Finance Officer , and Deva C Holt , Deputy Clerk Chairman Cookie Pope called the meeting to order at 10 00 am Commissioner Wade M Stewart led those in attendance in the pledge of allegiance to the American flag Commissioner W Ray Woodall opened the meeting with a prayer 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by of Transportation – Additions to System Buckhorn Drive – Buckhorn Glade Subdivision Phase III , Section II – O’Neals Township C Proclamation - Fall Litter Sweep - September 15 - 29 , 2007 as follows PROCLAMATION FALL LITTER SWEEP 2007 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , Johnston County , as well as all of North Carolina , enjoys the beautiful scenery and clean environment , which are a source of great pride , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the fall 2007 LITTER SWEEP cleanup will take place September 15 - 29 , 2007 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate by sponsoring and organizing local roadside cleanups ; and WHEREAS , the 2007 fall cleanup will celebrate the 19th Anniversary of the North Carolina Adopt - A - Highway program and its 6,000 volunteer groups that donate their labor and time year round to keep our roadsides clean ; and WHEREAS , the cleanup will increase awareness of the need for cleaner roadsides , emphasize the importance of not littering , and encourage recycling of solid wastes ; and WHEREAS , the cleanup will be a part of educating the children of this great State regarding the importance of a clean environment to the quality of life in Johnston County and North Carolina ; and NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF one spoke at this time 4 Presentation of Blue Ribbon Committee Report Blue Ribbon Committee Co - Chairs Sammy Jackson and Harold Keen appeared before the Board to present the Committee’s findings Mr Jackson stated in February 2007 , the Commissioners had appointed 39 members of the public in Johnston County to serve on the Blue Ribbon Committee to study issues concerning challenges the County faces in relation to finance , infrastructure , etc After the initial meeting , the Committee divided into three workgroups in order to continue with the deliberation process as follows Finance Allen Wellons Kay Carroll Chair Vice - Chair Land Use Don Johnson Dennis Blackmon Chair Vice - Chair Infrastructure Dan Simmons Steve Biggs Chair Vice - Chair Mr Jackson reported at the end of the deliberation process , the Committee came together and accepted all of the findings from each of the three workgroups He noted the most relevant recommendation from the Committee is the need for the County to begin the process of developing a comprehensive land use plan and that the implementation of individual land use items should be delayed until studied as part of a comprehensive land use plan Mr Jackson called on Mr Keen to review each of the findings from the Committee Mr Keen read through the recommendations from the Committee as follows PagePage pageNumber6383 September 4 , 2007 – 10 00 am Continued Finance Workgroup Recommendations • Continue to encourage growth in Johnston County From a financial point of view , the economic well - being and progress of this county depends on new growth We cannot afford to become like some of the mid - western states where growth has stopped and economic “ doom ” has set in Growth is certainly better than “ no growth ” We must build our infrastructure faster We must build our schools faster We must find a way to get more roads built faster We cannot afford to have inadequate facilities that cause potential residents to go somewhere else • Change the current practice of property revaluations from an eight - year cycle to a four - year cycle with a revenue - neutral pledge This plan would reduce sticker shock for the public It would also allow property taxes to stay current with property values It will also be fairer to areas in the county which are not appreciating as fast as higher growth areas • With the recent change in the law , it is recommended that the Board of County Commissioners allow the citizens of Johnston County to vote either for the land transfer fee or the increase in sales tax , with any new monies dedicated to school construction or debt service There is no recommendation of which alternative revenue source to pursue initially The predictions are that the addition of a land transfer fee in this county would add approximately 45 million a year to the budget The predictions are also that the addition of a 1 4 cent sales tax would add 34 million a year to the budget It should be understood that this potential revenue is not supplanting existing funds for school construction or debt service , but may be a means to avoid increasing ad - valorem tax and creating a truly revenue - neutral reevaluation • Create a county concurrency committee that would consider the financing of water and sewer , fire and rescue , schools , roads , solid waste , drainage , and parks A broad - based 20 - year growth plan is recommended A 5 - year intense growth plan is also recommended Concurrency agreements would be obtained from each municipality This would alleviate the fears of different areas of the county by creating transparency in the planning process This committee would initially review all subdivision and industrial requests for construction from all over the county It would measure the requests against a well - developed formula that would indicate whether or not this new construction would adversely affect any one of the areas mentioned above , and how that problem could be mitigated by either private