Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman , Cookie Pope , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , J Mark Payne , County Attorney , J Chad McLamb , Finance Officer , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Wade M Stewart called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Jeffrey P Carver led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – September 8 , 2009 10 00 am and 6 00 pm ; and September 24 , 2009 Special Meeting B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Buckhaven Drive – Buckhaven Subdivision – Pleasant Grove Township C Resolution – National Farm City Week – November 20 - 26 , 2009 adopted as follows NATIONAL FARM - CITY WEEK RESOLUTION NOVEMBER 20 - 26 , 2009 WHEREAS , agriculture has always been a cornerstone of Johnston County’s way of life , we acknowledge dedicated farmers improve our well being by working to ensure a healthy and abundant agriculture supply To succeed in this important enterprise , our farmers rely on essential partnerships with non - rural communities to supply , sell and deliver finished products across the country and around the world During National Farm - City Week , we recognize the importance of this cooperative network to the success of the agriculture industry WHEREAS , farming was America’s first industry and continues today to provide us with many of the necessities of life such as food and clothing , as well as fuel for our energy needs Agriculture employs a substantial number of workers in Johnston County including farmers and ranchers , shippers , processors , marketers , retailers , truck drivers , and inspectors and others who annually contribute more than 38 billion in value - added income in Johnston County WHEREAS , we welcome new opportunities for trade , hard work and successful cooperation between farmers and city workers to continue to play a vital role in our country’s success and be a critical resource for countless people here and around the nation WHEREAS , Farm - City collaborations help maintain and improve our nation’s food and fiber supply and contribute to a better quality of life for countless citizens We commend the many Johnstonians whose hard work and ingenuity reflect the true spirit of America and help to ensure a Social Services 4 Public Comments A Update on the H1N1 Flu Vaccine – Health Department Johnston County Health Director , Dr Marilyn Pearson , provided an update to the Board on a vaccine for the H1N1 Flu Dr Pearson reported the Health Department expects a vaccine for the H1N1 Flu to be available by mid - October for target groups initially Dr Pearson also reported that the regular seasonal flu vaccine is now available and she urged everyone to get the vaccine as soon as possible Dr Pearson stated the Health Department will continue to keep everyone updated as more information is released 5 Animal Services – Proposal for Adding Rescue Pull Fees Ernie Wilkinson , Director for Animal Services , requested the Board to consider adding “ rescue pull ” fees to the Animal Services fee schedule Mr Wilkinson explained the rescue pull fee is proposed to be set at 1000 per animal pulled from the County Animal Services Shelter to registered rescue groups He stated the fee would cover costs associated with rabies shots when applicable , light medication when needed as well as transportation costs to and from NCSU for alteration services alteration services by NCSU are provided at no cost to the County Mr Wilkinson noted that most of the animal shelters in surrounding counties have the fee and due to the tight economy , it would allow the Animal Services Department to maintain their current level of services Commissioner Allen L Mims , Jr noted that some of the surrounding animal shelter rescue pull fees are more than what Johnston County is proposing Mr Wilkinson agreed with Commissioner Mims that some of the surrounding fees are higher ; however , he stated that the Animal Services Department works hard with the rescue groups to find homes for the animals and the fee is proposed at 1000 to basically recover costs Commissioner Tony Braswell asked how many animals on average is the Animal Services Department handling Mr Wilkinson reported that five years ago , the Animal Services Department was receiving approximately 2,100 animals on an annual basis ; however , this year they expect to receive in excess of 12,000 He stated the increase is largely due to the current economic situation with many animal owners being unable to afford care for their pets Commissioner Tony Braswell moved the Board approve for the Animal Services Department to add a rescue pull fee to their fee schedule set at 1000 per animal pulled from the County Animal Services Shelter to registered rescue groups Commissioner W Ray Woodall seconded the motion Commissioner Allen L Mims , vote 6 Johnston County Job Training – ARRA Grant Funds Opportunity Ramell Oakley , Assistant Director for Johnston County Job Training , informed the Board that the Job Training Office has a chance to apply for up to 