10 811 Meeting of the Johnston County Board of Commissioners November 1 , 2004 The Johnston County Board of Commissioners met in regular session Monday , November 1 , 2004 , at 10 00 am in the Commissioners ’ Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart and Jeffrey P Carver Absent W Ray Woodall Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , Della H Knight , Deputy Clerk , and April N Byrd , Assistant to Clerk The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the minutes of the October 4 , 11 , 2004 board meetings as presented Public Comments 2 Sprint Presents Plaque to Technology Services Joey Stephenson , Senior Enterprise Account Manager for Sprint , thanked the Board for the County’s long history of partnership with his company He noted the partnership has recently moved to a new level with the implementation of a wireless card data system He introduced Mark Roblee , General Manager of Government Accounts for the company , who presented a plaque of appreciation to Director Terry Ellis and the County’s Technology Services Department for their leadership in this innovative endeavor , which is a first of its kind nationwide for Sprint He noted Mr Ellis and his staff challenged Sprint to develop the card connection system as a means of both saving tax dollars and enhancing productivity for County employees Mr Ellis thanked Mr Roblee and credited his staff with developing this and other innovative ideas for improving technology for the County Chairman Langdon and Board members thanked Sprint for recognizing Mr Ellis and his staff for a job well done Commissioner Mims thanked Sprint also for their assistance in helping area municipalities obtain local phone service to Raleigh 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Falcon Run , Dove Circle , Partridge Circle , Eagle Lane , and Robins Nest Lane , Quail Village Subdivision , Sections 2 , 3 , 4 and 5 , O’Neals Township Sommerset Drive , Bennent Drive , Breland Drive , Ironwood Lane , Eagle Rock Place , Dock Pond Lane , Trawick Place , Leah Drive , Drew Court and Evan Court , South Plantation Subdivision , Sections 8 , 11 , 14 , 15 , 16 , 17 and 18 , Cleveland Township Commissioner Cookie Pope moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Jeffrey P Carver seconded the motion which carried by unanimous vote Page812 November 1 , 2004 Continued 4 Veteran’s Day Proclamation Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following proclamation P R O C L A M A T I O N - V E T E R A N S ’ D A Y - 2004 th WHEREAS , for decades America has paused on the 11 of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before all the world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2004 , as “ Veterans ’ Day ” in Johnston County , and urge our citizens to commend its observance st Proclaimed this the 1 day of November , 2004 5 National Farm - City Week Resolution Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution NATIONAL FARM - CITY WEEK RESOLUTION - NOVEMBER 19 - 25 WHEREAS , agriculture has always been a cornerstone of Johnston County’s way of life , we acknowledge dedicated farmers improve our well being by working to ensure a healthy and abundant agriculture supply To succeed in this important enterprise , our farmers rely on essential partnerships with non - rural communities to supply , sell and deliver finished products across the country and around the world During National Farm - City Week , we recognize the importance of this cooperative network to the success of the agriculture industry WHEREAS , farming was America’s first industry and continues today to provide us with many of the necessities of life such as food and clothing , as well as fuel for our energy needs Agriculture employs more than 62,000 workers in Johnston County including farmers and ranchers , shippers , processors , marketers , retailers , truck drivers , and inspectors and others who annually contribute more than 1 billion in retail sales in Johnston County WHEREAS , we welcome new opportunities for trade , hard work and successful cooperation between farmers and city workers to continue to play a vital role in our country’s success and be a critical resources for countless people here and around the nation WHEREAS , Farm - City collaborations help maintain and improve our nation’s food and fiber supply and contribute to a better quality of life for countless citizens We commend the many Johnstonians whose hard work and ingenuity reflect the true spirit of America and help to ensure a prosperous future for all WHEREAS , we gather with family and friends around the Thanksgiving table , it is fitting that we count among our blessings the vital farm - city partnerships that have done so much to improve the quality of our lives Rural and non - rural communities working together have made the most of our rich agricultural resources , and they continue to contribute to the health and well being of our people and to the strength of our economy NOW , THEREFORE , we the Commissioners of Johnston County , do hereby proclaim November 19 - Cisco Systems Local Government Units Contract Terry Ellis , director of Technology Services , requested the Board adopt a resolution authorizing the County to partner with other local government units to take advantage of purchasing discounts offered by Cisco Systems , provider of information technology products Mr Ellis informed the Board that this contract would be equivalent to a state government contract , and would save the County as much as 25 - 36 on products and contract costs Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following