10 526 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS December 1 , 2003 The Johnston County Board of Commissioners met in regular session Monday , December 1 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Jeffrey P Carver , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the November 3 , 10 , 17 , 24 , 2003 board meetings as presented 2 Organization of the Board Chairman James H Langdon , Jr turned the meeting over to Vice Chairman Cookie Pope for the election of chairman for the next year Commissioner Pope called for nominations Commissioner W Ray Woodall nominated Commissioner James H Langdon , Jr as chairman for the coming year Commissioner Wade M Stewart seconded the nomination No other nominations being made , the nominations were closed and by acclamation , James H Langdon , Jr was elected Chairman of the Board for a one - year term Chairman Langdon called for nominations for vice chairman Commissioner Wade M Stewart nominated Commissioner Cookie Pope There being no further nominations , Commissioner Pope was elected by acclamation as Vice Chairman of the Board for a one - year term Chairman Langdon asked Board members to continue serving on the same boards and committees they have been with this past year Public Comments 3 Tax Complaint Fred Grady , 100 Wilson Street , Kenly , complained about the tax values placed on his property during the recent revaluation He noted he purchased the family property from his siblings to keep it in the family , and immediately sold off some lots and timber in order to pay for it When he received the new valuation , he was shocked to learn that it had increased so much He went to the informal and formal hearings , but , in his opinion , did not receive enough help He complained that with the current value , it will be difficult to pay the taxes Following further discussion , Commissioner Wade Stewart agreed to meet with Mr Grady to look at this with him It was noted the Board of Equalization and Review will reconvene in April to consider appeals for the 2004 tax year 4 Schedule of Regular Meetings for 2004 Adopted Chairman Langdon asked the Board to consider rescheduling the March 1 , 2004 meeting so that the Commissioners that wish to do so will be able to attend an out - - 12 01 06 Asst Finance Officer Tyson Radford 100,000 2244175 12 01 02 - - 12 01 06 Economic Dev Director Micheal deSherbinin 100,000 2244175 12 01 02 - - 12 01 06 6 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Gordon Farm Drive in Gordon Farms Subdivision , Pleasant Grove Township ; Turlington Drive & Memory Lane in Turlington Acres Subdivision , Elevation Township ; Carlton Street , Livingston Place , Brylee Lane , & Oakfield Terrance in Winston Plantation Subdivision , Clayton Township Commissioner W Ray Woodall moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Thomas M Moore seconded the motion which carried by unanimous vote Page528 December 1 , 2003 Continued 7 New Agriculture Center to be Built Tom Trowbridge with the Wooten Company reviewed with the Board his firm’s proposal for a new Agriculture Center , which would be located on a 20 acre parcel of County owned land on NC 210 , approximately three miles west of Smithfield The 32,585 sq ft building would house a 625 seat auditorium , stage catering and storage , the Cooperative Extension Service Agency , USDA Farm Services , USDA Rural Development , and USDA Johnston County Soil Conservation Service Parking would be located behind the facility and would not be visible from the highway The estimated cost of the construction would be 4,166,636 , and the total estimated project budget would be 4,751,358 Mr Trowbridge stated the plans and specifications have been reviewed by County staff , and the documents have been reviewed by the County Attorney If the Board approves the project , advertisement for bids could be sent out almost immediately and bid opening in late January The estimated time frame for completion would be eighteen months Rick Hester , County Manager , stated this project has been a part of the long range capital projects for the County He recommended the Board authorize the Wooten Company to proceed with the bidding process , and let staff come back to the Board later with specific recommendations for financing If possible , some of the soft cost of the project can be paid out of existing capital funds Commissioner Thomas M Moore asked about the bid format Mr Trowbridge stated the project would be bid single and multi - prime Commissioner Moore suggested the site work should be bid separately Following discussion , Mr Trowbridge agreed this could be done Commissioner Jeffrey P Carver noted the lease rent revenue from the agencies housed in the facility would partially offset the cost of debt service on the project Mr Hester agreed but stated it is anticipated the County would be left with a cost of approximately 200,000 yearly for the debt Following further discussion , Commissioner W Ray Woodall moved the Board authorize the Wooten Company to proceed with the bidding process on the Agriculture Center Project , with the understanding the site work is to be bid separately Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Commissioner Allen L Mims , Jr pointed out the reason he can support this is because the County must provide additional space for the Department of Social Services , and moving these agencies to a new location will allow for necessary expansion of the DSS facility on its current campus 8 Request for Transfer of Funds - Johnston Community College Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board approved the transfer of 24,410 from Capital Outlay to Current Expense for Johnston Community College to cover an anticipated shortage for continuous operations due to enrollment growth 9 Board of Education - Use of Remaining COP’s Funds for New Project Dr Jim Causby , Superintendent of Schools , stated the Board of Education and County Finance Officer , John Massey , have determined that there is remaining in excess of 400,425 of the proceeds of the 16,600,000 1999 COP’s financing , which is not needed for the projects that were financed by the COPs The School Board is requesting that these funds be used for the renovation and improvement of the HVAC system at South Johnston High School , and bond counsel has confirmed that such use of those funds is permitted He noted the County did not get ADM funds last year , which would have been used for this project Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution approving the transfer of COP’s funds to a new project , the South Johnston High School HVAC renovation and improvement project and any associated legal fees Page529 December 1 , 2003 Continued RESOLUTION PROVIDING FOR USE OF COP’s PROCEEDS FOR SOUTH JOHNSTON HIGH SCHOOL HVAC PROJECT WHEREAS It is reported that there is in excess of 400,425 remaining of the proceeds of the 16,600,000 Johnston County Finance Corporation Installment Payment Revenue Bonds School and Museum