10 294 Meeting of the Johnston County Board of Commissioners October 3 , 2005 The Johnston County Board of Commissioners met in regular session Monday , October 3 , 2005 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , John R Massey , Finance Officer , J Mark Payne , County Attorney and Deva C Holt , Deputy Clerk The Chairman called the meeting to order , and announced that Deputy Clerk Deva Holt would be sitting as acting clerk for the next several meetings while Clerk to the Board April Byrd is out of the office Chairman Pope congratulated Ms Byrd and her husband on the birth of their son , Jacob Robert Byrd , and wished Jacob much success in the future Following Chairman Pope’s comments , the subsequent business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board approved the minutes of the September 6 , 12 board meetings as presented 2 Public Comments A Special Recognition of Dr John Booker Ernie Wilkinson , Director of Animal Services , recognized Dr John Booker for his key involvement in the establishment and success of the Johnston County Animal Shelter and Pet Adoption Center On behalf of the department , Mr Wilkinson presented Dr Booker with a plaque of appreciation that read as follows In recognition and deepest appreciation of John M Booker , DMV , for having and sharing a vision years ago for the county state - of - the - art animal services facility and the efficient animal services operation , and for his years of dedication , diligent planning , countless hours of hard work , voluntary veterinary service , personal sacrifice , and sheer persistence and determination working as a County Commissioner , a community leader , and a local veterinarian to see that this vision became a reality Dr Booker thanked the Animal Services staff for the honorable recognition , and further thanked the Board of Commissioners for their continued support and interests in the welfare of animals and the citizens of Johnston County 3 Public Hearing – 10 15 am Economic Development Incentive Package Advertised September 23 , 2005 The Smithfield Herald The Chairman opened the public hearing and stated the purpose of the hearing is to allow for public comment on a proposal for the County to provide certain economic incentives , pursuant to NCGS 158 - 71 , to a company that is planning the construction of a new facility in Johnston County She noted that following the Board’s hearing the Town of Micro would hold a public hearing to discuss the matter Economic Development Director Michael de Sherbinin stated the company is Bunting Enterprises , LLC , a privately owned family business which has been in operation for approximately 50 years Bunting affiliated companies includes Bunting Enterprises , Bunting Swine Farm , Wilson Milling , LLC , and Meat Masters Inc Bunting also has retail facilities that market directly to consumers The company has proposed to construct a 12,000 sq ft facility in the Town of Micro to market retail cuts of pork , chicken , and beef products The pork would be processed at the Micro facility ; however , chicken and beef products would be brought in already processed Over a period of five years , it is anticipated that the project will have a capital investment of 2,500,000 , and employ approximately 25 individuals The project could possibly include a greater capital expenditure beyond the 2,500,000 Mr de Sherbinin proposed that the County and the Town of Micro join together to respectively offer Economic Development Incentive Grants based on the projected capital investment of 2,500,000 He requested the Board’s approval of a County Economic Development Incentive Grant EDIG for fivePage295 October 3 , 2005 Continued consecutive years beginning in January 2007 for up to 10,000 per year for a total of 50,000 expiring on January 1 , 2012 The Town of Micro has agreed to contribute to the project as well with a similar Economic Development Incentive Grant EDIG for five consecutive years beginning in January 2007 for up to 5,000 per year for a total of 25,000 expiring on January 1 , 2012 The grants can be scaled back if the company’s investment is less than 2,500,000 The company can also return to the boards to request additional grant funds if their investment exceeds 2,500,000 Mr de Sherbinin introduced John Bunting and Ricky Pittman of Bunting Enterprises , LLC Mr Bunting reiterated the proposed facility would be for slaughtering and processing pork products , with a retail component as well Bunting’s intentions are to begin as a phase one facility employing 20 workers If the facility is successful and gains business , Bunting plans to expand to a phase two facility employing 25 workers , and possibly to a phase three facility employing additional workers In response to questions from the Board , Mr Bunting stated the animals would be brought to the facility , pinned under small quantities , and slaughtered on site The facility would be a new location with new employees , and only a couple of employees from the