10 59 Meeting of the Johnston County Board of Commissioners March 7 , 2005 The Johnston County Board of Commissioners met in regular session Monday , March 7 , 2005 , at 10 00 am in the Commissioners ’ Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , and Della H Knight , Deputy Clerk The Chairman called the meeting to order and the following business was transacted 1 Appointment of Clerk to the Board Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Tony Braswell and carried by unanimous vote , the Board appointed April N Byrd as Clerk to the Board 2 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board approved the minutes of the February 7 , 14 , 18 , 2005 board meetings as presented 3 Recognition of Retiring Clerk Chairman Cookie Pope presented a plaque of appreciation to Joyce Ennis , who retired February 28 , 2005 as Clerk to the Board Ms Pope commended Ms Ennis for the degree of efficiency and fairness she always brought to the job Ms Ennis stated that it had been a pleasure and an honor to serve the Johnston County Board of Commissioners for the past eighteen years 4 Public Comments Bob Satterfield , 415 West Main Street , Clayton voiced his concern with the County’s current sign ordinance , and how it did not support the retention of small businesses in the County He requested the Commissioners review this policy Commissioner Jeffrey P Carver stated that it is the Board’s intent to take care of small businesses in the County He suggested the Planning Board look at the current sign ordinance , and bring possible recommendations back to the Board of Commissioners 5 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Luke Court , Mackinson’s Trail Court , Mackinson’s Trail Subdivision - Section Three , Boon Hill Township Commissioner W Ray Woodall moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner DeVan Barbour seconded the motion which carried by unanimous vote 6 Proclamation - Week of the Young Child - April 3 - 9 , 2005 Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board adopted the following proclamation in support of the Week of the Young Child , April 3 - 9 , 2005 Page60 March 7 , 2005 Continued Week of the Young Child Proclamation WHEREAS , the Partnership for Children of Johnston County and other local organizations , in conjunction with the National Association for the Education of Young Children , are celebrating the Week of the Young Child , April 3 through April 9 , 2005 ; and WHEREAS , by calling attention to the need for high - quality early childhood services for all children and families within Johnston County , these groups hope to improve the quality and availability of such services ; and WHEREAS , the future of our county depends on the quality of the early childhood experiences provided to young children today ; and WHEREAS , high - quality early childhood services represent a worthy commitment to our children’s future ; THEREFORE , the Johnston County Board of Commissioners does hereby proclaim April 3 through April 9 , 2005 as The Week of the Young Child in Johnston County and urges all citizens to recognize and support the needs of young children in our county th Adopted this the 7 day of March 2005 7 Resolution Supporting Legislation to Phase - out County Cost Participation for Medicaid Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board adopted the following resolution supporting legislation to phase - out county cost participation for Medicaid RESOLUTION REQUESTING THE NC GENERAL ASSEMBLY TO ENACT LEGISLATION TO PHASE OUT THE COUNTY SHARE OF THE NON - FEDERAL SHARE OF MEDICAID COSTS WHEREAS , local governments have been making payments for the non - federal share of the established Medical Assistance Program as stated in GS 108A - 54 ; and WHEREAS , the local government share of Medicaid reimbursements in the State has increased over 67 percent in the last five years and now totals approximately 440 million ; and WHEREAS , GS 108A - 54 requires local governments to levy , impose , and collect taxes for the required special purpose of medical assistance ; and WHEREAS , North Carolina and New York are the only states requiring their counties to fully participate in Medicaid funding ; and WHEREAS , in the past five years there has been a 76 percent increase in Medicaid costs in Johnston County , resulting in an estimated payment for the current year of 63 million , which represents 48 percent of the County’s expenditures , or 7 cents of every property tax dollar collected NOW , THEREFORE , BE IT RESOLVED by the Johnston County Board of Commissioners that the North Carolina General Assembly enact legislation to phase out the counties ’ share of the non - federal share of Medicaid costs over the next few years , and to set a cap on the total