Mails and Other Electronic Data Electronic data , such as e - mails , are generally considered public records and should be treated in the same way as written documents Some electronic data , especially certain e - mails , do not have any long term value and therefore , do not fall within the category of public records For example , an e - mail suggesting a meeting for 9 00 am the following morning has no value the following afternoon and therefore may be deleted in the same way that a handwritten note with the same information could be discarded Please be advised that e - mail records and data are not personal but are property of Johnston County and backup documents may also be considered public records Record Retention Policy All Johnston County records must be maintained for a period of five 5 years unless it is a record set out in the exceptions listed below Please note that these records may be maintained in either electronic or paper version It should be noted that all building inspection department records shall be maintained for a period of at least six 6 years Many tax records must be maintained for a period of ten 10 years Records that otherwise may be disposed of consistent with this schedule but which have an unusual and significant historical value should be maintained permanently No record involved in pending audits and or legal proceedings may be destroyed until no longer needed for the audit and or legal proceedings Records should be protected upon receipt of sufficient and adequate written notice of pending action [ Note Any records destroyed consistent with the State’s Records Retention and Disposition Schedule set sooner than the time frame set out here within shall not be deemed a violation of the Public Records Act ] All non - permanent records may be kept in any format , paper or electronic , and therefore , paper documents may be destroyed when secured electronic copies are available Permanent documents are those documents of significant , historical and legal significance that are required to be maintained permanently [ See NC Gen Stat § 121 - December 1 , 2008 – 10 00 am Continued 6 Johnston County Schools – Current Expense Funds for FY 08 - 09 Chairman Wade M Stewart stated a decision on the request by Johnston County Schools would be tabled until the January 2009 meeting At the inquiry of Commissioner Allen L Mims , Jr , County Finance Officer John Massey reported the Board of Education , in making their budget request to the County Commissioners and in adopting their budget for Johnston County Schools for FY 2008 - 2009 , voted to move 1,351,727 from capital outlay to current expense Mr Massey explained that the motion to adopt the County’s budget by the Board of Commissioners did not include the request by the Board of Education and therefore , the Board of Education is now formally requesting the County to begin sending the 1,351,727 in current expense funds to Johnston County Schools on a monthly basis Mr Massey noted the Board of Commissioners has approved similar transfer requests in the past 7 Presentation of Audit Report for Year Ending June 30 , 2008 Alan Thompson with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2008 He stated the County received an unqualified opinion , ie , “ clean report ” , which has been approved by the Local Government Commission and there were no significant audit findings Mr Thompson reviewed with the Board financial information over the past five years for Johnston County He noted that some points of interest include the growth in the General Fund balance from 2004 to the present as well as the growth in the fixed assets Mr Thompson pointed out that the new school construction values are not included in the fixed asset numbers which , if added , would dramatically increase the overall total He noted the County’s tax rate has remained consistent , while the collection rate has steadily risen and is excellent at 9858 Mr Thompson also noted the County’s collection rate , excluding the motor vehicle taxes , is excellent at 9960 Mr Thompson stated one interesting point to mention is that debt service , education , and human services make up almost 77 of the total budget He reported that ad valorem taxes make up approximately 50 of the County’s total revenue and any change in valuation , outside of a tax rate increase , would have a significant impact on the total revenues of the County Mr Thompson reiterated that overall , the audit was in good shape and he offered to answer any questions by the Board Commissioner Jeffrey P Carver reminded everyone that the County will need to continue to monitor the liabilities , given the increase in the debt over the years He noted in FY 08 - 09 the debt service will increase by an additional 35 million and the upcoming budget by unanimous vote 8 Cooperative Extension – Update on Farmland Protection Plan Development Bryant Spivey , Director for Cooperative Extension , provided the Board with an update on the development of a Farmland Protection Plan for Johnston County Mr Spivey submitted the following timeline of events to date • November 2007 – Johnston County submitted a grant application requesting 39,500 from the North Carolina Agricultural Development and Farmland Preservation NCADFP Trust Fund to complete a Farmland Protection Plan for the County • July 2008 – Notification was received from the NCADFP Trust Proposals for consultants to assist the County with development of the Farmland Protection Plan Six proposals were received with cost ranging from 24,000 to 31,500 and varied approaches to developing the plan Page4138 December 1 , 2008 – 10 00 am Continued • November 2008 – The Johnston County Voluntary Agricultural District Board evaluated the proposals with assistance and input from staff with Cooperative Extension and the Soil and Water Conservation District , the Johnston County Planning Director and staff of Triangle Land Conservancy • November 17 , 2008 – The Voluntary Agricultural District Board selected Agricultural and Community Development Services , LLC of Columbia , Maryland to complete the plan Cost , experience and references were key factors in the selection Agricultural and Community Development Services proposed a cost of 29,715 , slightly less than the funds allocated by the NCADFP Trust Fund • January – February 2009 – The Voluntary Agricultural District Board and Cooperative Extension will begin work with Agricultural and Community Development Services toward completion