10 846 Meeting of the Johnston County Board of Commissioners December 13 , 2004 Special Meeting and Public Hearing The Johnston County Board of Commissioners met in special session Monday , December 13 , 2004 , at 6 45 pm in the Commissioners ’ Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , J Mark Payne , County Attorney , Della H Knight , Deputy Clerk , and April N Byrd , Assistant to Clerk Public Hearing - Amendment to Land Development Ordinance - Expansion of ESA District Advertised 12 3 ; 12 7 04 in The Smithfield Herald The Chairman called the meeting to order and the following business was transacted Chairman Cookie Pope stated the purpose of the special meeting was to discuss a proposed map amendment to the Johnston County Land Development Ordinance to expand the Environmentally Sensitive Area ESA as set out in Section 14 - 103 of the County Land Development Ordinance to include the Lower Little Creek watershed She opened the floor to anyone who wished to speak on this matter Sonny Johnson , 341 Sonny Road , Clayton , agreed that the need for the Clayton bypass is very pressing , but as a developer , expansion of the ESA would affect him greatly He remarked that it bothers him that the NC Department of Transportation is placing intense pressure on the County to expand the ESA instead of solving the problem themselves Randy Jones , 120 Dogwood Lane , Pine Level , owns a farm at the intersection of where the bypass is coming through , and agreed with Mr Johnson on the need for the bypass He stressed , however , that landowners in the area have not been given enough information to understand how this will affect them , and only learned of the proposal by reading the newspaper NC Cole and Earl Langdon , who also have interests in property in the area , voiced similar concerns Mr Cole noted that the Department of Transportation has still not talked terms with him concerning the land they will be needing for the bypass , and Mr Langdon suggested the expansion of the ESA could reduce the value of the affected property Commissioner Wade M Stewart noted that restrictions throughout most of the County are already in place due to the Neuse River Basin rule For example , harvesting timber near a stream is not prohibited , but there are restrictions on how it is done The expansion of the ESA would simply mean some additional development restrictions along streams in the Lower Little Creek watershed He agreed that property owners should be notified ; however , the rules are coming out of Raleigh and Washington , DC , not from local government County Manager Rick Hester stated that in 1998 when the County began building water districts , US Fish and Wildlife required the County to expand the ESA in Swift Creek At that time , it was not an action the Board wanted to make , but they were forced to do so in order to receive funding for the water districts Mr Hester emphasized that discussions on the expansion of the ESA for Lower Little Creek started in the spring of 2004 when the US Fish and Wildlife informed the Department of Transportation that this was something they wished to see done prior to the construction of the bypass In response to general discussion about the effects the ESA would have on property owners , Chandra Coats , Johnston County Environmental Protection Administrator , explained that the amount of impervious surface area allowed would be decreased slightly for residential construction - from 15 to 12 , and for commercial - from 60 to 50 She pointed out , however , that a developer may participate in a land dedication program to offset these additional restrictions Mark Payne , County Attorney , stated that expansion of the ESA should not change the fair market value of the property in the area ; and therefore , DOT’s offer for the land should not be impacted Page847 December 13 , 2004 Continued Leilani Paugh , NC DOT representative , explained that in 1998 the Corps Of Engineers issued an original permit for the Clayton bypass Since then , the design of the road has changed and a new permit is needed DOT conducted a new biological assessment and submitted this to US Fish and Wildlife Fish and Wildlife have requested expansion of the ESA as part of a conservation measure to avoid or minimize the impact to endangered species , particularly the dwarf wedge mussel , that has been identified in the area In response to questions from Commissioners , Ms Paugh and Jared Gray , also with NC DOT , further explained that the biological assessment conducted in 1998 did not take into account second impacts The recent assessment conducted in 2002 and 2003 showed substantial pollutant loading of nitrogen and phosphorous Expansion of the ESA should prove beneficial to reducing pollutant loading The dwarf wedge mussel was found in Swift Creek and Little Creek in 1998 , and now a new population has been identified in Little Creek in the area proposed for expansion In response to a question from Commissioner Allen L Mims , Jr , Ms Paugh stated that