Officer , J Mark Payne , County Attorney , and Deva C Holt , Deputy Clerk Chairman Cookie Pope called the meeting to order at 10 00 am Commissioner DeVan Barbour led those in attendance in the pledge of allegiance to the American flag Commissioner W Ray Woodall opened the meeting with a prayer 1 Approval Discussion of Agenda Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – January 22 & 29 , 2008 Community Meetings ; and February 4 , 2008 10 00 am & 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Neuse River Parkway Collector Road , Fox Hunt Lane Collector Road , E Walker Woods Lane , W Walker Woods Lane , First Light Trail , Morning Chase Lane , and Evening Lane – Walker Woods Subdivision – Wilders Township Bragg Court , Helenjean Court , and Fort Boone Court – Northfort Subdivision - Sections 4 , 5 , and 6 – Wilders Township C Adoption of Resolution – NCACC - Celebrating 100 Years of County Unity as follows Joint Resolution Celebrating 100 Years of County Unity in Recognition of Our Association’s Centennial WHEREAS , the North Carolina Association of County Commissioners is an advocacy and service organization made up of all one - hundred 100 North Carolina counties ; and WHEREAS , the active participation and engagement of all 100 counties have directed , strengthened and enhanced our Association ; and WHEREAS , the dedication and talents of individual county commissioners and county staff have led our Association’s success in advocacy , county - centered services and educational programs ; and WHEREAS , an informal agreement to form our Association was made by a handful of county commissioners who , at the behest of Craven County Commissioner CE Foy , met in New Bern in 1908 , to discuss county issues of common interest ; and WHEREAS , the first session of our unofficial Association was held at the Atlantic Hotel in Morehead City on August 19 , 1908 , where CE Foy was elected as president ; and WHEREAS , the North Carolina General Assembly passed an act on March 8 , 1909 establishing our Association on behalf of counties ; NOW , THEREFORE BE IT RESOLVED , that the North Carolina Association of County Commissioners and each Board of County Commissioners jointly recognize and celebrate “ 100 Years of County Unity ” in tribute to our Association’s four telephone calls complimenting the services of the Tax Department 15 Public Hearing – 10 30 am – Proposed Amendment to Water Service Ordinance The Chairman opened the public hearing and stated the purpose of the hearing is to consider public comment on possible amendments to Section 24 , Article II of the Water Service Ordinance Tim Broome , Director of Utilities and Engineering , stated the proposed amendments would affect the Water Conservation Section of the Water Service Ordinance Mr Broome reported the amendments consisted of definition changes in order to better describe use classes , modifications to the various stages of water conservation , as well as changes for more stringent penalties He noted one of the more significant changes would require the Board of Commissioners to initiate mandatory water conservation orders rather than the County Manager ; however , under the proposed amendments , the County Manager would still have the authority to call for voluntary conservation measures under an alert stage Any mandatory water conservation orders for a system - wide crisis would be called by the Board of Commissioners , while the County Manager could institute short - term voluntary or involuntary water conservation orders due to water distribution crises in isolated areas , such as a water line break Commissioner W Ray Woodall asked Mr Broome for clarification regarding water conservation mandates from the Governor’s Office Mr Broome reported the County is presently following mandates as issued by the Governor’s Office for water conservation measures , which to date , have been on a requested basis by the Governor’s Office Commissioner Woodall stated the County needs to make sure citizens understand that the County is following mandates issued by the Governor Commissioner Wade M Stewart asked for more explanation regarding where the County would stand under the new amendments , if approved , related to the various stages of advisories , alerts , or emergencies Mr Broome reported under the proposed amendments , the County’s water system would currently be classified under the Class 3 Crisis stage Commissioner Jeffrey P Carver reminded everyone that as he reported in the Board’s recent work session , Triangle J Council of Governments COG will be drafting uniform water conservation measures in the hopes that each member County will adopt the same measures to allow for a more consistent policy throughout the COG Commissioner Carver stated he intends to bring the draft uniform measures to the Board for review and possibly adoption once they are completed Mr Broome indicated the Board could adopt the proposed amendments as presented or wait until the recommendations are received from Triangle J However , he stated if the Board chooses to adopt the proposed amendments as presented today , once the recommendations come in from Triangle J , the ordinance could be further amended at that time Commissioner Carver stated he is in favor of the more uniform ordinance ; however , he suggested the Board go ahead and adopt the amendments as presented and amend with Triangle J’s suggestions at a later date County Manager Rick Hester stated the new ordinance , if approved , would allow for more flexibility Commissioner Stewart stated it is critical that the citizens of Johnston County understand the language in the ordinance and any resulting restriction orders He expressed concern over possible confusion with what Johnston County is mandating versus the drought crisis measures that Wake County is currently undertaking Commissioner Stewart indicated he feels there is no clarity and asked if there is a way to simplify the ordinance so the citizens will understand exactly how critical the water supply situation is as well as exactly what types of activities can be done under any possible restrictions Commissioner Stewart noted he believes Johnston County should mandate water under no circumstances should citizens feel as though they are receiving misinformation Mr Hester indicated staff has clearly outlined exactly what types of activities are allowed as well as the looks ahead Commissioner Stewart noted he did not question the fact that water is a precious commodity ; however , he cautioned that the County should be listening more intently to counties east of Johnston such as Wayne County with regards to the river flow values Commissioner Stewart reiterated that the citizens must understand exactly where the County stands on the water supply There being no
