10 377 Meeting of the Johnston County Board of Commissioners January 3 , 2006 1 00 pm The Johnston County Board of Commissioners met in regular session Tuesday , January 3 , 2006 at 1 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney and Deva C Holt , Deputy Clerk The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved the minutes of the December 5 , 12 , 2005 board meetings as presented 2 Public Comments Richard “ Dan ” Rockett , 115 Driver Road , Middlesex , expressed concern regarding denial of a recent rezoning and special use application request for his property He reiterated his comments from the December 5 , 2005 board meeting , and stated , in his opinion , there were discrepancies in the enforcement of the County’s Land Development Code Mr Rockett requested the Board look into the matter 3 “ State of Johnston County ” Address by Chairman Cookie Pope Chairman Cookie Pope presented the following “ State of the County ” address “ State of the County ” Address Chairman Cookie Pope January 3 , 2006 Good afternoon and Happy New Year , fellow Commissioners and citizens of Johnston County I sincerely hope that the new year brings you good health , prosperity and much happiness We live in the best county in North Carolina and I want to thank the citizens of Johnston County for the opportunity to serve as a County Commissioner I have served and continue to serve with great people who are committed to doing everything possible to make this county a great place to live , work and play This board does not always agree on everything that comes before us , but we respect each other greatly and once the vote is taken , we move forward in united formation For that , I am grateful to each of my fellow board members 2005 This past year has been one of the most rewarding years in the life of our county I’d like to highlight a few of those • We supported new job growth with incentive packages for new industries as well as existing industries Our incentive packages do not put taxpayer money at risk as front loaded funding , but provide grants once the projects meet certain criteria related to investment and jobs We have worked in concert with towns in our county in joint ventures and look forward to continuing those efforts We will continue to support our Economic Development Advisory Board and Michael deSherbinin to bring more opportunities to Johnston County citizens There is nothing more important to a family than a paycheck • We supported placing a bond referendum on the ballot for Johnston County Schools and Johnston Community College which passed by a 3 1 ratio We will continue to partner with Johnston County Schools and Johnston Community College in planning for future capital needs as well as annual operating expenses We are proud of our educational system Page378 January 3 , 2006 – 1 00 pm Continued • We continue to impress the bond rating agencies in New York with our sound fiscal program In the past year , we refinanced 56 million to provide interest savings to our citizens Secondly , we received a third bond rating upgrade with our most recent bond sale in July The bond rating agencies have advised us to continue to plan for future capital needs and facilitate job growth They have further advised that we are likely to enjoy future bond rating upgrades • We assisted with the opening of the new Workforce Development Center and the new Agricultural Center The Workforce Development Center now provides training for those who are currently in the bio - pharmaceutical industry and will also provide training for those who wish to seek that particular career in the future • The Board continued to support our rural water district program We now have water districts established in all but one area in Johnston County and look forward to establishing a rural water district there in the near future Having safe drinking water is critical to all of us • The Board agreed to partner with the Town of Clayton and the Town of Benson for a joint wastewater project that will result in the Town of Benson’s need for treatment and the Town of Clayton’s need for capacity We value our relationships with all of our ten towns 2006 • We will continue to support Johnston County Schools and Johnston Community College We are already planning years in advance for capital needs and will continue to do so • We are proud of our public safety program in Johnston County and will continue to support the same Our fine Sheriff Steve Bizzell’s record speaks for itself Johnstonians know that Sheriff Bizzell is working day and night to provide our citizens with the law enforcement program they deserve We also applaud Emergency Services , 911 Communications program , our fire departments and EMS services that are committed to serve all of us as taxpayers They all do a wonderful job for our county • We will continue to work in partnership with the NC Department of Commerce and our local towns to provide incentives for new job growth in our county We have all the tools in place to make this happen and will do so • We will continue to look at our land use planning programs and ordinances and review what may or may not need to be modified There is no question that Johnston County will continue to grow rapidly and we want to make sure we do everything possible to prepare for it During the past year , we adopted a new residential wastewater policy that serves as the backbone for our future growth management decisions • We will continue to plan for our future water and wastewater needs in Johnston County , for they are great In terms of drinking water needs , we are now planning for the years 2015 and beyond We plan to have announcements this year to solidify our water and wastewater needs for many , many years to come • We look forward to a presentation this year from our recreation study consultant who will share with us ways we can support our towns and rural recreation organizations The County is not going into the recreation business in terms of providing recreation programs Our focus is to support those existing groups with capital funding We look forward to that report later this year • Our board will hold