Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Wade M Stewart , Chairman , Allen L Mims , Jr , Vice Chairman , Cookie Pope , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , J Chad McLamb , Finance Officer , David Mills , Interim County Attorney , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Wade M Stewart called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer At the request of the Chairman , Commissioner Tony Braswell recognized his son , Sergeant Patrick Braswell who is midway through serving a term in Afghanistan in the 2nd Army 1 - 17 IN Division Commissioner Braswell reported that this division was recently featured in the Army Times as having lost more soldiers than any other unit in Afghanistan Commissioner Braswell spoke on how proud he is of his son as well as all the soldiers that are serving and sacrificing their lives for our freedom Commissioner Braswell along with his son , Sergeant Braswell , led those in attendance in the pledge of allegiance to the American flag The Board applauded and thanked Sergeant Braswell for his service to our country 1 Approval Discussion of Agenda Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – December 7 , 2009 10 00 am the County Address Johnston County , North Carolina Good morning Once again , it is my privilege to provide the annual State of the County Address I would like to start off by saying what I believe we all know , that it has been a stressful year filled with much economic turmoil for everyone We have seen many of our citizens lose their jobs and struggle to care for their families in the recession We have seen businesses close and others significantly downsize We have seen thePagePage pageNumber7632 January 4 , 2010 – 10 00 am Continued farmers left trying to recover from last year’s drought along with the increasing cost of fuels and supplies The churches , non - profit organizations , and recreational groups have also suffered due to the decrease in contributions The Fiscal Year 2009 – 2010 budget was perhaps one of the toughest we have ever faced , and unfortunately , it appears that the upcoming Fiscal Year 2010 – 2011 budget preparation will be even harder to work through In anticipation of the difficult time ahead , County government must continue to do more with less and strive to find savings wherever we can I must ask again this year , for every County department to find ways to continue to conserve Remember , our citizens are still facing hard times and we owe it to them to do our best With that said , I am pleased to report on some of the positive events that occurred in 2009 After many months of work , the Board adopted the Comprehensive Land Use Plan in March of 2009 As a result of the passage of the 2007 recreation bond , many of the community recreation projects were completed or are well on their way to completion We sold the last package of bonds this past summer and are pleased that we maintained our strong bond ratings As a result of those bond sales , the new Corinth Holders and Cleveland High Schools will be ready for students in the fall of 2010 We held community forums and established a committee to find ways to reduce and hopefully eliminate teenager driving injuries and deaths This continues to be one of the Board’s highest priorities We appreciate the strong working relationship we have with the Board of Education and Johnston Community College Our primary responsibility is providing funding each year , and we will continue to do the best we can with the funds we have available All of us are likely to operate next year on the same or less funding than the current year We are completing the final water district in Johnston County The water district program began in the mid - 1990 ’ s with the Hopewell - Pisgah Water District The combined districts currently have 27,000 services serving over 60,000 people in the County who reside outside towns There are still areas inside the 16 water districts that have not been served due to a lack of signups and budget limitations We will continue to look for opportunities to serve those areas when feasible Announced a 268 million expansion by Talecris of Clayton which is anticipated to add 259 new jobs In looking to 2010 , we must continue to be mindful of the recession and closely monitor our spending while balancing the needs of County government I look to the future of our County with hope and optimism I think I can speak for the entire Board in saying our number one priority will continue to be to do whatever we can to facilitate job retention and job growth As mentioned earlier , we recently had the largest economic development announcement in the history of our County from Talecris To me , that announcement alone is a sign that the growth in the commercial and industrial sectors will pick up , even though the recovery may be slower than normal I am also hopeful that we will see residential construction resume and more jobs created to help those that are unemployed