10 117 Meeting of the Johnston County Board of Commissioners November 3 , 2008 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , November 3 , 2008 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , J Mark Payne , County Attorney , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Cookie Pope called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comments A Archer Lodge Municipal Exploratory Committee – Request for Support of Incorporation Carlton Vinson , President of the Archer Lodge Municipal Exploratory Committee ALMEC , addressed the Board and requested the County’s support in the ALMEC’s efforts to incorporate the Archer Lodge area of Johnston County Mr Vinson introduced Mike Gordon , Clyde Castleberry , Lisa Barnes , and John Perry of the ALMEC Mr Vinson read the following prepared statement to the Board Just under two years ago , the citizens of Archer Lodge appeared before this body with the first official notice that the community of Archer Lodge was investigating the possibility of municipal incorporation Now two years , countless meetings and hundreds of hours later , we come before you again , seeking your official support as we move forward with presenting our petitions to the Joint Legislative Commission for Municipal Incorporation , and ultimately the North Carolina General Assembly During these many months we have met with various members of the Johnston County Administration , Town of Clayton officials , and representatives of various towns and organizations around the state , seeking to determine the best possible course for our community We have held public meetings for our citizens with the goal of not only educating them as to our plans , but educating ourselves as to their wishes We have spent many hours discussing boundaries , budgets , taxes and all of the various topics you can imagine , and some you can’t in seeking to move the incorporation effort forward The municipal incorporation of Archer Lodge is about the unique spirit of community that envelopes everyone , including its newest residents It is about individuals working together to the betterment of the whole It is about preserving an agricultural heritage and a relaxed community personality that attracts new residents seeking an escape from overdevelopment It is about people who are proud of their 150 - year heritage and look forward to making their own decisions toward building a prouder future together It is about the countless reasons so many have flocked to Archer Lodge , and ensuring that what they came for still exists well into the future It is about the right of a community of citizens to seek self - determination and self - governance , the very rights upon which our country was founded While not every “ i ” is dotted and every “ t ” crossed , we have been working diligently with various county departments to ensure that we hit the ground running as a town , in full cooperation with the County of Johnston as to the services we seek to provide to our citizens What we seek tonight is not approval of all of the details , though few remain left to be worked out What we seek tonight is your official statement of belief and confidence in our efforts Page118 November 3 , 2008 – 6 00 pm Continued On Friday , April 7 , 1995 , an article appeared in The Smithfield Herald , the primary news publication dedicated to serving the citizens of Johnston County The main headline read , “ A crossroads community with spirit ” Just underneath , the subhead displayed the words , “ Archer Lodge isn’t a town , but it sure acts like one ” The municipal incorporation of Archer Lodge is about making it “ official , ” and toward that end we seek your support of our efforts to do so Mr Vinson offered to answer any questions by the Board Commissioner Jeffrey P Carver commented that while he is in favor of self - governing , he noted there are many questions to be answered with regards as to how the incorporation would impact planning and zoning , building inspections , police protection , etc for the area Commissioner Allen L Mims , Jr agreed that there are a number of matters to be clarified regarding water districts , fire protection , and taxes Commissioner Mims asked what type of tax rate is being proposed , noting that the area needed to have an adequate tax rate while not overburdening the residents Mr Vinson stated the ALMEC is proposing a tax rate of 008 per 100 valuation , which does not include the fire tax Mr Vinson stated the Committee looked at recently incorporated municipalities similar to the Archer Lodge area in order to establish the proposed rate Mr Vinson explained that State law requires a municipality to provide at least four services within a three year period of time He noted the ALMEC is proposing to provide water service , fire protection , police protection , and land planning and zoning Mr Vinson stated land planning and zoning is the main reason for the incorporation effort Commissioner DeVan Barbour noted the ALMEC held a community meeting approximately one year ago and inquired if other meetings have been held since that time Mr Vinson reported they are required by State law to hold three community meetings and the third meeting was held at the Archer Lodge Middle School with approximately 450 people in attendance He noted the feelings of the community were overwhelmingly positive with only a few people opposed Mr Vinson stated he felt the ALMEC addressed the concerns of those who