its annual retreat in early 2006 to discuss additional goals and objectives for our county As with any board meeting , you are more than welcome to attend It is a privilege to serve as a county commissioner in Johnston County We have many challenges ahead of us , but are committed to meeting those “ head on ” We are not perfect , but I can assure you we take our jobs seriously and have one goal in mind To make the county great for you , your children , and their grandchildren This afternoon I would like to recognize two individuals who have contributed much to the success of their communities and the county as a whole Jackie Parrish , who resides in Four Oaks , needs no introduction As a cancer survivor , she has been instrumental in raising funds for Relay for Life , but more importantly , she has done much to educate and comfort other cancer survivors throughout Johnston and surrounding counties Her church and numerous civic groups depend on Jackie to make things happen Her sense of humor brings much laughter to those she touches by radio Jackie , Johnston County salutes you for making this a better place to work , live and play Page379 January 3 , 2006 – 1 00 pm Continued Wilson’s Mills is the home of Lloyd Barnes , Jr , a retired fireman , who continues to work for the betterment of mankind He is a part of local government at Wilson’s Mills and a Trustee at Union Hill Church Lloyd , Johnston County salutes you for your continued commitment and hard work Your leadership skills are a testimony to the young men and women of your community Your efforts to assist the elderly speaks loud and clear to all of us that true accomplishments are measured by what we have done for others In conclusion , I would like to thank the citizens of Johnston County for their contributions In my 11 years of service as a Commissioner , I have watched our county grow , diversify and lead the State in so many areas of accomplishment This is not by luck or chance It takes citizens who are committed to doing the right things , who possess strong leadership qualities and work hard to make good things happen Again , thanks to my fellow commissioners and the citizens recognitions 4 Resolution Requesting Participation in Economic Infrastructure Grants Program Economic Development Director Michael de Sherbinin thanked the Board for the opportunity to appear before them , and introduced Barry Partlo , Chairman of the Board and Chief Financial Officer for Agri - Supply Direct Distributors Currently , Agri - Supply Direct Distributors has wholesale and mail order businesses east of Micro Agri - Supply Direct Distributors is interested in expansion , however , sufficient fire protection is needed for the expansion Tim Broome , County Public Utilities Director , and Bill Piver , engineer for Agri - Supply Direct Distributors , have reviewed the proposed infrastructure for the Little River Water District , and discussed the fire flow and pressure requirements required for the expansion The expansion would create up to six new jobs Mr de Sherbinin stated the Rural Center offers an Economic Infrastructure Grants Program that would make available to the project 10,000 in grant funds for each newly created job The project would be owned by a public entity , either Johnston County or the Little River Water District He asked the Board to adopt a Resolution Requesting Participation in the Economic Infrastructure Grants Program The grant would assist in financing the cost of constructing a potable water line from the County’s existing 16 ” water transmission main , on the northwest side of Interstate 95 at Micro , to buildings requiring water service and fire protection owned by Agri - Supply Direct Distributors The grant could also pay for fire protection devices including ground storage tanks and fire pumps Following discussion , Commissioner Allen L Mims , Jr moved the Board approve the following Resolution Requesting Participation in the Economic Infrastructure Grants Program offered by the Rural Center Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote AUTHORIZING RESOLUTION BY GOVERNING BODY OF THE APPLICANT Economic Infrastructure Grants Program WHEREAS , The North Carolina General Assembly passed House Bill 1352 authorizing the making of grants to aid eligible units of government in financing the cost of construction of wastewater treatment works , wastewater collection systems , and water supply systems , that will result in job creation , and WHEREAS , Johnston County has need for and intends to construct a potable water line from the County’s existing 16 water transmission main on the northwest side of Interstate 95 at Micro to buildings requiring water service and fire protection owned by Agri - Supply Direct Distributors ; and WHEREAS , Johnston County intends to request grant assistance from the Economic Infrastructure Grants Program for the project ; NOW THEREFORE BE IT RESOLVED , BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS That Johnston County will arrange financing for all remaining costs of the project , if approved for a grant That Johnston County will provide for efficient operation and maintenance of the project on completion of construction thereof That Cookie Pope , Chairman and successors so titled , is hereby authorized to execute and file an application on behalf of Johnston County with the NCREDC Rural Center for a grant to assist in the construction of the project described above That Cookie Pope , Chairman , and successors so titled , is hereby authorized and directed to furnish such information as the Rural Center may request in connection with such application or the project ; to make the assurances as contained above ; and to execute such other documents as may be required in connection with the application Page380 January 3 , 2006 – 1 00 pm Continued That Johnston County has substantially complied or will substantially comply with all Federal , State , and local laws , rules , regulations , and ordinances applicable to the project and to the grants pertaining thereto Adopted this the 3rd day of January 2006 at Smithfield , North Carolina 5 Public Hearing – 1 