Bunting’s Wilson facility might transfer locations Mr de Sherbinin outlined the proposed incentive package Proposed Incentive Package The County proposes an Economic Development Incentive Grant EDIG for five consecutive years beginning in Year 2007 in the amount of 10,000 per year for a total of 50,000 expiring on January 1 , 2012 In the event the 2,500,000 capital investment is reduced beyond normal depreciation during any grant year as set out in this agreement , the County may , in its sole discretion , eliminate or reduce future annual grants The County’s participation in this EDIG occurs only after the Company pays their full ad valorem tax assessment for each year of the grant’s term The County of Johnston can reimburse a company on an annual basis certain project components that include , but are not limited to the following Architectural and engineering design costs , Project related legal fees , Permit costs , Site grading expenses , Utility extension and upgrade expenses , Capacity and or acreage fees , Installation of building pad costs , Costs for equipment and installation thereof , Cost for transportation and rigging of equipment , Worker training expenses , Sales tax , Costs for pretreatment , and Costs incurred for environmental compliance matters The company on an annual basis will be required to submit copies of invoices and canceled checks to the Johnston County Economic Development Office who will review and approve for payment to the Johnston County Finance Office Upon agreement by the Finance Office for payment , reimbursement to the company shall occur from the Johnston County General Fund This process will continue on an annual basis until such time as the Grant agreement expires In response to a question from Commissioner Allen L Mims Jr , regarding pretreatment , Mr de Sherbinin noted the Town of Kenly will be treating the waste from the facility Commissioner Wade M Stewart thanked Mr de Sherbinin for his work on the project , and Bunting Enterprises for their interest in Johnston County He emphasized the value of small businesses to Johnston County , and the importance to treat small and large businesses the same Page296 October 3 , 2005 Continued Buddy Jones , Mayor of the Town of Micro , stated their Board has reviewed the agreement and fully supports offering the Economic Development Incentive Grant from the town There being no further comments , the Chairman closed the public hearing for the Johnston County Board of Commissioners 4 Public Hearing – Town of Micro - Economic Development Incentive Package Buddy Jones , Mayor of the Town of Micro , called to order a special meeting of the Town of Micro for the purpose of allowing petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Saddle Ridge Drive , Silver Stirrup Court , Roping Horn Way , Bucking Saddle Way , Saddle Ridge Subdivision – Cleveland Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Tony Braswell seconded the motion which carried by unanimous vote 7 Surplus Property – Sheriff’s Department Sheriff Steve Bizzell requested the Board declare the following vehicles surplus , and authorize the vehicles be sold at public auction by Randy Wester Auction Company , of Benson , NC , on Saturday , November 19 , 2005 at declare the following Emergency Services vehicle surplus , and authorize the vehicle be sold at public auction by Randy Wester Auction Company , of Benson , NC , on Saturday , November 19 , 2005 at 10 00 am at the County gas pump facilities The vehicle was recently taken out of service due to the closing of the Quick Response Station at Micro , and the end of the QRV program in Johnston County Year at 10 00 am at the County gas pump facilities 9 Emergency Services – Update on Hurricane Katrina Relief Dewayne West , Emergency Services Director , provided the Board a brief update on the Hurricane Katrina Relief efforts Staff is in the process of totaling the donations from the County’s effort to contribute to the relief efforts Mr West suggested that if the funds are sufficient the donations be forwarded to two primary recipients in Mississippi Stone County and Pearl River County Stone County is a very rural area , approximately 445 sq miles , roughly half the size of Johnston County , with a population of 15,000 Pearl River is approximately 800 sq miles , about the size of Johnston County , with a population of 48,000 He further suggested if the donations turned out to be a tremendous amount , to consider assisting Hancock County , Mississippi as well He requested the Board’s permission to contact the two prospective counties in Mississippi Commissioner Tony Braswell offered to assist Mr West in delivering the funds to Mississippi Chairman Pope thanked the citizens of Johnston County for their generosity Following discussion , the Board agreed to discuss the details of how the money should be specifically allocated and used by the th Mississippi counties at the October 10 Board meeting In the meantime , the Board instructed Mr West