Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Allen L Mims , Jr , Vice Chairman Jeffrey P Carver , Cookie Pope , Wade M Stewart , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer J Chad McLamb , County Attorney David F Mills , and Paralegal Deputy Clerk Melissa A Daughtry Chairman Allen L Mims , Jr called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Tony Braswell led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Chairman Allen L Mims , Jr stated the Board had received a request from the National Active and Retired Federal Employees Association Johnston County Chapter 2107 to adopt a proclamation declaring the month of October 2011 as National Active and Retired Federal Employees Month in Johnston County Chairman Mims added the proclamation to the Consent Agenda Items , and the Board agreed by consent Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the consent agenda items as follows with the addition of Item G , the proclamation for the National Active and Retired Federal Employees Johnston County Chapter 2107 A Approval of Minutes – September 6 , 2011 10 00 am and 6 00 pm B Proclamation – Employee Appreciation Week – October 17 – 21 , 2011 adopted as follows JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK October 17 – October 21 , 2011 WHEREAS , Johnston County employees represent approximately 950 men and women , working in 31 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS , Johnston County employees provide a multitude of services for all the citizens of the County - the farmer , the retailer , the industrial businessman , the homeless , the jobless , the homeowner , the veteran , the disaster victim , the victim of violence , the sick , the poor , the educated , the uneducated , the youth , the elderly , the newcomer , and the old - timer ; and WHEREAS , Johnston County employees are both skilled and efficient in their jobs , making every effort to expend county tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS , Johnston County Government runs smoothly on a day to day basis primarily because Extension System of NC State University and NCA & T State University is a program where youth learn through opportunities that provide them hands - on experiences in 4 - H’s mission mandates of – Designation of Applicant’s Agent The Board adopted the following resolution authorizing Assistant Director of Finance Tyson Radford , and Emergency Management Coordinator Darrell Alford , as the primary and secondary agents , respectively , to represent and act for the County regarding the submittal of applications to the Federal Emergency Management Agency for Hurricane Irene BE IT RESOLVED BY the governing body of the Organization a public entity duly organized under the laws of the State of North Carolina that the above - named Primary and Secondary Agents are hereby authorized to execute and file applications for federal and or state assistance on behalf of the Organization for the purpose of obtaining certain state and federal financial assistance under the Robert T Stafford Disaster Relief & Emergency Assistance Act , Public Law 93 - 288 as amended or as otherwise available BE IT FURTHER RESOLVED that the above - named agents are authorized to represent and act for the Johnston County Finance Chad McLamb informed the Board that the Johnston County Finance Department received a Certificate of Achievement for Excellence in Financial Reporting awarded by the Government Finance Officers Association of the United States and Canada for its comprehensive annual financial report Mr McLamb stated the award is the highest form of recognition in the area of governmental accounting and financial reporting Mr McLamb recognized and introduced the Finance Staff including , Tyson Radford – Assistant Finance Director , Martha Lasater – Debt and Grant Management Analyst , April Wilkinson – Accounting Specialist I , Brenda Guyton – Payroll Supervisor , and Kristy Raynor – Accountant Internal Auditor Mr McLamb provided the Board with a brief overview of each staff member’s job duties and commented that the award would not have been possible if it were not for the work from his excellent staff Assistant Finance Director Tyson Radford stated that the award was also received due to the management , knowledge , and support by Mr McLamb Chairman Allen L Mims , Jr spoke on how the Board depends on the Finance Staff , especially during the budget preparation each year , and stated the Commissioners have complete confidence in them The Commissioners congratulated the Finance staff on the award B ATV Complaint James Stephenson , 5581 Elevation Road , Benson , North Carolina updated the Board concerning his complaint regarding noise and dust created by the use of ATVs on property located on Telfer Lane Mr Stephenson stated he had researched other ordinances and he provided the Board with a copy of the Currituck County , North Carolina Ordinance for ATV use Mr Stephenson asked the Board to review the ordinance as a possible starting point in finding a solution to his complaint C Johnston County Sports Council Jim Godfrey , Board Member of the Johnston County Tourism Authority and Executive Director of the Clayton Chamber of Commerce , appeared before the Board on behalf of the Tourism Authority along with Tourism Authority Executive Director Donna Bailey - Taylor Mr Godfrey informed the Board that the Tourism Authority is in the process of establishing the Johnston County Sports Council for the purposes of attracting more organized sporting related events to Johnston County Mr Godfrey explained that in the proposed bylaws of the Sports Council , the membership would include an appointee by the Board of County Commissioners He asked the Board to consider appointing a representative to the Sports Council Mr Godfrey spoke on the economic development benefits that more organized sporting events could bring to Johnston County He stated the Sports Council is being setup with the cooperation from all the municipal parks and recreation departments in Johnston County At the inquiry of Chairman Allen L Mims , Jr , Mr Godfrey reported the Sports Council membership would consist of one member from the Tourism Authority , which he has been designated to represent as well as one County Commissioner appointee , which could be anyone that the Commissioners choose Chairman Mims stated that the Commissioners could designate a staff member to serve , or perhaps the position could