10 1 Meeting of the Johnston County Board of Commissioners January 2 , 2007 10 00 am The Johnston County Board of Commissioners met in regular session Tuesday , January 2 , 2007 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour and Tony Braswell Absent None Also Present Rick J Hester , County Manager , April N Byrd , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , and Deva C Holt , Deputy Clerk Chairman Pope called the meeting to order , and acknowledged the day as a National Day of Mourning in memory of former President Gerald Ford Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Jeffrey P Carver led those in attendance in the pledge of allegiance to the American flag 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver and carried by unanimous vote , the Board approved the minutes for the December 4 , 2006 1 00 pm and 6 00 pm board meetings as presented 2 Public Comments No one spoke at this time 3 “ State of the County ” Address by Chairman Cookie Pope Chairman Cookie Pope presented the following “ State of the County ” address It is my privilege to deliver another “ State of the County ” address We have experienced a great 2006 in Johnston County One year ago , I delivered the 2005 address and I mentioned several goals and initiatives for 2006 I am pleased to say we have not only “ talked the talk , we have walked the walk ” One year ago , I stated that we would continue to support our public schools and Johnston Community College ; we showed our commitment by hosting a meeting with both boards , and committed to hold bond referendums in May for renovations and new construction For fiscal year 2004 - 05 , according to a North Carolina Public School Forum publication , th Johnston County ranked 11 in the state in “ relative effort , ” for local current expense funding Relative effort simply compares a county’s actual spending to their ability to pay Since 1999 , we have built and or renovated public schools in the amount of 255million We are grateful that the citizens of Johnston County have made this possible by supporting these bond referendums at the polls One year ago , I stated that we would support our public safety programs There is nothing more important than the safety of our citizens Public safety includes Sheriff Bizzell’s office , our fire departments , emergency medical services , the emergency management office and 911 communications Sheriff Bizzell continues to do a great job We will continue to support him Our fire departments and emergency medical responders are “ second to none ” Our 911 communications center began police dispatching for the Town of Clayton this year and we look forward to adding the Town of Selma this month All municipal police dispatching is now handled through our 911 communications center Through the efforts of our emergency management office , our county earned the “ Storm Ready ” designation from the National Weather Service in 2006 One year ago , we talked about our commitment to job growth in Johnston County Sysco opened their doors for business during 2006 and we are so excited to have them here We worked in partnership with the Town of Smithfield to keep Andrew Corporation in Smithfield Our economy is strong in that the labor force grew by 4,000 jobs in 2006 Wages in Johnston County totaled 14 billion this past year and retail sales totaled 19 billion Page2 January 2 , 2007 – 10 00 am Continued Investment in real property in our county has grown from 34 billion in 1998 to 8 billion in 2006 We are also so proud of our agricultural community and support their efforts One year ago , I stated that we need to study our land use planning ordinances and look for opportunities to strengthen and improve them I established the growth management committee The committee has met many times and the board will be discussing the committee’s work soon Public hearings have , and will be , scheduled for input from all interested parties One year ago , in the “ State of the County ” address , I mentioned our need to continue planning for the future for water and wastewater needs During the past year , we purchased land for the future wastewater treatment facility off of Galilee Road Even though the construction of a new plant is not planned before the year 2016 , we needed to move forward and purchase the property Thanks to the Town of Smithfield for approving our request for a special use permit We have recently purchased a 2 million gallon per day water allocation from Harnett County Partnering with our neighbors in somewhat of a regional approach is critical these days One year ago , we talked about the capital needs our recreation community faces and to show our commitment , we have agreed to place a 37 million referendum on the ballot in May This bond referendum will assist every community in our county 2007 The Board of County Commissioners plans for 2007 to be the best year ever We are committed to do everything in our power to make it happen We are committed to help make Johnston County a better place in which