to begin discussions with officials from Stone County and Pearl River County , Mississippi , and bring specific th guidance back to the Board on October 10 10 Keep Johnston County Beautiful Presentation – Historical Architectural Survey Susan Woodard , President of Keep Johnston County Beautiful , informed the Board a historical architectural survey , titled “ 30 Years in the Making ” , has recently been completed The survey details the historic buildings and homes that have shaped Johnston County’s history The project began in the late 1970 ’ s when the Board of Commissioners appointed the Historic Preservation Committee whose goal was to document , list , and describe the historic structures found throughout the county In the early 1980 ’ s , the Board of Commissioners allocated funds to Keep Johnston County Beautiful to hire a historian to publish a book ; however , the project fail through until almost three years ago when the project was revitalized Architectural historian Nancy Van Dolsen has been working on the project since that time A public presentation of the rd survey will take place on November 3 at the new Agriculture Center Ms Van Dolsen presented a brief power point presentation on the survey’s findings 11 Authorization to Advertise for Bids – Former Cooperative Extension Building Renovations Russell Pearlman , of the Wooten Company , provided the Board information on the renovations to the former Farm Services and Cooperative Extension buildings Minor renovations are needed to convert the Farm Services building into usable office space for the DSS Income Maintenance Division These renovations are estimated at 149,546 The necessary renovations to convert the Cooperative Extension building into space for DSS Child Welfare Services are more significant , and involve renovations to the mechanical , electrical , and plumbing systems Also , included is subdividing the former auditorium into three smaller meeting rooms andPagePage pageNumber5298 October 3 , 2005 Continued renovating all the offices Total costs are estimated at 856,417 The Cooperative Extension building renovations would need to be advertised for bid In response to a question from Commissioner W Ray Woodall , Mr Hester stated the former Cooperative Extension auditorium would not be converted into a small courtroom as previously discussed DSS Director Earl Marrett informed the Board that the auditorium would be used for staff meetings and training purposes He noted the renovated buildings would accommodate the agency’s needs at this time In response to a question from Commissioner Tony Braswell , Mr Pearlman responded that 33 DSS employees would relocate into the former Farm Services building , and 45 employees into the Cooperative Extension building Commissioner Wade M Stewart emphasized the urgency of providing additional space for DSS , and the strong push since the late 1990 ’ s from the State Department of Health and Human Services to make this happen Commissioner Stewart noted that in regards to the flat roof on the Cooperative Extension building , those involved in the renovation discussions decided not to address this matter at current time , rather , wait until the roof needed replacing County Manager Rick Hester reminded the Board that the renovations would be eligible for Federal reimbursement County funds , in the amount of 500,000 , have already been budgeted for the projects in the preparations for these renovations He requested the Board authorize staff to advertise for bids for the renovations to the former Cooperative Extension building Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board authorized staff to advertise for bids to sit as the Little River Water District Board Sandy Mills , Utility Development Manager , requested the Board establish the following proposed capital budget ordinance for the Little River Water District The project includes construction of the southern phase , south of Interstate 95 between Pine Level and Kenly , and the design and bid of the northern phase , the area from Interstate 95 north to NC Highway 42 She noted USDA has issued the letter of conditions for the first phase of the project , Phase 1 - South Little River Water District Capital Budget Ordinance BE IT ORDAINED by the Board of Commissions of Johnston County , North Carolina , that pursuant to Section 132 of Chapter 159 of the General Statutes of North Carolina , the following capital project ordinance is hereby adopted SECTION 1 The project authorized is the design and construction of water mains , water service assemblies and all other related work for Phase I South region of the Little River Water District to be financed by USDA Rural Development grant and loan funds Additionally , the project encompasses the design and permitting of the North region of the Little River Water District for future construction consideration to be financed by the General Fund SECTION 2 The Public Utilities Director of the County is hereby directed to proceed