Commissioners met in regular session Wednesday , February 3 , 2010 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members Stewart called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Jeffrey P Carver led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – January 4 , 2010 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Middle Landing Drive , Burke Court , and Peach Court – Middle Creek Landing Subdivision – Smithfield Township Rosepace Court , Himself Court , and Herself Circle – Williams Farm Subdivision – Section One – Pine Level Township C Town of Clayton – Appointments to Board of Adjustment for ETJ Members At the request of the Town of Clayton , the Board appointed the following individuals to the Clayton Board of Adjustment representing the ETJ area of the Town Gary Anthony Jewell – 2003 Pinebark Lane , Clayton term expiring on 12 31 2012 William R Wenzel – 420 Falls Drive , Clayton term expiring on 12 31 2012 D Tax Department – Resolution Ratifying Agreement to Collect Taxes for Archer Lodge The Board adopted the following “ Resolution Ratifying an Agreement Contract for Interlocal Undertaking with the Town of Archer Lodge Relating to Tax Collection ” RESOLUTION RATIFYING AN AGREEMENT CONTRACT FOR INTERLOCAL UNDERTAKING WITH THE TOWN OF ARCHER LODGE RELATING TO TAX COLLECTION WHEREAS , the governing body of Johnston County has found and determined that it is in the public interest and for the public benefit to provide for the collection by Johnston County of ad valorem taxes levied by the town ; andPage657 February 3 , 2010 – 10 00 am Continued WHEREAS , the County Commissioners believe that Johnston County has the means to provide for the collection of the ad valorem taxes levied by the town ; and WHEREAS , the County Commissioners have examined and approve of a contract which provides for said County collection of town ad valorem taxes and details the legal relationship and duties of the parties thereto ; NOW , THEREFORE , BE IT RESOLVED by the Board of Commissioners of Johnston County that the contract entitled Agreement Relating to Collection of Town of ARCHER LODGE Taxes by Johnston County which provides for collection by Johnston County of ad valorem taxes levied by the Town of ARCHER unanimous vote 5 Veterans Services Advisory Board – Modifications to Courthouse Veterans Monuments Rudy Baker , Chairman of the Johnston County Veterans Services Advisory Board , and Ricky Byrd , Director of the Veterans Services Office , requested the Board of Commissioners to grant approval for the Advisory Board to add four new plaques to the existing Courthouse Veterans Monument as well as to add five names to the monument honoring those that have lost their lives in conflicts Mr Baker stated the Advisory Board has received a quote for the work in the amount of 8,555 and they intend to raise the funds necessary to complete the project through the “ Veterans Helping Veterans ” initiative Mr Baker also asked for the Board’s approval to hold a dedication ceremony on Memorial Day , May 31 , 2010 at 2 00 pm at the Courthouse Mr Baker shared photographs of the monuments as they presently exist as well as the proposed new plaques that would be added , if approved He stated the new on Memorial Day , May 31 , 2010 at 2 00 pm 6 Soil Conservation – Funding for Possible Conversion of USDA Computer System James Massey , Director for the Johnston Soil and Water Conservation District JSWCD , addressed the Board to discuss possible budgeting for new computer terminals Mr Massey introduced John Langdon , Chairman of the JSWCD , Jerry Raynor , District Conservationist , and Terry Ellis , Director of Technology Services for Johnston County Mr Massey explained that beginning with the Federal Fiscal Year 2011 beginning on October 1 , 2010 , USDA will begin charging soil and water districts a “ seating fee ” for each computer that is used by district personnel in the amount of 3,000 per computer on an annual basis He reported the JSWCD office currently has four County employees on the USDA network which would then require an additional 12,000 each year to be added to their budget Mr Massey stated the JSWCD has discussed the possible conversion of the County employees in the JSWCD office from the USDA network to the County system for an estimated one - time cost of 5,000 , not including the cost of the new computers He noted the JSWCD is exploring other funding sources to help offset the cost of supplying the new computers At the inquiry of the Chairman , Mr Massey confirmed that no funds are needed in the immediate ; rather the JSWCD is providing the information to the Board in advance of the budget preparations for FY 10 - 11 Commissioner Allen L Mims , Jr inquired how long the process would take to convert the local JSWCD over to the County computer network , Massey for the information 7 Recognition of Maryland Stacy Evans – Retired Health Department Nurse Health Director Dr Marilyn Pearson recognized Ms Maryland Stacy Evans who recently retired from the Johnston