Finance Officer , J Mark Payne , County Attorney , and Melissa A Daughtry , Paralegal Interim Deputy Clerk Chairman Cookie Pope called the meeting to order at 10 00 am Commissioner DeVan Barbour led those in attendance in the pledge of allegiance to the American flag Commissioner W Ray Woodall opened the meeting with a prayer 1 Approval Discussion of Agenda Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – August 4 , 2008 10 00 am , 5 00 pm , and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Crestline Drive – Woodview Subdivision – Selma Township Lassiter Farms Lane , Troy Drive , Abram Way , and Moser Place – Lassiter Farms Subdivision – Sections I , II , & III – Cleveland Township Trenburg Place , Trellis Court , and Raven Hill Court – Trent Woods Subdivision – Clayton Township Brookhaven Drive , Streamwood Way , Buckleigh Drive , and Valleyfield Drive – Magnolia Village Subdivision – Wilders Township C Proclamation – American Business Women’s Day – September 22 , 2008 as follows AMERICAN BUSINESS WOMEN’S DAY PROCLAMATION WHEREAS , at the close of World War II , many women who had joined the workforce for the first time were reluctant to give up their new found careers and return to their homes They were striding down the professional path and they were exhilarated ; and WHEREAS , on September 22 , 1949 , a Kansas City businessman , Hilary A Bufton , Jr , recognized the positive impact women were having on the American economy and founded the American Business Women’s Association ; and WHEREAS , the American Business Women’s Association , a national support network for working women , has dedicated more than half a century to women’s professional development and has provided workplace skills and career development training for more than 600,000 women through more than 1000 ABWA chapters and networks nationally ; and WHEREAS , the Association established the American Business Women’s Day in 1983 ; andPage39 September 2 , 2008 – 10 00 am Continued WHEREAS , this day , the Association’s founding date , was recognized by a joint resolution passed by both houses of the US Congress and by a proclamation issued by President Ronald Reagan ; and WHEREAS , annually , on September 22 , the contributions and achievements of millions of employed women in the United States are recognized across the nation NOW THEREFORE , the Johnston County Board of Commissioners does hereby proclaim , September 22 , 2008 , as American Business Women’s Day in Johnston County , and urges all citizens to recognize the significance of working women and business owners and to actively support their programs and endeavors nd Adopted this 2 day of September 2008 D Proclamation – 2008 Fall Litter Sweep – September 20 through October 4 , 2008 PROCLAMATION FALL LITTER SWEEP 2008 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the fall 2008 LITTER SWEEP roadside cleanup will take place September 20 through October 4 , 2008 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will increase awareness of the need for cleaner roadsides , emphasize the importance of not littering , and encourage recycling of solid wastes ; and WHEREAS , the 2008 fall cleanup will celebrate the 20th Anniversary of the North Carolina Adopt - A - Highway program and its 6,000 volunteer groups that donate their labor and time year round to keep our roadsides clean ; and WHEREAS , the LITTER SWEEP cleanup will be a part of educating the children of this great State regarding the importance of a clean environment to the quality of life in Johnston County and North Carolina ; and NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS , does hereby proclaim September 20 through October 4 , 2008 as LITTER SWEEP time in Johnston County , and encourages all citizens to take an active role in making their communities cleaner nd Adopted this the 2 day of September , 2008 E Animal Cruelty Investigators Reappointment Request The Board reappointed Roger Davis and Chad Massengill as the two Animal Cruelty Investigators to serve Johnston County for one year terms F Department of Social Services – Work First Block Grant The Board concurred with the DSS Board for the County to remain a standard county for the Work First Block grant program for FY 2009 – 2011 nd G Selma Fire Department – 2 Vote on First Responder Franchise Request The Board approved by second vote the request from the Selma Fire Department to be franchised as a first responder unit H Call for Public Hearing – Proposed Amendment to Code of Ordinances – Section 10 – Emergency Services The Board scheduled a public hearing for the October 6 , 2008 10 00 am meeting to allow for public comment Over Paid Subsidy Policy Sandra Norris , HAPP Director , outlined a proposed revision to the Over Paid Subsidy Policy Ms Norris explained the policy pertains to a program participant not reporting all their household income in a timely manner Ms Norris noted currently , the policy only allows for one occurrence and the second time the participant has an overpaid subsidy , they are automatically terminated from the housing program Ms Norris stated the proposed revision would allow an additional step in order for the program participant