of the plan The first step in this process will be input from farmers and landowners in Johnston County • June 2009 – Completion of the Johnston County Farmland Protection Plan is expected For the plan to be useful it should be acceptable to farmers and landowners in Johnston County and approved by the Voluntary Agricultural District Board and the Johnston County Board of Commissioners Mr Spivey offered to answer any questions by the Board Commissioner Tony Braswell inquired if the Cooperative Extension staff is coordinating with the County’s consultant , Clarion Associates , on the development of the Comprehensive Plan Mr Spivey confirmed that staff is working to ensure that both the Comprehensive Plan and the Farmland Protection Plan will complement each other He noted that the Planning Department staff is also involved in the development of the Farmland Protection Plan to ensure the plan will coincide with the County Comprehensive Plan 9 Public Utilities – Presentations of Letters of Conditions for Seven Water Districts Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board recessed regular session to sit simultaneously as the Archer Lodge , Brogden , Buffalo , Ingrams Township , Meadow , O’Neals , and Princeton - Kenly Water District Boards Tim Broome , Director of Utilities and Engineering , stated staff , along with the County’s consulting engineers , have been working for two years to develop a strategy to insure compliance with the new US Environmental Protection Agency drinking water regulations for more stringent control of disinfection by - products DBP’s The strategy involves installation of a magnetic ion exchange process in the water treatment plant to accomplish enhanced removal of organic carbon Lower organic carbon concentrations will result in lower DBP’s The magnetic ion exchange process addition and related pumping and transmission improvements is projected to cost approximately 7,700,000 Mr Broome reported that the County applied for a low interest state revolving fund loan from NCDENR – Division of Environmental Health in the amount of 3,000,000 He noted that eight water districts , which will receive the primary benefit of the enhanced water quality , have applied for low interest loans and grants from USDA – Rural Development in the aggregate amount of 4,700,000 The districts will purchase the improved water quality service from the County Mr Broome stated USDA - Rural Development has reviewed the applications and offers funding for seven of the eight districts Mr Broome added that funding is being deferred for the Little River Water District , noting there may be sufficient funds remaining from the current construction project budget that can be applied along with the other district loans under consideration Julia Johnson , Area Specialist with USDA - Rural Development , presented the Letters of Conditions for the seven water districts , as follows Ms Johnson noted that the original Letters for a total project cost of 7,700,000 The interest rate of the 40 year loan is 3625 The annual payment is estimated at 19,28700 A reserve in the estimated amount of 1,92900 will be required which is based on 10 of whatever the final payment will be at the time of closing E Meadow Water District USDA - Rural Development is offering the District a loan not to exceed 511,000 with total contributions of 4,189,000 from the other six water districts and a contribution of 3,000,000 from Johnston County for a total project cost of 7,700,000 The interest rate of the 40 year loan is 3625 The annual payment is estimated at 24,39500 A reserve in the estimated amount of 2,44000 will be required which is based on 10 of whatever the final payment will be at the time of closing F O’Neals Water District USDA - Rural Development is offering the District a loan not to exceed 313,000 and a Rural Development grant not to exceed 153,000 with total contributions of 4,234,000 from the other six water districts and a contribution of 3,000,000 from Johnston County for a total project cost of 7,700,000 The interest rate of the 40 year loan is 3625 The annual payment is estimated at 14,94300 A reserve in the estimated amount of 1,49400 will be required which is based on 10 of whatever the final payment will be at the time of closing G Princeton - Kenly Water District USDA - Rural Development is offering the District a loan not to exceed 382,000 with total contributions of 4,318,000 from the other six water districts and a contribution of 3,000,000 from Johnston County for a total project cost of 7,700,000 The interest rate of the 40 year loan is 3625 The annual payment is estimated at 18,23700 A reserve in the estimated amount of 1,82400 will be required which is based on 10 of whatever the final payment will be at the time of closing Page6140 December 1 , 2008 – 10 00 am Continued Commissioner Jeffrey P Carver inquired as to why the interest rate for the Archer Lodge Water District was higher than the other districts Commissioner Carver also asked for more information with regards to the reserves that are required on each loan Ms Johnson explained the interest rates are based on the median household income of the respective districts and the Archer Lodge District is slightly higher than the other districts Ms Johnson reported the reserves are the security which will be held by the County and the County must provide documentation that one tenth of the funds are set aside each year for ten years until they total one equal payment for each of the loans The reserves must be set aside until the entire loan amount has been paid Ms Johnson noted the County could use the reserves for other purposes with prior approval by USDA - Rural Development ; however , the County would have to demonstrate a plan to replenish the amounts Commissioner Allen L Mims , Jr asked Mr Broome if the equipment being funded with the loans would last 40 years Mr Broome reported the mechanical equipment would have to be maintained and replaced from time to time and it currently has a 20 year life ; however , Mr Broome noted that the structures associated with the equipment would have a life of approximately 50 – 60 years Resolutions Adopted and Letters of Conditions Accepted Commissioner Jeffrey P Carver moved the Board adopt the following resolutions accepting the loan and grant funds for the seven water districts along with the acceptance of the associated Letters of Conditions Commissioner Cookie Pope seconded the motion , which carried by