county share during the phase - out period not to exceed the amount paid by each county for the 2004 - 2005fiscal year FURTHER BE IT RESOLVED that copies of this resolution be transmitted to the members of the NC General Assembly representing Johnston County th Adopted this the 7 day of March , 2005 8 Board Approves Purchase Price for Two Elementary School Sites Dr Anthony Parker , School Superintendent , requested the Board approve the purchase price for two school sites 1 670,000 for 44 acres on Cleveland School Road , donation of 22 acres , purchase of 22 acres referred to as the Doug Parker property , and 2 780,000 for 3775 acres on Dixon Road , off Highway 50 in the McGees Crossroads area , donation of 1275 acres , purchase of 25 acres referred to as the Langdon property The Board of Education would like to construct elementary schools on both sites Dr Parker commented on the excellent working relationship between the Board of Commissioners and the Board of Education to identify these two properties He further noted the donation of land would allow land for recreational purposes Commissioner Allen L Mims , Jr questioned whether the close proximity of the Parker property to Interstate 40 was conducive to learning Dr Parker stated that he had been on site and did not foresee this to be an issue Commissioner Wade M Stewart also commented on the cooperation between the Board of Commissioners and the Board of Education to identify the two sites , and stressed the continued need for cooperation in the future He urged the Board of Education to site the schools in such a way as to retain as much space for recreational purposes as possible He further noted the importance to strive to meet recreational needs as the two boards continue to build schools across the county Dr Parker stated the Board of Education would willingly join with the Commissioners to strive to build schools and meet recreational needs at the same time He mentioned that the School Board plans to present the Commissioners with information from ORED that predicts where school sites need to go five to ten years from now Page61 March 7 , 2005 Continued Ann Stephenson , 840 Dixon Road , Benson , shared her concern about traffic and safety issues on Dixon Road , the location of the Langdon site She stated both intersections onto Dixon Road from Highway 50 and Old Fairground Road are very dangerous , and the pavement along Dixon Road is not adequate to handle school buses She questioned what improvements would be made to the road if the school site is located there Randy Tice , President of the Cleveland Athletic Association CAA , noted the increasing interests in recreational sports programs the association provides He applauded the Board’s effort to acquire additional space for recreation when school sites are considered , and requested the Board consider leasing or providing space to the Association on new school sites in the Cleveland Area Decision on Parker Property Commissioner DeVan Barbour moved the Board approve the purchase price of 670,000 for the Parker property , 44 acres on Cleveland School Road , and also approve the following budget amendment designating funds be taken from unappropriated fund balance Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote Decision on Langdon Property Commissioner W Ray Woodall moved the Board approve the purchase price of 780,000 for the Langdon property , 3775 acres on Dixon Road , and also approve the following budget amendment designating funds be taken from unappropriated fund balance Commissioner Wade M Stewart seconded the motion Discussion Commissioner Mims noted that he would like to see DOT make improvements to Dixon Road , and also questioned why the Board of Education did not get an appraisal on the Langdon site Ann Williams , Johnston County Schools - Facilities Services , responded that DOT will be required to make a full review of the Dixon Road site Dr Parker stated the School Board had appraisals performed on the Parker property , and the Ward Property on Highway 210 , the other possible site for the McGees Crossroads school For the Langdon property , the School Board used comparables Vote The motion carried by unanimous vote Budget Amendment for Parker & Langdon Site FUND BUDGET LINE ITEM REQUESTED CHANGE CODE CLASSIFICATION EXPENDITURE INCREASE DECREASE 10 58559019 Transfer to School Capital 1,450,000 FUND BUDGET LINE ITEM REQUESTED CHANGE CODE CLASSIFICATION REVENUE INCREASE DECREASE 10 460033990 General Fund Balance Appropriated 1,450,000 9 Board of Education - Request to Purchase School Buses for FY 2005 - 2006 Dr Anthony Parker , School Superintendent , requested the Board commit to allocating 1,834,343 in the 2005 - 06 local capital outlay budget for 23 regular school buses