be advertised along with the regular Commissioner appointments to possibly find an individual with more expertise that could be useful to the Council Commissioner DeVan Barbour also suggested advertising the position in accordance with other Commissioner appointments and he asked when the Sports Council would become active Mr Godfrey responded that the Sports Council initiative is just beginning and the Tourism Authority has not yet adopted the bylaws He stated the Tourism Authority did not intend to adopt the bylaws until receiving feedback from the Board of Commissioners on the membership makeup Mr Godfrey reported an initial meeting has been held with representatives from the Benson , Clayton , Kenly , Selma , and Smithfield Parks and Recreation Departments who have all jumped onboard with the effort Upon a question from Commissioner Barbour , Mr Godfrey reported the proposed total membership of the Sports Selma , and Smithfield Parks and Recreation Departments ; two at - large members that are engaged in sports tournaments , sports organizations , sports promotion or facility development and located in Johnston County ; one appointee from the County Commissioners ; and one member from the Johnston County Tourism Authority Mr Godfrey stated if the County Commissioners chose to advertise their appointed position then the Council would actually have three at - large members that could bring expertise to the group Commissioner Tony Braswell asked if any of the other non - municipal athletic recreation organizations in the County had been contacted to get their involvement Ms Bailey - Taylor reported the Tourism Authority has contacted some of the other organizations in the County and those groups would be represented by the two at - large positions proposed for the Sports Council The Commissioners encouraged the Authority to involve the other athletic recreation organizations in the County in addition to the municipal parks and recreation departments Commissioner Wade M Stewart agreed that the other non - municipal organizations should also be involved in the initiative , commenting that the Board of Commissioners included many of those organizations in the recreation bond referendum Commissioner Barbour noted that the non - municipal athletic recreation organizations are managed by volunteers who would be a valuable contribution Ms Bailey - Taylor and Mr Godfrey concurred with the Board’s comments to include the other community athletic recreational organizations and noted the meetings would be open to the public Commissioner Jeffrey P Carver stated that Commissioner Tony Braswell was instrumental in the recreation bond referendum and has the knowledge and background to represent the County Commissioners on the Sports Council Chairman Mims asked how the two at - large appointments would be made Ms Bailey - Taylor reported the Tourism Authority would advertise for the two at - large positions Upon further discussion , it was the unanimous consensus of the Board to appoint Commissioner Tony Braswell to initially serve on the Sports Council as the Commissioner Representative D Dr David Johnson , President of Johnston Community College Dr David Johnson , President of Johnston Community College , invited the Board of Commissioners to attend the Fall Fest beginning on Wednesday , October 5 , 2011 with lunch being provided as well as the College’s annual golf tournament and auction event to follow on Thursday and Friday Dr Johnson also reminded the Board of the new Library’s grand opening scheduled for November 3 , 2011 E Dennis Nielsen – Request for County Firing Range Dennis Nielsen , 9485 NC Hwy 39 , Middlesex , informed the Board that he is a registered gun dealer and has opened a store in the Clayton area Mr Nielsen provided the Board with a background on his business Mr Nielsen requested the Board to look into the possibility of providing a firing range that would be open for all County citizens ’ use Mr Nielsen indicated he has received much interest from his customers regarding the need for a firing range in Johnston County Mr Nielsen suggested the Board form a non - profit organization to work with the County on the initiative and he offered to finance the legal costs associated with forming the non - profit corporation Mr Nielsen added that people feel they have no place to shoot their weapons in the County and the firing range would provide that opportunity Chairman Allen L Mims , Jr suggested that Mr Nielsen put a petition in his store so the Commissioners could see actual numbers of in - County residents that have an interest The Board took a five minute recess PagePage pageNumber9552 October 3 , 2011 – 10 00 am Continued 5 Moccasin Creek Service District Board – Amendment of Residency Requirement Betty Whitley , Administrative Services Supervisor with the Johnston County Soil and Water Conservation District and Secretary for the Moccasin Creek Service District Board , explained that the District Board would like to amend the residency requirement of its membership Ms Whitley reported that currently , members of the District Board must reside in the District The District Board would like to amend the requirement so that appointed members of the District Board shall reside or own real property within the District She offered to answer any questions Chairman Allen L Mims , Jr stated he did not see a problem with the amendment so long as the District Board Members would still be residents of Johnston County , noting it is possible that some property owners in the District could live outside of the County Upon a motion by Commissioner Tony Braswell , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the amendment to the residency requirement of the District Board membership to allow individuals that reside or own real property within the District to serve , so long as they are residents of Johnston County 6 Register of Deeds – Historic Records Automation Project Register of Deeds Craig Olive informed the Board that he would like to continue the historic records automation project He explained the project consists of converting the old historic indices to electronic indices He requested the Board to approve entering into a contract with Advanced Imaging Systems for the project and further , to approve the transfer of 75,000 from the Register of Deeds Automation Fund to cover the first payment on the project Mr Olive offered to answer any questions At the inquiry of