As I stated last year , Johnston County is a great place to live , work , play and raise a family I still strongly believe this and always will I know that together , we can help Johnston County thrive once again 5 Presentation of Audit Report for Year Ending June 30 , 2009 Alan Thompson with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2009 He stated the County received an unqualified opinion , ie , “ clean report ” and there were no significant audit findings Mr Thompson reviewed a summary of financial information with the Board from 2005 to 2009 He noted that the County saw a considerable decrease in sales tax revenues in 2009 Mr Thompson also pointed out information demonstrating the annual increases in debt service and funding forPagePage pageNumber8633 January 4 , 2010 – 10 00 am Continued education which he commented presents a challenge going forward He noted that the audit report lists the total debt amount for governmental activities excluding water and sewer debt at 404,980,953 , of which 387,242,884 pertains to debt incurred for assets for Johnston County Schools He stated a continuing challenge for the County will be the ongoing educational costs needed to support the school system due to the County’s growth Mr Thompson also stated he believes the school system will be facing significant funding challenges of their own due to the budget shortfalls at the State level Mr Thompson reviewed the remainder of the financial information with the Board , as outlined audit is the County’s tax collection rates have remained steady over the years and the current collection percentage rate is 9959 excluding motor vehicles which he stated is incredible given the current state of the economy Mr Thompson reviewed information in the audit regarding contributions to the pension plan and other postemployment benefit obligations which consist of what the County owes for costs associated with future health insurance to retirees and other benefits Mr Thompson stated as of June 30 , 2009 , the unfunded actuarial accrued liability was 77,766,836 He noted that the liability will be paid out overtime ; however , it is a significant amount Mr Thompson offered to answer any questions by the Board At the inquiry of Commissioner Cookie Pope , Mr Thompson stated the postemployment benefit liability is not the result of any newly enacted legislation , but has more to do with health insurance and other non - retirement system type costs Mr Thompson stated there is potential for retirement system costs to increase in that the State’s pension plan is underfunded and the State may look to the counties to fund a larger portion in order to balance the funding Chairman Wade M Stewart asked if actuarial accrued liability estimates were available for past years in order to determine how often and how much the number has increased Mr Thompson responded that the information could be generated ; however , he indicated that it would be an extensive research project to complete in that the payroll records and policies at the specific time would have to be accounted for Mr Thompson stated going forward it will be easier to monitor the estimate and report on its status every fiscal year Chairman Stewart stated he would like a report on the number each year to have a better idea of all future obligation estimates Commissioner Allen L Mims , Jr pointed out that the County’s total outstanding debt in the audit totals 516,164,001 and the County has 37,555,000 in General Obligation refunding bonds authorized but un - issued as of June 30 , 2009 Commissioner Mims noted that in the audit , it reads , “ the State of North Carolina limits the amount of general obligation debt that a unit of government can issue to 8 percent of the total assessed value of taxable property located within that government’s boundaries ” He expressed concern with the upcoming 2011 revaluation and asked what would happen if the County goes above the required 8 percent threshold Mr Thompson responded he was unsure what would happen if the County exceeded the 8 percent required threshold ; however , he stated that he believes a key factor for any bonding or State agency would be to consider if the cash flow projections indicate the ability to service existing debt He stated that as long as the existing debt could be covered , then he did not believe the State would do anything significant , other than request the County come back into compliance over time Commissioner Jeffrey P Carver commented on the importance for the County to maintain or improve the bond ratings Commissioner Carver expressed his concerns on how the County will pay for future needed projects such as the deferred maintenance on the old courthouse He also noted he is deeply concerned with the increasing expenditures versus the decrease in revenues along with decreasing investment income , increasing pension plan costs and contingent liabilities Commissioner Carver stated significant impacts to the County’s