10 36 Meeting of the Johnston County Board of Commissioners February 7 , 2005 The Johnston County Board of Commissioners met in regular session Monday , February 7 , 2005 , at 10 00 am in the Commissioners ’ Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , and April N Byrd , Assistant to the Clerk The Chairman called the meeting to order and noted that April Byrd , Assistant to the Clerk , would be the acting clerk for the meeting The following business was transacted 1 Comments from NC House Representative James H Langdon , Jr Chairman Pope recognized NC House Representative James H Langdon , Jr Representative Langdon expressed appreciation to the Board , and offered his assistance to the County and its citizens He reminded the Board that the House will be setting their calendar soon , and encouraged them to notify him of any local bills they may wish to have introduced 2 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board approved the minutes of the January 3 , 10 , 26 , 2005 board meetings as presented 3 Public Comments A Request for Funds - Public Library of Johnston County and Smithfield Margaret Marshall , director of the Public Library of Johnston County and Smithfield , informed the Board she is applying for a Library Services & Technology Act LSTA grant through the State in the amount of 100,000 for a new automated system for the County’s library The automated system would allow access to catalog information for each of the libraries in the County and the Heritage Center via the internet Library users would be able to go online to renew books at any time The grant requires matching funds from local entities , and the Town of Smithfield has already pledged 10,000 Ms Marshall requested the County pledge 15,000 County Manager Rick Hester clarified the match would be from the 05 - 06 budget , contingent upon the library receiving the grant In response to a question from Commissioner Allen L Mims , Jr , Ms Marshall stated that the new system would benefit all the libraries in the county The existing catalog information is currently stored on tapes , and can be easily transferred to the new system without the need of additional personnel Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board approved a commitment of 15,000 from the 05 - 06 budget as a match for a 100,000 LSTA grant for a new automated system for the library , contingent upon award of the grant 4 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Wilshire Way , Stafford Court , Chanticleer Circle , Plantation Point Subdivision - Phase 2A & Phase 2B , Wilders Township Commissioner W Ray Woodall moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Jeffrey P Carver seconded the motion which carried by unanimous vote Page37 February 7 , 2005 Continued 5 Surplus Property - Administrative Policy Change Melody Gates , Program Director for Housing Assistance Payments Program HAPP requested the Board approve an amendment to the Program Administrative Plan to raise the minimum rent requirement for total tenant payment rent & utilities from 25 to the allowed maximum of 50 The families who are eligible for the minimum payments , none of which are elderly or disabled , would continue to pay zero rent ; however , they would pay the additional 25 for their utilities With the recent funding changes from HUD , the HAPP office needs to find ways to reduce expenses This measure could save HAPP approximately 14,000 per year , and should not be a major hardship on any of the clients HAPP would give a 60 day notice before the new requirement became effective Page38 February 7 , 2005 Continued Commissioner W Ray Woodall moved the Board amend the Housing Assistance Payments Program Administrative Plan by raising the minimum rent requirement for total tenant payment , rent plus utilities , from 25 to 50 Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote 7 Public Hearing - 10 15 am 85 Million School Bond Order and Call for Referendum Advertised January 7 , 2005 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the questions of the validity of the bond order and the advisability of issuing the proposed 85 million School Bonds Chairman of the Johnston County Board of Education , Fred Bartholomew , thanked the Commissioners for their collaborative effort with his Board on the proposed school bond issue for school construction He noted that Johnston County is fortunate that its continued growth and economy will allow this to be done without an increase in taxes He provided statistics showing the tremendous growth in student population since 1995 , and stressed the need to continue with an aggressive school construction program to accommodate the anticipated future growth Dr Anthony Parker , superintendent of schools , pointed out that Johnston County is growing approximately 1400 students per year This growth , much of which is centralized in the western portion of the County , has created a need to realign some of the districts , and take other creative measures in order to alleviate overcrowding in specific schools As an example , he noted the fifth grade at Cleveland Elementary is being moved up to the middle school