Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman , Officer , David F Mills , County Attorney , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Wade M Stewart called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer Commissioner Jeffrey P Carver led those in attendance in the pledge of allegiance to the American flag Chairman Stewart noted the absence of Commissioner W Ray Woodall due to health reasons 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items County Manager Rick Hester asked to clarify Consent Agenda Item E regarding the easement transfer from Wake County to the Town of Clayton Mr Hester explained that if approved , the action would need to grant permission for Wake County to transfer the easement to the State of North Carolina who would then work with the Town of Clayton to build their portion of the Mountains to Sea Trail Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board approved the consent agenda items as follows with the clarification as noted by the County Manager A Approval of Minutes – July 6 , 2010 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Lee Trace Drive , Rustic Lane , Nicolet Lane , Mendel Drive and Tadley Court – Lee Trace Subdivision – Smithfield Township Morrison Manor Drive , E Paige Wynd Drive , W Paige Wynd Drive & Tudor Way – Morrison Manor Subdivision – Pleasant Grove Township C Call for Public Hearing – Tax Administration – 2011 Revaluation Schedule of Values The Board scheduled a public hearing to be held on Wednesday , September 22 , 2010 at 9 00 am in the Board of Commissioners ’ meeting room of the Johnston County Courthouse to allow for public comment on the proposed Schedule of Values , Standards , and Rules SOV for the 2011 general reassessment of real property in Johnston County D Cancellation of Public Hearings Related to Ordinance Amendment and Rezoning Cases for Internet Sweepstakes Operations Due to recent action taken by the North Carolina General Assembly HB 80 that outlawed internet sweepstakes operations in the State of North Carolina , the Board canceled public hearingsPage38 August 2 , 2010 – 10 00 am Continued scheduled for the September 7 , 2010 6 00 pm meeting for Rezoning Cases 10 - 07 and 10 - 08 as well as an ordinance amendment concerning internet sweepstakes E Mountains to Sea Trail – Easement Transfer for the Town of Clayton Wake County In 2004 , Wake County purchased a conservation greenway easement from Edith Romaine , etal as part of the Wake County Neuse River Corridor Protection Program ; however , at that time , the Wake County Board of Commissioners was unaware that 387 acres of the easement extended over into Johnston County In consideration of a request by Wake County and the Town of Clayton , per the clarification offered by County Manager Rick Hester , the Board granted permission for Wake County to transfer the 387 portion of the easement located in Johnston County to the State of North Carolina who intends to work with the Town of Clayton to build Clayton’s portion of the Mountains to Sea Trail F Request for Fireworks Display – 50 - 210 Fire Department The Board approved a fireworks display for the 50 - 210 Fire Department to celebrate their upcoming 50 - 210 Community Volunteer Fireman’s Day on September 11 , 2010 rain date of October 2 , 2010 to begin at approximately 9 15 pm on property owned by Richard Jones , Owner of Jones Farm Supply ; according to North Carolina General Statute 14 , Article 54 and Chapter 33 of the 2006 North Carolina Fire Code , and any subsequent amendments thereof , along with the necessary permits from the applicable Inspections Department G Memorandum of Understanding with the Town of Four Oaks – Allowing the Voluntary Agricultural District Program to Exist North Carolina , addressed the Board with his concerns regarding the panhandlers located in the McGee’s Crossroads area near the Food Lion and I - 40 exit Mr Thompson requested that the Board take into consideration the possible adoption of an ordinance outlawing panhandling B NC Stop Torture Now Quaker House Chuck Fager , 223 Hillside Avenue , Fayetteville , North Carolina , presented the Board with updated information regarding the accountability of those that NC Stop Torture Now alleges kidnap and abuse detainees C Emergency 911 Updates Jason Barbour , Director of 911 Communications , updated the Board on recent legislative actions that will affect how all 911 centers are funded Mr Barbour informed the Board that he had been selected to Chair the State 911 Committee that will oversee how the new regulations are put into place Mr Barbour also thanked the Board for funding and allowing the Communications Department to build a back - up center which is now located in Clayton Mr Barbour stated that since the opening of the back - up center , he has had to use it several times with the most recent occurrence being two weeks ago when severe weather