to keep receiving assistance Commissioner Jeffrey P Carver inquired as to how many people HAPP is currently assisting Ms Norris reported the HAPP office currently has 619 vouchers and of those , only about 20 participants have overpaid subsidies In response to a question from Commissioner DeVan Barbour , Ms Norris stated the HAPP office has approximately 700 families on the waiting list Upon a motion by Commissioner Wade M Stewart , seconded by Public Hearing – 10 15 am – Economic Development Incentive Grant Advertised August 20 , 2008 – The Smithfield Herald The Chairman opened the public hearing and called on Economic Development Director Michael de Sherbinin to address the Board Mr de Sherbinin stated the purpose of the hearing is to consider an Economic Development Incentive Grant EDIG agreement between the County and Coates Asphalt Corporation located in the McGee’s Crossroads area of Johnston County Mr de Sherbinin introduced Michael and Daniel Coates of Coates Asphalt Corporation Mr de Sherbinin reported the existing company known as Coates Grading & Transport , currently employs 48 people and with the addition of the new asphalt plant , the company will be in a better position to compete with other grading and paving companies He noted that the Johnston County Incentive Committee unanimously supports the new investment opportunity by the company Mr de Sherbinin reported Coates expects to increase their total employment to 85 people with the addition of the new asphalt plant He stated Coates has a wage rate structure of 600 to 800 per week with benefits including paid life insurance , health insurance , dental insurance , sick leave , vacation time , retirement options , uniforms , company phones , etc Mr de Sherbinin informed the Board that the EDIG agreement as drafted has been revised so the grant would begin in year 2010 He explained that Coates would like to push the agreement back by one year to allow more time for securing permits and plant components , which is time consuming Mr de Sherbinin requested the Board to consider approving the EDIG agreement which would be based on an investment of 5,000,000 whereby the company will be required to pay their annual taxes and would then be granted 50 of the value of their ad valorem taxes from the County for a period of five consecutive years Page047 September 2 , 2008 – 10 00 am Continued Upon a question from Commissioner Jeffrey P Carver , Mr de Sherbinin confirmed that the grant would equal 50 of the value of the ad valorem taxes paid each year by the company for five years for the new asphalt plant investment only He noted the grant opportunity mirrors past EDIG agreements Mr de Sherbinin clarified that Coates Asphalt Corporation is a separate entity from the existing grading business Commissioner Allen L Mims , Jr stated it was his understanding that Coates owns the site where they propose to construct the asphalt plant and questioned Exhibit A of the EDIG agreement Commissioner Mims noted “ site acquisition ” is listed as one of the components eligible for reimbursement under the grant terms and expressed concern going forward for future projects over someone possibly using the funds for site acquisition on a speculative basis Mr de Sherbinin explained that the safeguard on the agreement is the requirement of the company to first pay their annual taxes and further , that the reimbursement reflects many other components of the project He further explained that if someone were to speculate on a piece of property , the safeguard for the County would be that other components would be involved in the overall investment such as the structure for the operation Commissioner Mims stated perhaps site acquisition should be considered further for future projects to avoid someone receiving reimbursements on property for speculative purposes , only to never develop the site Mr de Sherbinin stated he understood the concerns by Commissioner Mims ; however , he noted the agreements set out a performance that must be measured in addition to site acquisition for such projects Commissioner Wade M Stewart indicated he also understood the concerns of Commissioner Mims in that Coates could potentially receive reimbursement on a partially completed project without having realized the full completion of the plant and the creation of the indicated job opportunities Commissioner Stewart commented that the County could also see a benefit in reimbursement on a partially completed project in that the reimbursements for the partially completed years would be significantly less than a completed project Commissioner Stewart asked what type of performance period was in place to ensure that both the County and the company would receive the most benefit from the EDIG Mr de Sherbinin stated January 1 , 2009 would start the new tax year as far as the Coates project is concerned and although some site development work may begin , the actual plant , which is delivered and constructed in components , would begin in 2010 Mr de Sherbinin reported if Coates needed to revise the years in the agreement in order to take full advantage of the reimbursements , they would have to appear before the Board and