one year early because there is no room for additional mobile units on the Elementary campus C P Thompson , 2373 Thompson Road , Four Oaks , stated he recognizes the need for additional schools , but opposed the bond issue because of the large debt service that entails He pointed out , in his opinion , the County can build schools without incurring additional large interest debt He suggested the amount earmarked for future debt service on these bonds could be used , along with funds from an impact fee on new construction and a land transfer fee , to build schools on a pay - as - you - go basis He reiterated his request from several months ago that the Board form a committee to study new sources of funding for schools Teeny Bizzell , 4650 Bizzell Grove Church Road , Princeton , stated he supports good schools , but pointed out the County citizens can not afford more taxes He questioned the wisdom of continuing to add to the County’s interest debt , and also questioned how funds , especially for school sites , are being spent by the Board of Education He asked the Commissioners to take a good look at how tax dollars are spent on schools Barbara Kuley , 7002 Scarlett Lane , Garner , voiced support for the bond issue She stressed the need for more classrooms in order to get children out of mobile units She noted Cleveland Elementary , where her children attend , has 21 mobile units She maintained that putting children in mobile classrooms is unfair to children and teachers as they are segregated from the rest of the school population The overcrowded conditions affect every aspect of school operation , including the cafeterias , as their limited seating capacity requires them to begin serving lunches as early as 10 15 am and as late as 1 40 pm Also voicing concerns about the overcrowded schools and speaking in favor of the Bond Issue were the following citizens Rhonda Coe , 1942 Boyette Road , Four Oaks , Dean Andrews , 3952 Stevens Sausage Road , Smithfield ; and Sonja McLamb , 164 Peach Orchard Drive , Benson , all spoke of the issues resulting from overcrowded facilities such as the additional mobile units , insufficient cafeteria space , and the traffic and safety concerns with the large number of children at these campuses Rhonda Jewell , 2003 Pinebark Lane , Clayton , added her concern with the problem of retaining good teachers in such crowded facilities Tim Britton , 444 Antioch Church Road , Zebulon , noted that some children are being shifted back and forth to different campuses because of the overcrowded situation , which does not allow them the opportunity to develop long term relationships with other children Both he and Joel Johnson , 340 Antioch Church Road , Zebulon stressed the need for new schools in the Corinth Holder area , especially a new high school Sylvia Stafford , 842 Godwin Lake Road , Benson noted that Meadow school has just been built , but is already at capacity The old building needs to be removed , a new wing built , and additional parking provided Also speaking in favor of the bond issue was Rob Feola , 635 Matthews Road , Clayton , NC , representing the Polenta Elementary Advisory Board There being no further comments , the Chairman closed the public hearing Page39 February 7 , 2005 Continued School Bond Issue Adopted and Resolution Approved Calling for Referendum Commissioners Wade Stewart and Allen Mims assured those who spoke that their concerns about overcrowded schools have been heard by both the Commissioners and the members of the Board of Education that are in the audience After consideration of the public hearing , Commissioner Wade M Stewart , moved the adoption of the Bond Order entitled BOND ORDER AUTHORIZING THE ISSUANCE OF 85,000,000 GENERAL OBLIGATION SCHOOL BONDS FOR THE PURPOSE OF FINANCING THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF SCHOOL FACILITIES Commissioner W Ray Woodall seconded the motion and the Bond Order was passed and adopted by the following vote Ayes Commissioners Cookie Pope , Wade M Stewart , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Nays None Not Voting None The following resolution was then introduced and its title was read RESOLUTION CALLING FOR REFERENDUM ON 85,000,000 GENERAL OBLIGATION SCHOOL BONDS , PROVIDING FOR NOTICE OF SUCH REFERENDUM AND PUBLICATION OF BOND ORDER AS ADOPTED WHEREAS , the Board of Commissioners of Johnston County the “ Board ” has today adopted a Bond Order entitled “ BOND ORDER AUTHORIZING THE ISSUANCE OF 85,000,000 GENERAL OBLIGATION SCHOOL BONDS FOR THE PURPOSE OF FINANCING THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF SCHOOL FACILITIES ” ; and WHEREAS , NCGS § 159 - 10 30 am 10 Million Community College Bond Order and Call for Referendum Advertised January 7 , 2005 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed 10 Million Community College Bond Order and subsequent call for referendum PagePage pageNumber540 February 7 , 2005 Continued Dr Don Reichard , president of Johnston Community College , thanked the Board for their support He stressed the importance of providing the increasing number of students in the County with the opportunity for further