threatened the County 4 Public Hearing – 10 10 am – Economic Development Incentive Grant Advertised in The Smithfield Herald – July 21 , 2010 The Chairman opened the public hearing and called on Economic Development Director Peggy Anderson to address the Board Ms Anderson stated the purpose of the hearing is to consider an Economic Development Incentive Grant EDIG agreement between the County ; Becton , Dickinson & Company BDC ; and The Keith Corporation TKC She reported that BDC plans to lease an approximately 719,000 sq ft facility that will be constructed by TKC at the Four Oaks Business Park for the distribution of medical supplies and devices Ms Anderson stated the total investment of the project is estimated at 384 million through the construction of the facility by TKC 234 million along with BDC’s proposal to invest approximately 15 million in equipment She added that the company projects to create approximately 187 new jobs within three years of opening the facility Ms Anderson explained the EDIG would be predicated upon the company paying in full their annual ad valorem tax assessment , with those funds collected by the County and escrowed in amounts sufficient to fund the grant She pointed out that at no time would the grant exceed the ad valorem tax payment by the company Ms Anderson reported the Economic Development Advisory Board Incentive Committee has reviewed the project and recommends the Board of Commissioners consider approving a seven year EDIG whereupon the company would receive grant funds in an amount equal to 90 of their annual ad valorem tax payment for the first five years of the grant , and declining to 80 for the sixth year and finally 70 for the seventh year at thePagePage pageNumber541 August 2 , 2010 – 10 00 am Continued close of the grant Ms Anderson introduced Katie Culp with Cassidy Turley site selection consultant for the project and Garrett Wyckoff with the North Carolina Department of Commerce Ms Culp thanked the Board of Commissioners , the Town of Four Oaks , as well as the County staff for their work and professionalism on the project Ms Culp provided the Board with a background on her work with BDC and how they chose Johnston County for their new facility She noted the site selection process began two years ago with nine other states in competition for the project before selecting Johnston County Ms Culp spoke on the enthusiasm the company has encountered in Johnston County as well as all the components Johnston County had to offer that led to their decision She offered to answer any questions The Board members expressed their appreciation to Ms Culp and Mr Wyckoff for their work on the project as well as BDC for their decision to locate in Johnston County There being no further comments , the Chairman closed the public hearing Chairman Wade M Stewart noted that BDC’s attorney is still reviewing the final language in the agreement and that staff is requesting the Board to approve the EDIG terms as recommended by the Incentive Committee with County Attorney David Mills to finalize the agreement document Commissioner DeVan Barbour moved the Board approve the Economic Development Incentive Grant Agreement terms as recommended by the Incentive Committee between the County ; Becton , Dickinson & Company BDC ; and The Keith Corporation TKC Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 5 Public Hearing – 10 15 am – Finance – Recovery Zone Facility Bonds Advertised in The Smithfield Herald – July 14 , 2010 The Chairman opened the public hearing Mary Nash Rusher , Attorney with Hunton & Williams , Bond Counsel to the Authority , recalled that the Johnston County Board of Commissioners adopted a resolution at their June 2010 meeting designating the County as a ‘ recovery zone ’ for the purposes of the American Recovery and Reinvestment Act of 2009 “ ARRA ” Ms Rusher explained that the purpose of the public hearing is to allow public comment on the proposed issuance and sale by The Johnston County Industrial Facilities and Pollution Control Financing Authority of Recovery Zone Facility Bonds in an amount not to exceed 35,000,000 , the proceeds of which will be loaned to Automatic Rolls of North Carolina , LLC Ms Rusher stated the bonds will be used to finance the acquisition , construction and equipping of an approximately 90,000 square foot commercial bakery and storage facility located at 317 Pony Farm Road , Clayton , Johnston County , North Carolina as well as pay certain costs of issuance of the bonds Ms Rusher noted the project is expected to create approximately 60 new jobs in Johnston County The Authority and the Company entered into an inducement agreement with respect to the project and the bonds on June 16 , 2010 and the Company expects the cost of the project to be approximately 35,000,000 Ms Rusher asked the Board to consider the adoption of a resolution approving in principal the issuance