Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman , Cookie Pope , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , J Mark Payne , County Attorney , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Wade M Stewart called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Allen L Mims , Jr led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – April 6 , 2009 10 00 am and 6 00 pm B Proclamation – Emergency Medical Services Week – May 17 - 23 , 2009 The Board adopted the following proclamation declaring the week of May 17 - 23 , 2009 as Emergency Medical Services Week in Johnston County Proclamation Emergency Medical Services Week May 17 – 23 , 2009 WHEREAS , emergency medical services is a vital public service ; and WHEREAS , the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day , seven days a week ; and WHEREAS , access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury ; and WHEREAS , the emergency medical services system consists of emergency physicians , emergency nurses , emergency medical technicians , paramedics , firefighters , educators , administrators and others ; and WHEREAS , the members of emergency medical services teams , whether career or volunteer , engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills ; and WHEREAS , it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services Week NOW , THEREFORE BE IT RESOLVED , that the Board of Commissioners of Johnston County , does hereby proclaim May 17 - 23 , 2009 as Emergency Medical Services Week in Johnston County , in recognition of this event th day of May , 2009 Adopted this the 4 C Proclamation – 2010 Census Partner The Board adopted the following proclamation partnering with the US Census Bureau to help ensure a full and accurate count in 2010 2010 Census Partner Proclamation WHEREAS , an accurate census count is vital to our community and residents ’ well - being by helping planners determine where to locate schools , day - care centers , roads and public transportation , hospitals and other facilities , and is used to make decisions concerning business growth and housing needs ; and WHEREAS , more than 300 billion per year in federal and state funding is allocated to states and communities based on census data ; andPage347 May 4 , 2009 – 10 00 am Continued WHEREAS , census data ensure fair Congressional representation by determining how many seats each state will have in the US House of Representatives as well as the redistricting of state legislatures , county and city councils , and voting districts ; and WHEREAS , the 2010 Census creates jobs that stimulate economic growth and increase employment opportunities in our community ; and WHEREAS , the information collected by the census is protected by law and remains confidential for 72 years NOW , THEREFORE BE IT PROCLAIMED , by the Board of Commissioners of Johnston County , that Johnston County is committed to partnering with the US Census Bureau to help ensure a full and accurate count in 2010 As a 2010 Census partner , we will 1 Support the goals and ideals for the 2010 Census and will disseminate 2010 Census information to encourage those in our community to participate 2 Encourage people in Johnston County to place an emphasis on the 2010 Census and participate in events and initiatives that will raise overall awareness of the 2010 Census and ensure a full and accurate census 3 Support census takers as they help our community complete an accurate count 4 Create or seek opportunities to collaborate Chapter 33 of the 2006 North Carolina Fire Code , along with the necessary permits from the applicable Inspections Department th Archer Lodge Community Center – Saturday , July 4 at the Archer Lodge Recreation Park , Clayton Further , the Board authorized the Chairman to approve future similar requests that may be received through the July 4 , 2009 holiday E Call for Public Hearing – Proposed County Budget for FY 2009 - 2010 The Board scheduled a public hearing for the June 1 , 2009 10 00 am meeting on the proposed budget for FY 2009 - 2010 F Memorandum of Understanding with Town of Benson – Allowing the Voluntary Agricultural District Program to Exist within the Town of Benson’s Boundaries The Board approved a Memorandum of Understanding between the County and the Town of Benson that will allow Voluntary Agricultural Districts to exist within the Town of Benson nd G Benson Fire Department – 2 Vote on First Responder Franchise Request The Board approved by second vote the request H1N1 Novel Flu Dr Pearson confirmed that the County’s Health Department is working with the appropriate agencies to prepare for any possible outbreak in Johnston County Dr Pearson informed the Board of the latest information from the Center for Disease Control reporting there are 35 states with confirmed cases and North Carolina , at the present time , has one confirmed case with six probable cases She encouraged all citizens to follow the same good hygiene practices that would be observed for the regular seasonal flu such as frequent hand washing , covering your mouth when coughing or sneezing , and staying home when sick Dr Pearson stated the Health Department has received a shipment of necessary supplies and will keep everyone informed of the situation as it progresses B Former Johnston County Commissioner Freddie Adams , Sr Family – Presentation of Photograph