5 , 2011 – 10 00 am Continued Commissioner Tony Braswell thanked Mr Holloman for his work during his tenure as EMS Training Officer B Animal Services Grant Award Director of Animal Services Ernie Wilkinson reported on two grants received by Johnston County Animal Services from the ASPCA in the amount of 3,000 and the Humane Society of the United States in the amount of 3,000 Mr Wilkinson stated the grants will be used for internal renovations primarily in the veterinary care area Mr Wilkinson also reported the spay and neuter program on adopted animals continues to increase He noted that six years ago Animal Services saw an average of approximately 22 adopted animals each month being spayed or neutered and now , the number has increased to over 150 animals per month Mr Wilkinson stated the Animal Services adoption contract requires all adopted animals to be spayed or neutered within 30 days The Board congratulated Animal Services on the grant awards 5 Request to Address the Board – Colonel Dennis Nielsen Mr Nielsen was not present Note Mr Nielsen attended the 6 00 pm meeting and presented his request , upon which the Board took no action 6 Triangle Land Conservancy – Narron Farm 2 Conservation Easement Partnership Robert Howes , Conservation Project Manager with the Triangle Land Conservancy , addressed the Board regarding a potential partnership between the County and the Triangle Land Conservancy TLC for the Narron Farm 2 Conservation Easement Project Mr Howes explained that TLC seeks to partner with Johnston County to protect approximately 82 acres along the Little River which would be donated by the landowner Mr Howes stated that TLC requests up to 19,000 from the County’s stormwater fee - in - lieu program to be used towards the survey costs and stewardship He noted TLC has secured grants from the Clean Water Management Trust Fund and the NC Environmental Enhancement Grant Program which will also contribute towards the transaction costs The landowner is contributing funds to TLC for the stewardship as is required in the conservation easement agreement Mr Howes presented the following budget for the project and offered to answer any questions Upon a question by Chairman Allen L Mims , Jr , Mr Howes reported the easement project would help protect the federally endangered dwarf wedge mussel as well as water quality which is an issue due to drainage from the property into the Little River Mr Howes stated TLC is also in partnership with the Clean Water Management Trust Fund for the conservation easement Commissioner Wade M Stewart noted that the budget calls for 13,500 of the County’s stormwater fee - in - lieu funds to be used towards stewardship of the easement and he asked what stewardship would involve PagePage there are no violations to the easement agreement He explained the cost estimate for stewardship is determined using a formula created by the Clean Water Management Trust Fund Mr Howes continued that the stewardship monies would be placed in an endowment dedicated to the specific project He stated once the funds are spent , TLC would be responsible for the ongoing obligation Commissioner Jeffrey P Carver noted the County would be contributing the largest amount of money towards stewardship at 13,500 with the Clean Water Management Trust Fund contributing 1,550 and the landowner contributing 2,000 He asked if the funds would become part of TLC’s operational budget Mr Howes stated the funds are placed into a separate account specific to the easement project and are drawn down as needed Commissioner Stewart questioned how the tax value of the property would change if the conservation easement project is approved Mr Howes stated tax values are based on the ability to develop properties ; therefore , if the conservation easement is approved , the tax value of the property would probably decrease Mr Howes added that if the property is already in the farm use tax deferment program , then the value is most likely already low Tax Administrator Pat Goddard stated the Tax Office does consider conservation easements when determining tax values and noted that most all of the conservation easements are already in the farm use tax deferment program Commissioner DeVan Barbour asked , in TLC’s annual inspection of the easement property , how they would address drainage or runoff issues on adjacent land Mr Howes stated while TLC is aware of activities on neighboring properties , there is little they can do unless the neighboring activities are directly impacting the easement property Commissioner Tony Braswell asked how TLC becomes involved with landowners on conservation easement projects Mr Howes reported TLC is contacted by interested landowners through word - of - mouth as well as TLC performs outreach by working with Soil & Water Conservation , the Forestry Service , and other appropriate agencies Commissioner Cookie Pope asked if timber harvesting is restricted on the conservation easement property Mr Howes stated timber harvesting is restricted within the buffer area of the easement ; however , timbering is allowed on the remainder of the property so long as best management practices are followed Chairman Mims inquired from staff as to the available funding in the stormwater fee - in - lieu fund Chandra Coats , PE , Public Utilities Engineering and Construction Manager , reported that approximately 400,000 remains in the stormwater fee - in - lieu fund She noted the fund has only been used on one other conservation easement project in Wake County She reported the original project loan was estimated at 301,10500 Ms Coats stated the work is complete which has resulted in the actual cost of the project running under budget by 24,90891 Ms Coats stated staff respectfully requests approval of a budget revision to reconcile the actual costs to equal the final principal forgiveness amount of 269,958 and establish a revenue account for the upcoming sales tax refund in the amount of 6,23809 The final cost of the project was 276,197 to serve 31 customers with County water which represents 24 new customers covered by the this Section 3 clause in all contracts executed under this CDBG Program Where necessary , listings from any agency noted above deemed shall be included as well as sources of subcontractors and suppliers The prime contractor selected for major public works facility or public construction work will be required to submit a Section 3 Plan which will outline his her work needs in connection with the project Should a need exist to hire any additional personnel , the Johnston County Employment Security Commission shall be notified and referred to the contractor Prior to advertising for construction contracts , Johnston County will advertise in a local newspaper an advertisement , prominently located as a display advertisement , the pertinent information regarding the project Employment and Procurement Plan Johnston County maintains the policy of providing equal employment opportunities for all persons regardless of race , color , religion , sex , national origin , 2011 Johnston County Community Development Block Grant Program Project # 10 - C - 2212 Procurement Policy