or public actions or funds This is not an “ adequate facilities ” policy , but the creation of a group that truly looks to the future in a very informed way to attempt to be ready for growth We are all in this together Today , we identify ourselves as being from Clayton , Smithfield , Benson or Princeton But one day , in the not too - distant future , it will be difficult to know where one town begins and another ends We are Johnston County In order to make some of these dreams come true , we must have more sources of revenue , and therefore , a greater percentage of revenue that can be used for growth purposes We will have to incur more debt We must have more revenue to pay off the debt faster in our generation , so we can continue with our future plans without mortgaging the future of our children We must work to get an infusion of funds sooner than later in order to try to get ahead of the curve of our expected growth We are Johnston County - a great place to live and work We must , first and foremost , have countywide planning so that we know what resources are needed where Growth and Infrastructure Workgroup Recommendations • Every resident of Johnston County should have access to a safe and reliable source of drinking water The county is doing a good job of securing water resources Efforts to secure the necessary financial resources to keep up with the needs of both the incorporated and unincorporated areas of Johnston County should be a high priority PagePage pageNumber7384 September 4 , 2007 – 10 00 am Continued • The current use of on - site wastewater disposal systems for the unincorporated areas of Johnston County should continue and all residential development outside of the municipal limits should be restricted to this method of wastewater disposal The unincorporated areas of the county should develop at a rural density or in a low - density suburban pattern with public water , but without the necessity of public wastewater collection and treatment capacity The county should operate wastewater treatment facilities primarily to support industrial and rural commercial development and to support urban growth patterns in municipalities Urban growth should center around municipal hubs , with traditional urban services provided by municipalities • The most likely threat to quality of life and sustained quality growth comes from the degradation of quality school facilities Involvement by local citizens , community leaders , and other governmental agencies should be considered in making school site selection Community schools , as a concept , must be a higher priority The cost and growth implications of extending water and wastewater infrastructure should be factored in when a school site is chosen Schools should be constructed in close proximity to existing infrastructure and denser population centers One of the factors a developer considers when selecting a site for development , is the school district the property is located in The Board of Education must address imbalances in public school achievement in order to better distribute growth across the county • It is recommended that the Board of County Commissioners appoint a citizens committee to make recommendations concerning the expenditure of funds in the open space fund It is also recommended that the board seek more discretion from the NC General Assembly in how these funds can be spent • It is recommended that further research be done on how to handle the impact of growth on the local roadways It appears the municipalities are better equipped to handle the impact of growth to the local roadway system than the county The municipalities operate and maintain their own roadway system They can also share in the costs of improvements to existing NCDOT roadways within the municipality through state - municipal agreements Land Use Workgroup Recommendations • The Board of County Commissioners should use the Strategic Plan proposed in the year 2002 as a starting point for incorporating the Land Use Planning Guidance October 2006 recommendations for developing a comprehensive land use plan for the county • The Board of County Commissioners should approve the municipal request for extensions of ETJ’s to facilitate development towards the cities • Johnston County needs to consider the preliminary approval process for subdivisions Is there enough preliminary due diligence in the platting on paper of possible lots on a tract of land Conforming to design standards without consideration to soil conditions , infrastructure availability and environmental issues presents a picture of “ development gone wild ” when nothing more than a paper approval has taken place The process to acquire vested rights should also be reviewed in the light of what is significant investment , to justify granting unlimited vested rights to a preliminary approval The land use workgroup voted on the following aspects of the recent growth management report prepared by the growth management committee in the following manner • The growth management report recommended all land be developed at an average density of one dwelling per two acres of usable land ” No • In the same report , there was a recommendation of a standard subdivision density of one house per two acres No • The report recommended special use subdivisions related to higher density with findings of fact shortfalls Those shortfall considerations were for community capability ; traffic impact and road conditions ; school capacity and planned capacity ; recreation and other amenities , and publicPagePage pageNumber8385 September 4 , 2007 – 10 00 am Continued utilities