10 137 Meeting of the Johnston County Board of Commissioners March 13 , 2007 8 00 am The Johnston County Board of Commissioners met in special session Tuesday , March 13 , 2007 at 8 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , W Ray Woodall , DeVan Barbour and Tony Braswell Absent Allen L Mims , Jr and Jeffrey P Carver Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Presentation of Letters of Conditions for O’Neals Water District – Phases I , II and III Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board recessed regular session to sit as the O’Neals Water District Public Utilities Director Tim Broome stated the purpose of the meeting is to present Letters of Conditions for funding Phases I , II and III of the O’Neals Water District , and lease - purchase loans for seven other water districts to buy extra capacity He introduced Mike Harris with USDA Rural Development Mr Harris noted that staff is trying to get a 41250 interest rate for the projects He stated that , currently , there is enough USDA funding for Phase I , however , Phases II and III may have to be funded three to four months from now Mr Harris introduced Julia Johnson to present the Letters of Conditions for the O’Neals Water District O’Neals Water District – Phase I - Letter of Conditions Ms Johnson presented a Letter of Conditions for the O’Neals Water District - Phase I , which includes a USDA Rural Development loan not to exceed 3,303,00000 , a USDA Rural Development grant not to exceed 1,000,00000 , a County contribution of 500,200 for upsizing of lines , and contributions from the O’Neals Water District of 70,80000 for a total project cost of 4,874,00000 Commissioner W Ray Woodall moved the Board adopt the following resolution accepting the loan and grant funds for the O’Neals Water District – Phase I Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote RESOLUTION OF THE BOARD OF COMMISSIONERS OF O’NEALS WATER DISTRICT PHASE I BE IT RESOLVED That the Board of Commissioners of the O’Neals Water District Phase I do hereby accept the conditions set forth in the Letter of Conditions dated March , 2007 , the RUS Bulletin 1780 - 27 , Loan Resolution , dated March , 2007 , and the RUS Bulletin 1780 - 12 , Water or Waste System Grant Agreement ; and That the Board of Commissioners will adopt an operating budget for the O’Neals Water District Phase I that will maintain a water use rate schedule at rates sufficient to meet all budgeted operating , replacement , and debt service expenses , and , the O’Neals Water District Phase I may make modifications to the rate system as long as the rate schedule remains sufficient to meet budget requirements ; and , That the Chairman and Clerk be authorized to execute all forms necessary to obtain a loan and grant from the USDA Rural Development , Rural Utility Service including , but not limited to the following forms ; and , That this resolution becomes part of the official minutes of the Board of Commissioners of the O’Neals Water District Phase III meeting held on March 13 , 2007 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board adjourned as the O’Neals Water District , and regular session was resumed 2 Presentation of Letter of Conditions for Archer’s Lodge Water District Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour and carried by unanimous vote , the Board recessed regular session to sit as the Archer’s Lodge Water District Mike Harris with USDA Rural Development presented a Letter of Conditions for the Archer’s Lodge Water District , which includes a Rural Development loan not to exceed 750,00000 He explained this loan and the six others to follow in today’s meeting would be for installment - purchase agreements to buy extra capacity for the districts These particular districts are the ones with robust growth , and currently use more capacity than they originally paid for To comply with requirements of the Rural Development loan , the County must establish and fund annually a debt service reserve fund for each district equal to 10 of the annual payment each year over the life of the loan until one annual installment is accumulated Mr Harris noted that , currently , installment purchase agreements for water districts are not permitted , however , local legislation has been introduced that would allow this practice Staff wishes to proceed with the presentation of the letters ofPage140 March 13 , 2007 – 8 00 am Continued conditions and Board consideration approval to lock in the interest rates , and if the legislation does not pass , revenue bonds will be used as alternative financing Commissioner Tony Braswell moved the Board adopt the following resolution accepting the loan funds for the Archer’s Lodge Water District Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote RESOLUTION OF THE BOARD OF COMMISSIONERS OF ARCHER’S LODGE WATER DISTRICT BE IT RESOLVED That the Board of Commissioners of the Archer’s Lodge Water District do hereby accept the conditions set forth in the Letter of Conditions dated March 13 , 2007 , the RUS Bulletin 1780 - 27 , Loan Resolution , dated March 13 , 2007 ; and That the Board of Commissioners will adopt an operating budget for the Archer’s Lodge Water District that will maintain a water use rate schedule at rates sufficient to meet all budgeted operating , replacement , and debt service expenses , and , the Archer’s Lodge Water District may make modifications to the rate system as long as the rate schedule remains sufficient to meet budget requirements ;
