the meeting with a prayer Commissioner Allen L Mims , Jr led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – April 5 , 2010 10 00 am and 6 00 pm ; April 23 , 2010 Work Session B Proclamation – Emergency Medical Services Week – May 16 – 22 , 2010 The Board adopted the following proclamation declaring the week of May 16 - 22 , 2010 as Emergency Medical Services Week in Johnston County Proclamation Emergency Medical Services Week May 16 – 22 , 2010 To designate the Week of May 16 - 22 , 2010 , as Emergency Medical Services Week WHEREAS , emergency medical services is a vital public service ; and WHEREAS , the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day , seven days a week ; and WHEREAS , access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury ; and WHEREAS , the emergency medical services system consists of emergency physicians , emergency nurses , emergency medical technicians , paramedics , firefighters , educators , administrators and others ; and WHEREAS , the members of emergency medical services teams , whether career or volunteer , engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills ; and WHEREAS , it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services Week ; NOW , THEREFORE BE IT RESOLVED , that the Board of Commissioners of Johnston County , does hereby proclaim May 16 - 22 , 2010 as Emergency Medical Services Week in Johnston County , in recognition of this event rd Adopted this the 3 day of May , 2010 C Resolution – Ratification of Approval for Water Conservation Ordinance Amendments from the April 5 , 2010 meeting The Board adopted the following resolution ratifying the Board’s previous approval of the Water Conservation Ordinance amendments at the April 5 , 2010 meeting the adoption of the resolution is a requirement by NCDENR Page795 May 3 , 2010 – 10 00 am Continued RESOLUTION FOR APPROVING WATER SHORTAGE RESPONSE PLAN WHEREAS , North Carolina General Statute 143 - 355 l requires that each unit of local government that provides public water services or plans to provide such services shall , either individually or together with other such units of local government , prepare and submit a Water Shortage Response Plan ; and WHEREAS , as required by the statute and in the interests of sound local planning , a Water Shortage Response Plan for the County of Johnston , has been developed and submitted to the Johnston County Board of Commissioners for approval ; and WHEREAS , the Johnston County Board of Commissioners finds that the Water Shortage Response Plan is in accordance with the provisions of North Carolina General Statute § 143 - 355 l and that it will provide appropriate guidance for the future management of water supplies for the County of Johnston , as well as useful information to the Department of Environment and Natural Resources for the development of a state water supply plan as required by statute ; NOW , THEREFORE , BE IT RESOLVED by the Johnston County Board of Commissioners that the Water Shortage Response Plan as set out in the Johnston County Code of Ordinances , Section 24 , Article II Water Services , Division 2 Water Conservation , as amended on April 5 , 2010 is hereby approved and shall be submitted to the Department of Environment and Natural Resources , Division of Water Resources ; and BE IT FURTHER RESOLVED that the Johnston County Board of Commissioners intends that this plan shall be revised to reflect changes in relevant data and projections at least once every five years or as otherwise requested by the Department , in accordance with the statute and sound planning practice rd This the 3 day of Manager Rick Hester , Director of Utilities & Engineering Tim Broome , and Director of Human Resources Pat LaCarter recognized employees from the Water Plant as well as the Human Resources Department for their extra effort displayed recently during a major water main break at the Johnston County Water Treatment Plant due to construction activities at the site It was noted that the staff worked diligently through the night to ensure that the break was repaired , that citizens had uninterrupted water service during the event , and the plant was brought back online in a timely manner Mr Broome commented that the contractor in charge of the improvements at the Water Plant was performing the work in accordance with the plans and specifications and was instrumental in helping to repair the break Mr Broome also thanked all the neighboring towns and counties that have mutual aid agreements in place with the County for emergency water supplies , noting that without those agreements , the water supply situation would have been much worse during the event Mr Broome recognized employees from the Water Plant in the audience as follows Randy Merson , Howard Mills , Dan Wall , James Davis , and Steve Beale Mr LaCarter recognized the employees from the Human Resources Department that assisted with getting vital information out to the public regarding the water main break during the event , as follows Lu Hickey , Melanie Proctor , Tim Builderback , Robin Gurgainus , and Valerie Beaty Mr LaCarter complimented the Water Plant employees noting they did an excellent job throughout the night working to repair the break The Board thanked the employees for their dedication and work that ensured that the citizens of Johnston County maintained water service and for their fast response Barbour recognized the employees in the 911 Communications Department , the Technology Services Department , and the Sheriff’s Office Mr Barbour reported that over the past weekend , the computer system at the main 911 Center in the Courthouse went down He stated that upon discovering the system error , staff immediately began procedures to activate the backup 911 Center located in Clayton to avoid a disruption of service to the citizens Mr Barbour spoke on the importance of having the backup 911 Center and he thanked the Board for their support as well as for recognizing the need and allowing the department to construct and equip the center Mr Barbour pointed out that during the event , the public was never aware that there was an issue due to the rapid response of staff and the activation of the backup center Mr Barbour stated the event was an excellent example of the staffs from 911 Communications , Technology Services , and the Sheriff’s Office working together to keep the public hearing and called on Economic Development Director Peggy Anderson to address the Board Ms Anderson stated the purpose of the hearing is to consider an Economic Development Incentive Grant EDIG the North Aviation Industrial Park west of the Town of Smithfield in Johnston County Ms Anderson reported the company plans to expand their current operation with the purchase and installation of 12 million in equipment and the addition of 45 new jobs Ms Anderson explained the EDIG would be predicated upon the company paying in full their annual ad valorem tax assessment , with those funds collected by the County and escrowed in amounts sufficient to fund the grant , based on the new investment She pointed out that at no time would the grant exceed the ad valorem tax payment by the company on the new investment Ms Anderson reported the Economic Development Advisory Board Incentive Committee has recommended EDIG terms consisting of a five year grant beginning in 2011 , according Carroll and asked her to review the recommendations with the Board Mr Parrish stated Ms Carroll is the mother of four children with one being a junior at South Johnston High School Lynda Carroll , Subcommittee Chair , stated that she has a passion for lessening teen deaths in Johnston County and she commented it has been a privilege to serve on the Committee Ms Carroll explained that the Committee first met in the fall of 2009 and three subcommittees were formed She stated the Committee has met with the State Highway Patrol and had the opportunity to experience the driving course where State Troopers are trained in defensive driving skills Ms Carroll also reported that the Committee members have researched programs in other States as well as met with representatives from driving simulator companies throughout the process Ms Carroll reviewed the Committee’s recommendations with the Board , as follows I Get Organized A Establish a permanent working group to monitor continued efforts regarding teen driving i This group will be the “ central receiving and distribution ” of all programs related to teen driving in Johnston County The group will be tasked to review Appoint A Teen Driving Safety Coordinator i This person will oversee the teen driving group listed above by facilitating meetings , researching existing programs , reaching out to other partnering agencies ii We recommend creating a position or assigning an existing county employee to ensure consistency and non - bias iii The Teen Driving Safety Coordinator will oversee the creation of a county website to address teen driving safety issues C Increase traffic stops and law enforcement presence at High Schools during arrival and departure times D Support efforts to identify coordination of teen driving programs at State Level i Currently , there are multiple agencies at the State Level assembling strategies and programs to aggressively reduce teen fatalities Department of Public student awareness Utilize programs already in existence such as the Texas program “ Teens in the Driver’s Seat ” which provides videos , t - shirts and other marketing strategies to gain the attention of teens and parents III Identify and Improve the Roadways in Johnston County A Create awareness of an already existing service , where all citizens , county employees , teachers , teens , etc can Currently , Driver’s Education in Johnston County is 37 hours of classroom training and 6 hours of behind the wheel driving This committee feels that students need more experience and training behind the wheel C This committee suggests shifting the Driver’s Education program back into the day educational curriculum either as part of the health curriculum or as an elective Classroom training only VI Improve Graduated Licensing Program GDL Page2805 May 3 , 2010 – 10 00 am Continued A Mandate a parental driving log where students and their parent guardian must spend at least 50 hours behind the wheel in training during the Level 1 of GDL Parents must sign off when completed B Look at requiring no driving after dark at Level II C Possible revocation of license for charges such as speeding , texting , talking on cell phone , etc Ms Carroll stated since January 1 , 2004 , Johnston County has had 42 teen fatalities due to motor vehicle accidents She stated it is a hard and cruel fact that teen deaths cannot be stopped in their entirety ; however , it is the Committee’s belief that Johnston County can lessen teen deaths through better organization , teen involvement , better communication with the Department