No • The growth management report suggested caps on permits Maybe • The growth management report suggested impact fees , land transfer taxes and property tax increases Maybe • The growth management report suggested four - year revaluation schedule Yes • The growth management report suggested a “ Welcome Stranger ” program to put property on tax books at market value Yes • The growth management report suggested multi - track year - round schools No Mr Keen thanked the Board for the opportunity to be a part of the Blue Ribbon Committee and asked if there were any questions Regarding the land transfer fee and sales tax referendum , Commissioner Tony Braswell inquired if the Committee had specified where any new monies from these potential sources of revenue should be spent Mr Jackson stated the Committee recognized that the Commissioners direct how revenue coming into the County is spent In response to a question from Commissioner Braswell regarding the requests by the municipalities for ETJ extensions , Mr Keen reported the Committee did not get into the technical side of this issue as it relates to a one or two mile extension ; however , the Committee would like to see growth directed towards the towns where feasible Commissioners Allen L Mims , Jr and Wade M Stewart both questioned the bullet from the Finance work group related to revaluation and a “ four - year cycle with a revenue - neutral pledge ” and asked for more detail Mr Keen reported “ revenue - neutral ” should be considered when looking at the revaluation process To the Committee “ revenue - neutral ” simply means if the County is taking in 100 before revaluation , then after revaluation occurs , the Commissioners should make the appropriate adjustments within the budget to ensure the County is still collecting 100 Mr Keen further noted adjustments to the budget should be done on a “ revenue - neutral ” basis so the burden on the property owners would be equal Commissioner Mims questioned how the recommendation of creating a concurrency committee differs from the County’s Planning Board and Economic Development Advisory Board Mr Jackson reported a concurrency committee would be seen as a preplanning committee and would evaluate how developments would affect the County as a whole Commissioner Mims stated he could possibly see the usefulness of a concurrency committee when looking at large developments ; however , for smaller projects such as a 25 - lot subdivision , he felt another committee would only slow down the review process Mr Keen reported planning and how it affects the overall County is a big deal Mr Keen noted the report says that we are all one County and whatever benefits Benson should benefit Clayton , and so on Mr Jackson reported he is on the Johnston Memorial Hospital Authority and noted when the Authority was working on a strategic plan , they went around the County holding “ town hall meetings ” and were amazed as to what the citizens wanted from the hospital Mr Jackson felt this was a useful tool in determining citizen input and he highly recommended the same process to the Commissioners Commissioner Stewart inquired if the Committee , in determining their recommendations , recognized the magnitude of trying to shape the County in a quality way according to how everyone felt it should be Mr Jackson replied he realized there are hard decisions to make Mr Keen agreed it is a difficult task to bring everyone together to discuss issues and come to a consensus Mr Keen noted that even on the Blue Ribbon Committee , there were recommendations that not all members agreed with ; however , he felt the Committee had come together as a group to create a consensus Mr Keen stated he believed that the Board should begin the process of getting citizens involved in discussions as well as the creation of a concurrency committee would pull the towns and the County together to help prepare for growth that is coming PagePage pageNumber9386 September 4 , 2007 – 10 00 am Continued Commissioner Mims asked for a definition or an example of a comprehensive land use plan Mr Jackson reported although he could not define exactly what the comprehensive land use plan should be , he noted approximately 90 other counties in North Carolina had one and the Committee noticed Johnston County , as one of the fastest growing counties in North Carolina , did not He stated perhaps Johnston County could look at what some other counties have in place Commissioner Mims stated the County already has parts of a comprehensive land use plan through the zoning ordinances as well as sewer policies ; however , as a member of the Planning Board he sees issues with a set plan Commissioner Mims noted it takes great strengths to have one plan and be able to put it into place to suit everyone Mr Keen stated the County had looked at a guide in October 2006 ; however , it was not endorsed nor was it put to the citizens Mr Keen felt although it was a good start , the process of public hearings to obtain citizen comment was not finished Commissioner Stewart stated he believed the Blue Ribbon Committee had done a good job overall and what he personally gained from the report was the satisfaction of having the opinions from 39 citizens across the County from various occupations , who came together and formed a consensus of what our fellow citizens are generally recommending Commissioner Stewart further stated he would use the Committee’s report as a basis for making future decisions Mr Keen stated one of the things he gained from the Committee’s work is how much the engineers , surveyors , contractors , and other professionals