10 277 Meeting of the Johnston County Board of Commissioners June 11 , 2007 Special Meeting The Johnston County Board of Commissioners met in special session Monday , June 11 , 2007 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , and Deva C Holt , Deputy Clerk The Chairman called the meeting to order , and announced the purpose of the meeting is to consider the 2007 - 08 County budget and related matters as well as a continuation of a discussion involving a proposed amendment to the Johnston County Code of Ordinances , Land Development Code , Section 14 - 75 b Permitted Uses regarding Commercial Vehicles 1 Continuation of Discussion from June 4 , 2007 6 00 PM Meeting County Code of Ordinances – Land Development Code – Section 14 - 75 AR b Permitted Uses – Commercial Vehicles Chairman Cookie Pope announced the Board had tabled a discussion following a public hearing involving a proposed amendment to the Johnston County Code of Ordinances , Land Development Code Section 14 - 75 AR b Permitted Uses regarding commercial vehicles at the June 4 , 2007 6 00 pm meeting Chairman Pope called on County Attorney Mark Payne to update the Board County Attorney Payne stated the matter involved complaints received by citizens regarding commercial trucks in residential areas Mr Payne noted there were two specific complaints and informed the Board the Planning staff was moving forward with enforcement actions on those two specific complaints as staff had determined these were zoning violations Mr Payne stated the question now was how to determine at what point does storing and maintaining commercial trucks in a residential area constitute as commercial use He noted commercial use is not allowed in a residential area , and therefore would be considered a zoning violation Mr Payne stated staff has reviewed the ordinance and determined it does not clarify exactly where the line of demarcation is regarding a commercial use and for that reason , staff has prepared a recommendation for an ordinance amendment that would give the County more direction in future cases Mr Payne noted the latest version of an amendment takes into account that the County is large and has very rural areas as well as dense residential areas He stated staff’s recommendation was to have a standard of one truck as the limit on commercial trucks within subdivisions and more dense residential areas and have another standard for areas that are more rural Commissioner Tony Braswell asked what did “ moving forward ” mean regarding the enforcement actions of the two specific complaints received Mr Payne stated the Planning staff has made contact with the two owners and informed them it is the County’s opinion they are in violation of the ordinance and their trucks need to be removed Mr Payne noted the County has not issued citations at this point , in that staff is trying to assist the owners with locating a place to store the trucks and get them out of the neighborhoods However , Mr Payne stated if the trucks are not removed , the County will move forward with issuing a citation Commissioner DeVan Barbour inquired as to the time frame of getting the trucks removed Mr Payne stated he has not established a time frame ; that communications with the truck owners have come directly from the Planning staff Commissioner Barbour stated if the truck owners are not in compliance , staff must have a timeframe as to the removal Mr Payne noted he felt the County needed a plan of action in a matter of days as opposed to weeks and compliance should come within a matter of weeks as opposed to months Mr Payne reported he does feel comfortable with an enforcement action on the two zoning violations based on the way the ordinance is currently written ; however , he noted it would be stronger once an amendment has been made to clarify the issue Upon a question from Commissioner Braswell , County Manager Hester stated it may be appropriate to draft the revised amendment and hold another public hearing at the July 9 , 2007 6 00 pm meeting Page278 June 11 , 2007 - 6 00 pm Continued Commissioner Barbour stated he had no problem with holding another public hearing ; however , he asked for assurances that the two existing zoning violations would be addressed immediately and would not be delayed due to the need to hold another public hearing Berry Gray , Assistant Planning & Zoning Director , reported staff would be taking enforcement actions on the zoning violations Commissioners Wade M Stewart and W Ray Woodall called on County Attorney Payne to clarify to the citizens that the zoning violation and the proposed ordinance amendment are two different items Mr Payne stated enforcement actions are in the process of moving forward and communications have been made with the two current violations Mr Payne noted he could not say exactly when the trucks would be gone ; however , staff needed to have a plan as to that timeframe as soon as possible After further discussion , Chairman Pope asked Mark Payne and Berry Gray to speak with the citizens at the meeting concerned over this matter and called for the second public hearing regarding the proposed amendment to the Johnston County Code of