were not in favor at that meeting Commissioner Barbour asked what types of efforts have been made to ensure that all the residents in the affected areas are notified and have a chance to be involved Mr Vinson explained the main effort to keep people informed has been through the petition drive He noted packets of information have been distributed along with the petition drive Mr Vinson reported they are required to have at least 15 of the registered voter population in the area sign the petition of support He noted that the ALMEC has been able to acquire three times the amount that was needed for the petition of support Mr Vinson stated the ALMEC will have public notices published in The Smithfield Herald next week Commissioner Barbour reiterated the need to ensure that all the residents in the affected areas are properly notified At the inquiry of Chairman Cookie Pope , Mr Vinson stated the community of Echo Forest initially expressed concern over the possibility of incorporation ; however , the ALMEC held a special community meeting specifically for Echo Forest He noted that once the meeting was held , many of the residents of Echo Forest signed the petition of support before they left the meeting Mr Vinson reported the ALMEC has a website and they have done everything possible to make sure everyone is educated on the effort Commissioner Tony Braswell asked how Archer Lodge proposed to prepare their ordinances Mr Vinson responded that the ALMEC would like to adopt the land planning ordinances of the County in the beginning and work with the County on enforcement He noted by adopting the County’s ordinances , it would allow Archer Lodge the opportunity to draft a set of ordinances specific to Archer Lodge He indicated a survey would be sent out to all the affected residents in order to gather their opinions for a long range plan Commissioner Mims noted that perhaps an overlay district could be added to the County’s Comprehensive Plan , in the event the incorporation effort fails He stated the overlay district would allow the Archer Lodge community the opportunity to create standards for growth in the area Page119 November 3 , 2008 – 6 00 pm Continued After further discussion , it was the unanimous consensus of the Board to provide a letter , stating the following The Board of Commissioners believes that incorporation is a community decision If the residents of the Archer Lodge community are in favor of incorporation , then we are in support and will partner with the Town of Archer Lodge We enjoy a great working relationship with every town in Johnston County If the community decides to remain unincorporated , we will also continue to support and partner with the Archer Lodge community 2 Public Hearings – Rezoning Cases and Special Use Permit Requests Advertised – In The Smithfield Herald – October 22 and 29 , 2008 Certified letters were mailed to adjoining property owners on October 23 , 2008 Notices were posted at the locations on August 22 , 2008 for Cases 06 - 11 and 08 - 28 The Chairman opened the Special Use Hearing for Case 06 - 11 Case 06 - 11 Special Use Modification A request to modify the Special Use Permit as follows original permit allows for a storage area for bricks and mixed debris , staging area for bricks to be separated from debris from a demolition site , and then removal of all brick and debris The Special Use Permit is valid for a period of twenty - four 24 months Applicant is requesting that the Special Use Permit be extended for an additional thirty - six 36 months Property is located on Enoch Road SR 1252 just west of the intersection with Meadowbrook Road SR 1136 in Meadow Township Tax ID 09I15011 Applicant James E Godwin Owner Anna M Godwin It was determined that the applicant was not present for Case 06 - 11 There being no further comments , the Chairman recessed the Special Use Hearing for Case 06 - 11 It was the unanimous consensus of the Board to wait until later in the meeting to hear Case 06 - 11 in the event the applicant arrives Note Later in the meeting , it was determined that the applicant still had not arrived ; therefore , the Board tabled Case 06 - 11 until the December 1 , 2008 6 00 pm meeting The Chairman opened the Rezoning Hearing for Case 08 - 28 Case 08 - 28 Petition to rezone a 1089 acre tract located on Little Creek Church Road SR 1563 , in Clayton Township from General Business - Special Use District GB - SUD to General Business - Special Use District GB - SUD Tax ID 05H05025R Owner Erika M Sherrell Applicant New Age Communications , Inc Planning Director Berry Gray introduced case 08 - 28 and advised that since the property was previously rezoned to General Business – Special Use District , a public hearing for rezoning the property was not required and the Board could hear the special use petition There being no further comments , the Chairman closed the Rezoning Hearing for Case 08 - 28 The Chairman reopened the Special Use Hearing for Case 08 - 28 Case 08 - 28 To allow for the construction and operation of a radio transmission tower Owner Erika M Sherrell Applicant New Age Communications , Inc Those wishing to speak on special use case 08 - 28 were sworn in by the Clerk to the Board Planning Director Berry Gray introduced the special use case and stated the request is to allow for the construction and operation of a radio transmission tower Mr Gray introduced the following summary of evidence into the record A pre - application