10 513 Meeting of the Johnston County Board of Commissioners September 8 , 2009 10 00 am The Johnston County Board of Commissioners met in regular session Tuesday , September 8 , 2009 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman , Cookie Pope , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , J Mark Payne , County Attorney , J Chad McLamb , Finance Officer , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Wade M Stewart called the meeting to order at 10 00 am and the following business was transacted 1 Approval Discussion of Agenda Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Commissioner Allen L Mims , Jr questioned the consent agenda item regarding the proposed Code of Ethics He stated that he does not object to adopting the code for the Board of Commissioners ; however , he noted it is a requirement placed on local governing boards by the General Assembly and he asked if the State legislators are also required to adopt a code of ethics County Attorney Mark Payne reported the newly passed legislation requiring all local governing boards to adopt a Code of Ethics is an expansion of the ethics law that the General Assembly put into place approximately two sessions ago , which created the Ethics Commission and also requires the General Assembly to undergo ethics training Commissioner Cookie Pope agreed with the comments by Commissioner Mims and noted she has also had to undergo ethics training as a trustee at Johnston Community College Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – August 3 , 2009 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Brahma Drive – The Meadows of Southfort Plantation – Section II , The Bluffs of Southfort Plantation - Phase I – Cleveland Township Oak Ridge Drive and Clifton Drive – Oak Ridge Subdivision – Pleasant Grove Township C Proclamation – American Business Women’s Day – September 22 , 2009 adopted as follows AMERICAN BUSINESS WOMEN’S DAY PROCLAMATION WHEREAS , at the close of World War II , many women who had joined the workforce for the first time were reluctant to give up their new found careers and return to their homes They were striding down the professional path and they were exhilarated ; andPage514 September 8 , 2009 – 10 00 am Continued WHEREAS , on September 22 , 1949 , a Kansas City businessman , Hilary A Bufton , Jr , recognized the positive impact women were having on the American economy and founded the American Business Women’s Association ; and WHEREAS , the American Business Women’s Association , a national support network for working women , has dedicated more than half a century to women’s professional development and has provided workplace skills and career development training for more than 600,000 women through more than 1000 ABWA chapters and networks nationally ; and WHEREAS , the Association established the American Business Women’s Day in 1983 ; and WHEREAS , this day , the Association’s founding date , was recognized by a joint resolution passed by both houses of the US Congress and by a proclamation issued by President Ronald Reagan ; and WHEREAS , annually , on September 22 , the contributions and achievements of millions of employed women in the United States are recognized across the nation NOW THEREFORE , the Johnston County Board of Commissioners does hereby proclaim , September 22 , 2009 , as American Business Women’s Day in Johnston County , and urges all citizens to recognize the significance of working women and business owners and to actively support their programs and endeavors th Adopted this 8 day of September 2009 D Proclamation – 2009 Fall Litter Sweep – September 19 through October 3 , 2009 adopted as follows PROCLAMATION FALL LITTER SWEEP 2009 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the fall 2009 LITTER SWEEP roadside cleanup will take place September 19 through October 3 , 2009 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will increase awareness of the need for cleaner roadsides , emphasize the importance of not littering , and encourage recycling of solid wastes ; and st WHEREAS , the 2009 fall LITTER SWEEP will celebrate the 21 Anniversary of the North Carolina Adopt - A - Highway program and its 5,750 volunteer groups that donate their labor and time year round to keep our roadsides clean ; and WHEREAS , the LITTER SWEEP cleanup will be a part of educating the children of this great State regarding the importance of a clean environment to the quality of life in Johnston County and North Carolina ; and NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS , does hereby proclaim September 19 through October 3 , 2009 as LITTER SWEEP time in Johnston County , and encourages all citizens to take an active role in making their communities cleaner th Adopted this the 8 day of September , 2009 E Animal Cruelty Investigators Reappointment Request The Board reappointed Roger Davis and Chad Massengill as the two Animal Cruelty Investigators to serve Johnston County for one year terms F Code of Ethics for Johnston County Board of Commissioners adopted as follows Code of Ethics for the Johnston County Board of Commissioners Preamble The purpose of this code is to establish guidelines for ethical standards of conduct for the Johnston County Commissioners It should not be considered a substitute for the law or a county commissioner’s best judgment Johnston County Commissioners shall act in a manner to maintain their integrity and independence , yet must be responsive to the interests and needs of those they