and 5 activity buses , and further asked that the allocation be over and above the current funding for capital outlay As a result of an analysis on the school’s transportation system and the effort to become more efficient , he pointed out that the request is notably less compared to last year In response to a question from Commissioner Tony Braswell , Dr Parker stated that there is a tremendous demand for activity buses for athletics and educational related trips for both in county use and out of county use Also , one of the requested activity buses is to replace the burned bus that was vandalized at Cleveland Middle School Page62 March 7 , 2005 Continued Commissioner Wade M Stewart recalled that in April 2004 he moved the Board approve the request for 1,171,420 for school buses for fiscal year 2004 - 05 with funds to come from the capital outlay allocation designated for the schools , and that the Board of Commissioners approved the action It was further noted that the Board stated that after review of the 03 - 04 audit , if the Board of Education had money at the end of June 2004 , then the Board of Education should be paying for school buses out of their capital outlay account Mr Stewart noted that the year end audit showed that the schools did have funds in their capital outlay account He further expressed concern that in the past the Board of Education has requested to transfer capital outlay funds to current expense Dr Parker stated that the Board of Education currently has 600,000 in their capital outlay fund balance account , and the request for buses is for 18 million He also maintained that the amount normally designated for current expense in the past has not been sufficient to cover expenses , and the transfers from capital outlay were needed Motion Commissioner Stewart moved the Board approve the Board of Education’s request to purchase 23 regular school buses and 5 activity buses , pursuant to the purchase being paid from the capital outlay fund for fiscal year 05 - 06 Discussion Dr Parker voiced strong concern that if the school buses were paid from the capital outlay fund for fiscal year 05 - 06 , this action would be detrimental to the schools ’ ability to operate Commissioner Stewart pointed out that any decision as to the amount for capital outlay for fiscal year 05 - 06 had not been determined yet , and would be discussed during budget sessions In response to a question from Commissioner Allen L Mims , Jr , Dr Parker stated that it appears the utilities expense would be over budget by approximately 14 million Commissioner Mims stated , in his opinion , the Board would prefer for utility bills to be paid from fund balance Vote Commissioner Jeffrey P Carver seconded the motion made by Commissioner Stewart , and the vote was as follows Ayes Commissioners Cookie Pope , Wade M Stewart , Allen L Mims , Jr , W Ray Woodall , Jeffrey P Carver No Commissioners DeVan Barbour , Tony Braswell 10 Public Hearing - 10 30 am Proposed Amendment to Code of Ordinances , Section 14 - 103 Advertised February 18 , 25 , 2005 The Smithfield Herald The Chairman opened the public hearing and stated the purpose of the public hearing is to consider public comment on proposed amendments to the Johnston County Code of Ordinances , Chapter 14 - Land Development , Section 14 - 103 Environmentally Sensitive Area ESA District , as it pertains to buffers and other restrictions within an ESA district County Manager Rick Hester recalled that in December 2004 the Board extended the boundaries of the ESA at the request of NC DOT and US Fish and Wildlife After further discussion and clarification , US Fish and Wildlife has asked the Board to approve a 100 foot buffer on the Lower Little Creek watershed in the ESA He stated that most of the property in the requested 100 foot buffer is already in the County’s 100 year flood plain , which limits development Mr Hester noted that Leilani Paugh and Jared Gray with NC DOT were present to answer questions Don Robbins , 1009 Wigeon Lane , Clayton , expressed concern that the sum of all regulations imposed by County , State , and Federal agencies might restrict valid forestry operations In his opinion , a single regulation may not restrict forest operations , but the regulations as a whole might His hope is that the buffers will protect the environment , and not further hamper valid forestry operations In response to a question from Commissioner Allen L Mims , Jr , Ms Paugh stated that if the Board chose not to approve the 100 foot buffer for Little Creek , a great deal of additional study and research would have to bePagePage pageNumber563 March 7 , 2005 Continued performed to determine the effect on the endangered dwarf wedge mussel , and the bypass could be delayed She further