10 241 Meeting of the Johnston County Board of Commissioners August 1 , 2005 The Johnston County Board of Commissioners met in regular session Monday , August 1 , 2005 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney and Deva C Holt , Deputy Clerk The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board approved the minutes for the July 11 , 2005 - 10 00 am and 7 00 pm board meetings as presented 2 Proclamation – Employee Appreciation Week – August 1 - 5 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following proclamation in appreciation of county employees JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK August 1 - August 5 , 2005 WHEREAS , Johnston County Employees represent approximately 950 men and women , working in 31 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS , Johnston County employees provide a multitude of services for ALL the citizens of the County - the farmer , the retailer , the industrial businessman , the homeless , the jobless , the homeowner , the veteran , the disaster victim , the victim of violence , the sick , the poor , the educated , the uneducated , the youth , the elderly , the newcomer , and the old - timer ; and WHEREAS , Johnston County employees are both skilled and efficient in their jobs , making every effort to expend county tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS , Johnston County Government runs smoothly on a day to day basis primarily because of the dedicated employees in each of its departments and agencies NOW , THEREFORE , in appreciation for their dedication to the welfare of the citizens of our County , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS DOES HEREBY PROCLAIM the week of August 1 - 5 , 2005 as COUNTY EMPLOYEE APPRECIATION WEEK st Adopted this the 1 day of August , 2005 3 Presentation of Service Pins The Board presented years of service pins to those employees who have worked for Johnston County for 5 , 10 , 15 , 20 , 25 , and 30 years Chairman Pope presented a five year service pin to Eleanor Taylor , mother of former Sheriff’s Office employee Denise Taylor who recently passed away 4 Report from Representative James H Langdon , Jr Representative James H Langdon , Jr provided the Board a brief update on the status of the State th budget He noted the General Assembly hopes to adopt a budget by August 5 , however , legislators are still working out the details on a number of issues including the cigarette tax and the possible lottery Representative Langdon stated , unfortunately , it seems counties will not be receiving assistance with Medicaid He pointed out the significance of a bill , which he co - sponsored , that would require individuals to pay their county taxes when purchasing renewing vehicle license tags He expected the bill to pass by final reading in the House , and be sent to the Senate for their approval soon Further , Representative Langdon noted that he and other former countyPage242 August 1 , 2005 Continued commissioners , members of both the House and Senate , have formed a coalition to work hard for counties throughout North Carolina The Board thanked Representative Langdon for his attendance at the meeting , and most importantly , for his continued efforts to assist the citizens of Johnston County 5 Public Comments No one spoke at this time 6 DOT – Request Resolution Supporting Turn Lanes – NC 42 Old Drug Store Realignment Tim Little , NC DOT District Engineer for Johnston and Wayne Counties , informed the Board that the NC 42 Old Drug Store realignment project will begin within the next couple of weeks The realignment will eliminate the existing turn lane from NC 42 to Old Drug Store Road He requested the Board adopt a resolution in support of a new left turn lane on NC 42 at the proposed Old Drug Store realignment , and DOT’s efforts to secure funds for this endeavor In response to a question from Commissioner Allen L Mims , Jr , Mr Little stated currently there are no median plans for the area , and any future development would dictate the installment of a median Commissioner Wade M Stewart suggested DOT representatives and County planning staff work together with developers on future residential and commercial projects in the area Mr Little responded that currently County planning staff sends DOT all preliminary development information , and both groups try to work closely with developers Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board adopted the following resolution in support of a left turn lane on NC 42 at the proposed Old Drug Store realignment RESOLUTION IN SUPPORT OF A LEFT TURN LANE ON NC 42 AT THE PROPOSED OLD DRUG STORE REALIGNMENT WHEREAS , Johnston County is one of the fastest growing counties in North Carolina ; and WHEREAS , New roads and road improvements are a vital component in the safety and orderly development of the county ; and WHEREAS , The North Carolina Department of Transportation NCDOT is responsible for roads in the unincorporated areas of Johnston County ; and WHEREAS , The NCDOT will realign Old Drug Store road in the fall of 2005 ; and WHEREAS , NCDOT funds are needed estimated at 250,000 for a left turn lane on NC 42 at the proposed Old Drug Store Road realignment to facilitate the movement of traffic NOW , THEREFORE , BE IT RESOLVED by the Johnston County Board of Commissioners that the NCDOT be requested to provide financial support for the left turn lane aforementioned st Adopted this the 1 day of August , 2005 7 Johnston County Airport Authority – Request County Match for Grant Projects On behalf of the Johnston County Airport Authority , Airport Director Ray Blackmon , requested the Board appropriate County funds , in the amount of 72,222 , to match two FAA grant projects The County’s share would include a 10 match for a Tree Clearing project , 16,667 , and the second installment of a 10 match for the Extended Runway Safety Area project , 55,555 In response to a question from Commissioner Allen L Mims , Jr , Mr Blackmon stated revenues from airport property sales were not available , at this time , as they had been in the past County Manager Rick Hester pointed out for FAA grant approval the County must agree to provide matching funds Once the County commits to providing matching funds , it may be two - 269 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board