represent Johnston County Commissioners serve in an important advocacy capacity in meeting the needs of their citizens and recognizes the legitimacy of this role as well as the intrinsic importance of this function to the proper functioning of representative government At the same time , Johnston County Commissioners must , at times , act in an adjudicatory or administrative capacity and must , when doing so , act in a fair and impartial manner Johnston County Commissioners shall distinguish these roles and when each role is appropriate and they must act accordingly Johnston County Commissioners are aware of their obligation to conform their behavior to standards of ethical conduct that warrant the trust of their constituents Each Johnston County Commissioner must find within his or her own conscience the touchstone on which to determine appropriate conduct Page515 September 8 , 2009 – 10 00 am Continued Section One Johnston County Commissioners Shall Obey the Law Johnston County Commissioners shall support the Constitution of the United States , the Constitution of North Carolina and the laws enacted by the Congress of the United States and the General Assembly pursuant thereto Section Two Johnston County Commissioners Should Uphold the Integrity and Independence of His or Her Office Johnston County Commissioners should demonstrate the highest standards of personal integrity , truthfulness , honesty and fortitude in all their public activities in order to inspire public confidence and trust in county government Johnston County Commissioners should participate in establishing , maintaining , and enforcing , and should themselves observe , high standards of conduct so that the integrity and independence of their office may be preserved The provisions of this Code should be construed and applied to further these objectives Section Three Johnston County Commissioners Should Avoid Impropriety and the Appearance of Impropriety in All His or Her Activities A It is essential that county government attract those citizens best qualified and willing to serve Johnston County Commissioners have legitimate interests — economic , professional and vocational — of a private nature Johnston County Commissioners should not be denied , and should not deny to other Commissioners or citizens , the opportunity to acquire , retain and pursue private interests , economic or otherwise , except when conflicts with their responsibility to the public cannot be avoided Johnston County Commissioners must exercise their best judgment to determine when this is the case B Johnston County Commissioners should respect and comply with the law and should conduct themselves at all times in a manner that promotes public confidence in the integrity of the office of county commissioner and of county government C Johnston County Commissioners should not allow family , social , or other relationships to unduly influence their conduct or judgment and should not lend the prestige of the office of county commissioner to advance the private interests of others ; nor should they convey or permit others to convey the impression that they are in a special position to influence them Section Four Johnston County Commissioners Should Perform the Duties of the Office Diligently Johnston County Commissioners should , while performing the duties of the office as prescribed by law , give precedence to these duties over other activities In the performance of these duties , the following standards should apply A Legislative Responsibilities 1 Johnston County Commissioners should actively pursue policy goals they believe to be in the best interests of their constituents within the parameters of orderly decision - making , rules of the Board of County Commissioners and open government 2 Johnston County Commissioners should respect the legitimacy of the goals and interests of other Commissioners and should respect the rights of others to pursue goals and policies different from their own B Adjudicative Responsibilities 1 Johnston County Commissioners should be faithful to the general and local laws pertaining to the office and strive for professional competence in them They should be unswayed by partisan interests , public clamor , or fear of criticism 2 Johnston County Commissioners should demand and contribute to the maintenance of order and decorum in proceedings before the Board of County Commissioners 3 Johnston County Commissioners should be honest , patient , dignified and courteous to those with whom they deal in their official capacity , and should require similar conduct of their staff and others subject to their direction and control 4 Johnston County Commissioners should accord to every person who is legally interested in a proceeding before the commission full right to be heard according to law 5 Johnston County Commissioners should dispose promptly of the business of the county for which they are responsible C Administrative Responsibilities 1 Johnston County Commissioners should clearly distinguish legislative , adjudicatory and administrative responsibilities and should refrain from inappropriate interference in the impartial administration of county affairs by county employees Commissioners should diligently discharge those administrative responsibilities that are appropriate , should maintain professional competence in the administration of these duties and should facilitate the diligent discharge of the administrative responsibilities of fellow commissioners and other county officials 