noted that the 100 foot buffer , on top of the 100 year flood plain regulations , would prevent clearing and vegetative management , and provide cover and no ground disturbance for the mussel Commissioner Wade M Stewart stated that it seemed the numerous changes in the design of the Clayton bypass and the initiatives to lessen the impact on the dwarf wedge mussel are causing the Commissioners to impose more restrictions on property owners He stated , in his opinion , the Board has done what DOT asked of them in their November 10 , 2004 letter by expanding the ESA to include the Lower Little Creek watershed , and noted the redundancy of the situation since the 100 year flood plain is already in place He questioned who would compensate property owners for the loss of financial benefits of their property , and whether imposing the 100 foot buffer could be considered a taking of one’s property Ms Paugh commented that US Fish and Wildlife has agreed that if the 100 foot buffer is placed on the Lower Little Creek watershed , and the associated Memorandum of Understanding is adopted , they would not come back to the County to ask for additional measures in the future Rudolph Howell stated that he has harvested timber in Johnston County for over 50 years , and urged the Board to remember that citizens deserve fair compensation for property taken from them County Attorney Mark Payne clarified that based upon State and Federal case law , to be considered a taking of one’s property the restriction must take the entire value of the land There being no further comments , the Chairman closed the public hearing Decision to Adopt Memorandum of Understanding Commissioner Mims noted that he agreed with the concerns addressed in the hearing but believes the Clayton bypass project is important to the economic development , and the lives and safety of the citizens of Johnston County and eastern North Carolina Commissioner Mims moved the adoption of the following Memorandum of Understanding between Johnston County , NC DOT , and US Fish and Wildlife Commissioner Jeffrey P Carver seconded the motion , and the vote was as follows Ayes Commissioners Allen L Mims , Jr , W Ray Woodall , Jeffrey P Carver , Tony Braswell No Commissioners Cookie Pope , Wade M Stewart , DeVan Barbour MEMORANDUM OF UNDERSTANDING BETWEEN THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION , THE UNITED STATES FISH AND WILDLIFE SERVICE , AND THE COUNTY OF JOHNSTON , NORTH CAROLINA THIS MEMORANDUM OF UNDERSTANDING hereinafter , MOU is made and entered into on the date herein below last written , by and between the STATE OF NORTH CAROLINA , acting through the DEPARTMENT OF TRANSPORTATION hereinafter , NCDOT ; the UNITED STATES OF AMERICA , ACTING THROUGH THE US FISH AND WILDLIFE SERVICE hereinafter , USFWS and JOHNSTON COUNTY , NORTH CAROLINA hereinafter , the County , and collectively referred to hereinafter as the Parties RECITALS WHEREAS , the USFWS is authorized to enter into agreements with NCDOT and the County in accordance with the Endangered Species Act 18 USC 1531 , et seq ; as amended hereinafter , ESA ; WHEREAS , NCDOT and the County are authorized to enter into agreements with USFWS ; WHEREAS , NCDOT proposes to construct Transportation Improvement Program Project R - 2552 , also known as the Clayton Bypass hereinafter , the Project , which may impact the Dwarf Wedge Mussel Alasmidonta heterodon hereinafter , the Mussel , which is listed as a Federally endangered species ; WHEREAS , NCDOT desires to minimize the impacts of the Project on the Mussel ; WHEREAS , it has been determined in consultation with USFWS that the following measures will help minimize the potential effects to the Mussel or its habitat resulting from the Project ; and WHEREAS , no party to this MOU shall be obligated to provide additional compensatory measures for the Project beyond what is set out herein NOW , THEREFORE , the Parties hereby agree as follows 1 NCDOT agrees to avoid and minimize potential impacts to the Mussel through proposed roadwayPagePage pageNumber664 March 7 , 2005 Continued design changes and other conservation measures as described in the Biological Assessment prepared for the Project Those measures include a Providing 75,00000 to USFWS for research regarding propagation of the Mussel These funds have already been provided to USFWS and were used to finance a three - year research project by Richard Neves at Virginia Polytechnical and State University ; b Adding hazardous spill basins to Sections AA and AB of the Project closest to Swift Creek ; c Extending controlled access at interchanges on Sections AB , B , and C of the Project ; d Removing curb and gutter from the proposed Ranch Road widening plans ; e Shifting the alignment of the I - 40 