10 461 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS October 6 , 2003 The Johnston County Board of Commissioners met in regular session Monday , October 6 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Jeffrey P Carver , and W Ray Woodall Absent Wade M Stewart Left following early recess to attend a funeral Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , and John R Massey , Finance Officer The Chairman called the meeting to order and immediately recessed for the Board members to attend a presentation in the Courthouse Atrium of the new Johnston County Superintendent of Schools , Dr Anthony Parker The meeting was resumed and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the September 2 , 8 , 2003 board meetings as presented Public Comments 2 Citizen Complaint - Phil Taylor Phil Taylor , 75 Natalie Drive in Waverly Point Subdivision , stated it is his belief that one or more homebuilders in the County are not paying the correct inspection fees for their building projects He suggested that at least one builder is paying inspection fees based on submitted plans and drawings , then building larger homes under the permits He noted he has voiced this concern privately to several people , but now feels that it is time for the Board of Commissioners to look into the matter If proven , he urged the Board to prosecute since this practice is cheating the taxpayers of the County Motion to Investigate Complaint Commissioner Thomas M Moore responded that these are serious charges , and moved the Board investigate this matter immediately Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote Discussion Chairman Langdon asked staff if they had received any notice of this , and if any action has been taken Attorney Mark Payne responded that the County has been working with Mr Taylor on a number of complaints , some of which have gone before regulatory boards Staff is continuing to investigate all issues , and will certainly look into this matter 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Wildwood Lane , Briarwood Lane , Boxwood Lane , Red Oak Drive , Green Bramble Court , and Maple Leaf Lane in Swift Creek Hills Subdivision , Smithfield Township Norwood Drive , Cottsworth Court , Kingston Court , Regent Court , Albemarle Drive , Athol Court , and Homestead Way in Edenton Subdivision , Sections 1 , 2 , & 3 in Wilders Township Commissioner W Ray Woodall moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote Page462 October 6 , 2003 Continued 4 Board of Education - Request for Additional Funds Based on Student Membership Dan Jones , finance officer with the Board of Education , was present to request additional funding based on the official number of students for the 2003 - Division of Community Corrections - Judicial District Eleven Donald Jones , chief probation officer , presented the annual report for the Division of Community th Corrections , 11 Judicial District He gave a brief overview of the report and noted that for the first time in a number of years , his agency is fully staffed 8 Agreement with Cleveland Athletic Association CAA Ed Perfetto with the Cleveland Athletic Association thanked the County for working with CAA on an agreement that outlines the use of the recreation facilities on County property on the old Cleveland School campus He noted CAA registers approximately 2000 people yearly for participation in athletic programs , and operates on a budget of approximately 150,000 The association , which offers many opportunities for the people in the area , is run by a twenty - two member volunteer board Commissioner Thomas M Moore asked how this would affect the use of the gymnasium County Manager , Rick Hester , explained this agreement deals only with the outdoor facilities Usage of the gym is under a different three - Old Cleveland School - Broadmoor PUD Sewer Line Project Engineer Tim Broome explained that in March the County entered into an agreement with Broadmoor Associates , LLC to build a gravity sewer line that would benefit both parties This sewer line will allow the County to abandon the old Cleveland School wastewater pump station and will become a part of the Cleveland Area Wastewater Diversion Facilities project The County , which will derive the greater benefit from the proposed line , agreed to pay 70 of the pipeline cost on the Broadmoor property and 100 of the cost of the remaining pipeline , which will be on County owned property He reviewed with the Board the following four nd bids for the project , which were received on September 22 PagePage pageNumber6466 October 6 , 2003 Continued Blackmon Associates , Inc , Four Oaks , NC 111,31790 Selco , Inc , Smithfield , NC 113,07150 RLL Earthworks , Selma , NC 114,78250 RD Braswell , Smithfield , NC 119,08320 Mr Broome recommended the Board concur with the award of contract by Broadmoor Associates to low bidder Blackmon Associates of Four Oaks in the amount of 111,31790 and approve a project budget of 108,000 for the County’s portion of the cost Commissioner Cookie Pope asked what would be done with the old wastewater pump station site Mr Broome stated the fence would be removed and the equipment taken out Nothing will be left but a manhole at the location Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board concurred with the award of contract by Broadmoor Associates with low bidder , Blackmon Associates of Four Oaks , at a cost of 111,31790 , and approved the County’s project budget of 108,000 12 Resolution Modifying the Uniform Policy for Water Service Areas and Water Districts Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board recessed regular session to meet as the Board of Commissioners and the fifteen water district boards Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board adopted the following resolution modifying the uniform policy for Water Service Areas and Water Districts in the County RESOLUTION PROVIDING FOR MODIFICATION OF UNIFORM POLICY WHEREAS , The Board of Commissioners of Johnston County has adopted uniform policies and fee schedules for customers of all water districts within Johnston County , as well as all retail water service areas of Johnston County the “ Uniform Policy ” ; and WHEREAS , The Board of Commissioners of Johnston County acting simultaneously as the governing body the “ Board ” of the retail water service areas and the following Water Districts Archer’s Lodge Water District , Brogden Water District , Buffalo Water District , Clayton Water District , Cleveland Water District , Elevation Water District , Hopewell Pisgah Water District , Ingram’s Township Water District , Little Creek Water District , Little River Water District , McGee’s Crossroads Water District , Meadow Water District , Princeton Kenly Water District and Wilson’s Mills Water District collectively , “ the Districts ” has adopted the Uniform Policy as well as all future amendments thereto ; and WHEREAS , The Board of Commissioners of Johnston County had determined to amend the Uniform Policy to clarify certain provisions thereof ; BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY 1 Paragraph 3 of the Uniform Policy is hereby amended to read as follows 3 The County Manager of Johnston County is authorized to receive bids , process invoices and payment requests for construction projects in the Districts , and to execute and deliver other documents and instruments on behalf of the Districts 2 This resolution shall take effect immediately Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the fifteen water district boards were adjourned , and regular session was resumed 13 Extension of Incentive Subscription Campaign -