budget will be coming including the recently Jeffrey P Carver seconded the motion , which carried by unanimous vote Page1636 January 4 , 2010 – 10 00 am Continued 6 Public Hearing – 10 20 am – Amendments to Code of Ordinances – Section 4 Animals Advertised – In The Smithfield Herald – December 23 and December 30 , 2009 The Chairman opened the public hearing Ernie Wilkinson , Director of Animal Services , stated the purpose of the public hearing is to solicit public comment on proposed revisions to the Code of Ordinances as it relates to Section 4 – Animals Mr Wilkinson clarified that Johnston County Animal Services and the codes that govern their operation do not affect or have any jurisdiction over the municipalities and the County does not enforce municipal animal control regulations Mr Wilkinson explained there have been several changes made to NC General Statute § 130A by recently passed legislation He noted some of the changes include the addition and clarification of several animal related definitions , ie , stray and dangerous dogs ; the inclusion of ferrets within the State’s rabies vaccination statute ; and the allowance for a rabies vaccination fee at the County sponsored clinics Mr Wilkinson stated staff has drafted the proposed revisions in order to be in compliance with the recently passed legislation , as well as , to address issues that Animal Control is facing regarding equine and other types of animals At the inquiry of Commissioner Jeffrey P Carver , Mr Wilkinson reported that North Carolina Animal Welfare established the euthanasia qualifications for animals domestic dogs and cats in North Carolina , which allows for injection or carbon monoxide He explained any animal that is sick , injured , or less than four months of age must be euthanized by injection , otherwise carbon monoxide is allowed Mr Wilkinson stated Johnston County Animal Services utilizes the services of a veterinarian who comes into the shelter on an as needed basis to perform euthanasia as prescribed by the State He reported Johnston County has three EBI injection certified technicians and four carbon monoxide certified technicians on staff Commissioner Tony Braswell asked Mr Wilkinson to comment on how the recession has affected the rate of abandoned animals Mr Wilkinson reported in the last eight months , Animal Services has seen a significant increase in the number of abandoned and surrendered animals by individuals who have had to downsize due to the loss of employment and are now unable to care for their pets Mr Wilkinson stated his staff is dedicated to finding homes for the animals and their adoption success rate is very good He noted Johnston County has approximately 30 animals available for adoption featured in this month’s issue of Training Secrets for Rescued Dogs which is published by Dog Fancy Magazine Mr Wilkinson stated it is an emotional issue for his staff to see how the economy has affected animals and they work hard to find suitable homes Commissioner Carver asked for an update on the adoption rate Mr Wilkinson reported the adoption rate presently stands at approximately 47 and the shelter had a good holiday season with the adoption of almost 400 animals Mr Wilkinson stated last year , his staff answered over 16,500 calls with three officers Commissioner Cookie Pope noted that the Johnston County Animal Shelter was recently featured in the State Farm magazine Upon comments by Commissioner Braswell , Mr Wilkinson confirmed that staff is also handling more exotic animals along with the more familiar dogs and cats He noted that equine issues are becoming more of a problem and the proposed amendments to the ordinance should help with those matters At the request of the County Manager , Mr Wilkinson reported that even though Johnston County does not enforce animal regulations for the municipalities , the County does provide emergency backup services for the towns in situations with aggressive animals where the local police departments may not have the expertise or equipment He clarified that the ETJ areas of the towns are enforced by the County Cindy Stansell , 2199 Government Road , Clayton , addressed the Board and stated she has been involved in the sport of dogs show and agility for over 25 years as well as she is an animal obedience instructor , CGC Evaluator , AKC Judge , and has served on the National Pet Population Council which reviews shelter issues Ms Stansell stated she is also a co - founder of a breed rescue group in North Carolina , a founding member of the Johnston County Kennel Club , and serves as a consultant to a leading kennel club in China Ms Stansell askedPage2637 January 4 , 2010 – 10 00 am Continued the Board not to approve the proposed amendments to the Animal Services code at this time She spoke on her concerns with the language in the definitions regarding vicious animals , direct control , and the lack of a hearing process for dangerous dogs Ms Stansell stated she has reviewed the amendments