Chairman Wade M Stewart noted that Johnston County recently lost a dear friend and former County Commissioner , Mr promotion and recent award and thanked him for his continued dedication to Johnston County and its citizens 4 Juvenile Crime Prevention Council – Proposed Budget for FY 2009 - 2010 The Honorable Judge Addie Rawls , Juvenile Crime Prevention Council JCPC Chairperson , presented to the Board the Council’s proposed budget for FY 2009 – 2010 and requested its approval Judge Rawls stated the JCPC has received notice that the State’s allocation for the months of April , May , and June 2009 will be reduced by 10,799 and she will be meeting with the various programs concerning the reduction in funding Judge Rawls reported the largest program that will be affected by the reduction is Johnston County Youth Services She noted the State’s allocation for FY 2009 – 2010 is anticipated to be 264,454 , and the JCPC is requesting 39,000 from the County for the upcoming year , which is 1,000 less than last year’s request Judge Rawls offered to answer any questions by the Board Chairman Wade M Stewart asked Judge Rawls to give an update on the juvenile situation in the County Judge Rawls reported the juvenile problem is getting worse in the County She stated typically in the summer months , the number of juvenile cases decrease ; however , to date , the number of cases has maintained their current level Judge Rawls informed the Board that gangs do exist in Johnston County as well as Harnett and Lee Counties which is a significant problem Judge Rawls reported on some of the programs that receive funding allocations which are trying to help improve the juvenile problems in the County She introduced fellow JCPC members Aleta Ballard , Jason Coats , and Steve Strickland Chairman Stewart spoke of the importance to deal with the juvenile situation in the County and suggested that perhaps later this year , the Board of Commissioners could work with the JCPC and hold a forum with other appropriate agencies concerning the subject of juveniles and how it impacts the quality of life in Johnston County Judge Rawls stated she would be glad to assist in holding such a forum County Manager Rick Hester stated that the forum could perhaps build on the High Five Program already in place by Johnston County Schools Commissioner Cookie Pope expressed her appreciation to Judge Rawls for her dedication and efforts and noted she has heard many good things from the work by Judge seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board recessed regular session to sit as the Wilson’s Mills Water District Board Chairman Wade M Stewart opened the public hearing Tim Broome , PE , Director of Utilities and Engineering , addressed the Board and outlined the project Mr Broome reported that a Preliminary Engineering Report and Environmental Assessment has been prepared for a project described as the Wilson’s Mills to Cleveland Area Water Transmission Project consisting of approximately 20,000 linear feet of 24 ” water main Mr Broome stated the water main would run from the vicinity of the Johnston County Water Treatment Plant to the Cleveland Area with the first phase ending at Little Creek Church Road and the second phase involving extensions on SR 1010 and Steel Bridge Road He stated the pipeline has been designed and easements are being acquired Mr Broome noted that staff brought this project to the Board several months ago and requested approval to apply for stimulus funds to pay for the project Mr Broome stated staff has been told that the District will not receive any stimulus funding for the project ; however , staff hopes to secure USDA - Rural Development financial assistance Mr Broome outlined the proposed route of the pipeline on a map for the Board He stated the project is urgently needed in order to meet seasonal peak water demands in the western part of the County Commissioner Tony Braswell asked if staff was aware of any other potential stimulus funding opportunities for other projects in the County Mr Broome responded that the magnetic ion exchange process project at the Water Treatment Plant is the only project that will receive stimulus funding , which was disappointing to staff Mr Broome reported that even though the County and the Water Districts are legal separate entities , staff was informed that the County would only receive funding for one project In response to a question from the County Manager , Mr Broome stated there will be a second round of funding allocations with considerably less money in June or July He stated there is some hope to secure USDA - Rural Development become effective over the next 20 months involving materials to be banned from landfill disposal Mr Proctor outlined the materials to be banned and their effective dates , as follows Material Effective Date Motor Oil Filters 10 1 09 Recyclable Plastic Bottles 10 1 09 Recyclable rigid plastic containers that have a neck smaller than the body of the container , and that accept a screw top , snap cap , or other closure Wooden Pallets 10 1 09 This ban will affect the MSW landfill only C & D landfill disposal will be allowed Televisions 1 1 11 Computer Equipment 1 1 11 Computer equipment does not include printers , scanners , or fax machines Chairman Wade M Stewart questioned how citizens would be able to dispose of the above referenced