of the recovery zone bonds to finance the project Ms Rusher specifically noted that the Bonds will not constitute a debt of the State of North Carolina or any political subdivision thereof , including the Authority and Johnston County or a pledge of the faith and credit of the State of North Carolina or any political subdivision thereof , including the Authority and Johnston County There being no further comments , the Chairman closed the public hearing Chairman Wade M Stewart introduced the following resolution , the title of which was read APPROVAL IN PRINCIPLE OF SPECIAL PURPOSE PROJECT FOR AUTOMATIC ROLLS OF NORTH CAROLINA , LLC AND THE FINANCING THEREOF WITH RECOVERY ZONE FACILITY BONDS IN THE PRINCIPAL AMOUNT OF UP TO 35,000,000 WHEREAS , The Johnston County Industrial Facilities and Pollution Control Financing Authority the “ Authority ” proposes to assist in the financing under the North Carolina Industrial and Pollution Control Facilities Financing Act , Chapter 159C of the North Carolina General Statutes , as amended the “ Act ” of a “ special purpose project ” by Automatic Rolls of North Carolina , LLC , a North Carolina limited liability company , or an affiliated or related entity the “ Company ” , which plans to acquire , construct and equip anPagePage pageNumber642 August 2 , 2010 – 10 00 am Continued approximately 90,000 square foot commercial bakery and storage facility the “ Project ” , to be owned and operated by the Company in Clayton , Johnston County , North Carolina ; and WHEREAS , on June 7 , 2010 , the Board of Commissioners of the County of Johnston , North Carolina the “ County ” declared the County to be a recovery zone for purposes of Sections 1400U - 1 through 1400U - 3 of the Internal Revenue Code of 1986 , as amended the “ Code ” ; and WHEREAS , under the Code , the Project constitutes “ recovery zone property ” because it is depreciable property located in a recovery zone which is used in the active conduct of the Company’s trade or business ; and WHEREAS , the Act and the Internal Revenue Code of 1986 , as amended the “ Code ” require that the governing body of a county approve in principle any project to be financed under the Act after a public hearing ; and WHEREAS , the North Carolina Tax Reform Allocation Committee “ TRAC ” has reallocated 35,000,000 of recovery zone facility bond allocation to the Authority for the Project ; and WHEREAS , this Board of Commissioners today has held a public hearing with respect to the advisability of the Project and the issuance of recovery zone facility bonds therefor , as evidenced by the Certificate and Summary of Public Hearing attached hereto as Exhibit A ; and WHEREAS , the Authority intends to issue its Recovery Zone Facility Bonds Automatic Rolls of North Carolina Project , Series 2010 the “ Bonds ” in the principal amount of up to 35,000,000 which will be issued as a variable rate bond that is privately placed with PNC Bank , National Association ; and WHEREAS , Section 147 f of the Code requires that the Board of Commissioners approve the plan of financing for the bonds ; and WHEREAS , under Section 159C - 4 of the Act the issuance of bonds under the Act must be approved by the governing body of the county in which the project to be financed is located ; NOW , THEREFORE , the Board of Commissioners of Johnston County , meeting in regular session in Smithfield , North Carolina , on August 2 , 2010 , does the following BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF JOHNSTON 1 The proposed “ special purpose project ” consisting of the acquisition , construction and equipping of an approximately 90,000 square foot commercial bakery and storage facility the “ Project ” , to be owned and operated by Automatic Rolls of North Carolina , LLC , and the issuance of recovery zone facility bonds in an amount not to exceed 35,000,000 therefor are hereby approved in principle 2 The Board of Commissioners hereby approves the plan of financing as required by Section 147 f of the Code 3 The issuance of the Bonds in the principal amount of 35,000,000 is hereby approved for purposes of Section 159C - 4 of way can be obtained from all the property owners whereas , they are then placed back on the list as a top priority Mr Little stated in the case of Monroe Road , the DOT was recently contacted by two of the three landowners that had originally refused to sign the right - of - way encroachment and indicated they are now willing to sign Mr Little added that the DOT has contacted the third landowner and so far the conversations have gone well Mr Little also stated that with regards to the realignment of Monroe Road , due to environmental concerns along the road , the DOT plans to pave along the current footprint of the road Commissioner Jeffrey P Carver stated that the bridge on NC Hwy 42 East near Flowers Plantation appears to be deteriorating and he asked if there were any