and has found a number of inconsistencies as well as grammatical problems Ms Stansell offered to work with the County staff on the ordinance amendments At the inquiry if Commissioner Carver , Ms Stansell offered to donate her time to work with the staff on the revisions Shelia Goffe , 1935 Steven’s Chapel Road , Smithfield , Director of Governmental Relations for the American Kennel Club , stated she has also reviewed the amendments and agrees with the comments by Ms Stansell Ms Goffe stated she believes there are some areas in the amendments that could be improved in order to benefit both the community and animal owners Ms Goffe spoke on her concerns with the proposed amendments regarding the definition of a potentially dangerous dog She stated there may be instances where a dog may bite under pressure from provocation , which under such circumstances , she would not consider the animal a “ potentially dangerous dog ” Ms Goffe also spoke on issues involving the definitions for cruelty , negligence , and direct control Commissioner Allen L Mims , Jr stated that while Ms Goffe had some good points , the County employs staff to handle animal control issues Commissioner Mims indicated staff would review situations involving complaints on dangerous dogs , negligence , etc and would listen to all parties involved before making determinations He noted that he receives many complaints from citizens regarding animals coming onto their property and he believes that a strong ordinance needs to be in place to address such issues Ms Goffe also volunteered her time to work with the County staff on the proposed amendments Chairman Wade M Stewart asked for the County Attorney to comment on the amendments Interim County Attorney David Mills reported staff reviewed the amendments in depth to make them consistent with North Carolina General Statutes ; however , they would be glad to work with Ms Stansell and Ms Goffe on their suggestions There being no further comments , the Chairman closed the public hearing Commissioner Allen L Mims , Jr moved the Board table the proposed amendments to allow staff time to review the changes and work with the citizens that spoke during the public hearing on their concerns Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote 7 Health Department – State of the County Health Report Health Director Dr Marilyn Pearson stated that Cynthia Toudle , Johnston County Health Education Supervisor , would be presenting the State of the County Health Report Dr Pearson explained that the Health Department is charged with developing an annual health report along with the development of a community health assessment every four years Dr Pearson called on Ms Toudle to present the report Ms Toudle informed the Board that the Health Department has completed the 2009 State of the County , Health Report which is a tool created by the Health Education Section to inform the Johnston County community of current health updates Ms Toudle reviewed the demographic information in the report with the Board She noted that Johnston County’s percentage of uninsured adults has increased significantly to 228 and the Health Department is continuing to see more and more people coming to the Health Department for care due to job losses and the lack of insurance Ms Toudle reminded everyone that the Health Department will be holding a panel discussion on January 13 , 2010 at 4 00 pm in the Agricultural Building Auditorium to talk about health care for adults that have no insurance Ms Toudle noted the Board of Commissioners established a committee to review teenage driving safety issues and she reported the County saw a decrease from 2007 to 2008 in the number of motor vehicle accident deaths among 15 – 19 year olds Ms Toudle stated a new category regarding Deaths by Mental Behavior Disorders has been added to the report since the Health Department is beginning to see deaths caused by individuals experiencing mental disorders including loss of memory and dementia Ms Toudle reported on the following leading causes of mortality morbidity in Johnston County as follows Page3638 January 4 , 2010 – Diseases Bacterial 35 27 24 31 Ms Toudle pointed out the rate of obesity for 5 – 11 year olds is rising and is affecting an estimated 303 of this age group She reported the Health Department is deeply concerned over obesity in the preadolescent phase due to the increased risk of chronic illness later on in life Ms Toudle reported on the emerging health care issues in the County and strongly encouraged everyone to get vaccinated for the H1N1 as well as seasonal flu She stated throughout 2007 – 2008 , there were 530 influenza - like illnesses reported and in 2008 – 2009 , the number increased to 1,343 Ms Toudle complimented the efforts of Dr Pearson and the Health Department staff on making the vaccine available to the citizens Upon a question by Commissioner Tony Braswell , Ms Toudle explained that the number of influenza cases in the report are those