education beyond high school He noted that most jobs require post secondary education today , and in the next 25 years , the most popular degree will be the associate degree , which can be obtained through the Community College system He noted the 10 million would build an emergency services building , and an addition to the health building for biology and physics labs as well as room for massage therapy training Former County Commissioner , Dr John M Booker , 307 North Second Street , Smithfield , agreed that the needs are real for both the schools and the community college ; however , he voiced concern about how the debt will be repaid He suggested the County will be faced with decisions on more bonds within the next few years based on growth projections , and that at some point , the Board will have to look at the fairness of who is paying the cost He noted , in his opinion , the people east of I - 95 are overpaying when you consider that most of the facility needs are in the western portion of the County Dr Booker recommended the Board pursue help from the NC General Assembly in freezing and eventually phasing out the County’s cost of Medicaid , which would free up funding for schools He also suggested the Commissioners ask for a local bill before the deadline that could be used to obtain authorization for other revenue sources such as impact fees , and or the assumption of the ½ cent sales tax if and when it is released by the State There being no further comments , the Chairman closed the public hearing Community College Bond Issue Adopted and Resolution Approved Calling for Referendum After consideration of the public hearing , Commissioner W Ray Woodall moved the adoption of the Bond Order entitled BOND ORDER AUTHORIZING THE ISSUANCE OF 10,000,000 GENERAL OBLIGATION COMMUNITY COLLEGE BONDS FOR THE PURPOSE OF FINANCING THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF COMMUNITY COLLEGE FACILITIES Commissioner Allen L Mims , Jr seconded the motion and the Bond Order was passed and adopted by the following vote Ayes Commissioners Cookie Pope , Wade M Stewart , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , Devan Barbour and Tony Braswell Nays None Not Voting None The following resolution was then introduced and its title was read RESOLUTION CALLING FOR REFERENDUM ON 10,000,000 GENERAL OBLIGATION COMMUNITY COLLEGE BONDS , PROVIDING FOR NOTICE OF SUCH REFERENDUM AND PUBLICATION OF BOND ORDER AS ADOPTED WHEREAS , the Board of Commissioners of Johnston County the “ Board ” has today adopted a Bond Order entitled “ BOND ORDER AUTHORIZING THE ISSUANCE OF 10,000,000 GENERAL OBLIGATION COMMUNITY COLLEGE BONDS FOR THE PURPOSE OF FINANCING THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF COMMUNITY COLLEGE FACILITIES ” ; and WHEREAS , NCGS § 159 - up - Request County to Waive Landfill Fees Dean Naujoks , Upper Neuse Riverkeeper , Neuse River Foundation , Inc , requested the Board waive the tipping and tire fees for trash collected in Johnston County on Saturday , April 2 , 2005 , during the Neuse River Clean - up He also inquired about an access point to the Neuse near the County’s water treatment plant on Highway 70 He stated that the clean - up will cover 50 miles of river beginning at Falls Lake and ending in Smithfield Wake County has agreed to waive the tipping and tire fees for trash collected in Wake , and the City of Raleigh has volunteered their garbage trucks and staff Mr Naujoks noted he plans to contact the Town of Smithfield , to request their participation in the clean - up as well Board members stated they would want to be sure that only trash collected in Johnston County is brought into the County’s landfill Engineer Tim Broome pointed out that the State permit does not allow out - of - county solid waste at the landfill He agreed to speak with Mr Naujoks following the meeting about using the water treatment plant as an access point to the Neuse for the clean - up project Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board agreed to waive the tipping and tire fees for trash collected in Johnston County on Saturday , April 2 , 2005 as part of the Neuse River Clean - up Mr Naujoks thanked the Board and assured them that only trash collected in Johnston County would be dumped in Johnston County 10 Wilson’s Mills Fire Districts as Combined Insurance Districts Dewayne West , Emergency Management Director , requested the Board adopt the combined boundaries for the Wilson’s Mills five mile district and the Wilson’s Mills six mile district as a single insurance district , to meet requirements set forth by the Department of Insurance and the Office of the State Fire Marshall He stated that combining the boundaries would not change any of the actual outer points for the two districts , rather it would result in a new boundary description for the single insurance district only Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Tony Braswell and carried by unanimous vote , the Board approved the combined boundary description for the Wilson’s Mills five mile district and the Wilson’s Mills six mile district as a single district for insurance purposes only 11 EMS -