Ordinances , Land Development Code Section 14 - 75 AR b Permitted Uses involving commercial vehicles to be held on July 9 , 2007 at the 6 00 pm meeting 2 Reins From Above – Request for Funding Tom Moore , 305 N Third Street , Smithfield , speaking on behalf of Reins from Above RFA , thanked the Board for the opportunity to appear and present a request from RFA for grant funding in the amount of 100,000 to help construct a new facility to provide therapeutic recreational services to over 200 handicapped children Mr Moore stated the Board of Directors of RFA has taken on the task of raising approximately 300,000 to build the new facility Mr Moore informed the Board no other organization in Johnston County offers these types of services and it would fulfill a need to a segment of the County’s population that he felt has long been neglected Mr Moore reported the response RFA has received from the citizens of Johnston County have more than justified their faith in this endeavor He submitted a contributors list to the Board and noted currently , RFA has raised 60,000 in cash pledges and 125,000 in services and materials Mr Moore went on to say , having been a past commissioner , he understood the task of finding and designating funds to all the requesting organizations He stated he had spoken with County Finance Officer John Massey and learned that as of April 30 , 2007 , the County had collected 192,000 generated from fees paid by developers in lieu of setting aside open spaces Mr Moore stated the Board had given grants to construct and maintain recreational facilities for healthy children over the years and he asked the Board to give their support to a facility that will operate year round for children with special needs Stacey Ryder , Executive Director of RFA , addressed the Board and submitted pictures demonstrating the services RFA provides At the request of Ms Ryder , approximately 35 people raised their hands to represent their attendance for RFA Ms Ryder gave the Board a background of the services RFA provides and read their mission statement as follows Reins from Above Therapeutic Riding Center , Inc is a 501C3 non - profit organization and NARHA center member , that strives to maximize the potential for our students well - being by providing equine - facilitated activities in the areas of therapy , education , sport , and recreation RFA also aims to enhance physical and mental skills , aid in mobilization , and promote socialization and communication Ms Ryder informed the Board she started RFA in September 2005 when upon obtaining her certification as an instructor , she learned there was not a therapeutic riding center in this area She noted in the first year of operation RFA began with 3 students , ending with 23 and this year they expect to double that number Ms Ryder also informed the Board she is constantly receiving words of encouragement from parents of special needs children that are happy to have a place close by , since many of these children are unable to ride in cars for long periods of time Ms Ryder stated RFA is a place where special needs children can participate without having to worry about ridicule from others and provided some success stories of children utilizing RFA Ms Ryder stated RFA was in jeopardy of losing their home ; however , through the generosity and support of Mr Bobby Lewis who has donated the use of his land to them , they now have a permanent location that needs a facility Ms Ryder asked the Board to consider funding so RFA can continue to provide safe and beneficial opportunities for special needs people Ms Ryder introduced Ron Howrigon , 132 Highland Drive , Angier , and stated Mr Howrigon was the parent of one of her students Mr Howrigon told the story of his son Conner who is diagnosed with Autism Mr Howrigon briefed the Board on his son’s condition and shared the story of how RFA has benefited Conner He informed the Board that Stacey Ryder and the volunteers at RFA deserved all the support the County could give and requested the Commissioners to consider supporting Reins from Above Page279 June 11 , 2007 - 6 00 pm Continued Linda Braund , 4109 Gates Mill Pond Road , Raleigh , appeared before the Board and gave a background on what RFA and therapeutic riding has done to improve her condition Ms Braund stated she suffers from multiple sclerosis and felt the services provided at RFA are proven to help with social skills , developmental delays as well as other disabilities and no other organization in Johnston County can provide those services Ms Braund stated the County is fortunate to have RFA and she asked the Board to consider assisting the organization Katherine Nappen , 6751 Cleveland Road , Clayton , addressed the Board and stated she would like to speak from the volunteer’s point of view Ms Nappen informed the Board that one of the best parts of the RFA effort was the teenagers becoming involved as volunteers She noted her teenage daughter was a volunteer and has learned a great deal about others and giving back to the community Ms Nappen further described the positive efforts associated with volunteering at RFA , gave accolades to Stacey Ryder for her work with