from the County play a role in the quality of the product the citizens end up with He felt more of an emphasis must be placed on working with these professionals and noted they can be a tremendous asset Mr Jackson thanked the Board for the opportunity to be a part of the Committee and stated he felt the group worked together to try and create something the Commissioners can use to make Johnston County a better place Mr Jackson requested the Board to consider the recommendations on behalf of the Committee members Chairman Cookie Pope thanked Mr Jackson and Mr Keen and invited all the members from the Committee back to the October 1 , 2007 6 00 pm meeting to be formally recognized for their efforts Motion to accept the report from the Blue Ribbon Committee Upon a motion by Commissioner Tony Braswell , seconded by Commissioner W Ray Woodall , and carried unanimously , the Board accepted the report from the Blue Ribbon Committee dated September 4 , 2007 5 Public Hearing – 10 15 am – Economic Development Incentive Grant Public hearing was delayed due to lengthy presentation of Blue Ribbon Report Advertised August 24 , 2007 The Smithfield Herald The Chairman opened the public hearing and called on Economic Development Director Michael de Sherbinin to address the Board Michael de Sherbinin , Johnston County Economic Development Director , stated the purpose of the hearing was to consider an Economic Development Incentive Grant EDIG between the County , the Town of Benson , and PGI , formerly known as Chicopee , for a proposed 15 - 20 million expansion at their Benson facility Mr de Sherbinin reported the EDIG as drafted , establishes a tax base of 22,920,562 as of 2007 – 2008 The EDIG would be based on any investment over and above the base Mr de Sherbinin noted the base would be used as the number to judge any new capital expenditures ; however , would be subject to revaluation and depreciation The company will be required to pay their annual taxes and would then be reimbursed 50 of the net new ad valorem taxes over and above the existing base amount for a period of five consecutive years Mr de Sherbinin introduced Mr Dave Wood , Plant Manager of the Benson PGI facility Mr Wood informed the Board that PGI is currently in a difficult situation in that their equipment is old and their competition , both foreign and domestic , has upgraded Mr Wood stated PGI needs to upgrade the Benson facility and he is trying to encourage the company’s investors to invest in new capital for the plant PGI has developed new technology and the first line will be installed at the Benson plant which is a great step in securing the future PGI currently provides over 10 million per year in salaries for their employees Mr Wood stated he is trying to create job security for those employees and believes that the initial investment will securePage0387 September 4 , 2007 – 10 00 am Continued those jobs as well as encourage the company to further expand Mr Wood requested the Board consider the EDIG opportunity and asked if there were any questions Chairman Cookie Pope inquired as to the current number of jobs and whether any new jobs would be added as a result of the expansion Mr Wood reported PGI in Benson currently employs just under 300 people and he could not predict any new jobs , noting it all depended on future projects Mr Wood verified the current project would mainly secure the existing jobs at the facility There being no further comments , the Chairman closed the public hearing Motion to Approve the Economic Development Incentive Grant Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Tony Braswell and carried by unanimous vote , the Board approved the Economic Development Incentive Grant Agreement between the County , the Town of Benson , and PGI Chicopee as proposed 6 Resolution to Adopt the Current Editions of the NC Building Code County Attorney Mark Payne requested the Board consider a resolution adopting the current editions of the North Carolina State Building Code , including all appendices and amendments as adopted by the North Carolina Building Code Council Mr Payne reported this was mainly an administrative cleanup and that Inspections is asking the Board to adopt the resolution so that any changes to the NC Building Code , including changes on appendices , can be enforced by the Johnston County Inspections Department Mr Payne noted the State is putting many changes into the appendices and this resolution would help to enforce those In response to a question from Commissioner Allen L Mims , Jr , Mr Payne reported this resolution would cover the adoption of any changes made by the State to the building code in the future Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Jeffrey P Carver and carried unanimously , the Board adopted the following resolution for the current editions of the NC Building Code , including all appendices and amendments RESOLUTION WHEREAS , the North Carolina General Assembly has by virtue of General Statutes 143 - 138 e specified that the North Carolina Code shall apply throughout the State ; and WHEREAS , the 1977 session of the General Assembly in G S 153A - 351 a required that each county arrange for the enforcement of the Building Code within a specified time ; and WHEREAS , Johnston County recognized the necessity of complying with all applicable state laws and adopted by Resolution the enforcement of the Building Code on June buildings and facilities as it pertains to accessibility , except in one and two family dwellings General Where , in any specific case , different sections of these codes specify different materials ,
