10 437 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS September 2 , 2003 The Johnston County Board of Commissioners met in regular session Tuesday , September 2 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Jeffrey P Carver , and W Ray Woodall Absent Wade M Stewart Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the August 4 , 11 , 2003 board meetings as presented Public Comments - No one spoke at this time 2 Proclamation - American Business Women’s Association Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following proclamation PROCLAMATION AMERICAN BUSINESS WOMEN’S DAY WHEREAS , in salute to the more than 80,000 ABWA members for their supportive efforts in helping women advance through education , and for developing an informed and responsible citizenry NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim September 22 , 2003 , as American Business Women’s Day in Johnston County Adopted this the 2nd day of September , 2003 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Ashton Court and Pond Field Court in River Hills Subdivision , Phase 1 , Section D , in Wilders Township Line Drive , Travel Lite Drive , Natalie Court , Hobby Court , Peggy Court , Mark Lane , Irene Lane , and Ione Lane in Waverly Point Subdivision , Phase 1 in Cleveland Township Water Oak Drive in Walkers Ridge Subdivision , Phase 3 in Cleveland Township Messer Road and Rockhurst Court in Rockhurst Landing Subdivision , Cleveland Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote 4 Resolution Authorizing Financing Agreement for Johnston Memorial Hospital Chairman James H Langdon , Jr , who also sits on the Johnston Memorial Hospital Board of Trustees , explained the Hospital plans to purchase MRI equipment and construct a building to house the unit They are proposing two separate financings , one for 3,000,000 for five years to purchase the equipment , and one for 2,000,000 for 15 years to build the structure He noted that after some delay , the State has finally issued a Certificate of Need for JMH to have this equipment He recognized Lee Farnell , hospital administrator , and Hank DeBragga , hospital finance officer Page438 September 2 , 2003 Continued Mr Farnell informed the Board a MRI mobile unit has been coming to JMH for some time , however , this service is now cutting back on MRI procedures The new in - house equipment will operate up to 70 hours a week with full day time and on - call night staff This should speed up the process for the procedures considerably In response to a question from Commissioner Allen L Mims , Jr , Mr Farnell noted the new building would be just large enough to house the equipment with some room for storage The current hospital plant does not have room for the MRI machine , which requires considerable shielding Following discussion , Commissioner Thomas M Moore moved the Board adopt the following resolution authorizing the financings for Johnston Memorial Hospital Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR APPROVAL OF A FINANCING AGREEMENT AUTHORIZED BY NORTH CAROLINA GENERAL STATUTE 160A - 20 WHEREAS , the County of Johnston , North Carolina “ Johnston County ” owns Johnston Memorial Hospital the “ Hospital ” which is operated by a Board of Trustees appointed by the County ; and WHEREAS , The Hospital desires to purchase certain equipment , consisting of a magnetic resonance imaging scanner “ MRI ” and a computerized axial tomography scanner the “ Equipment ” , and construct a building on the Hospital property to house the MRI the “ Improvements to Real Estate ” collectively , the “ Project ” ; and WHEREAS , it proposed that the Project be financed through an installment purchase contract the “ Contract ” entered into by Johnston County pursuant to GS 160A - 20 for the benefit of the Hospital for a term of five 5 years for the Equipment and a term of fifteen 15 years , for the Improvements to Real Estate , and WHEREAS , the purpose of the Project is to better serve the healthcare needs of the citizens of Johnston County ; and WHEREAS , findings of fact by the Board of Commissioners of Johnston County must be presented to enable the North Carolina Local Government Commission to make its findings of fact set forth in North Carolina General Statute 159 , Article 8 , Section 151 prior to approval of the proposed contract ; NOW , THEREFORE , BE IT RESOLVED that the Board of Commissioners of Johnston County , meeting nd in regular session on the 2 day of August , 2003 , makes the following findings of fact 1 The proposed Contract is necessary or expedient because I the Project will enhance the diagnosis and treatment of illness and improve the provision of health care to the citizens of Johnston County , and ii it would be financially disadvantageous to internally fund the Project with Hospital reserves 2 The Contract is preferable to a bond issue for the same purpose because the costs of retaining bond counsel and other origination costs for such a small obligation would increase the effective interest rate to an unacceptable rate 3 The sums to fall due under the Contract are adequate and not excessive for the proposed purpose because I the Equipment will be purchased pursuant to a competitive group purchasing program , ii the Improvements to Real Estate will be competitively bid and iii the interest rate or rates paid under the Contract will be determined pursuant to a competitive process 4 Facts supporting the conclusion that debt management policies have been carried out in compliance with the law and reasonable assurances that compliance with the law will henceforth be carried out