2 Johnston County Commissioners should conserve the resources of the county in their charge They should employ county equipment , property , funds and personnel only in legally permissible pursuits and in a manner that exemplifies excellent stewardship 3 Johnston County Commissioners should require county employees subject to their direction and control to observe the standards of fidelity and diligence that apply to Commissioners as well as those appropriate for employees 4 Johnston County Commissioners should take or initiate appropriate disciplinary measures against a county employee for improper conduct of which the Commissioner may become aware 5 Johnston County Commissioners should not employ or recommend the appointment of unnecessaryPage516 September 8 , 2009 – 10 00 am Continued employees and should exercise the power of employment only on the basis of merit , avoid favoritism and refrain from illegal discrimination and nepotism They should not approve compensation of employees beyond the fair value of services rendered Section Five Johnston County Commissioners Should Conduct the Affairs of the Board in an Open and Public Manner Johnston County Commissioners should be aware of the letter and intent of the State’s Open Meetings Law , should conduct the affairs of the Board of County Commissioners consistent with the letter and spirit of that law and consistent with the need to inspire and maintain public confidence in the integrity and fairness of county government and the office of county commissioner Consistent with this goal of preserving public trust , Commissioners should be aware of the need for discretion in deliberations when the lack of discretion would pose a threat to the resources of the county , to the reputation of current or potential county employees , to orderly and responsible decision making , to the integrity of other governmental processes or to other legitimate interests of the county Section Six Johnston County Commissioners Should Regulate His or Her Extra - Governmental Activities to Minimize the Risk of Conflict with His or Her Official Duties A Johnston County Commissioners should inform themselves concerning campaign finance , conflict of interest and other appropriate state and federal laws and should scrupulously comply with the provisions of such laws B Johnston County Commissioners should refrain from financial and business dealings that tend to reflect adversely on the Board or on county government or to interfere with the proper performance of official duties C Johnston County Commissioners should manage their personal financial interests to minimize the number of cases in which they must abstain from voting on matters coming before the Board D Information acquired by Commissioners in their official capacity should not be used or disclosed in financial dealings or for any other purpose not related to official duties Section Seven Johnston County Commissioners Should Refrain from Political Activity Inappropriate to His or Her Office A Johnston County Commissioners have a civic responsibility to support good government by every available means , to continue to inform and educate the citizenry about the affairs and processes of county government , and to make themselves available to citizens of the county so that they may ascertain and respond to the needs of the community In doing so , Commissioners may and should join or affiliate with civic organizations whether partisan or non - partisan , may and should attend political meetings , may and should advocate and support the principles or policies of civic or political organizations consistent with the Constitution and laws of the United States and North Carolina B Candidates for the office of county commissioner , including incumbents 1 Should inform themselves concerning the laws of this state with regard to campaigns and relevant disclosure requirements and should scrupulously comply with the provisions of such laws ; 2 Should maintain the dignity appropriate to the office , and should encourage members of their families to adhere to the same standards of political conduct that apply to Commissioners ; 3 Should not make pledges or promises of conduct in office that they will not or cannot perform or would be illegal if it were performed ; 4 Should not misrepresent their identity , qualifications , present position , or other fact ; and 5 Should avoid Department Johnston County Health Director , Dr Marilyn Pearson , provided an update to the Board on a vaccine for the H1N1 Flu Dr Pearson reported the Health Department expects a vaccine for the H1N1 Flu to be available by mid - October for target groups initially , with other official recommendations on the vaccine to follow She also reminded everyone to get their annual regular seasonal flu vaccine which is now available as well as to stay at home when sick Dr Pearson stated the Health Department will continue to keep everyone updated as more information is released 4 Triangle Land Conservancy – Buffalo Ridge Farm Conservation Easement Partnership The Chairman accepted a request from Commissioner W Ray Woodall to abstain from the TLC request , and the Board agreed by consent Jon Scott , Conservation Project Manager with the Triangle Land Conservancy TLC , recalled that last month , TLC requested to partner with Johnston County’s Stormwater Department to protect approximately 140 acres of land along Buffalo Creek near Selma Joe and Frances Moore have offered to donate a permanent conservation