request such There being no further comments , the Chairman closed the public hearing Decision - Economic Development Incentive Grant Commissioner W Ray Woodall moved the Board approve the Economic Development Incentive Grant Agreement between the County and Coates Asphalt Corporation Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote 8 Public Utilities – Hopewell - Pisgah Water District – Water Main Additions Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board recessed regular session to sit as the Hopewell - Pisgah Water District Tim Broome , PE , Director of Utilities & Engineering , informed the Board that in March 2008 , the County received a grant and loan from USDA - Rural Development as well as a matching grant from the North Carolina Rural Center in June 2008 for the installation of supplemental water mains in the district to alleviate low system pressure in the vicinity of NC Hwy 210 and Lassiter Road Mr Broome requested the Board adopt the project budget as well as establish a capital project budget ordinance for the project Mr Broome further requested the Board to adopt a minority business enterprise resolution , which is one of the conditions associated with the grant from the NC Rural Center Chairman Cookie Pope asked if the project would involve the extension of any water lines Mr Broome reported the project would involve paralleling existing water lines in an effort to raise water line pressures in certain areas near Broome stated staff is actively looking for additional funds to help extend water lines where possible At the inquiry of Chairman Pope , Mr Broome stated the homeowners in the project area would be and appointed Deborah Wall and Gladys Pilkington for one year initial terms to expire on September 30 , 2009 C Moccasin Creek Service District Board – Reappointed Gerald F Peedin , Jesse Ray Evans , and James D “ Pete ” Edwards for two year terms to expire on September 30 , 2010 All three individuals were granted waivers in the length of service policy D Juvenile Crime Prevention Council – Reappointed Addie M Harris Rawls for a two year term to expire on September 30 , 2010 10 Delinquent Tax Collection Report Tax Administrator Pat Goddard reported on the collection of delinquent taxes for the month of August 2008 She noted in addition to garnishments and bank attachments , 13 foreclosure complaints were filed and 67 demand letters were sent , resulting in a collection of 39,07164 As of August 29 , 2008 the Tax Department has collected 720 of the real and personal levy for 2008 , and 5275 of the motor vehicle levy Through the NC State Debt Setoff Program , 23 accounts have been paid for a total of 2,57001 as of August 29 , 2008 The next foreclosure sale is scheduled for September 25 , 2008 Ms Goddard noted the tax bills for 2008 were mailed on July 31 , 2008 and a total of 2,965 telephone calls were received in the ten days following the mailing 11 2011 Revaluation Project – Request for Proposals Tax Administrator Pat Goddard informed the Board that the Tax Office had received three proposals for the 2011 revaluation services Ms Goddard stated two options were requested for the project , one for a turnkey project and the other would allow County staff to jointly perform the work associated with the revaluation Ms Goddard noted both options requested separate pricing for street level images Ms Goddard reviewed the three proposals with the Board , as follows Option # 1 Option # 2 Firm Turnkey Joint – County Firm Assessment Solutions 1750 Parcel 1300 Parcel No exceptions to the proposal 1,662,500 Total 1,235,000 Total Page350 September 2 , 2008 – 10 00 am Continued Pearson Appraisal Services 2531 Parcel 1390 Parcel Exception to the proposal 2,404,450 1,320,500 New Construction 2500 Parcel Tyler Technologies CLT Division No proposal 1670 Parcel Exception to the proposal 1,594,850 New Construction 30 and 50 Parcel 193,000 Additional costs for Appeals Hearings 1,787,580 Total Ms Goddard reported staff recommended the selection of low bidder , Assessment Solutions for Option # 1 – Turnkey at 1750 per parcel Ms Goddard explained that staff preferred the turnkey proposal rather than the joint option due to concerns of labor and travel costs Ms Goddard stated for the County staff to conduct the same tasks , the cost would be very close to the difference in the options She noted as a point of reference , the price of the proposal from Assessment Solutions is a 944 increase from the last contract for revaluation services in 2003 Ms Goddard stated she has checked the references of Assessment Solutions and is still receiving calls back from some entities Ms Goddard noted the firm is located in the Cleveland community of Johnston County Commissioner Wade M Stewart inquired about the background and experience of Assessment Solutions Ms Goddard reported that although Assessment Solutions is a relatively new company , they do have experience and have performed revaluations in Bladen , Martin , Yancy , Franklin , and Lee Counties Ms Goddard stated she did contact those counties and received mixed reviews ; however , Ms Goddard indicated with a project such as a revaluation , she expected to receive mixed reviews