 1003 Buffalo Road , including property on SR 1735 Jordan - Narron Road between this and the preceding point ;