easement over their property and the Moores would like to complete the project by the end of 2009 TLC would facilitate the acquisition of the conservation easement , hold the conservation easement , and be responsible for annual stewardship , including monitoring and enforcement Mr Water Quality Protection Criteria WQPC The Water Quality Protection Criteria are as follows 1 In the Environmentally Sensitive Area , land considered meeting the WQPC may not contain any of the following environmentally sensitive areas jurisdictional wetlands , the 100 - year floodplain as shown on the most recent FIRM’s and the 100 - ft riparian buffers for Swift Creek , White Oak Creek , Little Creek , and Little River from the county line to NC Highway 39 2 For areas outside the Environmentally Sensitive Area , land considered meeting the WQPC may include areas within the 100 - year floodplain but may not include any of the 50 - foot Riparian Buffer area , or jurisdictional wetlands 3 The minimum length of property line along wetlands , riparian buffers , floodplains , or streams must be 100 ’ per acre for property to be included in the Land Dedication Program ; the minimum length applies to land both inside and outside of the ESA 4 The chosen land must be located within the same watershed as the development The watersheds are Little River Black Creek Buffalo Creek Mingo Swamp Neuse River Stone Creek Swift Creek Hannah Creek Middle Creek Moccasin Creek Mill Creek A map of these watersheds is available in the Public Utilities Office and is on the County GIS system The Stormwater Administrator will evaluate each watershed every 3 years for total imperviousness and for stream river condition 2306 County Policy The County or other party such as the Triangle Land Conservancy will identify potential tracts of land for setting aside as perpetually undeveloped land in the Land Dedication Program Each tract or corridor of land must meet all of the following criteria 1 The tract must be placed into a perpetual conservation easement that will not allow Subject to the County Zoning ordinance 5 The tract of land cannot be counted or used for Total nitrogen export calculations or attenuation calculations 6 Forestland shall be maintained in accordance with a Forest Management Plan as outlined by the NC Division of Forest Resources 7 Land that is not actively farmed prior to acceptance in the Land Dedication Program must be maintained in a natural vegetative state Dedicated land can be selectively timbered and replanted as forestland However , no clear cutting will be allowed and timbering and replanting must be done consistent with all forestry water quality BMPs as outlined by the NC Div of Forest Resources The land cannot be farmed and must be maintained in a natural vegetative state Funds from land dedication payments shall be used only for purchase of environmental preservation lands Property will be acquired once funds become available The County can enter into options to purchase with landowners , purchase the property outright , or have a third party such as the Triangle Land Conservancy administer the land transactions Motion and Vote Regarding Buffalo Ridge Farm Conservation Easement Project Commissioner Tony preferences on how to implement the program Mr Broome presented the following three options for the Board to consider , if the Commissioners choose to proceed with the initiative Option 1 “ County Only ” County construction and operation of gas collection system and power generation system Option 2 “ Developer Only ” Developer construction and operation of gas collection system and power generation system Option 3 “ County Developer ” County construction and operation of gas collection system and developer construction and operation of power generation system Mr Broome offered to answer any questions and introduced Mr Jackie McLamb , consultant on the project for the County Chairman Wade M Stewart asked Mr Broome if staff preferred one of the options over another Mr Broome explained that while Option 1 - County Only , would provide the most return on the investment , there would be some risks Mr Broome reported that staff prefers the County constructing andPage1523 Board prefers , staff can advertise for Requests for Proposals for Options 2 and 3 followed by a report back to the Board on the comparisons with Option 1 Commissioner Jeffrey P Carver stated he would like for staff to get proposals on the options in order to evaluate what type of revenue is associated with each option He noted it may be good to have a study group review the proposals once they come in Commissioner Allen L Mims , Jr agreed with Commissioner Carver and stated he would like for staff to send out Requests for Proposals on both Options 2 and 3 and then compare the results with the County constructing and operating the entire project Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board authorized staff to proceed with developing and advertising Requests for Proposals on Option 2 and Option 3 of the Landfill Gas to Energy Initiative with the understanding that based upon further analysis and the results of the RFPs , the Board would then review and compare all the options at a later date to determine the future direction of the project 6 Public Utilities – Rural Center Grant for Reclaimed Water System Extension Tim Broome , PE , Director of Utilities and Engineering , reported the County applied for a Clean Water Partners Supplemental Grant from the NC Rural Center earlier this year