are as follows a The Local Government Commission has taken no action against the County , nor found the County to have acted improperly in debt management b The County has not defaulted on any debt obligation © The County follows the debt management guidelines of the North Carolina Local Government Commission 5 There will be no increase in taxes necessary to meet the sums to fall due under the Contract 6 Johnston County is not in default in any of its debt service obligations 7 The attorney for the Johnston County has rendered an opinion that the proposed Project is authorized by law and is a purpose for which public funds may be expended pursuant to the Constitution and laws of North Carolina 8 The probable net revenues of the project to be financed will be sufficient to meet the sums to fall due under the proposed contract , and Johnston Memorial Hospital has agreed to make all payments 9 All assets shall be titled in the name of Johnston County NOW , THEREFORE , BE IT FURTHER RESOLVED that the Finance Officer is hereby authorized to act on behalf of the Johnston County in filing an application for funding of 3,000,000 and 2,000,000 with terms of 5 years and 15 years , respectively , with the North Carolina Local Government Commission for approval of the Project and the proposed Contract and other actions not inconsistent with this resolution nd This resolution is effective upon its adoption this 2 day of September , 2003 Page439 September 2 , 2003 Continued 5 Budget Amendments Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved the following budget amendments Social Services - Recognition of Homeland Security Coordinating Group EMS Director , Dewayne West , pointed out that as mentioned last month , Johnston County will have the opportunity to apply for a number of Homeland Security Grants that will provide funds for “ all hazards ” planning in the County In order to receive the grants , a process must be put into place to insure that the money is distributed and spent appropriately The Federal Emergency Management Agency FEMA has classified 10 disciplines as first responder agencies that need to participate in the process Admin Policy , Communications and Interoperability , Emergency Management , Fire Service , LEPC HazMat , Health Hospital , Public Health , Public Works , Law Enforcement , and Emergency Medical Services Mr West recommended the Board establish these ten disciplines as the Homeland Security Coordinating Group with the understanding a core grant committee would be made up of representatives from each discipline The committee and sub - committees made up of others within the group will review and make recommendations to the Board of Commissioners on matters pertaining to homeland security Following discussion , Commissioner W Ray Woodall moved the Board establish the official Homeland Security Coordinating Group made up of the ten disciplines identified by FEMA Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 7 Appointments A Board of Adjustments - 1 position , 3 year term Commissioner Allen L Mims , Jr stated he talked with current member , Jesse Austin who informed him that he was under the impression he would not be eligible for reappointment due to the number of years he has already served When Commissioner Mims explained the length of service policy could be waived , Mr Austin stated he would like to be reappointed Based on the information above , Commissioner Allen L Mims , Jr moved the Board waive the length of service policy and reappoint Jesse Austin to the Johnston County Board of Adjustments for a three year term to expire September 2006 Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote PagePage pageNumber5441 September 2 , 2003 Continued B Alcoholic Beverage Control Board - 03 Looping Main and Small Water Main Extensions project , and approved the total project budget of 420,000 PagePage pageNumber6442 September 2 , 2003 Continued 10 Award of Bid - Brogden Water District Phase III Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board recessed regular session to sit as the Brogden Water District Board Mr Broome reviewed with the Water District Board the following bids that were received on August th 19 for construction of phase III of the Brogden Water District , which will add approximately 145 services He explained this project will be funded with the money remaining from the original project , and will provide service to many who were missed with the first construction Bidder Bid Bond Total Base Bid Byrd Brothers , Inc , Wilson , NC Yes 381,72600 Herring & Rivenbark , Inc , Kinston , NC Yes 396,92300 T A Loving Company , Goldsboro , NC Yes 398,04540 HB West , Inc , Smithfield , NC Yes 428,20300 Mecklenburg Utilities , inc , Oxford , NC Yes 449,18700 Billings & Garrett , Inc , Raleigh , NC Yes 531,59500 Mr Broome stated that staff is recommending award of contract to the low bidder , Byrd Brothers , Inc of Wilson in the amount of 381,726 , subject to USDA Rural Development approval Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board awarded contract to low bidder , Byrd Brothers , Inc , of Wilson in the amount of 381,726 for the Brogden Water District Phase III project Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Brogden Water District Board adjourned , and regular session was resumed 11 County to Allow Commercial Antennae on County Water Tanks The Board again discussed the issue of whether or not to allow commercial antennae on the County water tanks Chairman Langdon stated that Commissioner Allen L Mims , Jr made a valid point during the last discussion when he noted