to live , work and play We believe in keeping our plans simple and being responsive to the needs of the citizens In the upcoming year , we will strive to Continue to be a leader in customer service We are challenging our county manager to see that county services not only maintain their excellent service level , but continue to improve every day Continue to look for ways to save taxpayers money We were excited to save 620,000 during the past year by refinancing bonds , and we’ll continue to look for other opportunities to do so Continue to look for opportunities to improve our land use planning ordinances and discuss the recommendations of the growth management committee Continue to work closely with our economic development advisory board and staff to assist companies that are currently in Johnston County and encourage them so that they may grow We are also excited about the possibilities of new business development in our county in 2007 Continue to support public safety programs in Johnston County That has always been , and will continue to be , one of our main objectives as leaders I would like to thank my fellow board members for all they do We are so fortunate to have board members who care so much about what they do We all want a better Johnston County for our children and grandchildren We are committed to making it happen We believe we have the winning team to make it happen in 2007 Happy New Year 4 Approval of Tax Exempt Loan Status - Meadow Fire Department On behalf of the Meadow Volunteer Fire Department , County Fire Marshal Harold Henrich requested the Board approve tax exempt loan status for a loan from Four Oaks Bank & Trust Company , in the amount of 200,000 , to purchase a new fire truck He noted the total cost of the truck is 267,000 , however , the fire department is making a down payment of 67,000 Commissioner Tony Braswell moved the Board adopt the following resolution approving tax exempt loan status for the Meadow Volunteer Fire Department for a loan from Four Oaks Bank & Trust Company , inPage3 January 2 , 2007 – 10 00 am Continued the amount 200,000 , to purchase a new fire truck Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Resolution Approving Tax Exempt Loan Status for Meadow Volunteer Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Meadow Volunteer Fire Department of Johnston County , North Carolina the “ VFD ” , from Four Oaks Bank & Trust Company , in the principal amount of 200,00000 , which loan is for the following purpose The purchase by the VFD of a fire truck , which will be owned and operated by the VFD , and will be maintained at the following address 7409 Highway 50 South , Benson , NC 27504 5 Cooperative Extension - Memorandum of Understanding Bryant Spivey , County Extension Director , requested the Board approve a new Memorandum of Understanding MOU that has been developed between county governments and NC Cooperative Extension He explained the MOU serves as the structure of the cooperative relationship created between local , state , and federal governments committed to bringing research - based knowledge from NC A & T State University A & T and NC State University NCSU to the citizens of each county The new MOU was developed by a team representing the NC Association of County Commissioners , County Managers , the Extension Program at A & T , and the Extension Service at NCSU Mr Spivey pointed out the major change in the new MOU is from “ regular ” status to “ ascending ” ; Johnston County made this change for new incoming employees about two months ago In response to a question from Commissioner Tony Braswell about Section 736 which states “ The County will pay its proportional share of state longevity for SPA employees upon an employee’s service anniversary date ” , Mr Spivey noted because Johnston County has its own payroll system , and in effect is already doing this , he recommends Section 736 be stricken from the MOU County Manager Rick Hester commented the MOU has been reviewed thoroughly by staff He recommended approval of the MOU with omission of Section 736 Commissioner Allen L Mims , Jr moved the Board approve the new Memorandum of Understanding MOU between Johnston County and NC Cooperative Extension with omission of Section 736 Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote 6 Presentation of Audit Report for Year Ending June 30 , 2006 Alan Thompson , with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2006 He stated the County received an unqualified opinion , ie “ clean report ” , which has been approved by the Local Government Commission Mr Thompson briefly elaborated on the following items • General fund equity has increased 7 million ; net assets have decreased 11 million For the County to continue receiving favorable bond ratings and good interest rates , fund balance needs to show an increase and illustrate stability Mr Thompson emphasized that it is very important to have a strong fund balance to continue to fund debt payments • General fund expenditures have increased over 13 