Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman , Cookie Pope , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , J Chad McLamb , Finance Officer , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Wade M Stewart called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Tony Braswell led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – October 5 , 2009 10 00 am and 6 00 pm B Veterans Day Proclamation , as follows P R O C L A M A T I O N V E T E R A N S D A Y - 2009 WHEREAS , for decades America has paused on the 11th of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before the entire world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2009 , as “ Veterans ’ Day ” in Johnston County , and urge our citizens to commend its observance nd day of November , 2009 Proclaimed this the 2 C Keep Johnston County Beautiful with Canned Food Collections Proclamation , as follows Proclamation Keep Johnston County Beautiful , Inc Canned Food Drive Week December 3 - 9 , 2009 To combat food insecurity for Johnston County families Whereas , the volunteers with Keep Johnston County Beautiful , Inc are concerned with the issue of severe food insecurity for Johnston County families during the 2009 holiday season ; and Whereas , the local food ministries have had a 30 increase in food vouchers given out during 2009 ; and Whereas , the Johnston County Department of Social Services is averaging an increase of 100 new families per month requesting food stamps ; and Whereas , Keep Johnston County Beautiful , Inc is willing to provide assistance to these families in need ; andPage566 November 2 , 2009 – 10 00 am Continued Whereas , Keep Johnston County Beautiful , Inc will inaugurate its first canned food drive to be held in conjunction with its Sixth Annual Festival of Trees during the week of December 3 - 9 , 2009 The 2009 Festival of Trees theme is “ A Gift to the County ” where the canned food drive will alleviate hunger for Johnston County families during this holiday season The Festival of Trees annual attendance averages over 15,000 visitors throughout the week , therefore adequate food collection is anticipated There will be food collection bins sited at both the North and South entrances of the Johnston Medical Mall and the Keep Johnston County Beautiful “ Food Tree ” where citizens may donate their canned food items Now , Therefore , the Johnston County Board of Commissioners does hereby proclaim the week of December 3 - 9 , 2009 , as “ Keep Johnston County Beautiful with Canned Food Collections , ” to help combat food insecurity for Johnston Health Department Johnston County Health Director , Dr Marilyn Pearson , provided an update to the Board on a vaccine for the H1N1 Flu Dr Pearson reported the Health Department expects to continue to receive the vaccine for the H1N1 Flu on a weekly basis Dr Pearson also reported that the priority groups are still the focus of the vaccination effort ; however , the Health Department will be working diligently to ensure everyone is vaccinated She stated the Health Department continues to work with the appropriate agencies to ensure the safety of the citizens and will keep everyone updated as more information becomes available 4 Triangle Tomorrow – Resolution Endorsing Reality Check Guiding Principles for Quality Growth Pam Wall , Executive Director for Triangle Tomorrow , explained that the Triangle Tomorrow Reality Check Initiative was created to address the future growth that is anticipated for the region She stated the committee developed three guiding principles for quality growth to be focused on involving transit , vibrant centers , and sustained green space She noted they are in the implementation phase of the effort and feel it is important that the cities and counties in the region endorse the project Ms Wall requested the Board to consider adopting a resolution in support of the guiding principles and offered to answer any questions Commissioner Jeffrey P Carver commented that he participated in the Reality Check initiative in February 2009 along with the County Manager , the Smithfield - Selma Chamber of Commerce and other businesses , community colleges , etc He stated it was a good exercise in discussing not only regionalism but what the area will look like as we continue to grow Commissioner Carver stated the County should adopt the resolution and noted that the Triangle J Council of Governments has also endorsed the principles as well as played an instrumental part in the process He stated that going forward , the Board must consider what the County will look like in the future and take into account water resources , open spaces , transit , etc Commissioner Allen L Mims , Jr noted under the proposed guiding principles regarding transit and Public Hearings – 10 15 am - Bethany and Four Oaks Fire Depts – First Responder Franchises The Chairman simultaneously opened the public hearings for the Bethany and Four Oaks Fire Departments first responder franchise requests Kim Robertson , Director of Emergency Services , stated that both of the fire departments are requesting permission to offer first responder services and if approved , it would bring the total number of first responder units to 19 out of 24 fire departments Ms Robertson spoke on the importance of first responder units , noting they greatly assist the EMS agencies She reported the EMS Advisory Board has recommended the approval of the franchises Commissioner Allen L Mims , Jr asked if both departments would be prepared to offer services immediately after a second vote of approval is given Ms Robertson stated that Bethany Fire Department would be ready to offer the services in December and Four Oaks Fire Department could begin to respond to calls for assistance just after the first of the year She introduced Bethany Fire Chief Larry Vick Hodge and Four Oaks Fire Chief Berry Stanley Chairman Wade M Stewart expressed his appreciation to both Bethany and Four Oaks for taking on the endeavor of a first responder franchise Ms Robertson echoed comments by Chairman Stewart and stated that it would increase the amount of work for both departments in that their call volume would go up tremendously She noted on many occasions the first responder units arrive at calls for assistance before the EMS agencies and can provide life saving services Commissioner Tony Braswell reminded everyone that in the EMS Assessment completed two years ago , one of the main recommendations was for more fire departments to achieve first responder