the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman meeting with a prayer Commissioner W Ray Woodall led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Millennium Court – Millennium Pointe Subdivision – Phase I – Boon Hill Township C Proclamation – American Business Women’s Day – September 22 , 2010 adopted as follows AMERICAN BUSINESS WOMEN’S DAY PROCLAMATION WHEREAS , at the close of World War II , many women who had joined the workforce for the first time were reluctant to give up their newfound careers and return to their homes They were striding down the professional path and they were exhilarated ; and WHEREAS , on September 22 , 1949 , a Kansas City businessman , Hilary A Bufton Jr , recognized the positive impact women were having on the American economy and founded the American Business Women’s Association ; and WHEREAS , the American Business Women’s Association , a national support network for working women , has dedicated more than half a century to women’s professional development and has provided workplace skills and career development training for more than 600,000 women through more than 1000 ABWA chapters and networks nationally ; and WHEREAS , the Association established the American Business Women’s Day in 1983 ; and WHEREAS , this day , the Association’s founding date , was recognized by a joint resolution passed by both houses of the US Congress and by a proclamation issued by President Ronald Reagan ; and WHEREAS , annually , on September 22 , the contributions and achievements of millions of employed 2010 Page68 September 7 , 2010 – 10 00 am Continued D Proclamation – 2010 Fall Litter Sweep – September 18 through October 2 , 2010 adopted as follows PROCLAMATION FALL LITTER SWEEP 2010 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the fall 2010 LITTER SWEEP roadside cleanup will take place September 18 through October 2 , 2010 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will as the two Animal Cruelty Investigators to serve Johnston County for one year terms F Proclamation – Child Passenger Safety Week adopted as follows CHILD PASSENGER SAFETY WEEK 2010 PROCLAMATION WHEREAS , Children are our country’s most precious resource As parents and caregivers it is our responsibility to keep America’s children safe Every year , thousands of children are tragically injured or killed in motor vehicle traffic crashes For children age 3 and older , it is the leading cause of death It is hard to overstate the toll this takes on families Together we can put an end to this WHEREAS , Today , all 50 States , the District of Columbia , and our Territories have laws requiring the use of child safety seats and seat belts for children traveling in motor vehicles These laws were enacted because of the tremendous safety benefits they provide We know that child safety seats help save lives and reduce injuries We also know that they are most effective when installed and used correctly Sadly , nearly 3 out of 4 child safety seats are not used properly Starting now , working together , we must join forces to prevent these deaths and injuries WHEREAS , Johnston County is committed to working closely with our partners and safety advocates to help reduce the number of young lives lost on our roadways Our goal is to educate parents and caregivers on how to properly install and use child safety seats During Child Passenger Safety Week , there will be hundreds of free child safety seat inspection stations set up across the country We encourage all parents and Mills Road , to the Wilson’s Mills Planning Board representing the ETJ area of the Town H Social Services – Work First Plan Amendment Per the request of the Department of Social Services , the Board approved an amendment as follows to the Johnston County Work First Plan FY 2009 – 2011 IV Plans to Achieve the Outcomes and Goals A Activities Subsidized Employment Program Our agency will continue our current TANF Subsidized Employment Grant Program as it existed through the ARRA Stimulus funding to employ individuals in temporary positions at DSS These individuals must have a minor child in the home and must be either a current TANF recipient or meet the income requirements of 200 of the Federal Poverty Level The purpose of the program is to assist unemployed eligible individuals to gain temporary employment that will assist with improving their work skills and potentially allow them to gain permanent employment at some point in the near future The temporary positions can work up to realized the financial constraints that everyone was facing during the budget process B Fire Department Insurance Rates At the request of Commissioner Tony Braswell , Johnston County Fire Marshal Chris Perry outlined for the Board the detailed process that volunteer fire departments must go through during insurance rating evaluations Mr Perry specifically noted that Blackman’s Crossroads Fire Department had recently completed their evaluation and through the successful organization within their fire department as well as the collaboration with surrounding departments Benson , Strickland’s Crossroads , Four Oaks , Meadow , and Bentonville , Blackman’s Crossroads expects to receive a better insurance rating for their district Mr Perry noted that the improved rating could result in savings on homeowners insurance premiums for the residents living in the district Mr Perry also spoke on the dedication and time that is put forth by the firefighters to achieve a better insurance rating and he noted that the County’s Public Utilities Department as well as the Sheriff’s Department aided in this effort and that everyone involved should be commended The Board congratulated Blackman’s Crossroads Fire Department Chief William Grantham and his fellow firefighters for successfully completing the insurance rating evaluation Mr Grantham stated that he would like to thank the surrounding