million ; of the total 7 million in general fund equity , undesignated fund balance has increased 28 million This correlates well with the overall increase in the general fund expenditures in terms of the ratio to general fund balance • The overall tax collection rate is 9833 This is up 016 from last year Specifically , the real and personal tax collection rate is 9944 The overall statewide collection rate average is 97 Mr Thompson commented on the auditing firm’s opinion of the internal control system , and noted the Finance Department does a good job , the Tax Collections and Public Utilities Departments are managed well , and the overall management of cash assets is good County Manager Rick Hester added the County tries to maintain a fund balance between 16 - 18 of the total general fund budget In regards to the 7 million increase in general fund reserves , he stated thePage4 January 2 , 2007 – 10 00 am Continued undesignated fund balance , which is the money available for appropriation that has not yet been designated , only grew by 28 million Mr Hester noted new internal processes are also in the works County Finance Director John Massey commented , in his opinion , the County is in sound financial condition at this time Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board accepted the County Audit Report for fiscal year ending June 30 , 2006 7 Resolution Introducing School Bond Order and Calling for Public Hearing The following Bond Order was discussed and its title was read BOND ORDER AUTHORIZING THE ISSUANCE OF 99,000,000 GENERAL OBLIGATION SCHOOL BONDS FOR THE PURPOSE OF FINANCING THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF SCHOOL FACILITIES WHEREAS , the Board of Commissioners of Johnston County the “ Board ” has decided to pursue the issuance of general obligation school bonds in the maximum aggregate principal amount of 99,000,000 under the Local Government Bond Act the “ Act ” to finance the acquisition , construction and equipping of modifications , renovations , additions , improvements and extensions to existing facilities and or one or more new buildings or other educational facilities for Johnston County public schools , including acquisition of necessary land and rights - of - way ; and WHEREAS , the Board has filed an application with the Local Government Commission of North Carolina for approval of such bonds as required by the Act ; BE IT ORDERED by the Board of Commissioners for the County of Johnston , North Carolina 1 Pursuant to The Local Government Bond Act , as amended , the County of Johnston , North Carolina , is hereby authorized to issue general obligation bonds of Johnston County for the purpose of providing funds , together with any other available funds , to finance the acquisition , construction and equipping of modifications , renovations , additions , improvements and extensions to existing facilities and or Hearing - 10 30 am - 2006 Wastewater Facilities Improvements Plan Advertised December 19 , 26 , 2006 - The Smithfield Herald The Chairman opened the public hearing , and stated the purpose of the hearing is to receive public comment on the proposed 2006 Wastewater Facilities Improvements Plan The plan projects the County’s wastewater needs for the next 20 years , recommends facilities construction to meet the needs , determines cost and funding for construction , evaluates impact on user changes , and evaluates impacts on the environment For the 20 year planning period , the projected capital cost is 55,000,000 At least one half of the funding is expected from the North Carolina Revolving Fund low interest loan pool and the remainder will be from local contributions including capacity assessment fees and capital reserve funds A copy of the 2006 Wastewater Facilities Engineering Report has been available for public review in the County Manager’s office , in the Land Use Center , and the Public Library in Smithfield Public Utilities Director Tim Broome provided a power - point presentation on the 2006 Wastewater Facilities Improvements Plan He informed the Board that for the past 24 months staff has been working with its consulting engineers to prepare a 20 - year capital improvements plan for its wastewater collection and treatment facilities Hazen & Sawyer Engineers was retained to prepare a detailed engineering study of wastewater collection and treatment facilities The study involved • Projecting wastewater needs for the next 20 years and determining the most cost effective means to meet those needs • Completing an environmental assessment for the selected program • Determining detailed estimates of cost , a phasing plan , and a financing plan for the improvements PagePage pageNumber88 January 2 , 2007 – 10 00 am Continued Mr Broome introduced Engineers Bob Berndt and Chris Belk with Hazen & Sawyer On a parallel basis , the County retained McKim and Creed Engineers to prepare a study and report for expansion of the reclaimed water system , which is an integral part of the County’s wastewater management strategy