County Health Department after 35 years of service as a Public Health District Nurse Dr Pearson read the following resolution in honor of Ms Evans that was adopted by the Johnston County Board of Health on January 5 , 2010 Resolution to Honor Maryland “ Stacy ” Evans January 2010 By the Board of Health WHEREAS , Maryland “ Stacy ” Evans retired from the Johnston County Health Department after 35 years of dedicated service as a Public Health District Nurse , Tuberculosis , Communicable Disease , and STD Nurse , Public Health Home Care Coordinator , Director of Preventive Health Service and Director of Nursing ; and WHEREAS , in 1958 graduated from Richmond Polytechnical Institute , and continued her educational growth through studies from UNC School of Public Health , Wayne Community College , Johnston Community College , Western Carolina University , and the North Carolina Department of Human Resources Office of Public Health Nursing ; and WHEREAS in 1958 worked as a Registered Nurse in Private Sectors , she worked as a staff nurse and supervisor to both Maternity and Pediatric services at John Randolph Hospital in Hopewell , Virginia ; and WHEREAS , in – Request to Use Federal Funding Health Director Dr Marilyn Pearson requested the Board to approve the use of federal WIC Women’s , Infant , and Children funds to cover the cost of a vacant unfunded Community Health Aide position in the Health Department Dr Pearson stated the funding is from the 2010 Agriculture Appropriations Bill which increased WIC funds to North Carolina She reported funding to the Johnston County Health Department for April – June of 2010 is 7,375 , and continued funding is anticipated through Fiscal Year 2010 - 2011 to cover the cost of the position , including salary and benefits , anticipated at 25,720 Dr Pearson explained the WIC Program is a supplemental nutrition program serving pregnant and postpartum women , infants and children The program offers healthy foods , nutrition and breastfeeding support , and referral to health and community services She stated presently , the program serves over 3,600 clients in Johnston County , up from 3,233 clients in 2009 Dr Pearson reported the Community Health Aide position would provide breastfeeding information , encouragement , and support for new mothers and help to meet the increasing demand for services Upon a question by Commissioner Allen L Mims , Jr , Dr Pearson confirmed that the position is presently vacant and unfunded within the Health Department and she is requesting to use the funds for the position as long as they are available Commissioner Mims noted that the Board has approved adding positions in the past , so long as the state or federal funds were available to cover them He asked if the County has tracked such positions and if so , have any of the positions been eliminated once the funding was depleted Dr Pearson reported the Health Department has had one position eliminated this mind that the State continues to ask the counties to provide more services while providing less funding to help cover the cost of the services which places a hardship on the counties He noted that the upcoming budget discussions will be extremely difficult Page0665 February 3 , 2010 – 10 00 am Continued 10 Dr David Johnson – President , Johnston Community College Chairman Wade M Stewart recognized Dr David Johnson , President of Johnston Community College in the audience Dr Johnson stated his attendance was simply to continue to learn about the County and show his support to the Board of Commissioners on behalf of the Community College Dr Johnson stated the College is also anticipating a tough year financially and they are doing the best they can to manage within the strict confines of their budget Commissioner Cookie Pope noted that when the economy is down and unemployment is up , the enrollment at the College increases Dr Johnson agreed with Commissioner Pope and stated that for the second consecutive Spring enrollment period , the College has seen the enrollment numbers surpass the Fall whereas typically , the Spring enrollment numbers are usually not as strong as the Fall He stated the College will continue to ask for support from the Board of Commissioners as they do all they can to provide services and meet the demand Dr Johnson noted that there will come a time when the College will not be able to support the enrollment growth with the continued decline in their fiscal appropriations 11 Public Utilities – Capital Budget Ordinance Revisions Tim Broome , PE , Director of Utilities and Engineering , explained that the adopted Fiscal Year 2009 - 2010 budget for the Department of Utilities included 500,000 under Capital Outlay in the Water Fund for the first construction phase of the parallel 20 ” water transmission main to serve the East Clayton Industrial Area He stated the Capital Improvements Plan CIP provides for completion of the 20 ” water main project in phases over three to five fiscal years Mr Broome noted the recently announced Talecris