resolution authorizing the County to partner with other local government units for services offered by Cisco Systems , provider of information technology products RESOLUTION AUTHORIZING COOPERATIVE PURCHASING AGREEMENT AMONG THE LOCAL GOVERNMENT UNITS WHEREAS , County of Johnston and other Local Government Units , hereafter called PARTICIPATING PARTIES , in order to conserve resources , reduce procurement cost , and desire to join for the purpose of procuring certain information technology products under the same terms , conditions and pricing as each other , and WHEREAS , there is currently no active convenience contact at the state level for Cisco information technology products and services , and WHEREAS , the PARTICIPATING PARTIES , desire to purchase from the City of Jacksonvilles Convenience Agreement with Cisco Systems , Inc for these products , and WHEREAS , NCGS 160A Article 20 , Part 1 & 160A - 461 authorizes interlocal cooperation , and NOW THEREFORE , be it resolved that the Johnston County Board of Commissioners hereby authorizes the County Manager or his designee to enter into this cooperative purchasing agreement with the other Local Government Units st Adopted in regular session this 1 day of November , 2004 7 Appointments for Deputy Map and Plat Review Officers Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution of appointment for Patricia B Heavner , Thomas W Clifton , Jr and Shelia A Leagan as Deputy Plat and Map Review Officers , and removed Tammy Adams Norris , Theresa Lee Stanley , and Shannon Starling from the approved list RESOLUTION OF APPOINTMENT th WHEREAS , NC Senate Bill 875 , ratified the 8 day of July , 1997 , revised Article 2 of Chapter 47 of the NC General Statutes by adding section 47 - 302 to require the Board of Commissioners of each county to designate by name one or more persons as a Review Officer to review each map and plat required to be submitted for review before recordation by the Register of Deeds ; and WHEREAS , the Johnston County Board of Commissioners has reviewed the requirements for this position and discussed the qualifications needed to perform this duty NOW , THEREFORE , the Johnston County Board of Commissioners does hereby appoint Patricia B Heavner , Thomas W Clifton , Jr and Shelia A Leagan of the Customer Service Department as a Johnston County Deputy Map and Plat Review Officer Adopted this the 1st day of November , 2004 8 Council on Aging - Request for Commitment of Grant Matching Funds for FY 05 - 06 Budget Donna Creech , executive director of Council on Aging , requested that the Board make a commitment to provide 38,851 in the FY 05 - 06 budget as a match for the NCDOT Community Transportation Program FY06 Grant , which provides the administrative and capital funds for JCATS operation In response to a question from Commissioner Allen L Mims , Jr , Ms Creech noted that this year’s request is 3000 less than last year Duties have changed for one position making it only 50 eligible for the grant The grant includes the replacement of four vehicles with 100,000 or more miles JCATS transports approximately 360 to 450 people daily Page814 November 1 , 2004 Continued Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board agreed to allocate 38,851 in the FY 05 - 06 budget as matching funds for the NCDOT Community Transportation Program for the operation and capital needs of the Johnston County Area Transportation system Ms Creech thanked the Board and introduced the new transportation manager , Wanda Johnson , and Judy Weaver , operator of the system 9 Surplus Property - Emergency Management Equipment Trailer The Chairman stated that Emergency Management has requested the Board declare a used equipment trailer as surplus and authorize the title be turned over to the Town of Smithfield The trailer would be used by the Smithfield Fire Department for the County’s decontamination tent and associated equipment , which was purchased with a Homeland Security Grant The Fire Department has agreed to house and maintain the County owned equipment , and provide training and necessary response in the case of an emergency The trailer , on which the decon equipment sits , was originally secured as a mass casualty trailer , and is no longer being used by the County The Town has asked that the title of the trailer be transferred to them since they plan to make some modifications Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board declared surplus a used equipment trailer and authorized the title be turned over to the Town of Smithfield for use by the Smithfield Fire Department with the County’s decontamination tent and associated equipment 10 Call for Public Hearing - North Johnston EMS Change in Franchise Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board scheduled a public hearing for the December 6 , 2004 meeting to hear public comment on a request from the Emergency Services Advisory Committee to change the level of service for North Johnston EMS from the EMT - 1 position , unexpired term Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board appointed William Franklin Jordan to the McLemore Firemen’s Relief Fund Board of Trustees to fill an unexpired term to end October 2005 PagePage pageNumber7817 November 1 , 2004 Continued 13 Public Hearing - 10 30 am - Hazard Mitigation Plan Advertised in The Smithfield Herald Friday , October 22 , 2004 The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed Johnston County Hazard Mitigation Plan to come forward Lori Key , who currently works for the County’s Information Technology Services Department , wrote the original Hazard Mitigation