Both studies and reports were completed under the NC Department of Environment & Natural Resources NCDENR guidelines and rules to enable the County to qualify for potential state revolving low interest loan funding for portions of the 20 - year program Existing System Mr Broome explained the County’s existing wastewater system consists of a 70 mgd advanced technology wastewater treatment plant with conjunctive discharge to the Neuse River near Smithfield and effluent diversion to a reclaimed water system The County provides bulk sewer service to meet all the needs of the towns of Smithfield , Selma , Pine Level , and Four Oaks , a portion of the needs of Clayton , bulk service to the private utilities of Carolina Water Service and Aqua NC The County’s retail collection system now serves portions of the Cleveland , McGee’s Crossroads , 42 East of Clayton , Wilson’s Mills , and Meadow Township areas It will soon include the Devil’s Racetrack Road area The reclaimed water system uses recycled water for golf course and agricultural irrigation He referred to slides of the “ Current Sewer Service Areas ” , “ Existing Facilities ” , “ Existing Footprint of the Plant ” , and “ Existing Reclaimed Water Mains ” Challenges Mr Broome stated the challenges to the County wastewater system include 1 Expanding transmission and treatment capacity to meet the projected increase in wastewater flows over 20 years from a The five municipalities and two private utilities we serve b The retail service areas of the County , including limited residential wastewater service and unlimited commercial and industrial wastewater service 2 Obtaining an amendment to the County’s National Pollutant Discharge Elimination System NPDES permit for increasing the discharge capacity of the Central Regional Wastewater Treatment Facility 3 Complying with the Neuse River Basin Nutrient Management Plan with expanded treatment capacity , ie , complying with very stringent effluent organic and nutrient limits He referred to slides of the “ Generalized Service Area ” , “ Wastewater Flow Projections ” , and “ Nitrogen Plan Summary ” In regards to the wastewater flow projections , staff must plan for the maximum monthly flow , ie the average daily flow during the maximum month Staff estimates the current plant’s 70 mgd capacity to be overloaded by 2008 - 2009 By 2026 , staff estimates needs close to 130 mgd In regards to the nitrogen plan , with the future expansion from 70 to 135 mgd , the County will be producing over 82,000 lbs per year of nitrogen Staff expects a discharge limit of 67,460 lbs per year The County will have two options 1 buy nitrogen credits , or 2 apply more reclaimed water Based on analysis by Hazen & Sawyer , it will be more cost effective to expand the reclaimed water system By the year 2026 , the County will need to land apply 194 mgd of reclaimed water per day in order to avoid the discharge of 14,730 lbs of nitrogen Other challenges include the following 4 Implementing the 20 year program with minimal adverse impact to the natural environment 5 Obtaining a Finding of No Significant Impacts FNSI from the local regulatory agency – DENR’s Division of Water Quality 6 Phasing and funding the necessary additional pump stations and transmission pipelines , the plant expansion , and the reclaimed water system expansion by means and methods through reasonable , or at least , non - prohibitive user charges Proposed Improvements Mr Broome described the following scope of the proposed improvements for the 20 - year program 1 Wastewater Improvements Mr Broome stated the total estimated cost of improvements is approximately 55 million The phasing with associated costs is as follows Phase 1 190 million Phase 2 102 million Phase 3 137 million Phase 4 118 million He referred to Slide “ Proposed Wastewater Facilities Capital Program ” and described the scope of each phase Also , referred to Slide “ Phase 1 Funding Summary ” Proposed Changes in Customer Charges Mr Broome explained that based on the proposed state revolving fund loan , the initial phase of capital improvements will require an increase of 026 per 1,000 gallons in commodity cost for all users Assuming no additional state revolving fund loan assistance , funding of the three subsequent phases will require a total increase of 058 per 1,000 gallons ie , an additional 032 per 1,000 gallons beyond the initial increase for town customers and an increase of 201 per 1,000 gallons ie , an additional 175 per 1,000 gallons beyond the initial increase for County retail customers These increases can be reduced if future low interest loan funding and or grant assistance are to materialize Staff submits that , on the basis of the projected monthly bills for customers using 5,000 gallons , the rate increases are not prohibitive He referred to Slides “ Current Customer Charges ” and “ Proposed Changes in Customer Charges ” Environmental Assessment Mr Broome pointed out the following “ Environmental Assessment - Areas of Evaluation ” that has been reviewed