the program , and shared the story of a special needs child whose conditioned improved through guidance from RFA Ms Nappen asked the Board to consider supporting RFA Linwood Jones , 449 Grill Road , Clayton , stated he first read about RFA in a newspaper as well as he was contacted by Mr Tom Moore Mr Jones informed the Board he believed people are willing to give time and labor to the cause and with that in mind , he met with the Homebuilders Association of Johnston County recently Mr Jones stated he proposed a barn - raising to the Homebuilders Association for RFA to help build the new facility He noted the Homebuilders Association has taken the idea under consideration ; however , materials will be needed Mr Jones stated the County could help with the needed materials Mr Jones further stated he as a developer would have no problem with the County setting aside revenues from the fees paid by developers in lieu of setting aside open spaces , to be appropriated towards the RFA project Mr Jones requested the Board to consider this funding idea for RFA Chris Strayer , School Counselor at Wilson’s Mills School , stated she along with other teachers at Wilson’s Mills School are trying to start a character club whereby the club has the option of adopting either a rider or a horse at RFA The club is based on good behavior and raising money for the horses and riders at RFA Ms Strayer passed around a poster of pictures from a recent field trip of her students visiting RFA Ms Strayer stated the project has taught the students a sense of community as well as respect for others Stephanie Simmons , teenage volunteer at Reins from Above , informed the Board she began volunteering in March 2006 to obtain clinical hours for college Miss Simmons stated since she began her work at RFA , she has become amazed at the children and what they have been able to accomplish Miss Simmons shared with the Commissioners some of her experiences at RFA and asked the Board to consider their request for funding Chairman Pope stated the Board appreciated the Reins from Above program efforts , and that although the Board would not be making a decision tonight , the request had been heard and will be considered In response to a question from Commissioner DeVan Barbour , Tom Moore reported the land RFA is currently located on is for sale and has received an offer Ms Ryder stated they must be off the land by August and move to the new location Commissioner Wade M Stewart inquired as to the type of agreement RFA had with Mr Bobby Lewis for the new location and also was RFA soliciting financial participation from surrounding counties Ms Ryder reported the agreement with Mr Lewis stated they could operate the RFA facility on Mr Lewis’s property for the life of the program Mr Moore reported 22 acres have been set aside and recorded Mr Moore also stated Mr Lewis has no interest in developing the property and is trying to classify it as a land conservatory Mr Moore further reported they are contacting people from the Raleigh and Wake County areas and the program is open to other areas Upon a question from Commissioner Stewart , Ms Ryder reported Reins from Above is a local endeavor sponsored by a national organization Ms Ryder invited the Board to visit and learn more about Reins from Above The Board took a five minute recess 3 Johnston County Industries John Shallcross , Jr , 717 Sunset Drive , Smithfield , addressed the Board on behalf of Johnston County Industries Mr Shallcross stated the last request for an increase in funding was in 2001 Mr ShallcrossPage280 June 11 , 2007 - 6 00 pm Continued informed the Board that in 2006 and 2007 , Johnston County Industries has served 564 clients which is a 61 increase and placed 111 people in employment which represents a 106 increase from 2001 Mr Shallcross stated Johnston County Industries is requesting an increase of 25,000 for a total of 125,000 for FY 07 - 08 and called on Executive Director Vickie Shore to further comment Vickie Shore , Executive Director , Johnston County Industries , appeared before the Board and stated she appreciated all the support received from the County over the years Ms Shore informed the Board the last time Johnston County Industries asked for an increase was when they were starting their new building program She noted they are at the point now where they need to begin the second phase of the building program to serve the increased demand for services Ms Shore stated one of the causes for an increase in the request is the mental health reform She noted Johnston County Industries is seeing more services regarding mental health that they are becoming more involved in and she expects this to continue Johnston County Industries continues to need work space as well as office space due to the increase in paperwork associated with the mental health services programs Ms Shore stated in order to begin their second phase , she is requesting the Board consider the increase in funding for a total of 125,000 for Fiscal Year 2007 - 2008 In response to a question from Commissioner Allen L Mims , Jr , Ms Shore reported the new building constructed during the first building phase was financed