Plan in 1999 when she was employed elsewhere Because of her previous experience , Ms Key was asked to update the plan to meet new requirements so the County will qualify for State and Federal assistance She presented the revised document for the Board’s consideration Ms Key explained the revised plan is intended to improve the jurisdiction’s ability to respond to disasters , and defines strategies to do so She outlined the following nine plans of action that should reduce the loss of life and property during a natural disaster , and noted some of these are already being implemented 1 Investigate ways of improving the current flood ordinance 2 Implement a Reverse 911 system 3 Relocate critical computer servers located in the basement of the Johnston County courthouse 4 Increase the interconnectivity of the Johnston County water system with other local municipal and county systems 5 Apply to reduce our CRS Community Ratings System score 6 Determine the properties that have repetitive losses due to flooding , and contact the owners of these properties to offer information on flood programs and assistance 7 Investigate ways to provide auxiliary heating and cooling capabilities to four shelter sites 8 Provide an automatic email listserv for citizens so that they can be notified of upcoming hazardous events 9 Investigate the feasibility of developing a Johnston County burning ordinance In response to a question from Commissioner Wade M Stewart concerning action # 3 , it was noted that the 911servers have already been moved , and other servers located in the basement telephone room need to be moved as they would be difficult to access in case of an emergency Commissioner Thomas M Moore asked about the reference to a burning ordinance in item # 9 Dewayne West , Emergency Services Director , explained the County currently depends on the different State regulations , which sometimes conflict with one another A County ordinance would simplify the matter In response to a question from Commissioner Stewart about how and when an ordinance would be enforced , Mr West noted the Board would have the option to enforce or waive the requirements , depending on the circumstances He pointed out agricultural processes are exempt by state law There being no further comments , the Chairman closed the public hearing 14 Resolution Approving the Johnston County Hazard Mitigation Plan Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution approving the Johnston County Hazard Mitigation Plan RESOLUTION OF ADOPTION - JOHNSTON COUNTY HAZARD MITIGATION PLAN WHEREAS , the citizens and property within Johnston County are subject to the effects of natural hazards and manmade hazard events that pose threats to lives and cause damages to property , and with the knowledge and experience that certain areas , ie , flood hazard areas , are particularly susceptible to flood hazard events ; and WHEREAS , the County desires to seek ways to mitigate situations that may aggravate such circumstances ; and WHEREAS , the Legislature of the State of North Carolina has in Part 6 , Article 21 of Chapter 143 ; Parts 3 , 5 , and 8 of Article 19 of Chapter 160A ; and Article 8 of Chapter 160A of the North Carolina General Statutes , delegated to local governmental units the responsibility to adopt regulations designed to promote the public health , safety , and general welfare of its citizenry ; andPagePage pageNumber8818 November 1 , 2004 Continued WHEREAS , the Legislature of the State of North Carolina has in Section 1 Part 166A of the North Carolina General Statutes adopted in Session Law 2001 - 214 — Senate Bill 300 effective July 1 , 2001 , states in Item a 2 “ For a state of disaster proclaimed pursuant to GS 166A - 6 a after August 1 , 2002 , the eligible entity shall have a hazard mitigation plan approved pursuant to the Stafford Act ” ; and WHEREAS , Section 322 of the Federal Disaster Mitigation Act of 2000 states that local governments must develop an All - Hazards Mitigation Plan in order to receive future Hazard Mitigation Grant Program Funds , and WHEREAS , it is the intent of the Johnston County Board of Commissioners to fulfill this obligation in order that the County will be eligible for federal and state assistance in the event that a state of disaster is declared for a hazard event affecting the County ; NOW , THEREFORE , the Johnston County Board of Commissioners does hereby adopt the County Hazard Mitigation Plan as presented , agrees to take such official action as may be reasonably necessary to carry out the objectives of the Hazard Mitigation Plan , and charges the Johnston County Emergency Management Department with the responsibility , authority and means to a Inform all concerned parties of this action b Cooperate with Federal , State and local agencies and private firms which undertake to study , survey , map , and identify floodplain or flood - related erosion areas , and cooperate with neighboring communities with respect to management of adjoining floodplain and or flood - related erosion areas in order to prevent aggravation of existing hazards c Adjust the boundaries of County and municipal planning jurisdictions whenever a municipal annexation or extraterritorial jurisdiction expansion results in a change whereby a municipality assumes or relinquishes the authority to adopt and enforce floodplain management regulations for a particular area in order that all Flood Hazard Boundary Maps FHBMs and Flood Insurance Rate Maps FIRMs accurately represent the planning jurisdiction boundaries Provide notification of boundary revisions along with a map suitable for