consultation was held with the applicant for Case 08 - 28 on July 31 , 2008 At that time , the applicant was informed of the following • If approved , applicant must provide to the Planning Office a Site Plan for their review and approval Page120 November 3 , 2008 – 6 00 pm Continued • Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board • Applicant will be notified in writing of the Board’s decision • If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners • Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period • When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements • Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On September 16 , 2008 , the Johnston County Planning Board held a public hearing regarding Rezoning Special Use Permit Case 08 - 28 and made the following recommendations Upon a motion by Mr Smith , seconded by Mr Massengill and carried unanimously 8 - 0 , the Planning Board voted at its September 16 , 2008 meeting to recommend approval of rezoning Case 08 - 28 The Board reviewed and discussed the conditions for the Special Use Permit Upon a motion by Mr Schulz , seconded by Mr Gathers and carried unanimously 8 - 0 the Planning Board voted at its September 16 , 2008 meeting to recommend approval of the Special Use Permit request , Case 08 - 28 , based on and subject to the following findings of fact and special conditions Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; Applicant Transmission tower will be designed , located and operated to meet all requirements of the Johnston County planning ordinances , including the cell tower ordinance , to insure that the public health , safety and general welfare is maintained and promoted Staff The design of the tower , with guyed wires and 25 ’ sections , is intended to provide that in the unlikely event of a collapse , the structure will fall at or near the base The tower will be built and operated in accordance with various Federal , State and Local regulations to ensure the safety and welfare of the public 2 That the use of development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; Applicant A transmission tower is allowed in a general business zone by special use permit This property is already zoned as GB - SUD The tower will comply with all county , state and federal regulations Staff This development will comply with the use and intensity regulations as set forth in the Land Development Code A variance from the minimum setback requirement has been obtained by the Johnston County Board of Adjustment due to the design of the tower Communications towers are permitted in the GB district with a Special Use Permit 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; Applicant The transmission tower will be located in the middle of the 1089 acres and screened by the surrounding woods The operation of the tower will not have any adverse effect on contiguous properties Johnston County does not have an FM radio station nor an AM radio station that broadcasts after dark This new FM station will provide a county - wide outlet for emergency news and warnings addressed specifically to Johnston County Staff The tower will provide a needed FM radio service to the entire County , and will provide increased cellular phone service to the area Existing natural vegetation is very dense and will remain in place , or if removed , a Class B buffer shall be installed This , along with the special use conditions required by the Boards , will maintain the value of contiguous properties 4 That the use or development conforms with general plans for the physical development of the County’s Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners Applicant The special use requested is allowed by the Land Development Code and complies with the development policies of the County Staff Applicant’s proposed development will conform to all requirements of the Land Development Code and any conditions as required by the Boards and Federal , State and Local agencies APPLICANT Radio transmission tower Specific Land Uses Special Use Conditions 1 The Special Use Permit shall expire with the violation of any Special Use Condition 2 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 3 Installation of a Class B landscape buffer along the outer perimeter of the chain - link security fence surrounding the base of the tower 3 large trees , 3 small trees , and 12 shrubs every one hundred 100 linear feet Existing natural vegetation may be used if equal or more intense than the Class B buffer 4 All buildings and or structures must comply with rules enforced by Federal , State and Local agencies PagePage pageNumber5121 November 3 , 2008 – 6 00 pm Continued 5 No residences to be built in the boundaries of the property 6 All conditions recommended required by The Center for Municipal Solutions including the applicant must carry a general liability insurance policy a Timing waivers may be granted for the provision of the Geotechnical Report , the Performance and Removal Bond , the Insurance Certificate naming the County as an additional insured , and the structural design This information must be provided prior to issuance of the Building Permit b To prevent warehousing of permits or authorizations and to assure the best service to the County’s residents as expeditiously as possible , the facility must be built , activated and be providing service no later than 120 days after the issuance of the Special Use Permit or other applicable