plans to improve the conditions Bobby Lewis , DOT Division Maintenance Engineer , responded the DOT is trying to get funding to incorporate maintenance work on the bridge in with the NC Hwy 42 widening project which is hoped to occur in 2012 Mr Lewis stated he would look into the matter for a more definite timeline Commissioner Cookie Pope thanked the DOT for their recent shoulder repair work in and around the new Cleveland High School She noted that there is also shoulder repair work needed near the I - 40 NC 42 intersection Commissioner Braswell inquired if a decision had been made with regards to signalization on Barber Mill Road at the intersection with Cleveland Road Mr Little stated there are ongoing discussions regarding signalization on Barber Mill Road where it intersects with Cleveland Road He noted that there is a proposed project to construct turn lanes at the intersection which should come before signalization Mr Little assured the Board that the DOT is closely monitoring the situation considering the new high school traffic anticipated in the coming years Commissioner Carver inquired about past discussions regarding Castleberry Road and Neuse River Parkway at NC Hwy 42 and the possibility of some rerouting signalization in the area Mr Little responded that signalization has been installed near the bridge ; however , he commented that discussions on how to improve DOT has requested the Board to concur with the DOT’s recommendation to close the median access on US 70 at Oak Street in order to enhance safety along US 70 Tim Little , District Engineer , and Bobby Lewis , Division Maintenance Engineer , with the North Carolina Department of Transportation DOT , appeared before the Board on the proposed median closure at Oak Street in Selma Mr Little stated the requested median closure at Oak Street is in conjunction with a scheduled guardrail project on US Hwy 70 to install guardrail from Firetower Road to Oak Street and the DOT would like to continue the guardrail project from Oak Street down to the river Mr Little explained that there have been approximately 30 accidents in the last five years in the area and although the guardrail will not prevent US 70 at Oak Street to be closed ; however , he clarified that the Oak Street access onto US 70 would not be closed for those headed westbound , in that vehicles heading west will still be able to turn onto Oak Street as well as exit Oak Street heading west He stated the median would be closed and the guardrail continued down to the river Mr Little expressed concerns by the DOT regarding the tanker trucks that utilize the Oak Street median access to turn left heading east , considering the limited site distance at the median Commissioner Allen L Mims , Jr noted that a lot of the trucks from the oil terminals utilize the Oak Street US 70 median access and he asked if the DOT is planning improvements at the Buffalo Road Oak Street intersection to accommodate the increased truck part of the Peedin Road project Mr Little stated Firetower Road is a part of the Peedin Road project and he confirmed that eventually , Peedin Road , Firetower Road , Stevens Chapel Road and Country Store Road would all become right - in right - out access points with the goal being to continue the guardrail along those areas County Manager Rick Hester noted that there was an informal meeting held concerning the Oak Street median closure , at the Smithfield Fire Station with approximately 30 or 40 individuals in attendance Mr Hester stated the meeting was attended by DOT representatives to answer questions Chairman Wade M Stewart commented that there are a lot of businesses that would be impacted by the median closure Bruce Johnson , owner of Handy Andy Carpet Company , located on Oak Street , acknowledged the informal meeting mentioned by Mr Hester Mr Johnson stated at the informal meeting , he was not aware of anyone that was in favor of closing the median at Oak Street Mr Johnson read a prepared statement to the Board expressing his opposition to the median closure Mr Johnson commented that approximately two - thirds of his business comes from the west to his location and he stated if the median is closed , those customers would have to travel a mile out of their way Mr Johnson also expressed concerns that the Buffalo Road interchange is a busy area , especially on school mornings , and stated it is his opinion that adding more traffic to the mix , considering the railroad tracks in the area , would create an even more dangerous situation Mr Johnson also commented that the median closure could impact future economic development opportunities for the area He stated that in reviewing the “ 2005 US 70 Access Management Study ” , he saw only five accidents had occurred in a three year period at the Oak Street US 70 intersection Mr Johnson asked the Board to consider his investment and commitment to the County and