of Transportation , and a look to the future with newer training methods Chairman Wade M Stewart thanked the Committee for the report and stated that all the members put in a tremendous amount of work and effort on the initiative Commissioner Tony Braswell expressed his appreciation to Mr Parrish and Ms Carroll along with Commissioner Cookie Pope who began the initiative with him Commissioner Braswell stated that two years ago when he and Commissioner Pope first began to discuss what could be done , they both agreed that Charlie Parrish was the right person to lead the effort Commissioner Braswell reiterated how important Mr Parrish and Ms Carroll have been to the Committee and he appreciates them taking the lead and following through Commissioner Cookie Pope recalled how she felt after leaving the homes of two families that had lost teenagers due to motor vehicle accidents and she decided that even if there was ultimately nothing that could be done , the Board had a moral responsibility to try Commissioner Pope stated she has teenage drivers in her family and she also strongly feels the need to find ways to lessen future incidents Commissioner Pope noted in the beginning there were people that asked her what else could be done , and she stated that the recommendations from the Committee are worthwhile for the Commissioners to research Commissioner Pope thanked Ms Carroll and Mr Parrish as well as all the Committee members that had a part in the report At the request of the Chairman , those Committee members in the audience introduced themselves and were recognized by the Board of Commissioners Chairman Stewart commented that the Committee has a true passion for their work and he thanked the Department of Transportation and the Governor’s Highway Safety Program for their help Chairman Stewart stated the Steering Committee is focused on lessening teen deaths in Johnston County and the Committee has the full support of the Board of Commissioners in their effort Sheriff Steve Bizzell agreed with Chairman Stewart and he reported that teenagers are not getting the message ; however , his office will do all they can to change that Sheriff Bizzell expressed his alarm that just over the past weekend , some of the teenagers leaving the funeral visitation of one of their peers , due to a motor vehicle accident , were themselves driving in a reckless manner Sheriff Bizzell stated the Sheriff’s Office would support and help with the efforts of the Committee Commissioner Allen L Mims , Jr stated he has heard that the State is considering cutting back on the funding for Driver’s Education courses Will Sanders , Driver’s Ed Coordinator for Johnston County Schools , explained that Driver’s Education courses are funded through the Department of Motor Vehicles DMV whereby , the DMV transfers the funds to the Department of Public Instruction DPI who oversees Driver’s Education Mr Sanders stated in the DMV’s proposed budget , they did not include the transfer of funds over to DPI for Driver’s Education Mr Sanders stated as of right now , the funding has been included in the Governor’s proposed budget , but nothing will be finalized until the General Assembly approves the budget Ms Carroll reported that the Committee learned , through Mr Sanders , that for every license plate registration renewal , 300 of the renewal fee is transferred from the DMV to the Department of Transportation which then forwards the funds to DPI ; therefore , she stated the public is funding the Driver’s Education Program Commissioner Mims expressed his support for the recommendations in the report , specifically , the recommendation to increase the hours of “ behind the wheel ” training during Driver’s Education classes Page3806 May 3 , 2010 – 10 00 am Continued Commissioner Mims stated the County has changed and traffic has increased dramatically over the years which necessitates more training behind the wheel Chairman Stewart stated one of the recommendations in the report is to formally appoint a Teen Driving Safety Coordinator for the County Following a brief discussion , it was the consensus of the Board to appoint Derrick Duggins , Johnston County Emergency Services , as the Teen Driving Safety Coordinator for the County At the inquiry of County Manager Rick Hester , Chairman Stewart stated the Steering Committee is still officially in place until further notice and he asked the members to keep working on the issue Commissioner Pope stated that the Board is always bragging on Johnston County being ranked # 1 in many areas ; however , she stressed that the County cannot be # 1 in teen fatalities due to motor vehicle accidents Commissioner Pope stated Johnston County must be the county that lessens the teen tragedies more than any other county in North Carolina Commissioner Jeffrey P Carver thanked the Committee for their work and stated he is looking forward to seeing the Board Ms Whittington introduced Past President Susan Lassiter , and Executive Director Zilphia Adcock Ms Whittington reported their current year’s operating budget totals 191,77783 and as of their last board meeting in April , their income for the year was just over 164,00000 She stated next fiscal year’s budget is 200,79600 Ms Whittington added they have one full time staff member and every year a membership drive is conducted Ms Whittington stated at least 67 of their budget goes to program expenses which are diverse and touch all areas of the County She reported