15 pm – Proposed Amendment to County Landfill Facility Plan Advertised November 22 , 2005 The Smithfield Herald The Chairman opened the public hearing and stated the purpose of the hearing is to inform the community and receive public comment concerning a proposed amendment to the Johnston County Landfill Facility Plan The proposed amendment involves the permitting and installation of a construction and demolition C & D landfill cell Haywood M Phthisic , Assistant Public Utilities Director , informed the Board that he would be presenting the County’s Solid Waste Plan for development of the next Construction and Demolition phase C & D - Area 2 and an amended facility plan for the entire landfill facility , and also requesting expansion of the landfill service area He presented a power - point presentation , which included the following information • Aerial photo of the County’s Solid Waste Facilities located on County Home Road , north of Smithfield • Graph illustrating solid waste trends municipal solid waste MSW , construction and demolition C & D , and yard waste from 1998 to 2005 • Current solid waste disposal rates from July 1 , 2004 to June 30 , 2005 ; MSW disposal rate of 350 tons per day , and C & D disposal rate of 100 tons per day • MSW projections for 2015 , 2025 , and 2035 • Current solid waste facility plan • Proposed solid waste plan amendment outlining proposed expansion areas ; the proposed C & D – Area 2 is located to the east of the active sites , and the proposed MSW – Phase 5 - 10 cells are located to the west of the active sites • Cross section view of permitted and proposed facility plan ; the proposed MSW – Phases 6 - 10 cells would top - out at 375 ft above sea level ; the current MSW - Phase 5 cell tops - out at 250 ft • Total operating capacity and life expectancy of proposed facility plan ; the proposed lined cells would provide 15,135,600 cubic yards of air space , and life expectancy is up to 463 years ; the proposed C & D – Area 2 would provide 1,254,045 cubic yards of air space , and life expectancy is up to 142 years Further , Mr Phthisic stated the County’s current permit only allows the landfill to accept waste from inside the county He requested the Board approve the expansion of the landfill’s service area to include the State of NC , with the stipulation that the Board of Commissioners must approve acceptance of waste from outside the county In response to questions from Commissioner Wade M Stewart , Mr Phthisic noted that since 1997 , County policy has been to assess a fee four times the normal tipping fee charge for waste identified as coming from outside the county He pointed out that expansion of the service area to include all of NC would allow Johnston County to assist other landfills in times of crises , ie , hurricanes and other natural disasters County Manager Rick Hester clarified the Board would have to approve acceptance of waste from outside the county Commissioner Allen L Mims , Jr questioned whether accepting waste from outside Johnston County would affect the anticipated 70 year life of the County’s landfill Mr Phthisic responded the landfill’s capacity would not be affected , given the County does not accept huge amounts of waste in times of crises from outside the county Commissioner Mims expressed that he did not have a problem with expanding the service area as long as all requests come before the Board of Commissioners for approval Commissioner Jeffrey P Carver agreed County Attorney Mark Payne added that expanding the service area would not affect the State’s ability to force Johnston County to accept waste from other counties Dr Greg Richardson , County Landfill Consultant , stated the power to control the acceptance of solid waste resides with the local authority , and pointed out the service area could be revised again at a later date , if the Board chose to take this action He noted that Johnston County has the largest potential reserve capacity in the State PagePage pageNumber5381 January 3 , 2006 – 1 00 pm Continued In response to a question from Commissioner Cookie Pope regarding the difference between Johnston and Sampson counties , Mr Richardson responded that Sampson County is a privately operated landfill , however , the County is still responsible for the landfill In response to a question from Commissioner Stewart , Mr Phthisic stated the current landfill plan anticipates an approximate service life of between 29 and 46 years for MSW units , and 12 to 14 years for C & D units ; however , he pointed out this plan does not include the additional acreage purchased Dr Richardson added that , considering the additional acreage , Johnston County has the largest potential reserve capacity in the State Mr Phthisic reiterated his request , and asked the Board to adopt a proposed resolution granting approval for the issuance of a landfill permit by the Division of Waste Management for the C & D – Area 2 landfill unit including an amended facility plan for the entire landfill facility , and expansion of the service area to include the State of NC There being no further comments , the Chairman closed the public hearing Decision Postponed Until January 3 , 2006 6 00 pm Board Meeting Commissioner Allen L Mims , Jr requested the Board postpone decision on the item until the January rd 3 6 00 pm meeting to allow Commissioner Mims ample time to review the proposed resolution It was agreed that the decision be postponed as requested 6 Surplus Property – Public Utilities Haywood M Phthisic , Assistant Public Utilities Director , requested the Board declare surplus the Trimble Pathfinder surveying equipment In response to a question from Commissioner Wade M Stewart , Mr Phthisic noted the equipment , which uses Global Positioning Satellites GPS , was purchased in 1997 , and is now obsolete The cost to keep the unit operational is greater than the replacement cost due to technological improvements Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board declared surplus the Trimble Pathfinder surveying equipment used by the Public Utilities department 7 Board of Education – Request Approval of Budget Amendment Chairman