not to concur with the DOT’s recommendation to close the median access Ray Rhode , 345 America Drive , Selma , spoke in opposition to the median closure Mr Rhode stated one week ago , there was an incident at Buffalo Road where a gas tanker almost collided with an Amtrak Mr Rhode reported that following the near collision , there was a closure of the Buffalo Road intersection for approximately 45 minutes whereupon all trucks had to use the Oak Street US 70 access point He commented that if there had been a collision , the Buffalo Road intersection would have been closed even longer Mr Rhode stated there is a traffic issue at the Oak Street US 70 access ; however , the guardrail project is not the answer and perhaps signalization should be discussed instead Mr Rhode stated his business would not be impacted by the median closure because he does not have trucks , but he is speaking against the closure due to safety concerns Phillip McDaniel , Selma Fire Department Chief , addressed the Board and stated that from an emergency services perspective , the median closure would fix one problem ; however , the closure would possibly put a bigger issue at the Buffalo Road Oak Street intersection Mr McDaniel stated there is the potential for incidents with tankers , cars , as well as school buses in the area and he would like to see the DOT hold off on closing the median access until such time as the closure could be included in with a larger transportation improvement project to include Noble Street , Buffalo Road , as well as signalization Richard Douglass , Selma Town Manager , informed the Board that the Selma Town Council has not taken a formal action with regards to the proposed median access closure ; however , informally , they have indicated to him that they would prefer to see traffic streets , which could funnel even more truck traffic to the Buffalo Road interchange area Mr Douglass stated that Selma Mayor Charles Hester has instructed him to draft a resolution requesting traffic improvements to be made at the Buffalo Road Oak Street Noble Street corridor area to be considered by the Selma Town Council at an upcoming meeting Page147 August 2 , 2010 – 10 00 am Continued Jay Sasser of PLT Concrete , 3073 West Oak Street , Selma , stated he concurred with earlier comments by Bruce Johnson that the businesses in the area would suffer if the median access is closed Mr Sasser stated if traffic safety is a concern then signalization would be more appropriate than closing the median Chairman Stewart spoke on the difficulty of the matter and commented that he does not want to see the businesses in the area hurt ; however , he is concerned over the safety of traffic at the median access Commissioner Braswell stated that he believed the Board could agree to signalization ; however , he felt that the DOT would be opposed to adding a traffic signal in that there are plans to remove other traffic lights on US 70 Freddie Bailey , 3707 Buffalo Road , Selma , stated that he works at the oil terminals and he is concerned with adding more traffic to the Buffalo Road interchange area Mr Bailey stated that when school is in session , at times , traffic is backed up on Buffalo Road past Oak Street due to ethanol offloading during that time Mr Bailey also spoke to the recent near collision of a tanker truck and an Amtrak and stated if the collision had occurred , the Oak Street US 70 access point would be needed in order to reroute the traffic Mr Little readdressed the Board and clarified that his earlier reported information regarding 30 accidents occurring in the last five years in the area were taken from the area of Oak Street to Turnage Road and not just at the Oak Street median access Mr Little stated it is hoped that the guardrail project would prevent a vehicle from crossing over into the oncoming lanes in the event of an accident Mr Little spoke on concerns over safety issues surrounding the tanker trucks mingling with cars as well as the Amtrak in the area He stated that there will be 15 to 20 more traffic on Buffalo Road if the median access is closed and the DOT is considering the concerns of the business owners ; however , the DOT must also consider the safety of the traffic along US Hwy 70 Chairman Stewart noted that on Interstate 95 and Interstate 40 there are median breaks that are utilized by emergency vehicles Chairman Stewart asked if there was some flexibility that could allow the Oak Street median to be left in a state where the guardrail is installed , but the asphalt is left in place where it could be reopened in the future Chairman Stewart pointed out that the DOT can close the median access with or without the Board of Commissioners ’ concurrence Mr Little responded that there was an instance in Goldsboro where a median was left in a state where it could be reopened and the DOT could look at that same scenario at the Oak Street median Mr