on some of the programs as follows The Grassroots Arts Grants was the first program of the Johnston County Arts Council Since 1977 the Arts Council has administered these grants on behalf of the State of North Carolina and the North Carolina Arts Council Nonprofit organizations throughout Johnston County benefit from these grants These include Johnston County Schools Tobacco Farm Life Museum Johnston County Chorale Clayton Cultural Arts Foundation Clayton Visual Arts First Missionary Baptist Church Johnston Community College Clayton Area Development Foundation Johnston Community College Foundation Clayton High - Schools Ms Whittington stated the Arts Council sponsors many other programs , some at no cost and some at minimal cost , including Music for the Lunch Bunch , a summer weekly series of performances open and free to the public She stated they are in their second year of Plein Air Gatherings which give artists an opportunity to get together for a day of painting Additionally , an endowment fund was established by the Arts Council and is managed by the North Carolina Community Foundation which has annually provided money for two scholarships for students studying in fine arts and commercial art at Johnston Community College Ms Whittington stated the Arts Council continues to develop new programs that benefit and are accessible to everyone in Johnston County She noted new programs this year include a Community Read and the Piedmont Laureate Program Ms Whittington reported in their continuing efforts to fund programs , they recently held two successful fundraising events ; a golf tournament and their first Johnston County Arts and Food Festival Ms Whittington asked the Board for their continued support to the Arts Council The Board thanked Ms Whittington for the update 12 Public Utilities - Water Distribution Facilities to Serve Hialeah Subdivision in Wake County Sandy Mills , Utility Development Manager , requested the Board to adopt a resolution authorizing the submittal of a principal forgiveness loan application to the NCDENR – Division of Environmental Health , Public Water Supply Section under the Disadvantaged Community Program Ms Mills stated the funds would be used to construct a water improvements project to provide public water to 24 residences that are presently served by a community well system , known as the Hialeah Subdivision in Wake County , that no longer has the ability to maintain compliance with the Safe Drinking Water Act Ms Mills recalled that staff presented the initial request to the Board at the March 2010 meeting and since that time , staff has completed the preliminary engineering report for extension of a water main and installation of the new distribution system to serve Hialeah She stated staff estimates the project to cost 228,000 and reiterated that the funding would be a principal forgiveness loan , or grant ; therefore , the project would be at no cost to the County Commissioner Allen L Mims , Jr asked if everyone living in Hialeah Subdivision was aware of the County’s water policies and rates Ms Mills stated the residents currently pay approximately 35 per month each for water from the community well system and most likely , they may see their monthly water bills decrease once connected to the Johnston County system Ms Mills reported the State is trying to eliminate as many of the community well systems as possible because they tend to be problematic Commissioner Jeffrey P Carver inquired as to the timeframe of the construction project and if the principal forgiveness loan would cover all costs Ms Mills confirmed that the principal forgiveness loan would cover all costs associated with the project including design , permits , and construction , and the County would not have to contribute any funding She stated the construction should take approximately six to eight months to complete and staff hopes to bring the bids back to the Board of Commissioners for consideration possibly in July Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board adopted the following resolution authorizing the submittal of an application for a principal forgiveness loan for the water improvements project to serve Hialeah Subdivision in Wake County RESOLUTION BY JOHNSTON COUNTY BOARD OF COMMISSIONERS WHEREAS , The Federal Clean Water Act Amendments of 1987 and Safe Drinking Water Act Amendments of 1996 and the North Carolina Water Infrastructure Act of 2005 NCGS 159G have authorized the making of loans and grants to aid eligible units of government in financing the cost of construction of drinking water system improvements , and WHEREAS , Johnston County has need for and intends to construct a drinking water system project described as an emergency consolidation of a failing community well system in the Hialeah Subdivision , 3005 East Garner Road , Raleigh , NC 27610 of Wake County , North Carolina , by connecting to a public water supply involving a 6 - inch water transmission line extension from Johnston County’s surface water system and replacing existing distribution lines and water will provide adequate funds for proper operation , maintenance , and administration of the installed infrastructure for this project That Johnston County will provide for efficient operation and maintenance of the project on completion of construction thereof That Rick J Hester , County Manager , and successors so titled , is hereby authorized to execute and file an application on behalf of
