10 564 Meeting of the Johnston County Board of Commissioners February 4 , 2008 10 00 am The Johnston County Board of Commissioners met in regular session Monday , February 4 , 2008 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Cookie Pope , Chairman , Wade M Stewart , Vice Chairman , Allen L Mims , Jr , Jeffrey P Carver , DeVan Barbour and Tony Braswell Absent W Ray Woodall Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , John R Massey , Finance Officer , J Mark Payne , County Attorney , and Deva C Holt , Deputy Clerk Chairman Cookie Pope called the meeting to order at 10 00 am Chairman Pope recognized North Carolina House Representative James H Langdon , Jr in the audience Commissioner DeVan Barbour led those in attendance in the pledge of allegiance to the American flag At the request of the Chairman , Representative Langdon opened the meeting with a prayer 1 Comments by Representative James H Langdon , Jr Representative Langdon stated he appreciated the hard work by the Board of Commissioners for Johnston County He noted if there are any local bills the County would like to have introduced into the short session , to advise him Representative Langdon indicated that Johnston County has an outstanding record regarding funding for education projects and he acknowledged the transportation needs as well as the drought situation He informed the Board that Legislative Committees are currently being formed to review both transportation matters as well as possible bills to assist areas with water supply issues County Manager Rick Hester commented he appreciated Representative Langdon’s support with legislation for Public Utilities in 2007 2 Approval Discussion of Agenda Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the agenda as presented 3 Consent Agenda Items Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – January 7 , 2008 10 00 am & 6 00 pm B Tax Releases & Refunds – 12 16 07 - Personal Real Property 2,03545 Tax releases - Personal Real Property 1,76017 Motor Vehicle releases refunds 6,75098 Recommended by Tax Administrator Pat Goddard Approved by Finance Officer John R Massey 4 Public Comments None 5 Emergency Services – 2008 Allowable Medicare Rates Emergency Services Director Kim Robertson stated the Emergency Services Advisory Board met on January 15 , 2008 and discussed the new 2008 Medicare Allowable Rate for ambulance transport reimbursement Ms Robertson noted the 2007 Medicare Allowable Rate was 938 and the new 2008 rate is 963 per loaded mile The Emergency Services Advisory Board voted to request the Board of Commissioners to approve the increase of the Medicare Allowable Billing Rate for Johnston County to 963 per loaded mile PagePage pageNumber8571 February 4 , 2008 – 10 00 am Continued At the inquiry of Commissioner Wade M Stewart , Ms Robertson reported even if a person participates in the local rescue unit’s subscription program , the insurance company will still be billed for a transport The rate would apply to Medicare , Medicaid , as well as all other insurance companies In response to a question from Commissioner Allen L Mims , Jr , Ms Robertson confirmed the increase is needed due to the rising cost of fuel Commissioner Wade M Stewart moved the Board approve the increase to reflect the 2008 Medicare Allowable Rate of 963 per loaded mile Commissioner Tony Braswell seconded the motion , which carried by unanimous vote 6 Johnston County Airport Authority – Economic Incentive Proposal Airport Director Ray Blackmon addressed the Board and introduced Airport Authority Chairman John Bullock and Vice Chairman Dr Leonard Woodall Mr Blackmon stated the Airport Authority would like to offer an economic incentive program to attract new aircraft as well as maintain the current based aircraft in Johnston County The source of the incentive reimbursement is proposed to be fifty percent of the ad valorem taxes paid by the owner on the aircraft To qualify for the incentive program , the aircraft owner would have to purchase a minimum fuel capacity of 12,000 gallons per year , per aircraft The maximum period of eligibility for the incentive proposal would be five years Mr Blackmon reported once the aircraft owner submits an application for the incentive the Airport staff would then verify the fuel consumption while the Tax Department would confirm that the owner has paid the ad valorem taxes on the aircraft Once it is determined that the aircraft owner has met the required criteria , the County Finance Department would issue the reimbursement If approved , the Airport Authority requests to implement the program effective January 1 , 2009 with a 36 month trial period , at which time , a reassessment of the program would be conducted to determine the viability Mr Blackmon noted the Airport Authority feels this would be an excellent opportunity to bring additional revenue to the Airport in fuel sales and hangar rent , with the likely possibility that the aircraft owner may construct new hanger space Commissioner Jeffrey P Carver inquired if the Airport Authority had discussed marketing and recruitment with regards to the proposal , if approved Mr Blackmon reported the Authority would first seek out neighboring aircraft owners at Raleigh - Durham International Airport He stated with construction on the new Clayton Bypass nearing completion , access to the Johnston County Airport would be more convenient to those owners Commissioner Tony Braswell asked how the incentive proposal would affect existing hanger space at the Airport Mr Blackmon stated the Airport is completing construction on a new hanger that has the potential to house two or three larger aircraft It is the hopes of the Authority that the incentive proposal will attract aircraft owners who would construct new hangers at their own expense and enter into land leases with the Airport Commissioner Allen L Mims , Jr stated he had the opportunity recently to tour the Airport grounds and he was very pleased at some of the ongoing projects Commissioner Mims further stated everyone could be proud of the Johnston County Airport and he moved the Board approve the economic incentive proposal concept , as outlined by Mr Blackmon Commissioner Jeffrey P Carver stated the