Little cautioned against installing the guardrail with a break at the median in case a vehicle were to hit the blunt end of the guardrail or cross at the gap into the oncoming traffic Commissioner Mims asked if there was a chance the traffic improvements could be done at the Buffalo Road interchange area first , considering all the comments that have been made during the public hearing Mr Little responded that the funding is in place for the guardrail project and preliminary approval has been received to go ahead with the project Mr Little stated that he could ask the DOT State Office in Raleigh if the guardrail project can be delayed without losing the funding ; however , he is unsure as to what the response would be In response to a question from Bruce Johnson , Mr Little stated the funding for the guardrail project is not federal stimulus funding , but rather it is classified as “ safety money ” from the DOT State Traffic Unit Division that is received in order to eliminate hazards on four lane divided sections Mr Little added the funding is also tied to accident data in the area Mr Little stated if the median access at Oak Street is not closed then the DOT may not be able to continue the guardrail to the river Bobby Lewis , Division Maintenance Engineer with the DOT , stated that the DOT technically did not have to receive the concurrence from the County Commissioners to close the median ; however , they felt it was good business to bring the matter to the Board in a public setting in order to hear whether or not the project is a good idea Mr Lewis stated the DOT would pursue any type of funding they can to help with improvements at the Buffalo Road interchange as well as he would look into delaying the guardrail contract Commissioner Jeffrey P Carver noted that when the Neuse River Bridge project begins in Share information across jurisdictions as neededPage258 August 2 , 2010 – 10 00 am Continued HUMAN TRAFFICKING Ms Blair invited the Board to attend the regional meeting being co - hosted by Soroptimist International and Triangle J Council of Governments on September 1 , 2010 The Board thanked Soroptimist International for the information 10 Emergency Services – Thanksgiving Volunteer Fire Department Tax Exempt Loan Refinancing Chairman Wade M Stewart announced that the item was tabled until the September 7 , 2010 10 00 am meeting to allow the Thanksgiving Fire Department more time to gather their proposals for the refinancing 11 Emergency Services – Interlocal Agreement with Wilson County EMS Kim Robertson , Director of Emergency Services , requested the Board to approve an interlocal agreement with Wilson County EMS that would allow Johnston County EMS to transport citizens of Wilson County due to the close proximity of the Kenly EMS Unit located at the Kenly Fire Station Ms Robertson explained that the same area had previously received coverage from the North Johnston EMS Unit , prior to the County assuming those duties Ms Robertson stated that there are parts of the Kenly city limits that extend over into Wilson County Ms Robertson reported Wilson County EMS would pay an annual stipend of 5,000 to the County as well as allow Johnston County EMS to charge Wilson County patients that are transported a fee for service and engage in the solicitation of subscriptions for service within the designated district Kenly Fire Chief Paul Whitehurst addressed the Board and asked the Commissioners to approve the interlocal agreement He explained that it has been an ongoing service for the area that was originally covered by the Kenly Rescue Squad years ago prior to it becoming the North Johnston EMS Unit Mr Whitehurst stated the Town of Kenly is unique in that part of the city limits do extend over into Wilson County and the citizens of Kenly see the area as one community Mr Whitehurst also noted that part of the Beulah Fire District , which is served by the Kenly Fire Department , is located in Wilson County and on many occasions the Kenly firefighters have needed the services of the Kenly EMS Unit when they are responding to fire calls for their own needs and he would appreciate the service being continued Chairman Wade M Stewart asked if there were other similar situations in the County , noting that the Benson EMS Unit is located near Harnett County Ms Robertson explained that in the case of the Benson EMS Unit , Johnston County has responded to calls in Harnett County , at their request when needed , and she noted that Johnston County has had to call on Harnett County to return the favor during times when the Benson EMS Unit was busy responding to other calls Ms Robertson stated there has never been a franchise or other agreement with Harnett County for those services Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the following interlocal agreement with Wilson County EMS Page359 August 2 , 2010 – 10 00 am Continued NORTH CAROLINA