10 763 Meeting of the Johnston County Board of Commissioners September 7 , 2004 The Johnston County Board of Commissioners met in regular session Tuesday , September 7 , 2004 , at 10 00 am in the Commissioners ’ Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Jeffrey P Carver and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , Della H Knight , Deputy Clerk , and April N Byrd , Assistant to Clerk The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the August 2 , 9 , 2004 board meetings as presented Public Comments 2 Citizen Concerned About Pet Adoption Center Practices Melissa Kipp , 113 Deer Ridge Drive , Selma , voiced concerns about the operation of the Pet Adoption Center , especially the method of euthanizing animals She stated the use of gas is inhumane for puppies and elderly dogs , and can be dangerous to humans if not administered properly She also recommended outside runs for dogs , a large open room for cats , and suggested the center use the internet site “ petfinder ” to help publicize the animals and the length of time before they will be euthanized She asked the Board for permission to form a volunteer group that would seek grants and organize fund raisers to address some of these concerns County Manager Rick Hester noted that he had previously spoken with Ms Kipp , and stated he will be glad to work with her on this issue Commissioner Allen L Mims , Jr commended Ms Kipp on her efforts and supported the idea of a volunteer group 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Wagon Trail and Chickadee Court , Coats Crossing Subdivision , Pleasant Grove Township East Justin Drive , Goldfield Drive , East Keri Drive , Marigold Place , Blazing Star Ct , Partridge Berry Place , Wintergreen Drive , Foxglove Drive , Fawnlilly Place , Sunrise Drive , Morning Glory Drive , Creek Drive , Bobby Drive , Jordan Circle , Woodsorrell Court , Firewood Drive and Beargrass Court , Pleasant Woods Subdivision , Cleveland Township Leach Drive , Salamander Drive and Crawdad Court , Creekside Place Subdivision , Phase 3 , Cleveland Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote Page764 Meeting of the Johnston County Board of Commissioners 4 Proclamation - American Business Women’s Day Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board adopted the following proclamation in appreciation of American Business Women PROCLAMATION AMERICAN BUSINESS WOMEN’S DAY September 22 , 2004 WHEREAS , in salute to the more than 80,000 American Business Women’s Association ABWA members for their supportive efforts in helping all women advance through education , and for developing an informed and responsible citizenry NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim September 22 , 2004 , as American Business W omen’s Day in Johnston County Adopted this the 7th day of September , 2004 5 Recreation Study Findings and Recommendations County Manager Rick Hester presented information concerning the two - phase recreation study that the Board authorized in September 2003 Phase One consisted of an inventory of all county , town , and school recreation facilities Phase Two of the study focused on community involvement and input Seven community meetings were held from mid - April through early June 2004 The sentiment from those in attendance was for the county to look at ways to assist organizations already in existence with capital needs Based on the results of the study , the County Manager made the following recommendations to the Board 1 Assuming financial feasibility is determined , consideration of a recreation bond referendum in the spring of 2007 2 Formation of a steering committee to provide the Board with short and long range recommendations for county recreational needs 3 Purchase of additional land for recreation and open space when consideration is made for purchasing properties for new schools 4 Consideration of a passive recreation and open space area on county property on Hwy 210 by year 2009 , and to pursue grant funding for this Mr Hester thanked the municipalities , athletic associations and school representatives for their assistance in the study The Chairman invited anyone in the audience who wished to speak in regards to the recreation study to come forward Shelia Flowers , Wilsons Mills Parks and Recreation , thanked the Board for taking initiative to pursue recreation needs She stressed the need for additional grant money and additional facilities so that kids do not have to go outside their communities to participate in recreational activities Larry Bailey , Clayton Parks and Recreation suggested that a committee be formed that would have ongoing input in recreation plans for the future He stated he realizes that the County does not plan to have a Parks and Recreation Department , but does feel that a recreational professional could help He voiced support for school parks since most recreation is community driven , with a great need outside of the municipalities He offered to help in anyway possible Wayne Sinclair , Meadow Athletic Association , thanked the Commissioners for taking into consideration recreation needs of the county as a whole He offered his assistance in the future Commissioner Wade M Stewart suggested that the county look at properties located around existing schools to purchase as well as additional land at new schools in the future Commissioner Thomas M Moore stated he would like to see the County dedicate one cent of ad valorem tax for recreation rather than have a bond referendum The funds would then continue to grow as the county grows , thus , creating a continuous flow of money Page765 Meeting of the Johnston County Board of Commissioners Chairman Langdon agreed that recreation is important and land is the issue , especially on school sites since Johnston County has community schools He also agreed with Larry Bailey that a committee should be formed to look at the recommendations and determine a long - range plan He complimented Mr Bailey for his involvement in community needs and willingness to help Commissioner Cookie Pope stated that the Community College would also want to be involved in future recreation discussions , especially since Howell Woods has such potential for recreational purposes Commissioner W Ray Woodall remarked that school facilities are at the center of what goes on in an area He agreed with Commissioner Stewart that the Board needs to look at undeveloped land in the areas around existing schools Commissioner Allen L Mims , Jr suggested the County Manager set up an informal steering committee to look at the recommendations from the study Mr Hester stated he would be glad to do that 6 Department of Social Services - Work First Block Grant Earl Marett , Department of Social Services Director , addressed the Board and recommended that Johnston County remain a standard county with the Work First Block Grant program for FY 05 - 07 Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved Johnston County to remain as a standard county for the Work First Block Grant program for FY 05 - 07 7 Johnston County Schools - Request to Reallocate ADM Funds Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved a request from the Johnston County Board of Education to use 518,798 in state ADM funds left over from the Smithfield Selma High School project to help fund two other projects , 100,000 for Clayton High School and 418,798 for Benson Middle School 8 Budget Amendments Board members asked questions about a couple of the budget amendments The finance officer explained that the 328,179 of carry - free calling between the Kenly local calling area and Raleigh and Wake County will benefit all of its citizens and local businesses , NOW , THEREFORE BE IT RESOLVED , that the Johnston County Commissioners does hereby request that the North Carolina State Utilities Commission institute those actions necessary to expand the local telephone calling areas to provide toll - 015465 2000080114 Clarke , Jamison R 11954 14 Tax Collection Report Tax Administrator , Pat Goddard reported on the collection of delinquent taxes for the month of August 2004 She noted that in addition to garnishments , bank attachments and levies , 13 foreclosurePage1773 Meeting of the Johnston County Board of Commissioners complaints were filed , and 8 demand letters were sent , resulting in a collection of 46,39088 As of August 31 , 2004 , the Tax department has collected 530 of the real and personal levy for 2004 , and 5316 of the motor vehicle levy Through the NC State Income Debt Setoff Program , one account was paid for a total of 16283 She further informed the Board that the 2004 tax bills have been mailed 15 Emergency Management to Purchase Software Under the One - Source Statute County Attorney Mark Payne requested the Board authorize the Emergency Management Department to purchase software for centralized data collection storage and management for the County’s fire stations and rescue squads under the one - source statute , NCGS § 143 - 129 e 6 The software , “ Firehouse ” , is the only brand available for this purpose Based on the provisions of NCGS § 143 - 129 e 6 , Commissioner Allen L Mims , Jr moved the Board authorize the Emergency Management Department to purchase “ Firehouse ” software for centralized data collection storage and management for the County’s fire stations and rescue squads Commissioner Cookie Pope seconded the motion which carried by unanimous vote 16 Board Reports and Comments Commissioner Cookie Pope commended the Emergency Services department and those who work in the Emergency Operations Center for their excellent state of preparedness for Hurricane Charley 17 Closed Session NCGS § 143 -
