10 783 Meeting of the Johnston County Board of Commissioners October 4 , 2004 The Johnston County Board of Commissioners met in regular session Monday , October 4 , 2004 , at 10 00 am in the Commissioners ’ Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Jeffrey P Carver and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , Della H Knight , Deputy Clerk , and April N Byrd , Assistant to Clerk The Chairman called the meeting to order and asked for a moment of silence in memory of Greg Tobolski , reporter for the Princeton News Leader , who died unexpectedly Following the moment of silence , the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the September 7 , 13 , 15 , 2004 board meetings as presented Public Comments 2 Citizen Comments - Gun Safety Issue Martha Rosser , 200 Pond Avenue , Clayton , and her father , Herbert Rosser , again addressed the Board concerning the incident that happened to her in September 2003 when a neighbor and or his guest fired a weapon sending stray bullets onto her property and into her home The Rossers first spoke to the Board in November 2003 Ms Rosser updated the Board on her difficulties in trying to go through the legal system concerning this matter , and asked if the County plans to adopt a gun safety ordinance County Attorney , Mark Payne , stated that in checking with other local governments he has found that some towns have gun ordinances , but only a few counties He pointed out that there are state statutes in place that address the possession of firearms and the discharging of them into occupied dwellings Board members expressed their understanding of the frustration with the judicial system that the Rossers have encountered Commissioner Wade M Stewart added that even if the county had a gun safety ordinance in place it could do nothing more than place fines on people , and probably would not satisfactorily address the Rossers ’ situation County Manager , Rick Hester , stated that although this is a judicial matter , he would share the problems Ms Rosser has had with both the Sheriff and District Attorney 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Edmondson Drive and Look Out Court , Edmondson Place Subdivision , Pleasant Grove Township Arthur Drive , Grayson Place , Caroline Court and Melanie Court , Myatt Place Subdivision , Cleveland Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote Page784 October 4 , 2004 Continued 4 Board of Education - Request to Transfer Capital Outlay Funds to Current Expense In response to questions from Commissioner Thomas M Moore and Commissioner Allen L Mims , Jr , Dan Jones , finance officer for Johnston County Schools , explained that capital outlay funds are used for equipment , building renovations and vehicles He stressed that the transfer of funds will not affect the maintenance of facilities , as maintenance is paid for out of operating expenses Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board approved a request from the School Board to transfer 1,770,550 of School Capital Outlay Funds to School Current Expense in order to adjust their operating budget 5 Surplus Property - Wrecked Public Utilities ’ Vehicle Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board declared the following wrecked 2003 Chevrolet Utility Body Pickup truck surplus and authorized the title be turned over to the insurance company to settle the claim 2003 Chevrolet Utility Body Pickup Truck - Vin # 1GBHC24U13E276203 6 Request for Tax Exempt Loan Status - Corinth Holder Fire Department Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution approving tax exempt loan status for Corinth Holder Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax exempt loan to the Corinth - Holder Volunteer Fire Department , Incorporated , the “ VFD ” from First Citizens Bank and Trust Company in the principal amount of 195,00000 , which is loaned for the following purpose Finance the purchase of a new fire truck mounted on a 2005 Ferrara Intruder II chassis , which will be owned and operated by the Corinth - Holder Volunteer Fire Department , Incorporated , and will be maintained at the following address 5734 Lake Wendell Road , Zebulon , NC 27597 7 Social Services - Work First Block Grant Plan FY 2005 - 2007 Earl Marett , director of DSS , stated the final draft of the Work First Block Grant Plan for Fiscal Year 2005 - 2007 has been on view for public comment as required by law , and has been recommended for approval by the DSS Board It now requires the Commissioners approval before being sent to the state Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board formally adopted the 2005 - 07 Work First Block Grant Plan for the Department of Social Services 8 Social Services - Request for Additional Positions Earl Marett , director of DSS , asked the Board for two additional social worker positions in his department He stated he recently received notification that the General Assembly has allocated additional funds for Child Welfare staffing He asked for one position in Child Protective Services and noted the funding is 100 State and Federal money that will be reoccurring each year Regarding the second requested position , Mr Marett stated Johnston County DSS was approved for forty - one additional slots for the Community Alternatives Program for Disabled Adults CAP - DA CAP - DA provides services and durable medical goods to keep people who would typically go into nursing homes Currently , there