with the capital project within the terms of the loan Allocation Transfer to the Town of Clayton County Manager Rick Hester requested the Board approve an interlocal agreement between the County and the Town of Clayton for the transfer of 500,000 gpd of wastewater allocation After discussions with the City of Raleigh , the City has agreed to provide the County with 500,000 gpd of wastewater allocation Mr Hester pointed out the agreement between the County and the City of Raleigh is only guaranteed for 10 years , and there is no assurance that the allocation will be extended beyond the ten year time period The Town of Clayton has a similar agreement with the City of Raleigh for 500,000 gpd of wastewater allocation as well The Town of Clayton has agreed to serve a large planned unit development , Hermitage PUD that the County approved a few years ago The Town would offer the residents voluntary annexation , and provide water and sewer services Mr Hester proposed that the County transfer its allocation from the City of Raleigh to the Town of Clayton to serve the PUD Mr Hester suggested two changes to the proposed agreement originally submitted to the Board for their consideration 1 Modify Section 8 to specify that if the Town of Clayton does not provide water and sewer services to the development , the allocation would transfer back to the County and the County would have the option to accept or decline the transfer at that time , and 2 Add Section 17 which specifies the agreement between the County and Town of Clayton is subject to written formal notice from the City of Raleigh , which the County has not received yet Commissioner Allen L Mims , Jr supported the County Manager’s suggested changes He expressed concern that if the development falls through and the allocation transfer to the Town of Clayton did not take place , the County would be responsible for paying capacity charges for the wastewater allocation with no tax base to compensate for the charges Commissioner DeVan Barbour questioned what the consequences would be if the City of Raleigh terminated their agreement with the County after ten years Commissioner Mims stated it would be the responsibility of the board at that time to find a way to provide services to the residents in the area , however , in his opinion , the odds are the City of Raleigh will not terminate the agreement Following discussion , Commissioner W Ray Woodall moved the Board approve the following interlocal agreement , including the County Manager’s recommendations , between the County and the Town of Clayton for the transfer of 500,000 gpd of wastewater Allocation rd THIS AGREEMENT the “ Agreement ” is entered into as of the 3 day of October 2005 by and between Johnston County , hereinafter called the “ County ” and the Town of Clayton hereafter called the “ Town ” WITNESSETH WHEREAS , the County has entered into an agreement to purchase wastewater treatment capacity in the City of Raleigh Neuse River Wastewater Treatment Plant City’s WWTP , andPage0303 October 3 , 2005 Continued WHEREAS , the Town has agreed to annex and provide water and sewer utility services for a 916 + - acre planned unit development on Pritchard Road currently with County PUD zoning , NC PIN 1761 - 51 - 6477 and 1761 - 54 - 9261 , referred to hereafter as the “ Pritchard Road PUD ” WHEREAS , transfer of a 500,000 gpd wastewater allocation from the County to the Town is in the best interest of both entities NOW , therefore , in consideration of the mutual covenants and promises set forth herein , the County and Town agree as follow 1 The County hereby conveys to the Town a wastewater capacity allocation of 500,000 gpd in the City’s WWTP for the expressed and exclusive purpose of service to the Pritchard Road PUD 2 The Town will pay the County a lump sum fee of 1,800,000 for the 500,000 gpd wastewater allocation Fifty percent 50 of the fee will be paid upon execution of this agreement and the remaining fifty percent 50 of the fee will be paid within six 6 months of the date of execution of the agreement 3 The Town will pay all applicable monthly charges for the 500,000 gpd County allocation to the City of Raleigh as detailed in the interlocal agreement between the City of Raleigh and the County , dated __________ , 2005 , which is attached hereto City - County agreement , hereafter 4 The Town will pay to the City of Raleigh all nutrient reduction fees applicable for the use of the 500,000 gpd wastewater allocation in accordance with the City - County agreement 5 The Town , as a bulk customer of the City of Raleigh , will comply with all provisions of the City - County agreement , especially including hold harmless provisions 6 The Town acknowledges that the City - County agreement has a term of 10 years and is automatically renewable for a term of 10 years , provided the City obtains an NPDES permit expansion of 600 mgd to 750 mgd ; however , the Town acknowledges that the wastewater allocation could be terminated at the end