authorization c Once Curtis Media Group has met all the conditions of the permit and any other requirements of the County and a building permit has been issued , they must notify the County’s consultant if an inspection is required which is not performed by the County so that it may be performed by CMS for the County d At the completion of construction the Applicant must notify the County’s consultant and provide proof that all inspections have been satisfactorily competed and the project is ready for a final on - site inspection Upon passing the final inspection by the County’s consultant a recommendation regarding the issuance of a Certificate of Occupancy shall be made e After the County’s receipt of CMS’s final invoice , all moneys owed the County must be paid before the facility shall be allowed to provide service commercially and generate revenue from its use f Curtis Media Group shall not be permitted to actually provide service commercially until the Certificate of Occupancy or its functional equivalent has been issued or risk forfeiting its Permit Mr Gray noted the site was previously zoned for a store ; however , that use is no longer in operation He stated the applicant plans to remove the existing building Mr Gray reported the County’s consultant , The Center for Municipal Solutions CMS , was on hand to answer any questions by the Board regarding the tower construction Mr Gray clarified that the tower would not be a cellular tower , but would be utilized as an FM radio station tower Rusty Monroe , of CMS , addressed the Board and stated Johnston County currently does not have a 24 hour a day FM radio station He reported the applicant , New Age Communications , Inc , has complied with all the County’s ordinances Mr Monroe explained there was an issue regarding the fall zone which required a variance from the Johnston County Board of Adjustment He noted the tower will be a 500 ft guyed tower and the anchors will be oversized ; therefore , he feels very comfortable with the design and does not foresee any issues with the structural integrity Mr Monroe stated the applicant has requested waivers with respect to the timing of the filing of certain information required under the County’s ordinance and CMS recommends the Board grant the timing waivers since a building permit cannot be issued unless and until all items have been provided and reviewed by CMS Commissioner Wade M Stewart commented that he was surprised no one spoke at the Planning Board meeting in opposition to the tower Mr Monroe stated he had cautioned the applicant that there may be some opposition ; however , to date , none has been received Mr Monroe noted the site was posted and balloon tests were done with no comments from the surrounding residents Chairman Cookie Pope asked Mr Monroe to speak with regards to the fall zone Mr Monroe explained that the tower on the subject site did not comply with the 110 distance requirement from the nearest property line , road , or dwelling He noted the consulting engineers have rechecked all the information and they were very comfortable with the design Commissioner Allen L Mims , Jr reminded everyone that the applicant had already received a variance from the Board of Adjustment regarding the fall zone At the inquiry of Commissioner Jeffrey P Carver , Mr Gray reported the Board of Adjustment reviewed the request for a variance of the setbacks associated with the fall zone requirement He noted the fall zone was decreased to include the subject property only and no additional properties beyond Mr Gray confirmed that information regarding the tower’s design was provided to the Board of Adjustment which then determined a variance should be granted Mr Gray reviewed the site plan with the Board as well as the photographs from the balloon tests results Commissioner Mims stated he would like to discuss the generator information as well as how often testing would occur and what type of noise would be associated with the testing PagePage pageNumber6122 November 3 , 2008 – 6 00 pm Continued Hampton Whittington , Attorney for New Age Communications , Inc , the applicant , reported Curtis Media received a franchise from the FCC to construct and operate the FM radio station in Johnston County approximately one year ago Mr Whittington stated a centrally located area was needed and as the balloon test photographs have shown , the subject 10 acre site is a secluded area Mr Whittington noted that no opposition has been received , and several people have inquired if cell tower communications could be installed to help address cellular communication signals in the area Regarding the fall zone , Mr Whittington explained that a number of years ago when the towers in Garner , North Carolina collapsed due to the weather , those towers were 2,000 feet in height and fell within the 100 ft radius of their base Mr Whittington stated the proposed tower is overly designed to avoid falling and if so , the tower would come straight down rather than falling sideways Mr Whittington reiterated that no one spoke in opposition at the Planning Board meeting and called on Mr Don Curtis of Curtis Media to address the Board Commissioner Carver stated that when he reviewed the balloon test report and photographs he noticed the surrounding housing and asked if those property owners were notified Mr Gray reported some of the houses in the photographs from the balloon tests were not located within the fall zone ; therefore , they were not notified Don Curtis , of Curtis Media , explained that while the towers can fall flat , it is highly unlikely and they are constructed in 25 ft sections stacked on top of one another with guy wires in three directions He reported that all the guy wires would have to break in order for all the sections of the tower to fall at one time Mr Curtis stated a small 20 x 20 building will be constructed at the base of the tower to house the transmitter and other equipment He noted that with regards to noise and testing , the generator will be tested approximately once per month for about 30 minutes and there should not be any noise Commissioner Tony Braswell asked about the station numbers Mr Curtis stated the station would operate as 1023 which was formerly in Goldsboro ; however , Curtis Media has received permission to move it to Johnston County Mr Curtis noted a decision regarding the radio format would be made closer to the tower’s construction completion Upon a question from Commissioner Mims , Mr Curtis confirmed that Curtis Media has over - engineered the tower to allow for Emergency Services or Communications antennas , if needed by the County Mr Gray reported based on the findings of facts with the special use conditions , the Planning Board recommended approval of the special use application for case 08 - 28 Mr Gray clarified that the fall zone area is the actual area that is rezoned through the rezoning process and until the fall zone variance could be established by the Board of Adjustment , the Board of Commissioners could not hear the rezoning request Mr Gray stated that if the fall zone had not been decreased to just the subject site , it would have included the adjacent properties which would have required a rezoning hearing for those additional properties Mr Gray listed and reviewed each of the special use conditions with the Board Commissioner DeVan Barbour asked if the applicant understood all the proposed special use conditions Mr Whittington confirmed they were aware of all the special use conditions and had no concerns There being no further comments , the Chairman closed the Special Use Hearing for Case 08 - 28 Decision on Special Use Case 08 - 28 Case 08 - 28 To allow for the construction and operation of a radio transmission tower Owner Erika M Sherrell Applicant New Age Communications , Inc Based on the findings of facts and the special use conditions , Commissioner DeVan Barbour moved the Board authorize the Planning Department to issue a special use permit to Applicant New Age Communications , Inc to allow for the construction and operation of a radio transmission tower on a 1089 acre tract located on Little Creek Church Road in Clayton Township Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Findings of Fact for the Special Use Permit The Board of Commissioners adopts the findings of facts as set in Staff’s equivalent has been issued or risk forfeiting its Permit 3 Call for Public Hearing Land Development Code – Properties with Expired Special Use Permits Planning Director Berry Gray requested the Board to schedule a public hearing as it relates to the zoning classification of properties with an expired special use permit The amendment has been requested by the Planning Board as a result of repeated rezoning cases in which a special use permit has expired Staff has proposed amendments to Sections 14 - 256 and 14 - 653 of the Land Development Code so that in the event a special use permit is not recorded within 24 months of approval by the Board of County Commissioners , or construction has not begun within 24 months of the recording of the special use permit , the zoning classification would revert back to the previous zoning classification The Chairman scheduled the public hearing for the December 1 , 2008 6 00 pm meeting 4 Clarion Associates – Comprehensive Plan Update Roger Waldon , Clarion Associates , provided the Board with an update on the status of the draft Comprehensive Plan Mr Waldon reviewed with the Board the results from the community forum held on September 23 , 2008 He noted that the forum was very well attended and some of the items that received the highest support included the need for joint use of school facilities for parks and recreational opportunities , cooperation between the County and Johnston County Schools for future school sites , maintaining farmlands , preserving open space , and the continued attention to cooperation with the municipalities Mr Waldon reported he would be meeting with the Planning Board later this month to begin reviewing proposed implementation strategies and would like to do the same with the Board of Commissioners in December At the inquiry of Chairman Cookie Pope , Mr Waldon confirmed he will be working with Johnston County Cooperative Extension Director Bryant Spivey , with respect to the grants received for the Farmland Protection Plan Commissioner Tony Braswell asked Mr Waldon if he had been surprised by any of the forum survey results Mr Waldon stated he was not surprised by the interest of farmland protection or the preservation of open spaces He noted that he was more surprised by the low support for public transportation or the interest to have more of a mix in housing types Upon a question from Commissioner Allen L Mims , Jr , Mr Waldon reported he would be coming back to the Board with recommendations on maintaining farmlands and open spaces PagePage pageNumber8124 November 3 , 2008 –
