10 321 Meeting of the Johnston County Board of Commissioners November 7 , 2005 The Johnston County Board of Commissioners met in regular session Monday , November 7 , 2005 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , John R Massey , Finance Officer , J Mark Payne , County Attorney and Deva C Holt , Deputy Clerk The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and rd carried by unanimous vote , the Board approved the minutes of the October 3 board meeting as presented 2 Public Comments No one spoke at this time 3 Veterans Day Proclamation Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Tony Braswell and carried by unanimous vote , the Board adopted the following proclamation in observance of Veterans Day P R O C L A M A T I O N V E T E R A N S D A Y - 2005 WHEREAS , for decades America has paused on the 11th of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before all the world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2005 , as “ Veterans Day ” in Johnston County , and urge our citizens to commend its observance 4 Department of Transportation – Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Daffodil Lane , Goldthread Avenue , Fireweed Place , Geranium Way , Juneberry Place – East Lake Subdivision 1 and 2 – Wilders Township Sheffield Drive , Wilshire Lane , Dublin Court , Chaucer Place – Sheffield Wood Subdivision Phases 1 and 2 – Elevation Township Commissioner W Ray Woodall moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Jeffrey P Carver seconded the motion which carried by unanimous vote Page322 November 7 , 2005 Continued 5 Animal Services – Rabies Clinic Policy Change Ernie Wilkinson , Director of Animal Services , requested the Board consider a policy change to increase the rabies vaccination fee for dogs to 5 Currently , the County charges 5 to vaccinate cats , however , there is no charge for dogs Surrounding counties charge similar amounts for both dogs and cats Further , Mr Wilkinson requested the Board’s consent to allow the Animal Services department to offer only a one - year vaccination , versus the one - year and three - year vaccinations offered in the past This would eliminate excessive paperwork and tracking problems , and allow the department to incur more animals for vaccination in the future years , and generate recurring revenue In response to questions from the Board , Mr Wilkinson commented that last year the County vaccinated approximately 3,800 dogs Veterinary fees for the clinic cost the County approximately 12,000 annually He pointed out that the State requires the County to offer a rabies clinic County Manager Rick Hester noted that the County no longer collects taxes for dogs , and the 5 charge would help off - set the associated cost of the clinic Mr Wilkinson added that his department has already used 60 of its allocation for fuel during the first four months of FY 05 - 06 Other needs include collapsible cages for adoption fairs Further , he noted soon there would be a time when the department will need to buy drugs for euthanasia Commissioner Allen L Mims , Jr stated , in his opinion , citizens should pay for the vaccinations , and supported Mr Wilkinson’s recommendation Commissioner Wade M Stewart stated , in his opinion , the policy should remain the same , and the County should not charge for the vaccinations He commented that offering the vaccinations served as a good measure to promote public health in the county Following further discussion , Commissioner Allen L Mims , Jr moved the Board approve a policy change to allow the Johnston County Animal Services Department to charge 5 for rabies vaccinations for dogs The 5 charge for cats will remain the same Commissioner Jeffrey P Carver seconded the motion , which carried by the following vote Ayes Commissioners Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Nayes Commissioners Cookie Pope and Wade M Stewart 6 Public Hearing – 10 15 am – Land Development Code – Chapter 14 , Section 14 - 481 Advertised October 28 , November 1 , 2005 The Smithfield Herald The Chairman opened the public hearing and stated the purpose of the hearing is to consider public comment on the adoption of the latest revised FEMA flood maps , and to consider public comment on proposed amendments to the Johnston County Code of Ordinances – Chapter 14 – Land Development Code , Section 14 - 481 – Construction Standards Steven Finn , Planning and Zoning Director , stated that to continue participation in the FEMA Flood Insurance Program , the County must adopt revised flood maps Further , staff is requesting two revisions to the existing flood ordinance as outlined in the County Code of Ordinances – Section 14 - 481 1 Raise the existing standard for new home construction from 1 ’ to 2 ’ above the “ base flood elevation BFE ” in the 100 year flood plain 2 Limit earth filling in flood plains to a maximum of 20 of the gross area of the developed parcel or certification by an engineers flood study that greater filling will not raise the upstream BFE by more than 01 ft In response to questions from County Manager Rick Hester , Mr Finn stated , based on the type and square footage of the home , the difference in the construction cost for 1 ft above BFE to 2 ft above BFE would be approximately 200 - 400 Further , there would be better opportunities for reduced flood insurance premiums Commissioner Allen L Mims , Jr noted that according to the new flood maps , the flood plain elevation has increased , and , in his opinion , the flood plain elevation will continue to rise in the future Commissioner Mims expressed support for the revisions Page323 November 7 , 2005 Continued Mr Finn noted that most eastern counties maintain 2 ft above BFE standards , and western counties require 2 ft - 8 ft above BFE He stated , if the Board approves the recommended revisions , staff would report to the Board within the next several months with feedback regarding implementation Sammy Jackson , who was in attendance at the meeting for a separate matter , pointed out that the fuel cost to haul the extra dirt needed to increase to the 2 ft requirement might be significantly more than 200 - 400 , as mentioned earlier There being no further comments , the Chairman closed the public hearing Decision of the Board Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the revised FEMA flood maps as presented , and approved the following amendments to the Johnston County Code of Ordinances – Chapter 14 – Land Development Code , Section 14 - 481 – Construction Standards together with various administrative or grammatical changes b 1 Residential construction New construction or substantial improvement of any residential structure shall have the lowest floor , including basement , elevated no lower than one foot two feet above the base flood elevation Should solid foundation perimeter walls be used to elevate a structure , openings