Pope postponed discussion of the item until a later date The Board of Education was requesting approval of a budget amendment , in the amount of 204,18343 , to adjust remaining bond balances to begin restoration of the South Campus Community School Gym 8 Board of Education - Request for Additional State ADM Construction Funding On behalf of the Board of Education , Dr Anthony Parker , Superintendent for Johnston County Schools , asked the Board to approve a request for additional State ADM Construction Funding , in the amount of 208,863 , to allow early demolition of the three story building at Meadow Elementary School He stated the Board of Education would like to authorize demolition of the three story building prior to the next bond sale scheduled for early summer 2006 ; the project was originally scheduled to be funded by this bond sale Commissioner Wade M Stewart noted it was his understanding that the projected 25 million in funds from the summer 2006 bond sale is designated for the demolition of the three story building , and the construction of a new addition at the site He questioned if 23 million from the bond sale would cover the remainder of the project Dr Parker confirmed that 23 million would cover the remainder of the project He pointed out that there have been both under - runs and over - runs with several of the bond projects so far Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Tony Braswell and carried by unanimous vote , the Board approved the Board of Education’s request for additional State ADMPagePage pageNumber6382 January 3 , 2006 – 1 00 pm Continued Construction Funding , in the amount of 208,863 , to allow early demolition of the three story building at Meadow Elementary School 9 Presentation of Audit Report for Year Ending June 30 , 2005 Alan Thompson , with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2005 Mr Thompson stated the County received an unqualified report , and in the opinion of his auditing firm , the County remains in strong financial condition He pointed out a few of the report’s highlights • Although Johnston County is the fastest growing County in the State , the Tax Department has been able to keep the percentage of collection of current year taxes above the state average • The growth the County is experiencing requires the County to borrow significant amounts of funds in order to meet the needs of its citizens The borrowing for schools will have a two prong long - term effect 1 the debt will have to be paid back , and 2 the County’s current year expenditures for operations will likely continue to increase at a rapid pace • The ability to achieve profitability , considering the continuous growth of the water districts , is a reflection of good planning and management However , careful reconciliation of the department’s accounts should be made monthly since the software is not integrated with the County’s general ledger • The County should evaluate its self - insurance coverage annually to ensure this is the best option While self - insurance can be a cost savings , the spikes in expenditures when large claims are filed can be difficult to deal with from a budget standpoint In response to questions from Commissioner Jeffrey P Carver , Finance Director John Massey stated the Communications Fund borrowed 12 million from the General Fund to purchase 911 radios approximately three to four years ago , and since that time the Communications Fund has shown a deficit fund balance He noted the Communications department is paying back the loan Further , the audit showed a deficit balance for the Industrial Development Fund , however , this was due to the General Fund not yet making a payment to the fund , and since that time , the payment has been made Commissioner Carver applauded all those involved for the County’s sound fiscal management , and pointed out that Johnston County has almost 1 3 less debt than the amount the State allows counties in NC to acquire Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board accepted the County Audit Report for FY ending June 30 , 2005 10 Board of Elections – Voting Machines Update Teresa Davis , Board of Elections Director , provided the Board a brief update on the State Board of Elections initiative to update voting machines in all 100 counties On December 9 , 2005 , the State decertified Johnston County’s voting equipment , the Optech III - P Eagle optical scan paper ballot equipment , disallowing the equipment to be used for future elections , and issued a January 20 , 2006 deadline to purchase new equipment She pointed out the State has certified only one optical scan model supplied by a single vendor On th December 27 , the Johnston County Board of Elections held a public forum to discuss the issue , however , the Board has not made a decision whether to purchase new equipment at this time Ms Davis stated , in her opinion , there is nothing wrong with the equipment the County has been using , and emphasized the citizens like the paper ballot format She expressed concern that there would not be sufficient time to purchase new nd equipment , and train 250 precinct officials before the May 2 primary election Ms Davis stated that she had received a State grant in the amount of 408,000 to be used toward the new equipment The grant would cover the expense of new optical scan paper ballot equipment , and one direct record touch screen machine for each precinct ; however , if the Johnston County Board of Elections chooses to purchase all direct record equipment , it would take an additional 1 million to cover the upgrade She noted minimal funds might be needed to program the equipment as well Commissioner Wade M Stewart stated , in his opinion , any expense to upgrade the equipment should come from State funds , since the action came as a mandate from the State , and nothing appeared to be wrong with Johnston County’s equipment PagePage pageNumber7383 January 3 , 2006 – 1 00 pm Continued Following discussion , the Board asked staff to draft a letter to Governor Easley and Johnston County’s representatives to request delay in implementation of Senate Bill 223 , Public Confidence in