fire departments that assisted them in their effort as well as the County’s Public Utilities Department and Sheriff’s Department for their support and participation Mr Grantham stated the process has taken years to prepare for and a lot of hard work and unpaid man hours were put forth by the firefighters Commissioner Braswell spoke on the importance of a better insurance rating for the Tim Broome , PE , Director of Utilities and Engineering , explained that in June 2009 the Board authorized an application for an Energy Efficiency Conservation Block Grant Project grant in the amount of 636,200 , as part of the federal stimulus program Mr Broome stated the grant has been awarded , a consulting engineer has been retained , and studies have been completed to determine which improvements will produce the greatest savings in energy and other resources and , therefore , reductions in annual operating costs Staff proposes a project scope with an estimated total cost of 759,000 Mr Broome reported the higher cost is the result of adding an additional standby generator for the wastewater treatment plant which will allow the electrical service for a portion of the plant to qualify for a “ peak sharing ” rate Mr Broome stated this will save costs and put the plant in compliance with state rules for emergency power The 122,800 difference in the grant and the proposed County received a 500,000 grant from the North Carolina Rural Center and federal stimulus funding was anticipated to fund the 1,300,000 balance of the project cost ; however , the stimulus funding did not materialize Mr Broome stated staff recommends that applications be submitted for a low interest State Revolving Fund loan for the project as well as a Clean Water Management Trust Fund grant He construction Mr Broome explained that the NC Department of Environment and Natural Resources – Division of Water Quality now has funding for the project and is offering loan assistance in the amount of 3,500,000 Funding is being offered in two components 1 a 3,000,000 loan with a 20 year term and 0 apr interest ; and 2 a 500,000 loan with a 20 year term and 222 apr interest Due to prior commitments for wastewater transmission and treatment services in the Cleveland area and projected growth in the western area of the County , Mr Broome requested the Board to consider adopting , and the firm apparently has the resources to complete the project within the contract schedule Funding for the project is expected from a USDA – Rural Development low interest loan A loan commitment has not been made by Rural Development ; however , the agency has approved the project for bidding and construction due to the urgent need for the hydraulic benefit of the pipeline When USDA funds can be allocated , a loan will be awarded and the project funded retroactively In that it is necessary for the project construction to begin as soon as possible , staff requests the Board to fund the Division 1 project from Fund 67 – Water fund balance and to reimburse Fund 67 once the USDA – Rural Development loan materializes Ms Coats explained that a capital project was previously established Charlotte , representing State Utility Contractors , addressed the Board Mr Cox stated that his client does not feel that Monroe Roadway Contractors properly followed the instructions in the bid form ; therefore , they believe that the lowest responsive bidder should be State Utility Contractors Mr Cox referenced the bid form in question and reported the issue pertains to Line Item No 5 which includes “ Testing , Cleanup , and Seeding for all pipe Minimum 25 of Installation Cost of Line Items 2 , 3 & 4 ” Mr Cox stated that according to Monroe’s calculations , they did not fully account for 25 of the installation cost He asked the Board to consider State Utility Contractors as the lowest responsive bid on the project and offered to answer any questions Ryan Beaver , Attorney with Shumaker , Loop , & Kendrick , of 128 South Tryon Street , Charlotte , representing Monroe Roadway Contractors , addressed the Board Mr Beaver stated that Monroe Roadway Contractors fully believes that they have complied with the terms and conditions of the bid form Mr Beaver stated that the issue is how Line Item No 5 in the bid form is interpreted He stated material costs and installation costs are separate and from Monroe’s standpoint , Line Item No 5 does not contain a reference to 25 of the material cost ; therefore , the fact that a broader reading of the item was interpreted by another contractor should not disqualify Monroe’s bid Mr Beaver stated that Monroe is excited to begin work on the project and would be willing to address any concerns Motion and Second Commissioner Jeffrey P Carver moved the Board award the construction contract , based on staff and the County Attorney’s recommendation , to low bidder Monroe Roadway Contractors , Inc of Denver , NC in the bid Discussion Commissioner Tony Braswell asked for the County Attorney’s opinion on the information received regarding the disparity on the bid form County Attorney David Mills advised that while both parties Monroe Roadway Contractors and State Utility Contractors have both come before the Board with reasonable interpretations of the language in the bid form , he would recommend the Board award the bid to the low bidder , Monroe Roadway Contractors , in accordance with staff’s recommendation Commissioner Allen L Mims , Jr stated that this is the first time , since he has been a Commissioner , that he is aware of an issue regarding the interpretation of language on the bid form for a project Commissioner Mims commented that based on his reading of the language for Line Item No 5 , he would agree with Monroe’s interpretation of the bid form ; however , he asked that in the future to prevent confusion , for staff to clarify the bid form Commissioner DeVan Barbour asked if the