materials Mr Proctor stated oil filters can easily be added to the current recycling program at the convenience centers or the landfill He noted wooden pallets could still be accommodated in the C & D landfill or could be handled through the clean wood waste program Mr Proctor explained that staff is investigating options to address television and computer equipment disposal He noted there are three State contracts in place that offers turn - key disposal or a customized program with specific costs to be determined At the inquiry of Commissioner Cookie Pope , Mr Proctor confirmed that there are already ample containers in place at the convenience center sites to receive recyclable plastic bottles Chairman Stewart expressed concerns that if citizens are not able to easily dispose of such products at the landfill then those products will end up as litter on the side of the road Commissioner W Ray Woodall echoed the concerns by Chairman Stewart Commissioner Woodall stated he is already seeing computers and televisions on the roadsides Landfill Gas to Energy Project Jackie McLamb , Consultant to the Public Utilities Department , reported the Landfill Gas to Energy Project is progressing He noted there are approximately seven major phases in the project and currently staff is in phase two which involves field testing to quantify the daily volume of methane which can be captured and to determine the quality of the gas Mr McLamb stated staff is also in the process of exploring capital financing for the project He explained there are a number of financing options the federal government offers such as the Clean Renewable Energy Bonds and the Department of Energy’s Renewable Energy Production Incentive Program Mr McLamb stated landfill gas can be used to provide two sources of energy which are thermalPage2357 May 4 , 2009 – 10 00 am Continued energy or electricity generation He stated it is staff’s opinion that the County should concentrate on electricity generation in that thermal energy would only be beneficial to an industry requiring a large heat source Mr McLamb explained that the next phase involves developing a feasibility projection based on an operating budget and the capital cost He noted there is currently an open Request for Proposals from Progress Energy to purchase electricity generated from renewable energy sources such as the Landfill Gas to Energy Project There are other valuable intangible products associated with the program including renewable energy credits and carbon credits Mr McLamb reported staff hopes to have a final plan of development completed by mid June and a draft contract proposal for Progress Energy ready for the Board’s consideration by the July meeting The Board thanked Mr Proctor and Mr McLamb for the information and asked to be kept informed 9 decrease the aggregate principal amount of the 2009C Bonds by any amount , so long as such amount shall not exceed 35,500,000 , as determined to be in the best interest of the County , and may make any such increase or decrease either before or after the bids are opened The Series 2009C Bonds shall be stated to mature subject to adjustment as hereinafter set forth annually , February 1 or such other date designated in accordance with the immediately preceding sentence , 75,000 2010 , 295,000 2011 , 305,000 2012 , 2,700,000 2013 , 2,645,000 2014 , 2,590,000 2015 , 2,550,000 2016 , 2,505,000 Government Commission of North Carolina at the time the Series 2009C Bonds are sold , which interest to the respective maturities thereof shall be payable on August 1 , 2009 or such other date as is designated by the County Manager or the Director of Finance in connection with the sale of the Series 2009C Bonds and semiannually thereafter on February 1 and August 1 of each year or other semiannual dates designated by the County Manager or the Director of Finance in connection with the sale of the Series 2009C Bonds until payment of such principal sum Notwithstanding the foregoing provisions of this resolution , since interest rates on a proposed sale date are unpredictable , at any time before the Series 2009C Bonds are awarded , the County Manager or the Director of Finance , respectively , acting on behalf of the County , may from time to time defer the sale of all or any portion of the Series 2009C Bonds including postponement to a later date , to a subsequently announced date or indefinitely Section 3 Each Bond shall bear interest from the interest payment date next preceding the date on which it is authenticated unless it is a authenticated upon an interest payment date in which event it shall bear interest from such interest payment date or b authenticated prior to the first interest payment date in which event it shall bear interest from its date ; provided , however , that if at the time of authentication interest is in default , such Bond shall bear interest from the date to which interest has been paid The principal of and the interest and any redemption premium on the Bonds shall be payable in any coin or currency of the United States of America which is legal tender for the payment of public and private debts on the respective dates of payment thereof Section 4 The Bonds initially will be issued by means of a book - entry system with no physical distribution of bond certificates to be made except as hereinafter provided Initially