if the Board chose not to expand the ESA , DOT would move into formal consultation , which involves extensive documentation and more man hours ; thereby delaying the project for a minimum of several months , and possibly for considerably longer Commissioner Mims pointed out that when the existing ESA was established , the DOT provided some funds for enforcement of the new restrictions He asked if that would be forthcoming with this expansion Ms Paugh stated that this has not be discussed , and she is not sure if there is any funding left He noted the original agreement was for a position to last five years She suggested the County would need to address this matter with others at DOT Commissioner Wade M Stewart asked about expenses incurred as a result of disruption to the county’s water system during construction of the bypass Mr Payne explained that according the NC General Statutes , DOT would be required to cover most of the relocation costs , especially in the water districts He noted that regardless , it is likely that expansion of the ESA will cost the County something , whether it be relocation of county owned water lines or enforcement of the ESA Commissioner Stewart reminded everyone to not only consider the costs associated with the expansion of the ESA , but to remember the benefits that the bypass will bring to the County and its citizens There being no further comments , the Chairman closed the public hearing Decision to Amend County Code of Ordinances County Manager Rick Hester recommended that the Board commit to expanding the ESA , based on DOT’s November 10 , 2004 letter , effective February 1 , 2005 , and that staff hold at least one informal work session with landowners affected by the expansion before the effective date Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board amended the County zoning map to expand the Environmentally Sensitive Area Overlay District to include the Lower Little Creek watershed , and asked staff to arrange a meeting with landowners before st February 1 There being no further business , Commissioner Jeffrey P Carver moved called the meeting to order and the following business was transacted 1 Public Comments A West Johnston High School Band to Play in Presidential Inauguration Parade Chairman Pope and Board members congratulated the West Johnston High School band for being invited to play in the Presidential inauguration parade in Washington , DC Dr Pat Harris , principal , and Lance Britt , band director , remarked that they are very proud of their students for receiving this honorable invitation , and hope to represent the county well B Boy Scout Recognized The Chairman recognized Boy Scout , Jay Pearson , of Troop 77 Mr Pearson is currently working on his citizenship and community badge C Request to Place WWII Statue on Courthouse Grounds Matthew Sorrell , student at West Johnston High School , spoke to the Board about his desire to see a WWII statue on the Courthouse grounds He would like for the statue to be approximately 6 feet tall , dressed in military fatigues Mr Sorrell noted he has contacted local artist , Frank Creech , and was told the statue will cost approximately 75,000 to 125,000 He plans to begin a fund - raising drive in the near future , provided the Board gives him permission to move forward with his plan Board members commended Mr Sorrell on this project Commissioner W Ray Woodall suggested Mr Sorrell meet with the Veterans ’ Council , Veterans Service Director , Ricky Byrd , and other veterans organizations to receive their input on this matter 2 Public Hearings - Rezoning Cases and Special Use Permit Requests Advertised - In the Smithfield Herald - November 30 , December 7 , 2004 Certified letters were mailed to adjoining property owners on Thursday , December 2 , 2004 and notice posted at the locations on November 29 , 2004 The Chairman asked that Case 04 - 42 be heard first due to the large number of people in attendance for that case She then opened the Public Hearing for Case 04 - 42 Case 04 - 42 Petition to rezone approximately two acres located on Pleasant Lane in Pleasant Grove Township from Agricultural - Residential AR to Industrial 2 - Special Use District I2 - SUD Tax ID 13B01022 Owner Andrew Eugene and Hazel Pleasant Petitioner Michael J Pleasant Planning Director Steven Finn identified the property on the GIS map and noted this request is to rezone approximately two acres of a larger parcel The acreage in question is located adjacent to the southern property line The surrounding zoning is Agricultural - Residential , and adjacent to the subject property is a subdivision Ben Blalock , 3675 Jackson King Road , Willow Springs , requested staff to point out the stream that runs through this property , and noted it empties into Black Creek Page849 December 13 , 2004 Continued Jeremy Smith , planner , noted there is a very small ditch or stream that feeds into the existing pond on the property , which does not require a riparian buffer There is no blue line stream