of the initial 10 - year term 7 The Town will plan , design , permit , and fund without cost to the County wastewater transmission facilities to transfer wastewater from the Hermitage PUD to the City’s Neuse WWTP , including a sampling and meter station on , or near the Johnston Wake County line 8 The Town and County agree that in the event the Town elects not to proceed with annexation and or provision of water and sewer service to the Pritchard Road planned unit development , then the 500,000 gpd wastewater allocation shall be offered back to the County The County may decline or accept the transfer of allocation from the Town If the County accepts the allocation , the County shall refund to the Town all capital funds paid by the Town to the County The County will also assume responsibility for applicable monthly and nutrient reduction he wastewater allocation by the City of Raleigh 9 The Town and County agree to cooperate in future wastewater allocation and transmission matters including joint or shared use of transmission facilities with fair and equitable cost recovery programs 10 The County agrees to provide bulk water supply to the proposed development under the same terms and conditions as for other bulk service from the County to the Town 11 The Town agrees to install at its cost a bulk water meter near the point of connection to the County’s existing 12 ” main on Pritchard Road 12 This Agreement shall insure to the benefit of and be binding upon the parties hereto and their respective heirs , executors , administrators , legal representatives and successors Neither party may assign this Agreement , or any of its rights or obligations hereunder , without the prior written consent of the other party and any such attempted assignment shall be void , except that either party may assign this Agreement and or any of its rights and or obligations hereunder , without the other party’s consent , upon written notice to the other party , to any company that acquires all , or substantially all , of the assets of the party seeking to make the assignment 13 When written notice is required by this Agreement , it shall be considered as served unenforceable , the remaining provisions of this Agreement shall be unimpaired , and the invalid , illegal or unenforceable provision shall be replaced by a mutually acceptable provision , which being valid , legal , and enforceable comes closest to the intention of the parties underlying the invalid , illegal , or unenforceable provision 16 This Agreement constitutes the entire Agreement between the parties and supersedes all previous agreements included promises and representation , whether written or oral , between the parties with respect to the subjection matter hereof 17 This agreement is subject to written formal notice of wastewater allocation from the City of Raleigh 17 Pilot Program for Abandoned Dilapidated Mobile Home Removal County Manager Rick Hester stated that staff members and a committee of board members had met with members of the mobile home industry during the past several weeks to discuss a possible pilot program for the removal of dilapidated and abandoned mobile homes The pilot program would involve using a portion of funds from mobile home permit fees to support the program He pointed out the program would only be for hardship cases , such as bankruptcy , elderly , fixed income , in unincorporated areas Planning and zoning staff would determine eligibility , and coordinate referrals and dismantling of units prior to taking to the landfill Mr Hester requested the Board adopt a six month pilot program for the removal of dilapidated and abandoned mobile homes , and further requested the Board approve that no more than 15,000 from mobile home permit fees be allocated for the related labor and landfill tipping fees to remove the mobile homes If rd approved , he recommended an effective date of October 3 , and evaluation of the program after six months Jim Starling , Starling Homes , spoke briefly in support of the pilot program He stated that prior to 1966 there were no codes applicable to mobile homes , and unfortunately a number of these older mobile homes had been abandoned Mr Starling emphasized the unsightly nature of the structures , and the impact on the aesthetics of the county He requested that in addition to the 15,000 allocation requested by the County Manager , the Board consider waiving the tipping fees at the landfill for the program Melissa Johnson , NC Manufactured Housing Institute – Governmental Affairs Division , stated other counties experienced positive results by the waiving the landfill tipping fees for the disposal of abandoned and dilapidated mobile homes She informed the Board that the institute contributes 5,000 to each county for such programs At the request of the Board , Ms Johnson agreed to provide more information on the matter at the th November 7 Board meeting Commissioner Wade M Stewart expressed concern that the proposed program would result in