EMERGENCY MEDICAL SERVICES WILSON COUNTY INTERLOCAL AGREEMENT THIS AGREEMENT made and entered into by and between the COUNTY OF WILSON , North Carolina , a body corporate and politic existing pursuant to the laws of the State Of North Carolina , “ Wilson ” , and the COUNTY OF JOHNSTON , North Carolina , a body corporate and politic existing pursuant to the laws of the State Of North Carolina , “ Johnston ” W I T N E S S E T H Recitals The following recitals are incorporated as an integral part of this Agreement WHEREAS , Wilson and Johnston currently owns and operates Emergency Medical Services , “ EMS ” ; and WHEREAS , the General Statutes of North Carolina define emergency medical services as “ service rendered by emergency medical services personnel in responding to improve the health and wellness of the community and to address the individual’s need for emergency medical care within the scope of practice as defined by the North Carolina Medical Board in accordance with GS § 143 - 514 in order to prevent loss of life or further aggravation of physiological or psychological illness or injury ” WHEREAS , independent Corporate Volunteer services of Johnston have provided emergency medical services to Wilson via the Ordinance to Operate Ambulance Services within areas designated by Wilson for many years ; WHEREAS , these corporate entities no longer exist and have been replaced by Johnston ; WHEREAS , the parties desire to establish a formal agreement designating the responsibilities and duties of each party ; and WHEREAS , Wilson and Johnston are also authorized by NC General Statues 160A - 461 , Article 20 , to enter into contracts or agreements with each other to execute any undertaking involving the joint exercise or the exercise by one for the other of any power , function , public enterprise , right , privilege or immunity of local government ; NOW , THEREFORE , in consideration of the terms , conditions , and covenants expressed herein , the parties agree as follows 1 Purpose Of Agreement Section 11 The purpose of this Agreement is to establish a formal arrangement whereby Johnston provides emergency medical services to Wilson , within its corporate limits , limited to an area designated by Wilson see official map maintained by Wilson in exchange for revenues as specified in this agreement Section 12 – This agreement when properly executed satisfies all of the provisions , conditions , terms , and requirements set forth in the Ordinance Regulating Ambulance Services in Wilson County 2 Termination Section 21 - Term Subject to the terms and conditions of this Agreement , the term of this Agreement shall commence upon execution and shall continue for a period of three 3 years This Agreement shall be automatically extended for an additional three 3 year term unless one of the parties delivers a notice of intent to terminate by registered or certified mail at least one hundred twenty 120 days prior to the expiration of the initial three 3 year period Section 22 - Termination In addition to the other terms and conditions of this Agreement , either party may terminate this agreement upon a breach by the other party If either party desires to terminate this Agreement based upon a breach it shall deliver a notice of its intent to terminate to the other party by registered or certified mail Termination shall not become effective until thirty 30 days after receipt of the notice of intent 3 Responsibilities Of Parties Section 31 - Responsibilities of Johnston Johnston agrees to provide emergency medical services to Wilson within its corporate limits during the term of this Agreement subject to the terms and conditions set forth herein Section 32 - Responsibilities of Wilson Wilson agrees to pay an annual stipend , as appropriated by the Board of County Commissioners , of not less than 5,00000 ; allow Johnston to charge Wilson patients transported by Johnston a fee for service and engage in the solicitation of subscriptions for service within the designated district only 4 EMS System Section 4 1 - Each system shall operate EMS in accordance with the North Carolina General Statutes , their respective EMS System Plan and each System shall maintain their respective medical control and participate in Peer Review as deemed necessary by respective Medical Directors Section 42 - EMS Responses shall be managed in accordance with the following stipulations when a 911 EMS call is received by the Wilson County Emergency Communications Center WCECC originating in the Johnston EMS district it will be dispatched to the Johnston County EMS unit stationed in Kenly via the Johnston County 911 Center If the unit designated for that district is committed then the WCECC will dispatch a Wilson County EMS unit Wilson will dispatch a unit at the discretion of the ECC or on duty Supervisor when circumstances require 1 Wilson and Johnston units will transport to the medical