336,250 in American Recovery and Reinvestment Act ARRA grant funds to provide training opportunities for adults and dislocated workers in Johnston County who have been adversely affected by the recession Ms Oakley noted the grant would be federally funded and would not require matching funds from the County Ms Oakley reviewed with the Board the following programs that could be funded with the grant monies Classroom Training Eligible adults and dislocated workers who will benefit from short - term , occupational skills training programs , or courses of study , may be enrolled in an ARRA - funded program at the community college , or at other approved local training providers ARRA funding will cover classroom training costs for registration , tuition , textbooks , instructional materials , required fees , and required supplies Duration of the classroom training must be 6 months or less Occupational skills classroom training funded under ARRA must be directly linked to employment opportunities in the local area or the region The training will include programs such as the Allied Health Technician Certificate , Office Systems Technology , Medical Healthcare Occupational Certificate , Certified Nursing Assistant , Plumbing and HVAC , and Customer Service and Hospitality Occupations On - the - Job Training OJT On - the - Job Training is designed to provide occupational professional skills and job - specific knowledge that is essential to the full and adequate performance of a job A regular not temporary job opening should exist where the OJT customer can be retained in a full - time unsubsidized job upon successful completion of the subsidized training Under an OJT contract , the employer may be reimbursed for up to 50 of the base wage rate of the OJT trainee for the “ extraordinary costs of providing the training and the additional supervision related to the training ” Minimum hourly rate for OJT positions is 1400 per hour Adult Work Experience Work experience is a planned , structured learning experience that takes place in a workplace for a limited period of time Work experience may be paid or unpaid Work experience may be in the private for profit , non - profit , or public sector Work experience services are designed to promote the development of good work habits and basic work skills for individuals who have never worked , those who have very limited work history , and individuals who have been out of the labor force for an extended period of time Ms Oakley requested the Board’s support to apply for the grant funding and offered to answer any questions Commissioners Cookie Pope and W Ray Woodall inquired as to how Job Training obtains applicants for the various programs offered Ms Oakley reported Job Training works with the Employment Security Commission as well as advertising on their website along with serving walk - in clients She noted recruitment has been underway since the middle of September Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board voted to support the Johnston County Job Training staff applying for the grant funding available through the American Recovery and Reinvestment Act of 2009 in the amount of 336,250 with no matching funds required 7 Johnston County Airport Authority – Loan Proposal for Grant Funds Match Ray Blackmon , Director of the Johnston County Airport , reported that the Airport Authority has been involved in a project mandated and partially funded by the FAA since 2004 to construct an Emergency RunwayPagePage pageNumber9547 October 5 , 2009 – 10 00 am Continued Safety Area extending 1,000 feet from the departure end of Runway 03 toward Highway 70 He stated the project has been delayed several times due to environmental issues , but now it appears that progress is being made The total cost of the project is estimated at 66 million and the local match is 10 660,000 , of which 111,000 has been paid , leaving a balance of 549,000 for the County Mr Blackmon stated the Airport Authority is proposing to loan the matching requirement to the County , with interest rate and loan life to be determined , in order to move the project ahead to completion He requested the Board to consider the approval of the loan proposal in order to move forward with the project Chairman Wade M Stewart stated he believed that partial funds for the match were available in previous County budgets ; however , due to the uncertain timeframe of the project and the current economic situation , those funds were not included in the FY 09 - 10 budget County Manager Rick Hester confirmed Chairman Stewart’s comments and stated that staff was notified in August , after the adoption of the FY 09 - 10 budget , that the project would be moving forward Commissioner Allen L Mims , Jr asked when the Airport Authority would begin construction on the project and if Mr Blackmon had any ideas related to the current construction bid climate for such projects Mr Blackmon stated if the permits can be secured by January or February of 2010 , then construction could perhaps begin in late spring or early