by the engineers A Purpose and need for proposed project B Alternatives analysis for proposed meeting the sewer needs of the County’s service areas and bulk customers is the following • Reasonable • Most cost effective • Will result in non - significant impacts to the natural environment • Will be phased and financed to be affordable Discussion & Questions from the Board In response to a question from Commissioner Cookie Pope regarding public interest in reclaimed water , Mr Broome stated sod farms , plant nurseries , JCC , lumber mills , and golf courses have shown interests in the project He emphasized the reclaimed water system will need a lot of users to land apply 19 mgd Commissioner Wade M Stewart asked if the existing wastewater treatment plant site will be expanded from 70 to 135 mgd Mr Broome responded that , based on the latest analysis by Hazen & Sawyer , staff believes the process work can be done at the existing plant site , and use the new site across the river for flow equalization and pre - treatment He stated the original plan for the property across the river was to put a parallel plant with about 40 mgd capacity After another series of intensive modeling and tests , staff concluded that as a result of the current efficient operation , the main processes can be performed at the existing site , however , it will be necessary to go across the river for flow equalization during wet weather Mr Broome noted the land across the river is needed , just for a different purpose than originally intended Commissioner Stewart also asked how the wastewater treatment plant expansion will affect the reclaimed water system Mr Broome noted the wastewater treatment plant expansion will not require expansion of the reclaimed water system for about ten years , however , staff recommends a “ pay as we go ” approach to expand some each year He pointed out all the cost projections are based on no grant money ; although , staff hopes to receive grant funding for the reclaimed water system Also , Mr Broome commented that County staff is operating at about 30 lower than State expectations regarding nitrogen removal Commissioner W Ray Woodall asked , since staff is operating the wastewater treatment plant at better than State standards , does this give the County the opportunity to sell some of its nitrogen credits Mr Broome stated the County has leased nitrogen credits to one of the towns , however , there is not a big market for selling the credits In his opinion , it will be in the best interest of the County to retain the credits In response to a question from Commissioner Woodall regarding comparison to other government entities , Mr Broome noted the County is competitive with systems of similar size Commissioner Allen L Mims , Jr asked if staff plans to use more elevated tanks with the reclaimed water system in the future Mr Broome responded that higher elevation areas typically use ground level holding ponds and a means to re - pump the reclaimed water He anticipated using pressurized tanks in lower elevation areas such as the McGee’s Crossroads area , at Johnston Community College , and Howell Woods In response to another question from Commissioner Mims regarding the growth assumptions used in the reports , Mr Broome stated the growth figures were based on the area , township , and zone The northwestern section of the county was calculated at a 4 - 5 annual growth rate The central towns were calculated at a 2 - 25 rate The four phases of the wastewater treatment plant expansion can be moved forward or slowed down depending on the growth rate and demand for services Page111 January 2 , 2007 – 10 00 am Continued At the request of Commissioner Tony Braswell , Mr Broome explained in detail the proposed changes in customer charges Commissioner Braswell stated that some of the towns in his district have expressed concern regarding the increased rates Commissioner Stewart asked when did the Commissioners receive a prior facilities improvements plan , and how did it compare to the 2006 plan Mr Broome responded staff worked on a prior plan from 2001 to 2003 , and submitted this to the Commissioners at that time He anticipated that if the County is successful in obtaining the funding and the permit for 135 mgd , another plan can be avoided for eight to nine more years The 2003 plan was for a ten year expansion ; the 2006 plan is for a 20 year expansion Mr Broome noted the County has to do the ten year expansion three to four years earlier than expected Staff and associated engineers have tried to be more aggressive with the projections in the 2006 plan , while balancing their predictions , the economy , and what the public will approve Mr Broome stated that staff is not asking the Board to adopt the 2006 plan at this time Meanwhile , the information goes to the State as part of the public file for the project Staff anticipates additional comments from the State , and presenting the final plan to the Commissioners in March or April There being no further comments , the Chairman