indicated on the County GIS map Applicant Michael Pleasant , 110 Pleasant Lane , Willow Springs , clarified that the requested rezoning and special use permit is for his own private use , not public use The requested use would involve clearing and hauling of debris from residential lots He currently owns one dump truck , and would be hauling five to seven loads a day , Monday thru Friday from 8 - 5 , and Saturday from 8 - 12 His dump truck would not be on the road in the mornings , while school busses are running He further added that all necessary equipment would be on site , and field dirt would be stockpiled in case of an emergency , such as a methane induced fire , and he will carry extensive insurance to cover any damages , should any occur In response to questions from Commissioner Wade M Stewart , the applicant stated that he has been in the clearing and grading business most of his life With assistance from his son , he has recently gone into business for himself Mr Pleasant stated that he has been using the County landfill to dump stumps and limbs , but remarked that one load of stumps takes the place of five loads of compacted garbage , and at this rate the county landfill will fill up quickly He noted the County currently has only two small landfills for organic debris disposal In response to a question from Commission Jeffrey P Carver , County Manager Rick Hester stated that while it is true that stumps and organic debris do take up space in the landfill , the County is fortunate to have land enough to assure capacity until approximately 2075 Commissioner Stewart added that he spoke with Utilities Operation Director , Haywood Phthisic , and was informed that the County tries to deter any inert debris from being delivered to the landfill If such material is dumped , all dirt must be knocked off first , because it has go through a grinding machine Commissioner Tony Braswell noted that , according to the minutes of the Planning Board meeting , the applicant stated that the requested site would be filled within three to four years He questioned whether Mr Pleasant would be seeking additional acreage in the future Mr Pleasant assured the Commissioners that this is a one time request , and he would not be seeking to expand in the future Becky Holland Watkins , whose mother lives near the proposed rezoning , stated that she was worried about spontaneous fires that can result from burying organic matter , which sometimes burn for many weeks She questioned the applicant’s ability to respond to such emergencies , especially when , at the Planning Board meeting , he indicated a lack of knowledge about the creation of methane gas in these types of landfill She pointed out there are approximately 400 homes within a one mile radius She questioned the easement that would be used for a driveway , and whether it is wide enough for a dump truck to turn onto from Jackson King Road without crossing the center line She suggested this property is not a suitable place for this type of operation Maylon Taylor stated that he owns 48 acres within 500 feet of the proposed rezoning , some of which he plans to develop in the future , He opposed the rezoning and voiced concern about the potential danger of fires , geological hydrology issues , and questioned how all of this could impact the value of his land He noted , in his opinion , a two acre stump dump does not make sense economically , unless Mr Pleasant plans to expand his operation in the future Chana Dupree Ferrell , 3236 Jackson King Road , stated her father owns 40 acres adjoining the subject property She , too , opposed the rezoning and questioned the validity of the information on the permit , especially the width of the easement Ms Ferrell called for a show of hands of those opposing the rezoning A number of people in the audience raised their hands Also speaking in opposition to the rezoning were Donald Hicks , Michael and Lynne Felt , Deeter Holland , Jim Greer , Jamie Reyno , and Ken Hicks Planning Director Steven Finn stated that the Planning Board recommended denial of the request There being no further comments , the Chairman recessed the Rezoning Hearing for Case 04 - 42 Board meeting and , in his opinion , the information that was presented by the applicant at that time differs considerably from what has been said at this meeting He stated he feels the people who have spoken have legitimate concerns , and pointed out the Planning Board recommended denial by unanimous vote Following further discussion , the motion for denial passed by unanimous vote The Chairman reopened the Rezoning Public Hearing for Case 04 - 39 Case 04 - 39 Petition to rezone 115 acres located on Old US 70 SR 1004 in Clayton Township from Agricultural - Residential AR to Office and Institutional - Special Use District OI - SUD Tax ID 05G01020 Owner Petitioner K & K Associates of NC Jeremy Smith , Planner , identified the property on the GIS map and noted this request is to rezone 115 acres on Old US 70 , across from Clemmons