are approximately 90 people on the waiting list An additional social worker position in the Adult Services Unit would be funded by an additional medicaid reimbursement which would require a 5 county match County Manager , Rick Hester , pointed out the medicaid funds for next year could have an adverse effect on the County’s budget Based on the State’s estimates for Medicaid matching funds for the County being high in the past , we again allocated less than the estimate This year the estimates may end up being more on target than in the past Mr Marett agreed , however , he noted there is an effort being made to get the State to freeze the Counties ’ portion at either last year or this year’s level He noted the rise in medicaid is due to the number of aged and disabled adults that are now eligible Illegal aliens are not eligible ; however , any children born in this Country are Page785 October 4 , 2004 Continued Following further discussion , Commissioner Allen L Mims , Jr moved the Board approve two new social worker positions for the Department of Social Services , one position in Child Protective Services and one in the Adult Services unit of the Community Alternatives Program for Disabled Adults Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 9 Call for Public Hearing - Hazard Mitigation Plan Commissioner Allen L Mims , Jr moved the Board schedule a public hearing for November 1 , 2004 at 10 30 pm to discuss the Multi - Jurisdictional Hazard Mitigation Plan Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 10 Budget Amendments Board members asked questions about a couple of the budget amendments Earl Marett , director of DSS , stated on July 1 , 2004 the General Assembly had not completed its Smart Start allocations The program received an additional 100,000 that will allow pre - Proposed Extension of Boundaries - Buffalo Water District Advertised The Smithfield Herald - September 17 , 24 , 2004 Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed regular session to meet as the Buffalo Water District Board The Chairman opened the public hearing and invited anyone who wished to speak on the proposal to expand the Buffalo Water District There being no comments , the Chairman closed the hearing 15 Resolution Providing for Expansion of the Boundaries of the Buffalo Water District Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution RESOLUTION PROVIDING FOR EXPANSION OF THE BOUNDARIES OF THE BUFFALO WATER DISTRICT OF JOHNSTON COUNTY WHEREAS the Johnston County Board of Commissioners the Board at its regular meeting on August 2 , 1999 passed a resolution creating the Buffalo Water District the District in accordance with N C General Statutes § 162A - 86 , et seq ; and WHEREAS , the Board has determined , after receiving petitions from residents of property lying near the District , that these parcels of land contiguous to the District may be annexed into the District ; and WHEREAS , pursuant to NC General Statutes § 162A - 871 , the Board has determined to extend the boundaries of the District to include the petitioned parcels ; WHEREAS the Board resolved to hold a public hearing with respect to such extensions on October 4 , 2004 , and directed that the appropriate representatives of the County take the necessary actions to properly notice such public hearing as provided by law ; and WHEREAS , pursuant to N C General Statutes Section 162A - 871 e a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report containing a map of the District and the areas to be annexed were available for public inspection in the office of the Clerk to the Board , and that such annexation fit the requirements of § 162A - 871 ; and WHEREAS , pursuant to N C General Statutes § 162A - 871 e , the notice of public hearing was published once in newspapers that circulate in the proposed District , and pursuant to 162A - 871 b the County has received petitions forPagePage pageNumber7789 October 4 , 2004 Continued annexation signed by 100 of the real property owners in the areas to be annexed ; and WHEREAS , a public hearing was held at 11 00 am on October 4 , 2004 , in the Commissioners Room , Courthouse Annex , Smithfield , North Carolina at which time taxpayers and all other interested persons appeared and were heard concerning the question of expanding the boundaries of the Buffalo Water District of Johnston County ; and WHEREAS , at such meeting the Board determined that it was appropriate to extend the boundaries of the District to include additional parcels of land ; and WHEREAS , the Board , following the public hearing finds that 1 The areas to be annexed are contiguous to the District , with at least one - eighth of the areas aggregate external boundary coincident with the existing boundary of the District ; 2 The residents of all the territories to be annexed into the District will benefit from the Districts annexation ; and 3 It is economically feasible to provide the proposed service or services in the annexed district without unreasonable or burdensome annual tax levies ; WHEREAS , the Board now desires to annex the territories described herein into the Buffalo Water District of Johnston County ; NOW , THEREFORE , BE IT RESOLVED BY the Johnston County Board of Commissioners meeting in regular session at Smithfield , North Carolina , on October 4 , 2004 , do the following 1 It is hereby found that a The areas to be annexed are contiguous to the District , with at least one -