that the internal policy does not agree with the County Ordinance He stressed that this needs to be clarified Commissioner Mims pointed out that if the Board decides to allow the commercial equipment , it would not mean that antennae would go on every water tank This would only happen when one of the tanks is considered a good location by everyone involved County Manager , Rick Hester , informed the Board he contacted a number of cities and counties and received very positive feedback from those that do allow antenna on their water tanks ; however , it seems the key is to have the right user agreement in place to protect the County’s interest Commissioner Cookie Pope stated she is still bothered by the fact that this would take away opportunities for the private sector In response Commissioner Mims stated that when you consider the amount of property required for the fall zone , not many people would have enough land Using the County tanks would benefit everyone He noted the citizens at the meetings have indicated they would prefer using an existing structure over putting up another tower Following discussion , Commissioner Allen L Mims , Jr moved the Board abide by the County ordinance and allow the use of commercial antennae on County water tanks , if the water tank proves to be the best location according to the County’s consultant and all other parties involved , and the County establish a suitable user agreement for these cases Commissioner Jeffrey P Carver seconded the motion Discussion Commissioner Thomas M Moore stated he would like to see a draft agreement and have it incorporated in the County’s ordinance Commissioner Mims disagreed PagePage pageNumber7443 September 2 , 2003 Continued Commissioner W Ray Woodall suggested the motion be amended to stipulate that a memo must be in place before the motion is effective Following further discussion , Commissioner Mims agreed to amend his motion as follows , and Commissioner Carver agreed with the amendment Amended Motion Commissioner Allen L Mims , Jr moved the Board abide by the County ordinance and allow the use of commercial antennae on County water tanks , if the structure proves to be the best location , according to the County’s consultant and all other parties involved , and further moved that prior to any antenna being placed on a County water tank , a user agreement contract must be approved by the Board of Commissioners Commissioner Jeffrey P Carver seconded the motion , which carried by the following vote Ayes James H Langdon , Jr , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Jeffrey P Carver , and W Ray Woodall Nays Cookie Pope 12 Tax Releases and Refunds - 8 15 03 Tax refunds - Personal Real Property 50323 Tax releases - Personal Real Property 1,13363 Motor Vehicle releases refunds 3,36456 Recommended Approved Pat Goddard John R Massey 13 Delinquent Tax Enforcement Report Tax Administrator , Pat Goddard , stated that due to the month ending on a Friday and Monday being a holiday , she did not have a report on garnishments , bank attachments and levies for the month of August , but she did present information on the foreclosures She noted that nine demand letters were sent out , four first notices and five second notices by the outside attorney , resulting in a total of 73,84087 collected during the month Ms Goddard noted the 2003 tax bills have been mailed for individual tracts , and multiple bills will go out during the current week The Board of Equalization and Review has finished hearing 686 appeals on 1750 parcels Approximately 15 of the appeals will go forward to the Property Tax Commission In response to a question from Commissioner W Ray Woodall , Ms Goddard noted that 8800 of the bills are either the same or lower than last year Commissioner Thomas M Moore asked what the total number of bills are and if the County has a policy for accepting payments Ms Goddard responded the total number is approximately 80,000 , and the County informally accepts payments until January , at which time a formal payment plan can be set up with full payment by June The Board of Equalization and Review was commended for a job well done Page0446 September 2 , 2003 Continued Board Reports and Comments 14 Study to be Conducted on Recreation Facilities in the County Commissioner W Ray Woodall stated he would like to know more about how athletic fields paid for by taxpayer dollars are used He asked if school fields are being utilized by the public outside of school events Manager Rick Hester noted a two phase study on recreation is planned with the first phase to be an inventory of the facilities in the County , and the second phase to be a look at policies He stated he would have a report in October Commissioner Thomas M Moore stated he would like to see the School Board’s policy , if they have one , concerning the use of school athletic fields Chairman Langdon agreed a study is needed He noted recreation needs for citizens have become more and more of an issue , and the County needs to look at the overall picture of providing this service 15 Need for Bridges on NC 39 North to be Widened Commissioner W Ray Woodall asked the Board to again ask the NC Department of Transportation to widen the two bridges on NC 39 North He noted there have been several serious accidents in the last few months The County sent a letter to DOT in 1995 and adopted a formal resolution in 2001 asking that the bridges be widened The Chairman agreed to write another letter requesting DOT make the widening projects a top priority as they are a serious concern for the traveling public 16 Closed Session -