summer of 2010 Mr Blackmon noted that he is getting feedback from other airports across the state that similar projects are coming in as much as 30 under the original construction estimates At the inquiry of Commissioner W Ray Woodall , Mr Blackmon reported the project is a federally mandated safety project and if the emergency runway area is not constructed , eventually the area would be taken from the existing runway He noted if the existing runway is shortened , then it may require some of the larger aircraft to relocate to other airports with a larger runway Commissioner Tony Braswell congratulated Mr Blackmon on a successful recent open house Commissioner Braswell noted that he saw the Wake Medical Center helicopter fueling up at the Airport during the open house Mr Blackmon stated that the Airport sells fuel to the Wake Medical Center helicopter as well as Duke Life Flight Chairman Stewart noted that the Airport Authority is asking the Board to approve the proposal concept with the loan terms to be worked out and brought back to the Board of Commissioners Mr Hester stated if the Board approves the proposal , he would recommend the motion stating an approval for a 10 match for the cost of the specific Emergency Runway Safety Area project Motion Commissioner Cookie Pope moved the Board approve the loan proposal for the Johnston County Airport Authority to loan the County matching funds up to 10 of the cost of the Emergency Runway Safety Area project , with loan terms to be decided upon and approved at a later date , in order for the Authority to move forward with the construction of the Emergency Runway Safety Area project , as mandated by the FAA , if and when the funds are needed for the project to begin construction Second to Motion and Further Discussion Commissioner Allen L Mims , Jr seconded the motion and stated that the Airport Authority may not need the funds until the next budget cycle He also indicated that the project may come in under budget therefore ; the exact amount of the 10 match would not be known until the project has gone out for bid County Manager Rick Hester agreed with Commissioner Mims and reminded the Board that the project has been delayed in the past and could be delayed again until the next budget year Chairman Wade M Stewart commented that the motion contained representatives from C3 Church , requested the Board to consider granting an extension to complete the required lane widening project on SR 1010 – Cleveland School Road until June 1 , 2010 The lane widening was included as part of the requirements by the Department of Transportation in the special use conditions for the special use permit granted to C3 in November 2007 for the use of their coffee shop and book store Reid Stephenson stated the request for the extension is due to the paving season for 2009 nearing completion as well as the Church needs more time to obtain the funds required for the project Mr Stephenson stated C3 Church is prepared to submit a letter of credit or a performance bond in the amount of the project 192,05750 to the County , if the extension is granted At the inquiry of Commissioner Allen L Mims , Jr , Reid Stephenson stated the letter of credit or performance bond would be submitted to the County by the end of October 2009 Commissioner Jeffrey P Carver asked how long the issue regarding the lane widening project has been going on Planning Director Berry Gray stated the special use permit was approved in late 2007 and staff sent the first notice regarding the need to complete the lane widening improvements project to C3 Church in December of 2008 with subsequent letters sent in the spring and summer of 2009 He stated the specific condition on the special use permit for the traffic improvements project was that the project “ must meet all improvement requirements of the Department of Transportation ” Commissioner Carver commented that it has been almost a year that the Church has not been in compliance and staff has sent several letters Commissioner Cookie Pope stated it is her understanding that the Department of Transportation may have a project in the area that could fit within the timeline that C3 Church is requesting and could possibly assist with the improvements Mr Gray reported that DOT District Engineer Tim Little has since reported no projects are scheduled in the area that would coincide with the C3 Church lane widening project Chairman Wade M Stewart asked if the Church intended to submit a letter of credit or a performance bond He noted that the County needs to be able to present some assurance to the citizens in the area that the project will be completed Reid Stephenson stated as he understands , either a letter of credit or a performance bond would be acceptable Chairman Stewart stated that County Attorney Mark Payne has advised a letter of credit would be acceptable Commissioner W Ray Woodall stated that in C3 ’ s defense , area churches have gone through the same situation as other organizations with the downturn in the economy and he believed that they are