proposal offers no exposure to the County and he appreciated Mr Blackmon and the Airport Authority’s efforts Commissioner Carver seconded the motion , which carried by unanimous vote 7 Animal Services – Designation of “ Dog Warden ” County Attorney Mark Payne requested the Board to formally designate the Director of Animal Services as dog warden for Johnston County for the purposes of NCGS § 67 - 369 a and b1 , Ms Goddard informed the Board that the total amount of unpaid real estate taxes for 2007 is 4,168,90987 on 7,389 accounts as of January 31 , 2007 To satisfy the requirement of NCGS § 105 - 369 b1 , notices of unpaid delinquent taxes were sent via US mail to the owners of record as of January 8 , 2008 At the request of Ms Goddard , Commissioner Tony Braswell moved the Board authorize the Tax Department to advertise the liens for the delinquent 2007 tax bills Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote 16 Manager Reports and Comments A Revision to County Financial Policy Guidelines County Manager Rick Hester and County Finance Officer John Massey requested the Board to consider a revision to the County’s Financial Policy Guidelines Mr Hester reported the revision would allow the County’s available fund balance percentage calculation to mirror that of the Local Government Commission Mr Massey stated the original definition and interpretation in the County’s guidelines is somewhat more conservative than the Local Government Commission’s guidelines and has also caused some confusion in the past Mr Massey noted staff recommended the revision be adopted into the guidelines to avoid confusion by the bond rating agencies and the County’s financial advisors In response to a question from Commissioner Jeffrey P Carver , Mr Massey reported the proposed language has been taken directly from the Local Government Commission’s guidelines At the request of Commissioner Allen L Mims , Jr , Mr Massey outlined the differences in between the County’s current policy versus the proposed revision Mr Massey assured the Board that during the budget preparation period , he will also present the available fund balance percentage based on the more conservative calculation After further discussion , Commissioner Jeffrey P Carver moved the Board approve the following revision to the Johnston County Financial Policy Guidelines Commissioner DeVan Barbour seconded the motion which carried by unanimous vote RESERVE POLICIES 1 The County will calculate its “ Legally Available Fund Balance ” in accordance with Local Government Commission LGC guidelines and as outlined in The Local Government Budget and Fiscal Control Act Legally Available Fund Balance is calculated as Cash and Investments minus the sum of liabilities , encumbrances , and deferred revenues arising from cash receipts , as those figures stand at the close of the fiscal year next preceding the budget year 2 Legally Available Fund Balances at the close of each fiscal year should be at least 15 of the Total Annual Operating Budget of the County Page3576 February 4 , 2008 – 10 00 am Continued B Reminder – Board Work Session County Manager Rick Hester reminded everyone that the Board will be meeting on Friday , February 29 , 2008 at 8 30 am at Camp Mary Atkinson for a Board Work Session 17 Board Reports and Comments A Anti - Litter Campaign At the request of Commissioner Tony Braswell , the Chairman instructed the County Manager to coordinate a meeting with representatives from the NC Department of Transportation , the Johnston County Sheriff’s Department , the Johnston County Public Utilities Department , and the Johnston County Planning Department to discuss solutions for litter enforcement in the County B Possible Development of a Land Use Plan for Johnston County Commissioner Allen L Mims , Jr noted the recent community meetings regarding land use planning were completed and inquired if the Board could move forward with discussions regarding the possibility of developing a land use plan for Johnston County After discussion on this issue , the County Manager reported he would return to the Board with a suggested timetable once proposals have been received from interested consulting firms to assist the County with a land use plan It was noted the deadline for interested firms to submit proposals is February 25 , 2008 C Transportation Improvements Commissioner Tony Braswell noted the Department of Transportation’s recent decision to delay the widening of NC Hwy 42 East until 2015 and how this will adversely affect the area The Board discussed the Department of Transportation’s schedule and priorities related to transportation improvements projects in the County Commissioner Braswell reported the Transportation Advisory Committee would be meeting soon and he would continue to ask the DOT for additional support Chairman Cookie Pope asked Commissioner Wade M Stewart to provide assistance to Commissioner Braswell , if needed , as he continues to work with the DOT Representative James H Langdon , Jr , who was in attendance , indicated he would also be glad to take part in discussions regarding transportation issues for the County D Citizen Concern – Litter Complaint from Rental Property The Chairman recognized the Honorable Will Crocker , Clerk of Superior Court , who had entered the meeting accompanied by Louise Worley of 4517 Rains Crossroads Road , Princeton Ms Worley asked the Board if the County could assist her with requiring her former tenants to remove trash and debris they left behind on a rental property she owns near Rains Crossroads County Attorney Mark Payne outlined the process the County could initiate if the matter is determined to be a solid waste violation After further discussion , Commissioner Wade M Stewart instructed Mr Payne to contact Ms Worley after the meeting and assist her further 18 Closed Session – NCGS Sec 14331811 a 5 Acquisition of Property The Chairman announced the closed session has been postponed There being no further business , Commissioner Tony Braswell moved the Board adjourn Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote The meeting adjourned at 11 00 am ____________________________ Cookie Pope , Chairman Paula G Woodard , Clerk to the BoardPage