for 30 years at 67,000 per year plus the additional utilities , insurances , and other miscellaneous expenses Ms Shore stated Johnston County Industries is requesting the additional 25,000 in order to perform a study to determine what their needs will be She noted the long range plans are to tear down the older building constructed in 1959 and extend the newer building on to the land Ms Shore clarified they are just now beginning to evaluate future needs and are looking at their programming to learn what will best suit their program five to ten years from now Chairman Cookie Pope inquired if Johnston County Industries was receiving any funds from the state regarding the mental health programs Ms Shore informed the Board that Johnston County Industries does bill for those services and they plan to take over the community house in Selma County Manager Rick Hester stated the Board had designated approximately 50,000 per year up until 2001 and noted the additional 50,000 per fiscal year after that was used for debt service assistance on the new building Ms Shore stated Johnston County Industries would prefer to support themselves ; however , with large capital projects needed , they required assistance 4 Johnston County Health Department Dr Marilyn Pearson , Director for the Johnston County Health Department , addressed the Board and requested a full - time interpreter position for the Department Dr Pearson informed the Board interpreter services are vital to the people in Johnston County Dr Pearson noted they currently have two full - time interpreters and as an agency providing medical services to the underserved and uninsured , much of their client base is Hispanic and Spanish speaking Dr Pearson outlined the following statistics with the Board that were taken from the Review of the Community Health Assessment • The Latino population has increased from 3 of the County population in 1990 to 103 in 2005 ; • In 2005 , 296 of the births in the County were to women of Hispanic descent ; • The overall Latino client base has increased from 19 in 2004 to 31 in 2006 ; and • The Child Health and Maternal Health Clinics are consistently 60 - 70 Latino Dr Pearson stated with the above statistics , the Department needed to have more interpreters on hand in order to see more patients and try to improve the health of the people in the County In response to a question from Commissioner Tony Braswell , Dr Pearson verified this position is requested in addition to what is proposed in the budget 5 Council on Aging & JCATS Donna Creech , Director for Council on Aging , distributed to the Board a series of census maps from 2002 representing the distribution of age groups ages 50 and up across the County as well as an updated request for funding from Council on Aging Ms Creech stated the updated version represents revised estimates for Home Community Care Block Grant funds that resulted in a 2,422 increase PagePage pageNumber5281 June 11 , 2007 - 6 00 pm Continued Ms Creech explained the census maps for the Board and noted each dot represented a person Council on Aging is caring for which illustrated a significant area of coverage Ms Creech stated part of the difficulty of serving people from all over the County is the cost of providing those services at the homes , or providing those services in a senior center that is located nearby Ms Creech informed the Board of a new program Council on Aging is working with the Mental Health Department and stated it involved a grant to hire a geriatric trained person to work with the staff of mental health institutions Ms Creech also highlighted other programs such as JCATS and the home delivered meals Ms Creech noted they have approximately 450 volunteers which are needed for the home delivered meals program Ms Creech reviewed the following items from the “ Council on Aging Request for Funds ” Council on Aging Request for Funds July 1 , 2007 through June 30 , 2008 Change from FY 07 REVISION June 11 , 2007 1 Continued support for required match of State and 81,09300 83,515 + 2,422 Federal Funds based on amount of funding received in FY 07 May notice of funding added 21,801 to HCCBG requiring additional 2,422 match 48,80000 No change 2 Continued funding for supplemental support of nutrition program , senior lunch and home - kind help from the County than most agencies do and she appreciates the assistance , not only from County Manager Hester’s office but from the other County departments PagePage pageNumber6282 June 11 , 2007 - 6 00 pm Continued Ms Creech reported on the JCATS program and stated they have been able to get a rule change to expand the program to the general public to reach more people Ms Creech later noted the rural general public portion of the Rural Operating Assistance Program grant usually comes in April ; however , it has just been mailed out today Ms Creech reported there is a 10 match associated with that grant and she assumes they will receive the same amount as last year Ms Creech reminded the Board the match is used for eight vehicles in the community transportation plan She hopes JCATS will be notified soon as to their award amount County Manager Rick Hester clarified