Johnston County County shall use the following guidelines in the procurement of services and supplies , which will be financed whole or in part by Federal funds as applicable by program regulations 1 OFFICE SUPPLIES AND EQUIPMENT The County will use the Small Purchase Procedure for the procurement of supplies aggregate shall not exceed 10,000 The County shall prepare a list of the supplies that are anticipated to be needed during the startup and course of the project This list will be given to at least three vendors in the general area The County shall select the supplier vendor based upon the low bid for the total purchase 2 PROFESSIONAL SERVICES The County shall use the Competitive Negotiation Procedure for the procurement of professional services The following guidelines will apply a A notice soliciting professional service proposals will be placed in a newspaper with local circulation at least 14 days prior to the selection date b A Request for Proposal will be developed and sent to at least three interested firms or individuals known to provide the solicited professional services The Request will follow the procurement guidelines as expressed by Federal program guidelines and set forth clearly the requirements that the offeror shall be expected to fulfill c Proposals must contain cost of service expressed as a lump sum cost or a not to exceed cost with hourly rates Note Engineering firms are exempt from having to include a lump sum or not - to - exceed statement in their proposals d An adequate number of responses from qualified sources must be received in order to proceed with the selection process If this is not the case , then the County must follow the above - described procedure for a second time and expand the area of circulation of the advertisement On the second solicitation , any response may be reviewed for selection , but the County need not be obligated to accept the single proposal and may elect to begin the process again e Awards will be made to the responsible firm person having the ability to perform successfully under the terms and conditions of the proposed procurement Factors to be considered in the award of contract include contractor integrity ; record of past performance , experience ; education ; familiarity with the subject matter and with the County , etc Contract award cannot be based upon evaluation of cost of service alone Once a candidate has been selected , the County at its option may negotiate the cost of service Proposals will be reviewed on the following bases 1 CONTENT REVIEW Each proposal received will be evaluated to determine how the respondent addressed the scope of services Review should include a look for clarity , project understanding , feasibility and staffing qualifications to administer the service The proposal which most clearly meets this review should be ranked highest and should receive a 20 point score The average proposal should receive a 10 point score Proposals which contain poor contents should receive a 1 point score If no proposal is assessed to have superior contents or exceptionally poor contents , the rankings should be consistent at 5 points Page4632 December 5 , 2011 – 10 00 am Continued 2 PERFORMANCE REVIEW Proposals should be reviewed and reference calls should be made to assess past performance The individual firm determined to have the most superior performance based upon successfully working on similar projects will receive a 20 point score Average performance should receive a 10 point score Poor performance should receive a 1 point score If no proposal is assessed to have superior contents or exceptionally poor contents , the rankings should be consistent at 5 points 1 BONUS POINTS Bonus points may be assigned to the scores as applicable for the following a Disadvantaged firms minority ownership at least 51 of business 1 point b Small Business lt; 100,000 annually 1 point c Local Business Section 3 Area 1 point 4 COST OF SERVICE Cost of service shall be negotiated with the firm selected on the basis of the above criteria The County shall negotiate price with the firm having the highest ranking In the event that a price cannot be negotiated with the highest - ranking firm , the County will negotiate with the firm having the next highest ranking This process will continue until a reasonable price has been negotiated with the professional firm having the highest point total At this time the firm will be awarded the contract The County has the right to reject any or all proposals 3 CONTRACTUAL SERVICES OVER 2,000 These services , including but not limited to contractors for public works activities and housing rehabilitation , shall be secured through the bidding procedure as outlined in OMB Circular A - 102 , Attachment O Adopted December 5 , 2011 Johnston County Community 2011 Johnston County Community Development Block Grant Program Project # 10 - C - 2212 Guideform Residential Antidisplacement and Relocation Assistance Plan Under Section 104 d of the Housing and Community Development Act of 1974 as Amended Johnston County County recognizes that during the course of administering a CDBG program it sometimes becomes necessary to relocate businesses and residences , as applicable In the event that it should become necessary , the following Plan is provided as a guideform for any antidisplacement or relocation assistance that may be required UNDER THIS PLAN THE COUNTY will replace all occupied and vacant occupiable low moderate - income dwelling units demolished or converted to a use other than as low moderate - income housing as a direct result of activities assisted with funds provided under the Housing and Community Development Act of 1974 , as amended , as described in 24 CFR 570606 b 1 All replacement housing will be provided within three years of the commencement of the demolition or rehabilitation relating to conversion Before obligating or expending funds that will directly result in such demolition or conversion , the County will make public and submit to the North Carolina Department of Commerce the following information in writing 1 A description of the proposed assisted activity 2 The general location on a map and approximate number of dwelling units by size number of bedrooms that will be demolished or converted to a use other than as low moderate income units as a direct result of the assisted activity 3 A time schedule for the commencement and completion of the demolition or conversion 4 The general location on a map and approximate number of dwelling units by size number of bedrooms that will be provided as replacement dwelling units 5 The source of funding and time schedule for the provision of replacement dwelling units 6 The basis for concluding that each replacement dwelling unit will described in its adopted Optional Coverage Relocation Policy and as described in the Housing and Community Development Act of 1974 , as amended , as described in 24 CFR 570606 b 2 to each household displaced by the demolition of housing or by the conversion of a dwelling to another use as a direct result of CDBG assisted activities Consistent with the goals and objectives of activities assisted