that have been confirmed by their doctor ; however , she noted there are a lot of people who have the flu but do not visit their physician and receive a confirmation on the illness Ms Toudle concluded her report and stated she is always available at the Health Department for more information 8 Public Utilities – East Clayton Industrial Area Parallel Water Transmission Main Tim Broome , PE , Director of Utilities and Engineering , explained that in 1974 , an existing segment of 16 ” asbestos cement AC pipeline was installed from the Town of Clayton water system to the Talecris Corporation property Subsequently , 16 ” ductile iron pipeline extensions were connected to the AC pipeline at the Talecris entrance and in Clayton at the intersection of East Main Street and Compton Street Mr Broome stated in 2008 , a hydraulic deficiency was identified in the County’s water transmission system serving the East Clayton Industrial Area The 16 ” AC main has four fire pumps and two sprinkler systems connected which , in an extreme event , could overdraft the pipe segment and cause structural failure of the pipe He stated the situation can be corrected with the installation of a parallel 20 ” ductile iron water main from Talecris to Compton Street , running parallel to the Norfolk Southern Railroad He noted the project will consist of approximately 16,000 lf of pipeline and two railroad crossings Mr Broome reported the total estimated project construction cost , exclusive of technical services and easements , is approximately 2,000,000 Funds for the first of three phases of the pipeline construction were approved in the FY 2008 - 2009 budget , and carried over to the FY 2009 - 2010 budget He stated the Utilities Department staff pursued stimulus funding for the project , but without success ; therefore , a low interest loan application has been submitted to USDA – Rural Development , which is now under review Mr Broome went on to explain that the Town of Clayton water system improvements plan includes installation of a 10 mg elevated water tank in the vicinity of the Town’s fire station on NC 42 East He stated the elevated tank , in concert with the 20 ” parallel water main , will significantly improve hydraulic capacity of the East Clayton Industrial Area water system , and the estimated construction cost of the tank is 2,650,000 The Town has applied for a state grant and federal loan assistance for the project Mr Broome noted that the recently announced expansion of the Talecris Corporation biological pharmaceutical facility adds priority for completion of both the Town and County water system improvements project Page4639 January 4 , 2010 – 10 00 am Continued Mr Broome introduced Skip Green , Grants and Loans Consultant , who has contacted the Economic Development Administration EDA on behalf of the County and the Town to determine if EDA grant funds could be available for the combined projects on the basis of the Talecris expansion Mr Broome also noted that some grant funds could be available from the NC Rural Center ; however , he stated there may be some risk to the County and the Town in that if the jobs anticipated with the Talecris expansion are not created , the County and the Town would have to pay back to the Rural Center , a portion of the grant funds However , Mr Broome stated the project is necessary and would ultimately have to be constructed with or without the Rural Center grant funds ; therefore , staff believes the risk is justified Mr Broome outlined the project on an aerial photograph for the Board Commissioner Jeffrey P Carver asked if any additional income would be generated as a result of the project to help service the debt on the low interest loans that would have to be secured for the construction Mr Broome stated the funds for the debt service on the project would have to come from other sources ; however , he noted that funds in the amount of 500,000 are allocated in this fiscal year’s budget towards the project Mr Green addressed the Board and reported the EDA’s response to the project has been favorable , and he has prepared a joint application package for a total grant request of 1,500,000 , for the 51 million project Mr Green stated he has also contacted the NC Rural Center and has determined that 1,000,000 in grant funds may be available to both the County and Town on the basis of the number of jobs to be created with the Talecris expansion Mr Green noted he is working with Talecris representatives to get documentation on the number of jobs to be created for submittal to EDA and the NC Rural Center He stated the NC Rural Center requires the jobs to be created within three years of the time the grant offer is made The balance of funds required by the County and Town would come from low interest loans from USDA – Rural Development The Board thanked Mr Broome and Mr Green for the update and asked to be kept informed 9 Council on Aging – Request for Funding for Accessibility Ramps Note Request was