10 100 Meeting of the Johnston County Board of Commissioners April 11 , 2005 Regular Session The Johnston County Board of Commissioners met in regular session Monday , April 11 , 2005 , at 7 00 pm in the Commissioners ' Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , J Mark Payne , County Attorney , and Deva C Holt , Deputy Clerk The Chairman called the meeting to order and the following business was transacted 1 Public Comments - No one spoke at this time 2 Public Hearings - Rezoning Cases and Special Use Permit Requests Advertised - In The Smithfield Herald - April 1 , 2005 , April 5 , 2005 Certified letters were mailed to adjoining property owners March 31 , 2005 , and notices posted at the locations on March 30 , 2005 The Chairman opened the Public Hearing for rezoning cases CASE 03 - 43 Petition to rezone approximately 103 acres of a sixty - two acre parcel of land located on Bizzell Grove Church Road SR 2141 in Micro Township from Agricultural - Residential AR to Industrial 1 - Special Use District I1 - SUD Tax ID 10O07075D Petitioners Owners Albert J and Patricia McDaniels Eddy Davis , Planning and Zoning Manager , identified the property on the GIS map and stated this is a request to rezone approximately 103 acres of a sixty - two acre parcel located on Bizzell Grove Church Road from Agricultural - Residential to Industrial 1 - Special Use District He noted the property is located between Lowell Mill and Hinnant Edgerton Roads Clyde Larry Strickland , 1030 Bizzell Grove Church Road , stated that his property is directly adjacent to the applicant's property , and offered no objection to the rezoning and accompanying special use if the Board approved all special conditions discussed at the Planning Board meeting , and the applicant abides accordingly In response to a question from Commissioner Allen L Mims , Jr , Mr Strickland responded that all junk cars had been removed from the property , as discussed at the Planning Board meeting Mark McDaniels , 1000 Bizzell Grove Church Road , stated that he would be the person working the shop , and is requesting the Board to rezone the property to allow the reconditioning of vehicles for sale He did as the Planning Board requested at its January 18 , 2005 meeting , and stated he would carry out the Board of Commissioners ' instructions also Mr Davis noted the Planning Board recommended approval of the rezoning request There being no further comments , the Chairman recessed the Rezoning Hearing for Case 03 - 43 Decision on Rezoning Case 03 - 43 CASE 03 - 43 Petition to rezone approximately 103 acres of a sixty - two acre parcel of land located on Bizzell Grove Church Road SR 2141 in Micro Township from Agricultural - 43 CASE 03 - 43 Application for the repair of vehicles , and parking of salvaged vehicles and parts , outside storage Applicant Albert J McDaniels Those wishing to speak on Special Use Case 03 - 43 were sworn in by the Clerk to the Board Eddy Davis , Planning and Zoning Manager , explained that this is a companion special use permit request for this property to allow for the repair of vehicles , parking of salvaged vehicles and parts , and outside storage Mr Davis entered the following summary of evidence into the record A pre - application consultation was held with the applicant for Case 03 - 43 on July 22 , 2003 At that time , the applicant was informed of the following 1 If approved , applicant must provide to the Planning Office a Site Plan for their review and approval 2 Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board 3 Applicant will be notified in writing of the Boards decision 4 If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners 5 Applicants Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period 6 When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements 7 Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On January 18 , 2005 , the Johnston County Planning Board held a public hearing regarding Rezoning Special Use Permit Case 03 - 43 and made the following recommendations The Planning Board recommended approval with a vote of 6 - 0 for the Special Use Permit to allow the repair of vehicles , and parking of salvaged vehicles and parts , outside storage Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; 2 That the use or development appears to comply with all required use and intensity regulations of Articles II and IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - operable , in correlation with a towing service on approximately 142 acres on Church Road in Pleasant Grove Township Owner Richard A Jones Applicant Jay Zanini The Case was introduced , however , the applicant was not present at this time , and the case was postponed until later in the meeting The Chairman recessed the Special Use Public Hearing for Case 580 The Chairman reopened the Rezoning Hearing for Case 05 - 1 CASE 05 - 1 Petition to rezone approximately 234 acres located on Guy Road SR 1551 , in Clayton Township , from Agricultural - Residential AR to Community Business - Special Use District CB - SUD Tax ID 05G02034U , 05G02034V , 05G02034Z Owner Albert Newsome Petitioners Albert and Buddy Newsome Planning Director Steven Finn , identified the property on the GIS map and noted this is a request to rezone approximately 234 acres located on Guy Road , in the Clayton Township , from Agricultural - Residential to Community Business - Special Use District He noted the zoning in the area is primarily Agricultural - Residential In response to a question from Commissioner Wade M Stewart , the Applicant , Buddy Newsome , stated that the property was located in Johnston County , near the Wake County line Mr Finn noted that the Planning Board recommended approval of the rezoning request There being no further comments , the Chairman closed the Rezoning