10 673 Meeting of the Johnston County Board of Commissioners November 6 , 2006 1 00 pm The Johnston County Board of Commissioners met in regular session Monday , November 6 , 2006 at 1 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , and Deva C Holt , Deputy Clerk Chairman Pope called the meeting to order Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Wade M Stewart led those in attendance in the pledge of allegiance to the American flag 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the minutes for the October 2 , 2006 1 00 pm and 6 00 pm , and October 23 , 2006 12 00 noon board meetings as presented 2 Public Comments A Alzheimer’s Disease Awareness Blenda Braswell , 306 Maplewood Drive , Smithfield , informed the Board that November is National Alzheimer’s Disease Awareness Month Mrs Braswell , whose husband suffers from Alzheimer’s , requested the Commissioners look at the need for Alzheimer’s education , support groups , and respite programs in Johnston County She emphasized the County does not have a day program to provide relief for caregivers of Alzheimer’s sufferers Craig Olive , whose mother also suffers from Alzheimer’s , commended Mrs Braswell for her hard work and devotion to the issue , and supported her request Following discussion , Chairman Pope instructed the County Manager to form a committee to look at the need for a day program to provide relief for caregivers of Alzheimer’s sufferers She appointed Commissioners Wade Stewart and Tony Braswell to serve on the committee Upon a motion by Commissioner Tony Braswell , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board adopted the following resolution proclaiming November 2006 as Alzheimer’s Disease Awareness Month in Johnston County ALZHEIMER’S DISEASE AWARENESS MONTH November 2006 WHEREAS , Alzheimer’s Disease is a progressive , degenerative disorder of the brain causing memory loss and impaired thinking , judgement , behavior and ultimately death ; and WHEREAS , approximately four million Americans suffer from Alzheimer’s disease , with an estimated 150,000 of those being in North Carolina ; and WHEREAS , Alzheimer’s is a disease that primarily affects older adults , and with the growing senior population , the number of Alzheimer patients is expected to grow dramatically by the middle of the century ; and WHEREAS , Alzheimer’s disease affects whole families since it is usually a long term illness that requires long term care ; and WHEREAS , even though much progress has been made in the study of Alzheimer’s , medical research has not been able to determine what causes the disease , nor has it been able to develop effective treatment and prevention , and as a result , Alzheimer’s continues to take many of the best and most enjoyable years of life from millions of seniors NOW , THEREFORE , in conjunction with both President George W Bush at the federal level , and Governor Michael F Easley at the state level , the Johnston County Board of Commissioners does hereby proclaim November 2006 as ALZHEIMER’S DISEASE AWARENESS MONTH in Johnston County , recognizing the individuals , families , friends and caregivers dealing with the devastating effects of this terrible disorder Page674 November 6 , 2006 – 1 00 pm Continued B Fire Ant Problem Cooperative Extension Agent Shawn Banks shared with the Board preliminary survey results on the fire ant problem in the County He pointed out the following results • 31 of survey participants have over 20 mounds on their property • 87 of survey participants have been treating the mounds • 61 of survey participants think the treatment is working Mr Banks stated that Johnston County Cooperative Extension has invited an entomologist from NC State University to come and teach a couple programs on the topic ; the programs will be scheduled for the upcoming months The Board thanked Mr Banks for the presentation , and urged him and the Cooperative Extension Office to continue educating Johnston County’s citizens about the problem 3 Recognition of Leadership Academy Graduates The Johnston County Leadership Academy graduated its first class on October 18 , 2006 Eighteen County employees participated in the program , which included classes taught by members of the County staff on the workings and relationships of departments , and sessions on interpersonal relationships County Manager Rick Hester thanked Pat LaCarter , Lu Hickey , Pat Goddard , Tim Broome , and Dewayne West for assisting with the instruction He recognized the following 2006 Johnston County Leadership Academy Graduates Tammy Amaon Sheriff Support Leah Thorndyke Public Health Dan Wall Public Utilities 4 Department of Transportation – Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Windgate Drive SR 2666 Ext and Manchester Trail - Plantation Point Subdivision - Phase 3 - Wilders Township Tahoe Road , Silverado Court East , and Silverado Court West - Tyson’s Corner Subdivision - O’Neals Township Commissioner W Ray Woodall moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Jeffrey P Carver seconded the motion which carried by unanimous vote 5 Veterans ’ Day ProclamationPage675 November 6 , 2006 – 1 00 pm Continued Upon a motion by Commissioner Tony Braswell , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board adopted the following proclamation in observance of Veterans ’ Day P R O C L A M A T I O N V E T E R A N S D A Y - 2006 WHEREAS , for decades America has paused on the 11th of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before all the world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2006 , as “ Veterans ’ Day ” in Johnston County , and urge our citizens to commend its observance 6 Public Hearing - Extension of Wynn Four Oaks Fire District Boundaries Advertised October 20 , 27 , 2006 - The Smithfield Herald Letters mailed to affected property owners on October 5 , 2006 The Chairman opened the public hearing , and stated the purpose of the hearing is to provide the public an opportunity to address the Board on the proposed extension of boundaries of the Wynn Fire District to include specified properties along Devil’s Racetrack Road A map of the district showing the present and proposed boundaries of the district , and a statement certifying that the area to be annexed meets the standards and requirements established in General Statute 153A - 303 have been on file for inspection in the Clerk to the Board of Commissioners ’ Office Emergency Management Director Dewayne West presented the request on behalf of the Four Oaks Volunteer Fire Department , and noted approval of the extension would correct some boundary issues in the district Edith Wilkins , 411 South Third Street , Smithfield , stated that she owns property in the proposed extension area , and urged the Board