reproduction , clearly delineating municipal corporate limits and extraterritorial jurisdiction boundaries to all concerned parties FURTHER , the Board of Commissioners does hereby charge the Emergency Management Department with the responsibility of seeing that the Hazard Mitigation Plan is reviewed annually and in greater detail at least once every five years to assure that the Plan is in compliance with all State and Federal regulations , and that any needed revisions or amendments to the Plan are developed and presented to the Board of Commissioners for consideration st Adopted this the 1 day of November , 2004 15 Restoration Systems , LLC - Request County Provide Public Access to Little River After Lowell Dam Removed Ernest Wilkinson of Kenly stated that at the request of fellow citizens in his area , he investigated the proposed removal of Lowell Dam on the Little River There was concern about how this would affect the navigability of the river , the adjacent land , and fishing and hunting He learned that Restoration Systems , LLC has been awarded a contract from the Corp of Engineers for the project In meeting with George Howell , representative for the company , it is his understanding that with the requirements from the Corp , Restoration Systems will turn the area into a river park that will benefit everyone in the area The company is recommending that an easement to the property be held to provide public access , and since this is outside the city limits of Kenly , it is suggested that the County take the easement Bryan Brice , environmental attorney who has worked with Restoration Systems on the project , stated that from an environmental aspect , the removal of the dam will be a great improvement He noted he has worked with Mr Howard on other projects , and highly complemented his work He pointed out that if the County does not hold the public access easement , the only other possibility would be the Triangle Land Conservancy , which would not necessarily have the same interest as the County George Howard gave a brief overview of the project , which is to remove the dam to improve water quality and restore migratory fish to the river and its tributaries Currently the project consists of 75 acre and the easement ; however , he hopes to add additional land , possibly up to 10 acres , in the future If the County agrees to take the land and maintain the access easement , Restoration Systems will make an endowment to the County in two phases of 70,000 each for a total of 140,000 to offset any cost The amount of acreage would not affect the endowment amount He noted that one of the major concerns will be keeping trash picked up at the site The company will do all site preparation and water quality testing before turning over the land to the County , and will be involved in the project for 5 years to make sure everything goes well Removing the dam will allow fishing opportunities for spring migratory fish , and will provide a much safer environment He notedPagePage pageNumber9819 November 1 , 2004 Continued that people have been illegally fishing near the dam for years , which was very dangerous , and over the last fifteen years , three lives have been lost In response to a comment from Commissioner Wade M Stewart about the original reason for the dam , Mr Howard noted it was constructed many years ago for a mill to locate at the site Once the people along the river realized that the dam stopped fish from coming up the river , they petitioned for it to be torn down He further noted that the site has historic value since Sherman camped there at the end of his march during the Civil War Restoration Systems plans to erect signs with all the historic and environmental information for the public Commissioner Allen L Mims , Jr suggested the responsibility could be turned over to the Town of Kenly if the town limits should ever move out that far It was noted that the truck stop located in front of the dam has already been satellite annexed by the Town In response to a comment from Commissioner Stewart , Mr Wilkinson noted that Restoration Systems does get mitigation points for this project The points could be used anywhere along the Neuse River , however , mitigation is supposed to be taken to the closest point , which means they would probably be used in Johnston County County Manager Rick Hester stated he visited the site on Friday morning and his only concern is the question of liability , and noted that Attorney Mark Payne is looking for ways to diminish this as a problem Commissioner Allen L Mims , Jr suggested that staff look into the legal aspects of the property acquisition , discuss the idea with the recreation advisory committee and make a Board decision at the December 6 , 2004 meeting The Board agreed 16 Buffalo Water District - Award of Contract for Additional Construction Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed regular session to sit as the Buffalo Water District Board The Board reviewed the following bids , which were opened on October 21 , 2004 for the construction of additional water line extensions for the Buffalo Water District T A Loving , Goldsboro , NC 992,68800 Billings & Garrett , Inc , Raleigh , NC 1,149,55525 H B West , Inc , Smithfield , NC 1,229,00760 Staff has recommended award of contract to low bidder , T A Loving of Goldsboro in the amount of 992,68800 , subject to USDA Rural Development approval Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote the Board awarded a project contract to low bidder , T A Loving , of Goldsboro , NC , in the amount of 992,688 for the construction of additional