sufficient to facilitate the unimpeded movements of floodwaters shall be provided Related earth filling in flood plains is limited to a maximum of 20 of the gross area of the developed parcel or certification by an engineers flood study that greater filling will not raise the upstream Base Flood Elevation by more than 01 ft 7 Resolution Requesting NC DOT to Pave Cleveland Crossing Drive On behalf of Carolina Graphics Press , County Manager Rick Hester requested the Board adopt a resolution in support of the construction and paving of Cleveland Crossing Drive He stated the road is an integral part of the Carolina Graphics Press project , a new proposed manufacturing facility near the intersection of Interstate 40 and NC Hwy 42 Due to low funds , NC DOT has informed Carolina Graphics Press that the road may not be paved Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board adopted the following resolution in support of the construction and paving of Cleveland Crossing Drive RESOLUTION REQUESTING THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION TO PAVE CLEVELAND CROSSING DRIVE CLEVELAND AREA , NORTH CAROLINA WHEREAS , the Johnston County Board of Commissioners seek to create and foster economic development opportunities for the County ; and WHEREAS , new job creation and increased capital investment add to the economic health of the County ; and WHEREAS , Carolina Graphics Press has identified a + - 40 acre parcel of land served by Cleveland Crossing Drive , near Interstate 40 NC 42 Hwy in the Cleveland Area , North Carolina as a location for a new manufacturing facility ; and WHEREAS , Carolina Graphics Press will cause to occur 5,000,000 of investment and create 40 new jobs ; and WHEREAS , Carolina Graphics Press as a condition of their location decision , requires the construction and paving of the access road , funding provided by the North Carolina Department of Transportation contingent upon the Department of Transportation’s ability to secure right - of - way and funding for Cleveland Crossing Drive NOW , THEREFORE , BE IT RESOLVED that the Johnston County Board of Commissioners requests the North Carolina Department of Transportation’s consideration to upgrade , pave , and maintain Cleveland Crossing Drive to facilitate the location of this project 8 Tax Exempt Loan Status for Archer Lodge Volunteer Fire Department Pete Barnes , Chief of Archer Lodge Volunteer Fire Department , requested the Board approve tax - exempt loan status for Archer Lodge Volunteer Fire Department for a loan from Four Oaks Bank & Trust , in the amount of 375,000 , to purchase a new fire truck In response to a question from Commissioner Jeffrey P Page324 November 7 , 2005 Continued Carver , Mr Barnes stated the department would be able to maintain its existing fire district tax rate after the purchase of the new truck Commissioner Jeffrey P Carver moved the Board adopt the following resolution approving tax - exempt loan status for Archer Lodge Volunteer Fire Department for a loan from Four Oaks Bank & Trust , in the amount of 375,000 , to purchase a new fire truck Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote Resolution Approving Tax Exempt Loan Status for Archer Lodge Volunteer Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Volunteer Fire Department of Archer Lodge Community , North Carolina the “ VFD ” , from Four Oaks Bank & Trust Company , in the principal amount of 375,00000 , which loan is for the following purpose The purchase by the VFD of a fire truck , which will be owned and operated by the VFD , and will be maintained at the following address 6483 Covered Bridge Road , Clayton , North Carolina 27527 9 Tax Exempt Loan Status for 50 - 210 Volunteer Fire Department Commissioner Wade M Stewart moved the Board adopt the following resolution approving tax - exempt loan status for 50 - 210 Volunteer Fire Department for a loan from Four Oaks Bank & Trust , in the amount of 300,000 , to purchase a new equipment truck Commissioner Tony Braswell seconded the motion , which carried by unanimous vote Resolution Approving Tax Exempt Loan Status for 50 - 210 Volunteer Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Volunteer Fire Department of 50 - 210 Community , North Carolina the “ VFD ” , from Four Oaks Bank & Trust Company , in the principal amount of 300,00000 , which loan is for the following purpose The purchase by the VFD of an equipment truck , which will be owned and operated by the VFD , and will be maintained at the following address 50 Greenleaf Road , Angier , NC 27501 10 NC Forest Service – New On - Call Compensation Policy Michael Good , District Forester with the NC Forest Service , informed the Board that the NC Office of State Personnel initiated a new policy with regard to on - call compensation for State employees The policy was effective July 1 , 2004 , however , implementation of the policy began September 1 , 2005 NC Forest Service employees who are on - call for fire suppression in Johnston County fall under the policy The on - call rate is 2 per hour , and in Johnston County the total on - call hours per week is estimated at 108 hours Under the present agreement , Forest Service budgets are split 60 State , and 40 County The County’s FY 05 - 06 budget did not allow for implementation of the policy On behalf of the NC Forest Service , Mr Good requested the Board approve an allocation for the County’s share of the on - call compensation , which is estimated at a maximum of 5,000 He noted the expense would be included in budget requests for future fiscal years In response to questions from the Board , Mr Good stated to date the Forest Service has answered 28 calls in the county during the 2005 calendar year There are four forest rangers in Johnston County , all of which are salary employees and receive compensatory time for hours worked over 40 per week County Manager Rick Hester noted it is possible that the requested 5,000 allocation could be absorbed by existing funds already allocated to Johnston County Forestry Services , if the existing funds are not used in their entirety Finance Officer John Massey added that allocated funds have exceeded actual expenditures for the past three years , and questioned whether the County would receive an amended agreement Mr Good stated the district office could provide an amended agreement if the Board desires PagePage pageNumber5325 November 7 , 2005 Continued Commissioner Wade M Stewart stated , in his opinion , the on - call aspect of the job is part of the forest rangers ’ duties , and should not be compensated Commissioner Cookie Pope expressed support of Commissioner Stewart’s comment Following further discussion , Commissioner Jeffrey P Carver moved the Board approve the following budget amendment in the maximum amount of 5,000 in additional funds for the NC Forest Service to cover the County’s share of the on -