Hearing for Case 05 - 1 , based upon the following finding of facts and special conditions Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; 2 That the use or development appears to comply with all required use and intensity regulations of Articles II and IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; 4 That the use or development conforms with general plans for the physical development of the Countys Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners ; and 5 That the use provides residential development that will be accessible to businesses and thoroughfares that provide efficient travel throughout Johnston County Special Conditions 1 Final plats for the residential developments shall be submitted for review and approval by staff 2 All recreational and commercial developments shall submit a detailed site plan for review and approval by staff 3 Commercial sites located on a subdivision street shall have access via the subdivision street and not Cleveland Road SR 1010 4 Recreational Amenities shall be developed along with residential development Recreational amenities facilities as presented on the master plan can be divided into four major components each representing 25 of the recreational amenities development , therefore as 25 of the residential development is built out , then 25 of the recreational amenities development shall be built Permits for residential buildings will be held until the recreational amenities develops accordingly 5 Soccer field and basketball court shall be provided before any townhomes and residential development south of 1010 can be undertaken 6 Maximum of 5 driveway permits on 1010 7 Eliminate the go - kart suggestion as an option 8 Certifications 9 Note adjacent property owners 10 Entrance sign and street signs 11 Street name approval 12 Show lot sizes on final plat 13 Provide a parking area for the open space 14 Complete improvements or provide performance guarantee 15 Cul de sac lots must have 40 of road frontage 16 All residential lots and units must access internal street 17 Final plats must be signed by all current property owners 18 Provide stubout to the Stanton tract at proposed lot 54 so as not to create any offset with the street serving proposed lots 63 - 66 ; this is for future direct connection between the Taylor tract and Stanton tract 19 Master Plan approval by the Board of County Commissioners is required prior to final plat approval 20 A driveway permit and subdivision design approval must be obtained prior to construction All design aspects of the plans shall comply with the current NCDOT Standard Specifications for Roads and Structures , NCDOT Subdivision Roads Minimum Construction Standards , and Policy on Street and Driveway Access to North Carolina Highways 21 It will be determined at the time the driveway permit application is submitted , if any road improvements will be required 22 The owner developer shall install a three - lane section on NC 1010 throughout the project limits in accordance with the current NCDOT Standard Specifications for Roads and Structures and Policy on Street and Driveway Access to North Carolina Highways 23 Left and right turn lanes are required on SR 1010 into the main subdivision entrance 24 Approval of water & sewer system 25 Soil Erosion and Sedimentation Control Plan required Stormwater Compliance 26 Developer to provide a signed statement from Joe Carroll that he does not wish to be part of this PUD development 27 Provide a second full - service ingress egress , permanent or temporary , in the vicinity of proposed lots 293 & 294 , subject to DOT approval and DOT secondary subdivision road standards Mr Davis noted that in March 2003 , the Board allocated 200,000 gallons per day of sewer for the Village at Cleveland Springs Planned Unit Development In August 2003 , the Planning Board recommended approval of the original rezoning and special use permit for the project In October 2003 , the Board of Commissioners approved the recommended rezoning and special use permit Mr Davis stated that based on 360 gallons per day per residential unit , the inclusion of an additional 155 residential units would take up 162,000 gallons per day of the allotment In response to a question from Commissioner Jeffrey P Carver , Mr Davis stated that the only requirement of the original special use permit for the Planned Unit Developments - US 70 Access Management Study for Johnston and Wayne Counties Jim Trogdon , NC DOT Division 4 Highway Engineer , informed the Board that Kimley - Horn and Associates has completed an access management study for a portion of US 70 from NC 42 East in Johnston County to Beston Road in Wayne County The purpose of the stud y is to look at existing bridges , median openings , signal lights , etc and other issues related to improving traffic safety on US 70 Mike Rutkowski , Kimley - Horn and Associates Engineer , stated that 21,000 to 48,000 vehicles a day travel on particular portions of US 70 The crash rate in the Clayton area is 60 higher than the remaining areas in the study Mr Rutkowski noted that the access management study has concluded that the number one cause of majority of the accidents inPagePage pageNumber9108 April 11 , 2005 Continued the area is the speed differential of vehicles entering US 70 from private drives and vehicles already traveling the posted speed limit on US 70 The intent of the study now is to find ways to limit the number of access issues , resulting in a reduction of the number of accidents In response to a question from Commissioner Wade M Stewart , Mr Trogdon stated that NC DOT placed advertisements in local papers to inform citizens of the study , and will leave maps with the County Planning Department for citizens to view The Board thanked the representatives from NC DOT and Kimley -