the 10 match is included in the proposed budget , based on last year’s estimates Commissioner Tony Braswell inquired about the older building in Smithfield that houses the Senior Center Ms Creech reported the Senior Center is still located in this building and they have been working with the Town of Smithfield to allocate part of a new facility to be used as a Senior Center However , Ms Creech stated this new facility cannot handle the meals program and noted Smithfield has the largest meals program in the County She further noted this would require the office to staff two facilities in order to accommodate the meals program and they would be working on this project later this year Chairman Cookie Pope inquired about the new building in Smithfield Ms Creech reported they are working with the Town of Smithfield to obtain space in the new parks and recreation community building In response to a question from Commissioner Jeffrey P Carver concerning the one time funding for development of a County Aging Plan , Ms Creech replied Johnston County is one of two counties that do not have an aging plan which the State requires She further noted that Triangle J does not offer any financial assistance ; however , Triangle J can assist with an outline of what is needed to perform the study Commissioner Wade M Stewart asked Ms Creech to comment on the adult day care issue for Alzheimer’s patients and recalled meetings held last year towards this effort Commissioner Stewart asked how the County was going to address this need Ms Creech reported she was not involved in those meetings , but noted she has received several calls concerning this matter Ms Creech stated adult day care was not something her agency handles ; however , they could be of some assistance Ms Creech noted she felt this program should be an adult health day program to address care needs for the elderly who suffer from all ailments , and not just Alzheimer’s disease Ms Creech informed the Board that a survey needed to be performed to see if there are enough people who would participate She has spoken with contacts in Wake County who run similar operations to get more information Ms Creech stated the effort would require a significant amount of money up front and a good business plan would be necessary to undertake such an operation She informed the Board there are options available , but it would require time and effort to determine how great the need is and the cost involved Ms Creech stated transportation for the elderly to and from the centers would also be an issue Commissioner Stewart stated if Wake and Harnett Counties are operating such facilities , perhaps a visit to those operations would be appropriate Commissioner Tony Braswell stated he was on the committee last year looking at this effort and he recalled the group decided in lieu of visiting other centers , they felt there needed to be a feasibility study performed to determine the needs of all the elderly adults , including Alzheimer’s adult day care County Manager Rick Hester recalled the group had talked about holding a forum to receive feedback on the need He noted First Baptist Church in Smithfield had begun hosting meetings that have been opened to the public Ms Creech stated her agency is a sponsor of the First Baptist Church meetings and she reiterated money is needed in order to get the word out and generate interest Ms Creech noted her staff is limited ; however , this issue does fit in with the strategic plan of what is needed for the elderly in Johnston County After further discussion , Chairman Cookie Pope requested County Manager Hester arrange a meeting with Wake and Harnett Counties to tour their facilities and note the successes and or problems they have encountered 6 Social Services – Request for Additional Positions Earl Marett , Director of Johnston County Social Services , informed the Board of the five new positions he requested , only two are recommended in the proposed FY 07 - 08 budget Mr Marett submitted and reviewed a handout to the Board outlining the caseloads from June 2006 to April 2007 Mr Marett requested the BoardPagePage pageNumber7283 June 11 , 2007 - 6 00 pm Continued consider approving three new income maintenance caseworkers Mr Marett reported he has staff working weekends to meet the increased workload ; however , the comp time creates a problem in itself when the workers request to take the leave He noted the Department needs to address the situation by either hiring temporary workers or adding new positions Mr Marett outlined three options to alleviate the workload as follows 1 Hire temporaries 3 - Income Maintenance Caseworker II x 2080 6240 hours x 2004 125,050 x 143 temp admin fee 178,807 2 Have each Family and Children Medicaid Income Maintenance Caseworker work every fourth Saturday at one and one half their hourly wage 35 Income Maintenance Workers @ 3006 per hour x 50 Saturdays x 8 hours x ¼ the Income Maintenance Caseworkers 105,206 Have each Food Assistance Income Maintenance Caseworker work every fourth Saturday at one and one half their hourly wage 22 Income Maintenance Caseworkers x 3006 per hour x 50 Saturdays x 8 hours x ¼ the Income Caseworkers 