status He stated since that time , four departments have agreed to offer the service which greatly benefits the citizens in the County Commissioner Braswell expressed his appreciation to all the fire departments that offer the first responder units NOTE A second vote will be required at the December 7 , 2009 10 00 am meeting 6 Public Utilities – Bulk Wastewater Capacity Allocation Sale to Clayton Interlocal Agreement Tim Broome , PE , Director of Utilities and Engineering , explained that the Board of Commissioners authorized construction to proceed on the 2006 Wastewater Improvements Project in June 2008 The project involves installation of wastewater force mains from the NC Hwy 42 East area to the County’s interceptor system in Smithfield ; a wastewater interceptor , pump station , and force main to serve the Wilson’s Mills area ; and expansion of the Central Regional Wastewater Treatment Plant from 70 mgd to 95 mgd Mr Broome stated all elements were planned to meet residential and commercial growth over the next 10 years He noted that principal funding for the project is low interest State Revolving Loans in the total amount of 175 million Mr Broome informed the Board that most of the residential development the project was designed to serve has been put on hold due to the prevailing , unfortunate economic situation Further , a few residential projects or project phases have been permanently terminated He stated that wastewater capacity fees and commodity fee revenues projected for retirement of debt have been considerably diminished Page4578 November 2 , 2009 – 10 00 am Continued Mr Broome stated the Town of Clayton has a need for wastewater capacity He reported with the expansion of the Town’s ETJ which includes developable areas the County had planned to serve and the reduction in the near term wastewater service requests to the County , Town and County staff began discussions last winter on a possible wastewater capacity allocation sale of 500,000 gpd or less The Town expressed interest , provided the capacity could be purchased at terms equal to the SRF loans and provided annual payments could be made over the 20 year loan retirement period Mr Broome stated capacity sale revenue under the foregoing terms was evaluated through the financial model , and the results were positive The income from a capacity sale of 500,000 gpd significantly offsets the impact of deferred revenue from residential development Mr Broome stated staff proposes an interlocal agreement with the Town of Clayton which would cover the terms of the capacity allocation sale to the Town He noted the Town of Clayton has already approved the agreement At the inquiry of Commissioner Allen L Mims , Jr , Mr Broome confirmed that the SRF loan would remain in the County’s name and the County would ultimately be responsible for payment Commissioner Jeffrey P Carver stated while the loan would still be the responsibility of the County , the Town of Clayton would be under contract with the County for payment of the allocation Commissioner W Ray Woodall moved the Board approve the interlocal agreement with the Town of Clayton covering the terms of the capacity allocation sale to WASTEWATER AGREEMENT hereafter “ Agreement ” is entered into this the ____ day of November , 2009 , by and between JOHNSTON COUNTY , NORTH CAROLINA , a body corporate and politic and a political subdivision of the State of North Carolina hereafter the “ County ” , and the TOWN OF CLAYTON , NORTH CAROLINA , a body corporate and politic and a political subdivision of the State of North Carolina hereafter the “ Town ” collectively , the “ Parties ” ; WITNESSETH WHEREAS , the County owns and operates the Central Johnston County Regional Wastewater Treatment Facility the “ Facility ” which discharges into the Neuse River under NPDES permit no NC0030716 ; and WHEREAS , the County has obtained an Authorization from the North Carolina Department of Environment and Natural Resources , Division of Water Quality “ DWQ ” , to construct a 2500 million gallons per day “ mgd ” expansion of the Facility ; and new wastewater force mains from the Town’s utility service area to the Facility , and WHEREAS , the Town has need for and has requested an additional capacity allocation of 0500 mgd in the expanded Facility ; and WHEREAS , the County has agreed to provide the Town with an additional capacity allocation of 0500 mgd in the expanded Facility , subject to the terms and conditions of this Agreement NOW THEREFORE , in consideration of the foregoing agreement and mutual covenants and benefits contained herein , and for other good and valuable consideration , the receipt and sufficiency of which are hereby acknowledged , the Parties agree and covenant as follows 1 The County shall construct the expansion to its Central Regional Wastewater Treatment Facility and new wastewater force mains on an expeditious schedule 2 The County shall reserve for the exclusive use of the Town a wastewater treatment capacity allocation in the expanded Facility in the amount of 0500 mgd in addition to any wastewater treatment capacity allocated to the Town under any existing convey the 0500 mgd of wastewater referenced in Paragraph 2 of this Agreement from the Town’s utility service area to the Facility by diversion through the County’s Talecris wastewater pump station and new 16 ” and 20 ” diameter force mains 4 For consideration of the wastewater transmission and treatment capacity , the Town agrees to reimburse the County for the prorata share of the County’s annual debt service payments to the NC Department of Environment and Natural Resources – Division of Water Quality for the State Revolving Fund SRF loans Nos CS370560 - 09 and CS370560 - 10 The SRF Loans have annual percentage rates of 21 and terms of 20 years The Town’s aggregate prorata share of the annual payment shall be With flow equalization 169,500per year Without flow equalization 200,100 , per year 5 The first annual payment will be due on May 1 , 2010 6 In event the Town chooses to implement flow equalization , the Town shall fund all capital costs required to facilitate a constant flow rate from the Talecris wastewater pump station to the Facility As owner of the Talecris station , the County will handle design and construction of improvements 7 The County shall charge the Town a bulk rate for wastewater transmission and treatment under this Agreement which may be adjusted annually with 90 days prior written notice The current bulk rate isPage5579 November 2 , 2009
