10 398 Meeting of the Johnston County Board of Commissioners February 6 , 2006 1 00 pm The Johnston County Board of Commissioners met in regular session Monday , February 6 , 2006 at 1 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney and Deva C Holt , Deputy Clerk The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board approved the minutes for the December 21 , 2005 , and January 3 , 2006 1 00 pm & 6 00 pm board meetings as presented 2 Public Comments A 2005 Economic Development Award for New Industry in the Triangle Area Linwood Parker , Chair of the Economic Development Board , announced that Director Michael de Sherbinin recently received the 2005 Economic Development Award for New Industry in the Triangle Area for the Sysco Corporation project Mr de Sherbinin thanked the Board for their participation in the project B PI - LE Fire District – Technical Change to Fire District Description Dewayne West , Director of Emergency Management , informed the Board of a technical correction to the PI - LE Fire District description He stated the description should be recorded as a six mile district rather than a five mile district The boundary description will not change ; neither will the properties within the current district The change is required for the department to comply with ISO requirements and to correct a mapping problem brought about by changes to the road infrastructure County Manager Rick Hester stated that he wanted the Board to be aware of the correction to the description , however the item would be handled administratively The Board thanked Mr West for the information C Inquiry into House Inspection for Kenly Resident Fred Grady of Kenly addressed the Board regarding a recent inspection of a rental property that he owns He questioned whether he should be required to pay for damages that a former tenant caused to the electrical wiring of the residence County Manager Rick Hester agreed to look into the matter and report back to Mr Grady 3 Appointment of Deputy Map & Plat Review Officer Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution of appointment for Rebecca L Wilson as Deputy Map and Plat Review Officer for the County Resolution of Appointment th WHEREAS , NC Senate Bill 875 , ratified the 8 day of July , 1997 , revised Article 2 of Chapter 47 of the NC General Statutes by adding Section 47 - 302 to require the Board of Commissioners of each county to designate by name one or more persons as a Review Officer to review each map and plat required to be submitted for review before recordation by the Register of Deeds ; and WHEREAS , the Johnston County Board of Commissioners has reviewed the requirements for this position and discussed the qualifications needed to perform this duty NOW , THEREFORE , the Johnston County Board of Commissioners does hereby appoint Rebecca L Wilson of the Customer Service Department as a Deputy Plat and Map Review Officer th Adopted this 6 day of February , 2006 Page399 February 6 , 2006 – 1 00 pm Continued 4 Approval of Tax Exempt Loan Status – West Johnston Fire Department Travis Parrish , Chief of West Johnston Volunteer Fire Department , requested the Board approve tax exempt loan status for West Johnston Volunteer Fire Department for a loan from First Citizens Bank & Trust , in the amount 280,000 , to purchase a new fire truck Commissioner W Ray Woodall moved the Board adopt the following resolution approving tax exempt loan status for the West Johnston Volunteer Fire Department for a loan from First Citizens Bank & Trust , in the amount 280,000 , to purchase a new fire truck Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote Resolution Approving Tax Exempt Loan Status for West Johnston Volunteer Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the West Johnston Vol Fire Department of Johnston County , North Carolina the “ VFD ” , from First Citizens Bank & Trust Company , in the principal amount of 280,00000 , which loan is for the following purpose The purchase by the VFD of a fire truck , which will be owned and operated by the VFD , and will be maintained at the following address 5503 Old Fairground Rd , Benson , NC 27504 5 Neuse River Foundation – Request for Board Support Jacqueline Murphy Miller , representative from the Neuse River Foundation , requested the Board waive th the landfill tipping fees for trash collected in Johnston County on Saturday , April 1 , 2006 , during the 4 Annual Neuse River Clean - up The clean - up will extend from Falls Dam in Raleigh to the Smithfield Town Commons Commissioner Allen L Mims , Jr encouraged Ms Miller to notify the County if the foundation identifies particular sources of pollution , and further make the Board aware if they can be of help in the future Upon a motion by Commissioner Tony Braswell , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board agreed to waive the landfill tipping fees for trash collected in Johnston County on Saturday , April 1 , 2006 as part of the Neuse River Clean - up 6 Audit Proposal for Yrs Ending June 30 , 2006 - 08 – Thompson , Price , Scott , Adams , & Co Finance Director John Massey presented to the Board an audit proposal submitted by the County’s current auditors , Thompson , Price , Scott , Adams , & Co for the years ending June 30 , 2006 , 2007 and 2008 The proposed fee for the County , Mental Health , JTPA , HAPP and the fire departments would be 69,000 per year , and 5,200 per year for the Airport Authority , with both fees remaining constant for the three year period Mr Massey recommended the Board