Projects , Series 1999 the 1999 COPs which is not needed for the projects that were financed by the 1999 COPs ; and WHEREAS The Johnston County Board of Education has requested that those funds be used for the renovation and improvement of the HVAC system at South Johnston High School and any associated legal fees ; and WHEREAS , Bond counsel for the County has confirmed that such use of those funds is permitted NOW THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS does hereby approve the use of the remaining proceeds of the 1999 COPs for the renovation and improvement of the HVAC system at South Johnston High School the HVAC Project , and to include any related legal fees ; and that the Installment Financing Agreement dated as of August 1 , 1999 , between the Johnston County Finance Corporation and the County be amended to change the definition of Project contained therein to include the HVAC Project The officers of the County are hereby directed to execute and deliver such amendments to the documents relating to the 1999 COPs and other certificates as may be required to carry out the intent of the foregoing resolution st Adopted this the 1 day of December , 2003 Dr Causby , who will be leaving the school system at the end of December , thanked the Board for their support over the past 10 years He noted it has been the joint work of the Board of Commissioners and the Board of Education that has made Johnston County Schools the best in the State , and among the top in the nation Chairman Langdon agreed the County schools have come a long way in the last decade He noted that having worked under Dr Causby in the School System , and working with him as a Commissioner , he has gained a great deal of confidence and appreciation for what he has done 10 County to Hire Consultant to Write Comprehensive Land Use Plan Jim Jenkins , chairman of the Johnston County Planning Board , discussed with the Commissioners the possibility of retaining a consulting firm to help develop a Comprehensive Land Use Plan He noted with the increased growth , the County is facing new and complex issues Five years ago a plan was written for the County , but it was never adopted because the Commissioners felt it was too general He maintained , however , the need still exists for a planning tool that would help both boards look at the present and future development trends In response to comments and questions from Board members , Mr Jenkins recommended an outside consulting firm be hired to write the plan at an estimated cost of 20,000 He noted that staff and a task force made up of members of the Planning Board would keep a close watch on the progress being made Following further discussion , Commissioner Allen L Mims , Jr moved the Board authorize the Planning Department to move forward with this project with the understanding staff will report back to the Board concerning the actual cost Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote 11 Resolution - Installment Financing for Johnston Memorial Hospital Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following resolution approving the financing agreement and authorizing the execution of related documents for the installment financing for Johnston Memorial Hospital RESOLUTION APPROVING INSTALLMENT FINANCING AGREEMENT AND AUTHORIZING THE EXECUTION AND DELIVERY OF DOCUMENTS IN CONNECTION THEREWITH WHEREAS , pursuant to the North Carolina General Statutes , Johnston County , North Carolina , the “ County ” is authorized to acquire real or personal property or to construct or repair fixtures or improvements on real property ; and WHEREAS , the County desires to purchase certain equipment consisting of a magnetic resonance imaging scanner “ MRI ” , a computerized axial tomography scanner and certain other imaging equipment collectively , the “ Equipment ” , and to construct a building on the property of Johnston Memorial Hospital to house the MRI and toPagePage pageNumber5530 December 1 , 2003 Continued construct certain other improvements to the Hospital property collectively , the “ Improvements to Real Estate ” and , together with the Equipment , the “ Project ” ; and WHEREAS , the County desires to finance the Project by entering into two installment contracts authorized under North Carolina General Statutes Chapter 160A , Article 3 , Section 20 ; and WHEREAS , there has been presented to the Board of Commissioners the “ Board ” in substantially final forms I an Installment Financing Contract - Real Estate the “ Real Estate IFC ” , providing for a loan in the amount of 2,000,000 , together with a promissory note from the County to the Bank evidencing the loan the “ Note ” , between the County and First - Extension of Little River Water District Advertised The Smithfield Herald 11 14 03 & 11 21 03 Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed regular session to sit as the Little River Water District Board The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed expansion of the Little River Water District boundaries Sandy Mills , community water specialist with the Public Utilities Department , showed a map of the area with the proposed extended boundaries She noted that 1,275 taps have been sold during the early initiative sign - up period , more than any other water district Engineer Tim Broome complimented Ms Mills for the job she has done in getting the word out to the people in the area There being no further comments , the Chairman closed the hearing 17 Resolution Approving the Revised Boundaries for Little River Water District Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board adopted the following resolution approving the revised boundaries for Little River Water District RESOLUTION PROVIDING FOR EXPANSION OF THE BOUNDARIES OF THE LITTLE RIVER WATER DISTRICT OF JOHNSTON COUNTY WHEREAS the Johnston County Board of Commissioners the Board at its regular meeting on May 5 , 2003 passed a resolution creating the Little River Water District the District in accordance with N C General Statutes § 162A - 86 , et seq ; and WHEREAS , the Board has determined , after receiving petitions from residents of property lying near the District , that these parcels of land contiguous to the District may be annexed into the District ; and WHEREAS , pursuant to NC General Statutes § 162A - 871 , the Board has determined to extend the boundaries of the District to include the petitioned parcels ; WHEREAS the Board resolved to hold a public hearing with respect to such extensions on December 1 , 2003 , and directed that the appropriate representatives of the County take the necessary actions to properly notice such public hearing as provided by law ; and WHEREAS , pursuant to N C General Statutes Section 162A - 871 e a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report containing a map of the District and the areas to be annexed were available for public inspection in the office of the Clerk to the Board , and that such annexation fit the requirements of § 162A -