requesting the extension in good faith and the Board should honor the request County Attorney Mark Payne explained that either a performance bond or a letter of credit is satisfactory ; however , he stated a letter of credit may be easier to work with Commissioner Mims asked how a letter of credit could be issued when the Church has indicated they currently do not have the funds available to letter of credit Page5553 October 5 , 2009 – 10 00 am Continued Commissioner Mims noted that the requirement for the lane widening project has been in place since 2007 and he has had many complaints from citizens regarding the traffic congestion in the area , not necessarily from the book store coffee shop traffic , but the church traffic in general He stated C3 is a large church , which is a good thing , but the Board must consider the lack of turn lanes and the impact on the area Commissioner Mims reminded the Church representatives that they agreed to the special use permit conditions at the time of approval in 2007 and it was made clear at the time that if the conditions were not met , the permit could be revoked Commissioner Mims agreed with Commissioner Woodall that times are tight ; however , the Church has built a large facility and he believed that public safety is just as important as the facility itself Commissioner Mims expressed concern with a letter of credit and stated he would prefer a performance bond At the inquiry of Commissioner Tony Braswell , C3 Executive Minister Ken Stephenson , stated the Church asked for the special use permit in 2007 in order to have the coffee shop and book store and he acknowledged that the turn lanes were a part of that permit Mr Stephenson agreed that C3 is a large church ; however , they did not foresee the downturn in the economy and the funds were not available to do everything at the time He stated that the Church is going to take the next six months and focus their efforts on raising the funds in order to complete the lane widening project Mr Stephenson stated the turn lanes were a part of the book store and coffee shop and if the permit is revoked for those uses , then Church services will continue He noted that they hope to raise the funds for the turn lanes which are desperately needed Commissioner Carver stated he is not sure if there is a big difference in a letter of credit versus a performance bond , as far as the County is concerned He noted that through a performance bond , the insurance company would figure out a way to complete the project ; whereas , the bank would issue a check in favor of the County and the County would be responsible for completing the project Commissioner DeVan Barbour agreed that with a performance bond , the insurance company would complete the project and then file a lawsuit against the Church to collect the funds Commissioner Braswell commented that he has also heard the complaints from the citizens in the area regarding the traffic issues ; however , he stated that he believes the Church representatives are acting on good faith that the project will be completed Commissioner Carver stated he has also received many calls from citizens complaining about the traffic congestion on Sundays ; however , if the County has a letter of credit in place to make the project happen , then he can give some assurance to the citizens and vote to approve the extension Commissioner Cookie Pope moved the Board grant the extension to C3 Church until June 1 , 2010 and accept a letter of credit in the amount of 192,05750 for the lane widening Manager requested a closed session pursuant to NCGS § 143 - 31811 a 4 Location Expansion of Industry B Orange County Solid Waste Management Request for Expressions of Interest County Manager Rick Hester reported he had received a Request for Expressions of Interest to Provide Municipal Solid Waste Disposal Services for Orange County The request would involve Johnston County providing landfill disposal services for municipal solid waste from Orange County Following brief discussion , it was the consensus of the Board not to offer a proposal for services to Orange County Page6554 October 5 , 2009 – 10 00 am Continued 13 Board Reports and Comments A New Regulations Regarding Landfill Items Commissioner Cookie Pope reported that she has been receiving calls from concerned citizens regarding the new regulations for items banned from the Landfill , specifically , plastic bottles and how private solid waste companies would be handling the new laws The Board briefly discussed the new regulations with the County’s Director of Utilities and Engineering , Tim Broome , PE B Teen Driving Safety Initiatives Chairman Wade M Stewart informed everyone that the Board is still in pursuit of ideas and initiatives to curb teen driving accidents He noted that he does not want the Board to lose sight of the effort 14 Closed Session - NCGS § 143 - 31811 a 4 – Location Expansion of Industry Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board recessed regular session to sit in closed session in accordance with NCGS