interchange and the Clayton Bypass to the north away from Swift Creek , and reducing the footprint of the interchange ; f Adding four bridges and special drainage design features to the Project plans g Implementing multiple sediment and erosion control special design provisions , as well as inspections and water quality monitoring during construction 2 The County agrees to consider expanding the boundaries of the existing Environmentally Sensitive Area hereinafter , ESA overlay district , as defined in its Land Development Code , to include the Little Creek watershed This requires a 100 foot buffer on the mainstem of Little Creek from its confluence with Swift Creek to the proposed bypass This also limits impervious surface to 12 in residential and 50 in commercial development within the expanded ESA ; the limit can be increased to 30 40 in some areas in residential and 80 in commercial by the developer making payment to the Land Dedication Fund at a ratio of 25 1 or by dedicating land at a ratio of 15 1 3 The County affirms that its Land Development Code provides for designation of flood hazard areas in which no development is allowed 4 The County agrees to consider modifying its Stormwater Management Ordinance so that it limits total nitrogen from new development within the ESA below the levels currently allowed in the ordinance Nitrogen loading contributed by new development shall be limited to 36 lbs acre year A developer of property within the ESA will have the option of offsetting the nitrogen loading from commercial development by utilizing additional Best Management Practices or by paying into the Ecosystem Enhancement Program hereinafter , EEP of the North Carolina Department of Environment and Natural Resources formerly known as the Wetlands Restoration Program When using the offset payment , the total nitrogen loading from a development shall not exceed 8 lbs acre year for commercial development Residential development may not utilize the EEP offset option , but must limit nitrogen loading to 36 lbs acre year 5 The USFWS agrees to consider the NCDOT minimization measures listed in paragraph 1 , and the County ordinances listed in paragraphs 2 through 4 , as conservation measures when evaluating the potential effect of the Project on the Mussel The USFWS requires the ordinance amendments proposed in paragraphs 2 and 4 to be adopted before construction begins on the Project 6 The USFWS agrees that the ordinances listed in paragraphs 2 through 4 are the only ordinances or other governmental actions required of the County when evaluating potential effects of future County projects Any changes or modifications by the USFWS that are more restrictive in nature to any aspect of this paragraph or to paragraphs 2 through 4 will automatically result in the termination of this Memorandum of Understanding Amendment or modification of this Memorandum of Understanding may be proposed at any time but will not be adopted unless agreed to by all Parties in writing IN WITNESS WHEREOF , the Parties hereto have caused this Memorandum of Understanding to be executed as of the date below last written STATE OF NORTH CAROLINA , acting through the DEPARTMENT OF TRANSPORTATION By _____________________________ Date ________________ Its _____________________________ , Duly Authorized UNITED STATES OF AMERICA , acting through the US Fish and Wildlife Service By _____________________________ Date _______________ Its _____________________________ , Duly Authorized THE COUNTY OF JOHNSTON , NORTH CAROLINA By ______________________________ Date ________________ Its ______________________________ , Duly AuthorizedPagePage pageNumber765 March 7 , 2005 Continued Decision to Amend Code of Ordinances , Chapter 14 - 203437 2000048374 FLEMING , THOMAS S 27405 23 Re - Appointment of County Tax Administrator Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board reappointed Pat Goddard as County Tax Administrator for a four year term 24 Tax Collection Report Tax Administrator , Pat Goddard reported on the collection of delinquent taxes for the month of February 2005 She noted that in addition to garnishments , bank attachments and levies , 15 foreclosure complaints were filed , resulting in a collection of 49,40098 As of February 28 , 2005 , the Tax Department has collected 9534 of the real and personal levy for 2004 , and 7854 of the motor vehicle levy Through the NC State Debt Setoff Program , 20 accounts were paid for a total of 23,96062 Eleven parcels were sold at foreclosure on February 22 , 2005 , 6 redeemed by taxpayers She further noted that the lien advertisement will run in The Smithfield Herald on March th 18 , and in other local papers the following week 25 Board Reports and Comments A Results of Stakeholder’s Meeting -