State Forest , near Clayton The zoning in the area is predominately Agricultural - Residential AR Mr Smith informed the Board that the applicant was not present Since the applicant was not present , Commissioner Allen L Mims , Jr recommended the Board table a decision on this case until a later date The Chairman recessed the hearing for the Chairman reopened the Rezoning Public Hearing for Case 04 - 41 Case 04 - 41 Petition to rezone approximately three acres located on Cleveland Road SR 1010 in Cleveland Township , from Agricultural - Residential AR to General Business - Special Use District GB - SUD Tax ID 06F04016 Owner Denton F Lee , Jr and Jane A Lee Jeremy Smith , Planner , identified the property on the GIS map and noted the tract is located just west of the Cleveland Athletic Association fields , near the intersection with Cleveland Fire Road Denton Lee , III , requested the Board rezone this parcel so that he can build a baseball softball training facility He stated he plans to have batting cages , pitching areas and space for field practice In addition , he wishes to build a 2500 square foot building to house an arcade , which would provide a place for community events such as children’s birthday parties The only food planned would be possibly hotdogs and chips , or similar items He stated that it is his intent to build a family friendly business complete with a picnic area and playground facilities In response to a question from Chairman Cookie Pope , Mr Lee stated that there are three additional special use request to allow for the construction and operation of a batting cage and athletic facility , with a snack bar and arcade He entered the following summary of evidence into the record A pre - application consultation was held with the applicant for Case 04 - 41 on September 20 , 2004 At that time , the applicant was informed of the following 1 If approved , applicant must provide to the Planning Department for their review and approval 2 Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board 3 Applicant will be notified in writing of the Boards decision 4 If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners 5 Applicants Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period 6 When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements 7 Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearing were advertised in accordance with the requirements of the North Carolina General Statutes On October 19 , 2004 the Johnston County Planning Board a held public hearing regarding the Special Use Permit for Case 04 - 41 and made the following recommendations The Planning Board recommended approval with a vote of 7 - 0 for the Special Use Permit Application allow for the construction and operation of batting cage and athletic training facility with snack bar and arcade The Planning Board recommended the following Finding of Facts and Special Conditions Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; 2 That the use or development appears to comply with all required use and intensity regulations of Articles II and IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; 4 That the use or development conforms with general plans for the physical development of the Countys Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners ; and 5 The use as proposed will provide a valuable recreational service to the community Special Conditions 1 Submittal of a detailed an expansion of an interstate overlay district In response to a question from Commissioner Allen L Mims , Jr , Mr Finn stated an approved 600 rooftop subdivision is immediately south of the subject property The zoning in the area is predominately Agricultural - Residential AR He noted that if the land is developed General Business , a 50 foot riparian buffer would be required Sonny Johnson , Assignment The Board said good bye to Ellen Sung , reporter for the News & Observer who has been covering Johnston County Ms Sung will remain with the N & O , but will write a column and cover other news lt; Retreat Scheduled The Board scheduled a retreat for February 18 , 2005 from 8 30 am until 3 00 pm The Board asked the County Manager to check on several possible locations and report back to them lt; Retreat Discussion Item Commissioner Allen L Mims , Jr brought to the Board’s attention the large subdivisions that were approved by the Planning Board last month and suggested the Board look into this at their upcoming retreat to see if the County might find ways to encourage developers to donate land for schools He noted this could possibly involve the open space requirements lt; Request for Report Commissioner Wade M Stewart asked the County Manager to contact theTax Administrator , Pat Goddard , and ask her to report on the possible reduction qualifications for vehicle taxes that were referenced in a recent article in the News & Observer There being no further business , Commissioner Allen L Mims , Jr moved the Board adjourn Commissioner Jeffrey P Carver seconded the motion ,