accept the proposal as presented In response to questions from the Board , Mr Massey stated the County accepted bids for the audit proposal three years ago At that time , only one local firm submitted a bid , however , the firm would not be capable of performing the audits now Commissioner Jeffrey P Carver suggested the Board consider advertising for bids again in 2009 Following discussion , Commissioner Jeffrey P Carver moved the Board approve the audit proposal submitted by Thompson , Price , Scott , Adams , & Co for the years ending June 30 , 2006 , 2007 and 2008 Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 7 Health Department - Request for Full - time Medical Lab Technician – II position Dr Marilyn Pearson , Director of the County Health Department , informed the Board that the department currently has a Medical Lab Technician II position at 50 full - time employment with benefits The st position had been occupied by Brenda Pierce since 1988 , however , Ms Pierce retired January 31 Staff requests the position be moved to 100 full - time employment with benefits for the following reasons Page400 February 6 , 2006 – 1 00 pm Continued • Additional help in the lab is needed based on the increase of patients the department is seeing • It would be difficult to recruit a part - time Medical Lab Technician II position Dr Pearson noted that funds were available to pay for the additional time and associated costs for the current fiscal year The Board of Health supports the request In response to a question from County Manager Rick Hester , Dr Pearson stated the Health Department did have other vacant positions , however , the positions are critical to the services the department provides to the citizens of Johnston County , ie , nurses Following discussion , Commissioner W Ray Woodall moved the Board approve adjusting a Medical Lab Technician – II position , formerly at 50 full - Lan Development Company on Old Drug Store Road The project elements are located geographically such that major portions of the infrastructure most probably will serve future development in the area just west of the I - 40 NC42 interchange area Staff recommends that the County fund upsizing of certain components of the wastewater collection and transmission facilities , including three gravity sewer line segments , a wastewater pump station , and a force main Total cost to the County Sewer Enterprise fund is 342,060 ; amount of funds remaining in the FY05 - 06 budget for this purpose is 170,240 Son - Lan Development would be responsible for paying the full amount of the original project , given the County was not proposing the upsizing Mr Broome requested the Board approve an agreement between the County and Son - 002698 2000038194 ASHLEY TURNER BUILDING CO 16288 14 Delinquent Tax Collection Report Tax Administrator Pat Goddard reported on the collection of delinquent taxes for the month of January , 2006 She noted that in addition to garnishments , and bank attachments , 15 foreclosure complaints were filed , and 1 demand letter sent , resulting in a collection of 26,26103 As of December 31 , 2005 , the Tax Department has collected 9381 of the real and personal levy for 2005 , and 7668 of the motor vehicle levy Through the NC State Debt Setoff Program , 12 accounts have been paid for a total of 1,31370 Further , Ms Goddard noted the Tax Department had answered 10,527 calls during the month of January , which relates to a 191 increase from January 2005 Page2409 February 6 , 2006 – 1 00 pm Continued At Ms Goddard’s request , Commissioner W Ray Woodall moved the Board authorize the Tax Department to advertise the liens for delinquent 2005 tax bills Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 15 Manager Reports and Comments A Prospective Subdivision Near Town of Kenly ETJ County Manager Rick Hester noted that he and Commissioner Carver had recently met with representatives from the Town of Kenly regarding a prospective subdivision located in the County , close to the Town’s ETJ He stated the subdivision will come before the County Planning Board for review in the near future , and at a later date be turned over to the Town of Kenly B Date Set for Board Retreat th Following consensus of the Board , Mr Hester announced the Board retreat would be Friday , March 10 from 8 30 am to noon at the County Agricultural Center C Update from Recreation Consultant Mr Hester stated that the County’s recreation consultant is working well with the towns and athletic associations , and he anticipates a presentation on the matter in late spring 16 Board Reports and Comments A Future Water Supply Near Princeton Commissioner Ray Woodall announced that the County has options on property near Princeton for a future water supply The property is an old rock quarry The options are for two years to give time for staff to work with state agencies for permitting The County has been working on this project for some time B County Transportation Advisory Meeting Commissioner Tony Braswell encouraged the Board to attend the next County Transportation Advisory nd Meeting scheduled for February 22 at 3 30 pm C Upcoming NACO Conference Commissioner Ray Woodall reminded the Board the National Association of County Commissioners NACO Conference is scheduled for August 4 - 8 in Chicago 17 Closed Session – NCGS § 14331811 a 3 – Attorney Client Privilege – Torres v Johnston County Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board recessed regular session to sit in closed session in accordance with NCGS § 143 -