66,132 Family and Children’s Medicaid overtime pay 105,206 + Food Assistance overtime pay 66,132 171,338 3 Hire 3 income maintenance caseworkers @ 41,683 fringe benefits included 125,049 All totals would cost the county 50 of the total after state and federal participation Mr Marett stated they anticipate more caseload growth and the Department desperately needed the three additional positions He noted next year the Department would probably have to ask for more positions due to the increased workload Mr Marett stated Medicaid applications must be taken and processed in 45 days as well as food assistance applications have to be taken and processed within 30 days along with reviews that must take place twice per year at least Mr Marett asked the Board to consider his request , noting the Department serves many people and it continues to increase In response to a question from County Manager Rick Hester , Mr Marett verified the projected County cost for the three new positions would be approximately 62,500 per year 7 Special Olympics Carolyn Stafford , Coordinator of Special Olympics , on behalf of the 500 athletes who participate in the Special Olympics , thanked the Board for their past support Ms Stafford highlighted the past year’s accomplishments , including the implementation of a soccer and tennis program She further updated the Board on competitions the various teams traveled to this past year and noted many athletes received gold and bronze medals Ms Stafford reported at the spring games this year , they offered play activities for ages five through seven to get those age groups prepared for Special Olympics games Ms Stafford reminded the Board that she as well as her coaches are all volunteers and they enjoy what they do Ms Stafford stated she appreciated the support they continue to receive from the County and called on her son Robby Stafford , who had recently won a gold medal in aquatics to stand and be recognized 8 Citizen Concern – Transportation for the Disabled Jill Carpenter , 605 Castleberry Road , Clayton , informed the Board she has two disabled sons who participate in the Special Olympics ; however , she also wanted to speak about transportation issues for the disabled Ms Carpenter noted both of her sons have part - time jobs and transportation is a challenge for them , since she and her husband both work also Ms Carpenter stated the last time she checked into JCATS , the service was not provided between towns Ms Carpenter stated she wanted to bring this problem to the attention of the Board At the request of Chairman Cookie Pope , Ms Carpenter introduced one of her sons , Matt Carpenter who received a gold medal at the Special Olympics Alpine Skiing Competition 9 Budget Amendments At the request of Finance Officer John Massey and following discussion , Commissioner Allen L Mims , Jr moved the Board approve the following budget amendments for the Sheriff Juvenile Restitution Program and the Social Services Department Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote PagePage pageNumber8284 June 11 , 2007 - 07 recreation grant extensions Benson Parks & Recreation 3,908 left unspent Clayton Recreation Foundation 1,836 left unspent Smithfield Parks & Recreation 25,000 left unspent Mr Massey reported on the Smithfield Parks & Recreation grant , the Smithfield representatives are requesting to divert some of the funds from the original grant to be used on other projects He noted the original grant was to be used in Bingham Park ; however , that Park has been sold Mr Massey stated the Smithfield request may require review and approval by the Recreation Grants Committee prior to action by the Board Commissioner Barbour stated he felt the Smithfield Parks & Recreation representatives should meet with the Recreation Grants Committee and review the revised scope of the project before granting the extension Upon a motion by Commissioner Tony Braswell , seconded by Commissioner DeVan Barbour , and carried unanimously , the Board approved the extension requests for Benson Parks & Recreation and Clayton Recreation Foundation In response to a question from Commissioner W Ray Woodall , Mr Massey reported approximately 75,745 has not been drawn to date Mr Massey informed the Board that Chad McLamb in the Finance Office has either spoken with or left messages for all outstanding recipients It was the unanimous consent of the Board for the Recreation Grants Committee to review the Smithfield Parks & Recreation Grant , prior to taking action on an extension 11 Board Reports and Comments A Upper Coastal Plains Rural Transportation Planning Organization Withdrawal Commissioner Tony Braswell stated he brought to the Board’s attention at the June 4 , 2007 meeting the possibility of the County not renewing the contract with the Upper Coastal Plains Rural Transportation Planning Organization Commissioner Braswell moved the Board formally withdraw from this organization and form our own Rural Transportation Planning Organization to consist of Nash , Edgecombe , and Johnston Counties The motion was seconded by Commissioner W Ray Woodall and carried by unanimous vote PagePage pageNumber9285 June 11 , 2007 -