She noted she received more good references Commissioner DeVan Barbour asked Ms Goddard if she would prefer to wait until she receives return calls from all the references she had contacted regarding Assessment Solutions Ms Goddard stated she would prefer for the Board to go ahead and authorize the County Manager to begin contract negotiations with Assessment Solutions for the turnkey option County Manager Rick Hester informed the Board that the County has budgeted approximately 1 million so far for the revaluation project and would continue to add to that over the next few fiscal years in order to fund the project Commissioner Allen L Mims , Jr moved the Board authorize the County Manager and the Tax Administrator to proceed with finalizing a contract with Assessment Solutions for a turnkey project at 1750 per parcel for the 2011 Revaluation Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote 12 Manager Reports and Comments A Call for Public Hearing – JCATS ROAP Grant County Manager Rick Hester reported that JCATS Transportation Manager , Lynn Birmingham , has been advised by the North Carolina Department of Transportation that the County will need to hold an additional public hearing regarding the JCATS ROAP Grant program Commissioner W Ray Woodall moved the Board schedule the public hearing for the October 6 , 2008 10 00 am meeting , seconded by Commissioner Tony Braswell , and carried by unanimous vote B Emergency Water Supply Agreement with the City of Raleigh Director of Utilities and Engineering , Tim Broome , informed the Board that the City of Raleigh would be taking action on a possible emergency water supply agreement with Johnston County through an interconnection on Hwy 70 If approved by the City of Raleigh , Mr Broome reported he would bring the agreement back to the Board for their review and approval in October The agreement would provide for a mutual emergency water supply to either the County or the City , if needed Page451 September 2 , 2008 – 10 00 am Continued th C Update on Land Use Plan Draft - Special Meeting on September 4 6 00 pm County Manager Rick Hester reported that staff did not receive a draft land use plan from Clarion th Associates for the Board to review in advance of the September 4 6 00 pm special meeting Mr Hester stated he would speak with Clarion Associates later in the day and would report back to the Board at the 6 00 pm th meeting on the need to possibly reschedule the special meeting on the 4 Note At the 6 00 pm meeting , the th County Manager submitted the draft documents to the Board and the meeting on September 4 at 6 00 pm went ahead as scheduled D Citizens Workshop – September 23 , 2008 – 6 00 pm County Manager Rick Hester informed the Board that the Citizens Workshop for the purposes of presenting the draft Johnston County Land Use Plan to the public has been scheduled for September 23 , 2008 at 6 00 pm at the Johnston County Agricultural Building E Request for Closed Session County Manager Rick Hester and County Attorney Mark Payne requested a closed session related to NCGS 14331811 a 5 – Land Acquisition and NCGS 14331811 a 3 Attorney Client Privilege – Rebecca M Jones and Citizens similarly situated v NC Dept of Health and Human Services ; North Carolina Division of Social Services ; Johnston County ; WA Holland , Jr and Jennifer O’Connor , individually and d b a Holland & O’Connor , LLC ; and Systems & Methods , Inc d b a North Carolina Centralized Collections 13 Board Reports and Comments A Establishment of Veterans Services Advisory Board Commissioner Wade M Stewart presented a draft resolution regarding the potential establishment of a Johnston County Veterans Services Advisory Board Commissioner Stewart indicated the need to have an advisory board appointed by the Commissioners , to work with the County Veterans Services Office on the needs of the veterans in Johnston County He noted such an advisory board could report to the Board of Commissioners from time to time on the issues facing the veterans Commissioner Tony Braswell noted he has heard some concerns by some members of the Johnston County Veterans Council on such an advisory board possibly infringing on their efforts Commissioner Braswell stated he has tried to assure the Veterans Council that it is not the intent of the Board of Commissioners to create an advisory board that would interfere with the efforts of the Veterans Council Commissioner Braswell asked Commissioner Woodall to comment further on the Veterans Council , since he is a former member Commissioner W Ray Woodall stated that he is still an inactive member of the Council and he felt the advisory board is needed to provide even more support to the veterans of the County Chairman Cookie Pope stated she felt the establishment of the advisory board is timely Chairman Pope indicated that she was recently made aware that veterans can now be served by local hospitals and suggested that the Board make sure Johnston Memorial Hospital is also aware of that fact Commissioner Stewart stated he felt the creation of the advisory board would not be a duplication of efforts with the Veterans Council , but rather an additional form of promotion for the