to approve the request She noted her daughter was injured on a horse riding trail on the property , and the Wynn Fire and Rescue Departments responded quickly to the incident , and provided excellent care There being no further comments , the Chairman closed the public hearing Discussion Commissioner Tony Braswell expressed concern that some of the property in the proposed extension area is wetland along the Neuse , and may not be accessible He asked if the County had taken a different approach in the past when considering fire district boundaries and wetlands Mr West responded the Strickland’s Crossroads Fire District includes a 2000 ft buffer north and east of the road The land between the buffer and the Neuse River is not included in the fire district boundaries The land between the buffer and the road is included in the boundaries of the district He noted the Brogden Fire District Boundaries do not include a buffer , rather the boundary line runs all the way to the river In response to a question from Commissioner Allen L Mims , Jr , Mr West stated most of the dwellings are within the 2000 ft closest to the road He noted the Four Oaks Volunteer Fire Department is currently protecting the properties , even though the area is not technically in the district’s boundary description Commissioner Mims expressed concern that the Board is considering a decision that would tax raw land near the river He stated the Wynn Fire District should be consistent with other fire district boundaries Page676 November 6 , 2006 – 1 00 pm Continued Barry Stanley , Assistant Chief of the Four Oaks Volunteer Fire Department , agreed the proposed extension area does include some wetlands He pointed out that most likely all the fire districts in the County include at least a small portion of wetlands Mr Stanley emphasized his department is 100 volunteer , and additional income to the department is greatly needed If the Board approves the extension , the additional revenue from the fire district taxes on the extended area will be approximately 1,700 annually , which will purchase one set of “ turnout gear ” Motion & Vote Commissioner Tony Braswell moved the Board adopt the following resolution to extend the boundaries of the Wynn Fire District to include specified properties along Devil’s Racetrack Road Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote RESOLUTION PROVIDING FOR EXPANSION OF THE BOUNDARIES OF THE WYNN FIRE DISTRICT OF JOHNSTON COUNTY WHEREAS , the Wynn Fire District has been operating since its creation by the Johnston County Board of Commissioners ; and WHEREAS , the Board has determined , after receiving a request from the Four Oaks Volunteer Fire Department , which serves the district , that the District should be expanded to include certain parcels of land contiguous to the District ; and WHEREAS , pursuant to NC General Statutes § 153A - 303 , the Board has determined to extend the boundaries of the District to include the parcels ; WHEREAS the Board resolved to hold a public hearing with respect to such extensions on November 6 , 2006 , and directed that the appropriate representatives of the County take the necessary actions to properly notice such public hearing as provided by law ; and WHEREAS , pursuant to N C General Statutes Section 153A - 303 e a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report containing a map of the District and the areas to be annexed were available for public inspection in the office of the Clerk to the Board , and that such annexation fit the requirements of § 153A - 303 ; and WHEREAS , pursuant to N C General Statutes § 153A - 303 e , the notice of public hearing was published at least once in the newspaper that circulates in the proposed District , and the notice has been mailed at least four weeks before the date of the hearing to the owners as shown by the county tax records as of the preceding January 1 of all property located within the area to be annexed WHEREAS , a public hearing was held at 1 15 pm on November 6 , 2006 , in the Commissioner’s Room , Courthouse Annex , Smithfield , North Carolina at which time taxpayers and all other interested persons appeared and were heard concerning the question of expanding the boundaries of the Wynn Fire District of Johnston County ; and WHEREAS , at such meeting the Board determined that it was appropriate to extend the boundaries of the District to include additional parcels of land ; and WHEREAS , the Board , following the public hearing finds that 1 The areas to be annexed are contiguous to the District , with at least one - eighth of the area’s aggregate external boundary coincident with the existing boundary of the District ; 2 The residents of all the territories to be annexed into the District will benefit from the District’s annexation ; and 3 It is economically feasible to provide the proposed service or services in the expanded district without unreasonable or burdensome annual tax levies ; WHEREAS , the Board now desires to expand the territories described herein into the Wynn Fire District of Johnston County ; NOW , THEREFORE , BE IT the NC DOT Community Transportation Program grant for FY 07 - 08 The total grant from NC DOT is for 610,182 , and is the major administrative and capital grant with which JCATS operates Ms Creech outlined the following plans for use of the State grant and County match • 245,461 Administrative and Employee Development Budget Request o 145,214 for JCATS Administrative Staff o 100,247 for 07 - 08 Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 8 2007 Bond Referendum Proposal County Manager Rick Hester stated there have been several discussions over the past few months regarding a Spring 2007 Bond Referendum He pointed out to hold the referendum in May , the Commissioners will need to begin taking action on the matter soon Mr Hester presented to the Board the following 2007 Bond Referendum Proposal 99 million Johnston County Schools JCS 10 million Johnston Community College JCC 37 million Recreation He noted JCS will be meeting later this month to formalize their project list JCC has already presented their list Health Building Addition - 2,694,151 , and New Campus Library - 7,305,849 If the Commissioners approve the recommended amounts , representatives from the County , JCS , and JCC will meet with the Local Government Commission in the next few weeks to further discuss the matter On behalf of the students and staff , Dr Don Reichard , president of the College , requested the Board approve the recommended 10 million bond referendum for JCC Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board approved the amounts for the 2007 Bond Referendum , as recommended by the County Manager 9 Budget Amendments Following discussion , Commissioner