expansion places a higher sense of urgency on the project He reported in late 2008 , design and permitting began for a water transmission main from the vicinity of the water plant in Wilson’s Mills to the Cleveland and Little Creek Water Districts The proposed main is in the CIP and is required to meet near term peak daily demands in the western area of the County Mr Broome stated staff was unsuccessful in obtaining funding from ARRA stimulus funds , but anticipates receiving a USDA – Rural Development low interest loan for the project in the near future Mr Broome reported the Wilson’s Mills to Cleveland main has been designed with several “ cross country ” segments which require utility easements Design and permitting costs were covered in the budget ; however , sufficient funds are not available for the acquisition of easements Therefore , Mr Broome stated staff recommends that the 500,000 amount budgeted for the East Clayton Industrial Area water main be used for initial funding of both projects with 200,000 allocated for the East Clayton Water Main and 300,000 allocated for the Wilson’s Mills to Cleveland Area water main He asked the Board to adopt capital budget ordinances , if the Board agrees with staff’s recommendation Upon a motion by Commissioner Allen L Mims , Jr filed resulting in a collection of 31,85935 As of January 29 , 2010 , the Tax Department has collected 9219 of the real and personal levy for 2009 , and 7869 of the motor vehicle levy Through the NC State Debt SetoffPage3668 February 3 , 2010 – 10 00 am Continued Program , 92 accounts have been paid for a total of 10,74280 as of January 29 , 2010 The next foreclosure sale date is February 24 , 2010 Ms Goddard also reported that pursuant to NCGS § 105 - 369 a , 5,906,61827 of the 2009 levy remains unpaid amount represents real property only Pursuant to NCGS § 105 - 369 c , tax liens will be advertised in March Ms Goddard noted that the current real property value has increased 211 for 2010 15 Recognition of Various Departments and Staff During Recent Inclement Weather Chairman Wade M Stewart expressed his appreciation of the extensive coordination that was provided by Emergency Services , 911 Communications , Sheriff’s Office and all other individuals during the recent inclement weather Chairman Stewart stated that he was able to stop by and see firsthand the impressive organization and planning that takes place during such events Chairman Stewart asked Kim Robertson , Director of Emergency Services , to give a report on the recent weather event Ms Robertson reported that the Emergency Services staff began monitoring calls for assistance associated with the inclement weather over the week end on Friday night She noted that the staff worked diligently throughout the weekend helping to transport nurses back and forth to the hospital to work Ms Robertson expressed her appreciation to the local Fire Departments and EMS Units for their support during the weekend She stated the weather event was met with a coordinated effort by many agencies Ms Robertson stated that the Sheriff’s Department was also a tremendous resource to the Emergency Services staff during the inclement weather event as well as anytime they are needed Chairman Stewart agreed with Ms Robertson that it takes a great deal of coordination between agencies to respond to severe weather events in an organized manner and he along with his fellow Commissioners sincerely appreciated their efforts 16 Manager Reports and Comments A Recognition of Various Departments & Staff During Inclement Weather County Manager Rick Hester extended his sincere appreciation and recognition of the efforts by Emergency Services , Sheriff’s Office , Building and Grounds , Human Resources as well as all other individuals during the recent inclement weather Mr Hester also thanked Tim Broome , PE , Director of Utilities & Engineering , noting that Mr Broome has provided a great deal of assistance to him recently on several projects B Request for Closed Session The County Manager requested a closed session pursuant to NCGS § 143 - 31811 a 4 Location Expansion of Industry 17 Board Reports and Comments A New Hospital Patient Tower Commissioner W Ray Woodall reminded everyone that the Hospital is in the process of moving patients to the new tower this week and he asked for everyone to have patience during this transition period Commissioner Woodall further stated that he is very impressed and pleased with the extensive new technology available within the new patient tower and it is something for Johnston County to be proud of B Roadside Litter Commissioner Allen L Mims , Jr expressed his concerns with the overabundance of roadside litter in the County and initiated a brief discussion regarding the associated fines and enforcement of the littering statutes and ordinances Following discussion , it was the consensus of the Board to look into the matter in more detail at an upcoming annual work session C Board Annual Work Session At the request of the Chairman , County