authorized Public Utilities staff to sell by upset bid , according to NCGSPagePage pageNumber6246 August 1 , 2005 Continued 160A - 269 , the old Autocon equipment , which operated the water pump station and controlled the elevated storage tanks for the previous SCADA system 11 Public Utilities – Solid Waste Recycle Program Policy Enforcement Tim Broome , Public Utilities Director , provided a brief report on issues facing staff in regards to policy enforcement of the County’s Solid Waste Recycle Program He stated , over the past few years , growth and customer expectations have challenged the program , and policy violations have increased Under the current ordinance , there are penalties in place to combat policy violations However , Mr Broome noted Public Utilities staff has opted to be lenient and issue more warnings In his opinion , the penalties are restrictive and severe , and citizens would be better served if the Board and staff conduct a thorough review of the policy before staff begins enforcing the current penalties He also pointed out some sites receive higher demands for services than others , and this presents another challenge to staff Mr Broome requested the Board consider a special work session to allow discussion of these challenges in greater detail Following discussion , the Board agreed to schedule a special work session in the fall to further discuss policy enforcement of the County’s Solid Waste Recycle Program Commissioner Wade M Stewart requested a couple site attendants be present at the work session to give accounts of the challenges they face Commissioner Stewart also suggested staff provide alternatives based on what other counties are doing 12 Tax Releases and Refunds – 6 16 05 – 7 15 05 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board approved the following tax releases and refunds for the period 6 16 05 to 7 15 05 Release Refund Report 06 16 2005 thru 07 15 2005 Year Bill # Acct # Name Tran Type Paid 2004 0505 - 373 I request the Johnston County Board of County Commissioners accept the settlement and pursuant to NCGS 105 - 321 charge me as Tax Collector with the responsibility for collection of the 2005 taxes by all legal means necessary The final audit will be conducted by an outside auditing firm and included in the county - wide audit for 2004 - 2005 I thank each of you for your continued support of me and the tax office staff Motion to Accept Tax Settlement and Charge Tax Administrator to Collect 2005 Taxes Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board accepted the Annual Tax Settlement for 2004 taxes and issued the following charge to the Tax Administrator for collection of 2005 taxes To the Tax Collector of the County of Johnston You are hereby authorized , empowered , and commanded to collect the taxes set forth in the tax records filed in the office of the Tax Administrator and in the tax receipts herewith delivered to you , in the amounts and from the taxpayers likewise therein set forth Such taxes are hereby declared to be a first lien upon all real property of the respective taxpayers in Johnston County , and this order shall be a full and sufficient authority to direct , require , and enable you to levy on and sell any real or personal property of such taxpayers , for and on account thereof , in accordance with law 14 Board Reports and Comments A Resolution Opposing Additional Taxes on Tobacco Products Commissioner Wade M Stewart introduced a resolution opposing any action by the North Carolina General Assembly to raise additional taxes on tobacco - related products He stressed the financial impact additional taxes would have on convenient , grocery , and outlet stores , and questioned whether outlet stores such as JR’s would choose to relocate to states with lower taxes Commissioner Cookie Pope expressed support for the resolution , and noted additional taxes on tobacco - related products would also have an effect on the rural community Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the following resolution opposing any action by the NC General Assembly to raise taxes on tobacco - related products RESOLUTION OPPOSING ADDITIONAL TAXES ON TOBACCO PRODUCTS WHEREAS , the tobacco industry is a critical component to our state and local economy ; and WHEREAS , the County of Johnston is committed to supporting our local business community ; and WHEREAS , the cigarette and tobacco industry is especially important to Johnston County for the local business owners , the associated jobs , and sales tax proceeds ; and WHEREAS , additional taxes on the cigarette and tobacco industry will likely drive local businesses to other states with lower tobacco - related taxes ; NOW , THEREFORE , BE IT RESOLVED on Monday , August 1 , 2005 , that the Johnston County Board of Commissioners oppose any action by the North Carolina General Assembly to raise taxes on tobacco - related products Page1251 August 1 , 2005 Continued B Finance Committee Recommendation – Offer to Purchase County Property Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved a recommendation by the Finance Committee to retain the property located at 222 East Market Street , and decline Mark Hall’s recent offer to purchase the property C Change in Regular Meeting Schedule Following discussion , Commissioner Jeffrey P Carver moved the Board hold both regular board meetings on the first Monday of each month starting in January of 2006 , with meeting times at 1 00 pm for general business , and 6 00 pm for rezoning and special use hearings Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote 15 Manager Reports and Comments A Update on Extended Local Telephone Service Request County Manager Rick Hester reported that he had met with Sprint representatives , and suggested the Board , at this time , defer any action on extended local telephone service for Johnston County residents in the Bentonville , Corinth Holder , and Angier areas of the county It is his understanding future phone services for the areas will address any issues citizens have with local calling The Board agreed B Workforce Development Center Dedication Mr Hester reminded the Board that the Workforce Development Center dedication would be held on th Thursday , August 25 at 4 00 pm 16 Closed Session – NCGS 143 -