a request from other Johnston County citizens for assistance with the removal of abandoned and dilapidated structures , vehicles , etc In response to a question from Commissioner Stewart , Public Utilities Director Tim Broome stated tipping fees for a typical single wide mobile home are approximately 250 - 300 Following further discussion , Commissioner Tony Braswell moved the Board adopt a six month pilot program for the removal of dilapidated and abandoned mobile homes , and allocate 15,000 from , Director of Planning , Zoning and Inspections , informed the Board of the need to adopt revised flood maps if the County wishes to continue its participation in the FEMA Flood Insurance Program Mr Finn requested the Board adopt the revised FEMA flood maps , and recommended a public hearing to discuss possible revisions to the existing flood ordinance as outlined in the County Code of Ordinances – Section 14 - 481 He offered two suggestions for revising the current code Page2305 October 3 , 2005 Continued 1 Raise the existing standard for new home construction from 1 ’ to 2 ’ above the “ base flood elevation BFE ” in the 100 year flood plain 2 Limit earth filling in flood plains to a maximum of 20 of the gross area of the developed parcel or certification by an engineers flood study that greater filling will not raise the upstream BFE by more than 01 ft In response to a question from Commissioner W Ray Woodall , Mr Finn stated the revised flood maps had undergone the required public review process Chandra Coats , Environmental Protection Administrator , noted there was one protest to the revised maps in 2003 ; however , the matter had since been resolved Amendments to the flood maps can be made at anytime through FEMA , although , technical submittals are required The county did not receive any submittals that changed the maps Tim Broome , Public Utilities Director , stated that in the past 11 years the flood level in Swift Creek between Hwy 42 and the airport has rose four feet He emphasized that the base flood elevation would be continually rising especially on the northwest side of Interstate 95 Currently , commercial is 2 ’ above base flood elevation , and staff is suggesting that residential standards be the same Commissioner Wade M Stewart expressed concern that according to the current flood maps some citizens are located within the flood plain , however , according to the revised flood maps they are no longer in the flood plain He questioned how this could be possible Mr Broome responded that there is a tremendous amount of surveying and calculations involved in creating the flood maps but unfortunately some residents have fallen into these situations Dewayne West , Emergency Services Director , added that mapping has improved over the last few years , and is increasingly accurate In his opinion , there will be fewer complaints in the Pat Goddard reported on the collection of delinquent taxes for the month of September , 2005 She noted that in addition to garnishments , and bank attachments , 15 foreclosure complaints were filed , and 46 demand letters sent , resulting in a collection of 28,68289 Ms Goddard pointed out staff is now filing complaints against 2004 taxes As of September 30 , 2005 , the Tax Department has collected 1100 of the real and personal levy for 2005 , and 6083 of the motor vehicle levy Through the NC State Debt Setoff Program , 8 accounts have been paid for a total of 81706 She further noted that there is a foreclosure sale th scheduled for October 26 At the current time , there were 17 properties scheduled for sale , however , Ms th Goddard anticipated several property owners to pay the delinquent charges before October 26 In response to questions from the Board , Ms Goddard provided a brief overview of the details of the new motor vehicle tax collection legislation that will begin in 2007 21 Manager Reports and Comments A Upcoming Tax Revaluation County Manager Rick Hester reminded the Board that the County is required to perform the next revaluation by 2011 Staff has already begun taking the necessary steps to prepare for the next revaluation B Old Jail Study Mr Hester requested the Board’s approval to allow Moseley Architects of Charlotte to perform a study to determine whether it is feasible to remodel the old jail for dormitory style housing for “ weekend offenders ” Funds to pay for the study would come from revenue generated from inmates using the phone system in the jail Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board authorized Moseley Architects of Charlotte to perform a feasibility study on the old jail 22 Board Reports and Comments A Additional Planning Board Position Created Commissioner DeVan Barbour moved the Board add one additional ex - officio position to the Planning Board , with the requirement the position be filled by a member of the Johnston County School Board The School Board or its Chairman would be responsible for making a recommendation to the Board of Commissioners