tabled at the December 7 , 2009 meeting Chairman Wade M Stewart called on representatives from the Council on Aging to come forward The request by the Council on Aging for the Board to consider appropriating funding in the amount of 10,000 to build accessibility ramps at the homes of mobility challenged senior citizens was tabled at the December 7 , 2009 meeting Kay Carroll , Council on Aging Board Member , introduced Mickey Martin and Executive Director Jane Schirmer from the Johnston County Council on Aging COA Mr Carroll recalled that during the discussion on the request at last month’s meeting , the Commissioners questioned how many ramps could potentially be constructed in between now and the end of this fiscal year Mr Carroll stated after review , the COA has determined 24 ramps could be constructed He reported that the Johnston Union Baptist Church and the First Baptist Church in Smithfield have committed to building 12 ramps each Mr Carroll noted the Johnston Baptist Association will be holding Operation Inasmuch during the spring and has offered to construct all 24 ramps during that week He reported that most of the senior citizens requesting the ramps do not have the means to construct the ramps for themselves Chairman Stewart stated the Board is not unsympathetic to the request and they realize there is a need for the ramps ; however , the Board has tried not to approve appropriations mid - budget year , unless it is an emergency situation He stated the Board typically reviews such requests during the budget discussions each year in June Commissioner Tony Braswell agreed that the project is worthwhile , and he asked if the COA had funds available to float the project until such time as the Board could look at appropriating funds during FY 10 - 11 Mr Carroll stated the COA has no discretionary funds available for the project He explained that most of the COA funding comes from grants that are targeted for specific programs and cannot be used as discretionary funds He stated the Johnston Baptist Association would need to know by the first of February 2010 if the funds for materials are available so they can plan their projects to be constructed during Operation Inasmuch Mr Carroll stated the two churches could do the projects whenever the funds become available Page5640 January 4 , 2010 – 10 00 am Continued Commissioner Braswell stated in the last month , he has personally experienced a situation whereby he knew of someone that needed a ramp in order to maintain their mobility and he could understand the need is there Commissioner Braswell indicated that while he sees the need , he would like to possibly come to some kind of agreement with the COA that if the request is approved , then perhaps the COA could receive a budget appropriation next fiscal year 10,000 less Commissioner W Ray Woodall stated he can appreciate the request by the COA ; however , everyone’s budget has been affected by the recession and although no one wants to deny the request , there comes a time when hard decisions must be made Commissioner Braswell stated as he understands the request , the COA is looking for a commitment of funding in order to give the go ahead to the Johnston Baptist Association so they can plan on building the ramps during their spring project Mr Carroll agreed with Commissioner Braswell and stated if the Board cannot approve the entire request at this time , the COA would use any amount of funds that could be appropriated to build as many ramps as possible Commissioner DeVan Barbour commented that he understands the current budget situation ; however , he feels the project is important and he would like for the Board to fund some portion of the project so the COA can make some headway , if the entire amount cannot be committed Commissioner Jeffrey P Carver stated the County appropriates approximately 250,000 each year to the COA that is not earmarked to specific programs He also noted that four years ago , the County appropriated 400,000 to the COA for their building on a lease back arrangement Commissioner Carver stated other boards and committees that he sits on also have needs and he has told them that the County cannot provide any additional funding at this time Commissioner Carver stated everyone must operate on less and given the audit report earlier in the meeting , he is unsure if the County can afford to appropriate the funds at this time Mr Carroll reiterated that the project is worthwhile and the COA hopes the County can see fit to approve the request At the inquiry of Commissioner Carver , COA Executive Director Jane Schirmer , stated the 110,000 in the COA’s reserves is one month’s payroll for the COA She reported their total budget collectively , including JCATS , Senior Elderly Housing , and the Senior Services Block Grant Administration is approximately 4 million Commissioner Allen L Mims , Jr moved the Board deny the request for funding to the COA at the present time and revisit the request during