He explained the project consists of approximately 19,000 lf of 12 ” and 8 ” reclaimed water mains and appurtenances to serve Johnston Community College The estimated cost of the project is 1,200,000 Mr Broome stated on July 9 , 2009 , the County was notified that a grant in the amount of 500,000 had been awarded for construction of the project and must be th accepted by September 9 Mr Broome stated an anticipated matching grant from the NC Clean Water Management Trust Fund will not be available due to the State budget crisis , thus if the project is to move forward , it will be necessary to appropriate 700,000 from Fund 68 – Wastewater Mr Broome submitted the following proposed budget Construction 1,122,000 Construction Contingency 58,000 Technical Services Construction Phase Only 20,000 Total 1,200,000 NC Rural Center Grant 500,000 Appropriation from Fund 68 700,000 Total 1,200,000 Mr Broome noted that Enterprise Fund 68 is distressed due to the shortfall in developer wastewater capacity fee revenue Mr Broome stated that in order to receive the 500,000 grant from the Rural Center by the deadline , he would request the Board accept the grant and adopt the capital project budget ordinance Mr Broome further stated that if approved , staff will hold on advertising for bids for the construction for nine or ten months in the hopes that the County can apply for Clean Water Management Trust Fund monies in their next funding cycle to hopefully serve as the match for the project so that only a portion of the match would have to come from Fund 68 Mr Broome stated if staff cannot secure additional funding to offset the match , then at that time , he would recommend against proceeding with construction on the project and taking 700,000 from Fund 68 Commissioner W Ray Woodall moved the Board accept the 500,000 grant from the North Carolina Rural Center and adopt the following project budget ordinance Commissioner Tony Braswell seconded the motion , which carried by unanimous vote CAPITAL PROJECT ORDINANCE FOR RECLAIMED WATER SYSTEM EXTENSION BE IT RESOLVED by the Board of Commissioners of the County of Johnston , North Carolina the “ County ” , that pursuant to a Landfill Compactor Rick Proctor , Solid Waste Manager , requested the Board’s approval to purchase an 826H compactor from Gregory Poole Equipment Company for the landfill Mr Proctor stated he has worked with Gregory Poole Equipment Company of Raleigh , NC , to find a new machine which was procured through competitive bidding by the National Joint Power Alliance NJPA NJPA is a non - profit organization made up of federal , state , and local units of government that facilitate competitive bidding of major equipment and materials , and Johnston County is a member The low bid sales price for the Caterpillar 826H through NJPA is 539,000 Public procurement statutes allow “ piggyback ” purchases on the basis of another government organization’s bidding process At the inquiry of Commissioner Tony Braswell , Mr Proctor reviewed the following original pricing obtained for the same equipment through the January 2009 bidding process exclusive of the 48 month power train warranty and equipment trade in Al Jon Advantage 50003 564,44212 Caterpillar 826H 575,38250 Terex 3 - 75E 535,06268 The Terex unit did not comply with the County’s specifications Staff recommended approval of the purchase of the 826H compactor from Gregory Poole Equipment Company for a price of 539,00000 which includes a one - year warranty Further , staff proposed to purchase the machine power train warranty on a year - to - year basis Chairman Wade M Stewart inquired what would be done with the existing compactor that is used at the landfill Mr Proctor stated staff proposes to sell the existing compactor through their own channels in lieu of a trade in allowance County Manager Rick Hester reported the Board approved in the FY 2009 - 2010 budget for enterprise Fund 66 – Solid Waste , a capital expenditure of up to 560,000 for the purchase of a landfill compactor Commissioners Jeffrey P Carver and DeVan Barbour asked for more information regarding the National Joint Power Alliance County Attorney Mark Payne stated the statute requires the County to bid out the purchase , unless a “ piggyback ” bid can be secured through another governmental agency or buying association He there are three options to consider regarding the appointment 1 keep with the current policy and not appoint Ms Crisp ; 2 revise the policy to provide for exceptions to the residency requirement , keeping in mind that there is a statute concern with this option ; and 3 change the nature of the position that Ms Crisp holds and designate it to be a voting ex - officio position to be held by the Department Chair of Health and Emergency Services for Johnston Community College Commissioner Allen L Mims , Jr stated he would prefer to designate the position as a voting ex - officio spot for the JCC - Department Chair of Health and Emergency Services Commissioner Mims stated he understands the need for the expertise of the particular person holding the position and he would prefer not to 11 Commissioner DeVan Barbour moved the Board increase the membership of the Hospital Authority Board of Commissioners to 11 positions Commissioner Tony Braswell seconded the motion Discussion Commissioner Allen L Mims , Jr asked if the statute and or the Hospital Authority bylaws would allow 11 members County Attorney Mark Payne advised that the statute allows anywhere from 6 to 30 members