veterans that would be appointed by the County Commissioners Commissioner Stewart indicated that veterans could bring their issues to the advisory board who would in turn report to the Board of Commissioners on such matters Commissioner Stewart explained the Board of Commissioners perhaps has more influence on the legislative delegation and could voice the concerns of the veterans , more effectively Commissioner Woodall commented that the creation of an advisory board would be positive for the County He noted that many of the younger veterans are not joining the posts across the County and the establishment of an advisory board may generate the interest of the younger veterans Commissioner Allen L Mims , Jr stated that when he first heard discussions regarding the creation of an advisory board that he felt perhaps it may be a duplication of efforts and that it may be more appropriate to appoint a Commissioner to attend the Veterans Council meetings to learn more about their group Page552 September 2 , 2008 – 10 00 am Continued Commissioner Mims stated he is not against the creation of the advisory board and the Commissioners could monitor the interest over time Commissioner Stewart stated he believed the creation of the advisory board would help to organize the concerns of veterans and moved the Board adopt the following resolution appointing the Johnston County Veterans Services Advisory Board Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote RESOLUTION TO APPOINT THE JOHNSTON COUNTY VETERANS SERVICES ADVISORY BOARD WHEREAS , under NCGS § 153A - 77 , the Johnston County Board of Commissioners has the statutory duty , as Governing Body of Johnston County , to appoint persons to various boards , commissions , committees , or authorities to assist in the operation of county government ; and WHEREAS , Johnston County has a local Veterans Services Office with a mission to do the following 1 Advise local veterans and their dependants on their legal rights and entitlements under various state and federal laws 2 Actively assist veterans in filling out necessary documents and forwarding same to the Service Office of the veterans ’ choice 3 Processing claims for veterans regarding disabilities compensation and pension , educational benefits , home loans , insurance , death and burial benefits , health care , state veterans benefits , etc 4 Provide offsite support for homebound veterans or veterans and dependants confined in assisted living facilities to ensure continuation of benefits 5 Support all local veterans ’ organizations as well as the Johnston County Veterans Council WHEREAS , the Johnston County Board of Commissioners has determined that it is reasonable and desirable to appoint a Veterans Services Advisory Board to assist the Johnston County Veterans Services Office in its efforts NOW THEREFORE , BE IT RESOLVED , that the Johnston County Board of Commissioners does hereby establish the Johnston County Veterans Services Advisory Board as follows 1 Effective Date and Duration This resolution shall be effective upon its adoption by the Board of Commissioners and shall continue in effect until revised or rescinded by the Board of Commissioners 2 Membership a The Board shall consist of seven members , one member being appointed from each of the seven Commissioner Districts of Johnston County b Each member shall have one vote c Four members shall constitute a quorum 3 Qualifications Each member of the Veterans Services Advisory Board shall be a veteran as well as a resident of Johnston County 4 Terms of Office The term of office for each member of the Veterans Services Advisory Board shall be three years , except for the initial appointment where three of the initial appointees shall be appointed for a term of two years in order to create staggered terms All other term requirements shall follow the policy of the Johnston County Board of Commissioners “ Resolution for Establishment of Policy and Procedures for Appointments to County Boards , Commissions , Committees , or Authorities ” 5 Duties The duties of the Veterans Services Advisory Board shall be to act in an advisory capacity to the Johnston County Veterans Services Office on the issues facing the veterans residing in Johnston County as well as make recommendations to the Johnston County Board of Commissioners on such issues , as requested by the Board of Commissioners 6 Meetings and Notice The Veterans Services Advisory Board shall meet quarterly and shall be subject to the Open Meetings Laws under NCGS Article 33C – Meetings of Public Bodies 7 Staff Assistance The Veterans Services Advisory Board shall call upon employees of the Johnston County Veterans Services Office or any other County employee for technical assistance in carrying out its duties and requirements The Veterans Services Advisory Board may call upon the County Attorney’s Office for advice and assistance as it relates to the Board’s responsibilities and duties ND RESOLVED THIS THE 2 DAY OF SEPTEMBER , 2008 14 Closed Session – NCGS 14331811 a 5 – Land Acquisition and NCGS 14331811 a 3 Attorney Client Privilege – Rebecca M Jones and Citizens similarly situated v NC Dept of Health and Human Services ;