water line extensions for Buffalo Water District Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Buffalo Water District Board adjourned and regular session was resumed 17 Public Utilities - Request for Interim Residential Sewer Service Policy Tim Broome , director of Public Utilities , requested the Board adopt an Interim Residential Sewer Service Policy The policy would give Staff direction in dealing with the competing requests for allocation from approved residential projects until a more comprehensive revised policy is adopted Currently , the requests for allocation for approved projects exceed the county’s available capacity Should all projects be built at this time , the county would not be able to meet the demand until some changes are made Page0820 November 1 , 2004 Continued Staff is working with the state to relax the guidelines for required capacity per bedroom for residential development , and attempting to reacquire some allocated capacity In addition , the county has applied for grant funds to build a wastewater line from Benson to Four Oaks ; however , any capacity realized from this would be earmarked for industry Under the proposed policy , developers would be able to reserve capacity for future phases by submitting a 10 deposit at the time the developer pays the fee for the first phase This 10 would be a commitment from the developer that he will use the allocated capacity or forfeit it Commissioner Allen L Mims , Jr asked about commercial and industrial uses Mr Broome responded the county has reserved 150,000 gpd for commercial use , and 250,000 gpd for industrial use Commissioner Mims pointed out that the reserve for industrial use could be a problem if an industry with great sewer needs came into the county Several developers who were in the audience asked for clarification of points in the policy It was explained that developers will be expected to establish time - lines for when they will need allocation for all future phases of a development , and they will only have one opportunity to change their phasing plan Mr Broome noted that the county will accept deposit only on capacity that can be guaranteed Mr Broome stated that hopefully the issue can be helped if we could get some assistance from the state in recalculating their requirements He did suggest that the policy allow for a one year phasing plan instead of six months He noted that staff is working on a proposed revision of the overall residential sewer policy , and should have something to the Board for their consideration within a few months Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Allen L Mims , Jr and approved by unanimous vote , the Board adopted the following Interim Residential Sewer Service Policy Interim Residential Sewer Service Policy At the time of submittal of preliminary plans to the Department of Planning for initial Planning Board approval , a development phasing plan shall be included which specifies the schedule of development , the number and type of residential units , and the requested wastewater flow allocation required for each phase of development Wastewater capacity shall be allocated for residential projects on a development phase - by - development phase basis Capacity shall be reserved by payment of a cash deposit in the amount of 10 of the assessment fees for all phases for which capacity is available Payment of the deposit may be made following approval of the project preliminary plat by the Planning Board for subdivisions and approval of the PUD or PDM by the Board of Commissioners Payment for the balance of capacity allocations ie wastewater assessment fees may be made after approval of utility construction plans and specifications and receipt of the DWQ Non - Discharge Permit for a given development phase Payment of the balance of capacity fees wastewater assessment fees shall be made prior to recording of the final plat for a development phase The 10 deposit will be credited on a pro - rata basis against the assessment fees for later development phases Payment of capacity fees will not be accepted for any development phase until plans and specifications are approved and the Non - Discharge Permit is issued If later development phases are cancelled or delayed beyond the approved schedule , the 10 deposit will be forfeited The Department of Utilities will maintain records of wastewater capacities required for each project on a phase - NCGS § 143 - 3184 - Location or Expansion of Industry Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board recessed regular session to sit in closed session in accordance with NCGS § 143 - 3184 - Location or Expansion of Industry No action was taken , and Commissioner Jeffrey P Carver moved the Board adjourn closed session and resume regular session Commissioner Thomas M Moore seconded the motion which carried by unanimous vote Board Reports and Comments 21 Request to Approve Administrative Changes - County Animal Control Ordinance Mark Payne , County Attorney , explained that in reviewing the revised schedule of fees and charges approved on September 13 , 2004 to the Animal Control Ordinance , staff has realized that a few words were omitted in error While these omissions do not alter the action taken by the Board , the words are needed for clarification He asked the Board to approve the administrative changes as indicated below , which will be made a part of the County Code of Ordinances as Appendix A - Animals Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the following administrative changes in the appendix that accompanies the County’s Animal Control Ordinance APPENDIX A -