Commissioner Cookie Pope , Mr Olive stated the project will be spread over a three to five year period time Upon questions by Chairman Allen L Mims , Jr and Commissioner Wade M Stewart , Mr Olive stated the total cost of the project is 344,760 and would be spread over the three to five year period He reported the first phase of the project would convert the records back to 1940 into electronic form The next phases would convert records dated back to the 1700 ’ s as well as marriage , birth , and death certificates Commissioner DeVan Barbour noted Mr Olive is requesting an initial transfer of 75,000 and he asked where the funds would come from for the remaining cost of the project Mr Olive stated the remaining funds needed to complete the project would also come from the Register of Deeds Automation Fund He explained the funds are generated from 10 of the miscellaneous revenues that are collected by the Register of Deeds Office which are set by the General Assembly At the inquiry of Commissioner Tony Braswell , Director of Finance Chad McLamb reported the funds are designated as “ reserved ” specifically for automated enhancement ; however , because the reserved funds are in the County’s General Fund , it will increase the County’s budgeted expenditures Mr McLamb stated there are sufficient funds to cover the entire cost Commissioner Stewart asked what the funds could be used for , if not for the automation project Mr McLamb stated if Mr Olive did not go forward with the automation project , the funds would stay in the County’s General Fund ; however , the funds would remain as “ reserved funds ” and could not be used for any other purpose than the automation project Mr McLamb clarified that although the reserved funds are not included in the fund balance calculations , the funds will increase the budgeted expenditures which does in turn have a slight affect on the fund balance Commissioner Jeffrey P Carver added that although the expenditure may seem small , it is an expenditure that will increase the need for additional fund balance Commissioner Braswell asked how far back the records are currently in automated form Mr Olive stated the Register of Deeds Office presently has automated records dating back to 1989 Page0553 October 3 , 2011 – 10 00 am Continued Chairman Mims asked for more information on how many years the project would be spread out and if the company Advanced Imaging Systems has agreed to the time period Mr Olive stated he has elected to spread the project out over five years and the company has agreed Commissioner Carver noted that Mr Olive is proposing to piggyback off of a State contract that expires on 4 20 2013 and he asked if the company would honor the price over the five year period of time Mr Olive stated the company has agreed to honor the price over the five year period Commissioner Cookie Pope moved the Board approve the Register of Deeds entering into a contract with Advanced Imaging Systems at a total project cost of 344,760 for the historic records automation project ; and further , to approve the transfer of 75,000 from the Register of Deeds Automation Fund to cover the first payment on the project Commissioner W Ray Woodall seconded the motion which carried by unanimous vote 7 HAPP – Revision to Policy Regarding Family Voucher Size HAPP Director Sandra Norris requested the Board to approve a revision to the policy on determining the voucher size for a family She explained that the HAPP Office would like to adopt HUD’s minimum standard regulations that the voucher size , regardless of age , sex or family composition , will be based on one bedroom per every two people Ms Norris added that due to the recent reduction in HUD funding , the change would allow the HAPP Office to better utilize funds and maximize the number of families being served Chairman Allen L Mims , Jr asked about exceptions to the policy Ms Norris stated the Johnston County HAPP Office would continue to allow exceptions based on the need for a live - in aide and as a reasonable accommodation for a disabled family She stated if the policy amendment is approved , it would be effective October 31 , 2011 for all new families and existing families would not be changed until their next examination , per HUD regulations Ms Norris reported a few families would be impacted later on ; however , the change would allow more families to receive assistance Upon a question by Commissioner Cookie Pope , Ms Norris reported the Johnston County HAPP Office is presently allocated to serve 619 families and is presently serving 598 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the revision to the family voucher size policy , effective October 31 , 2011 , to follow HUD regulations that the voucher size , regardless of age , sex or family composition will be based on one bedroom per every two people , with the Johnston County HAPP Office allowing an exception based on the need for a live - in aide and as a reasonable accommodation for a disabled family 8 Johnston County Airport – Recertification of Matching Funds Johnston County Airport Director Ray Blackmon stated the Johnston County Airport Authority is requesting the Board to recertify the amount of matching funds needed for the Runway Safety Area Project RSA grant He explained that the project has experienced an overrun due to costs for additional fill material needed for construction of the embankment as well as an additional safety related project component has been added Mr Blackmon reported the project overrun was due to a miscalculation on the fill material that was required for the embankment which had an increased cost of 84,000 representing an additional 8,400 in local match funds He stated the Division of Aviation has agreed to reissue the grant with the additional 84,000 which would require a recertification on the 10 local match of 8,400 Mr Blackmon stated the additional safety related component is a clearing project that is needed due to obstacles in the surface areas on both runway approaches Mr Blackmon reviewed maps with the Board of the proposed clearing areas Mr Blackmon specifically referenced one piece of property that represents a small tract of land the Airport Authority either needs to purchase or obtain an easement from the property owner whereby the Authority would pay the landowner to clear and maintain the site Mr Blackmon stated the total cost of the clearing project is 208,000 with the local 10 match being 20,800 Mr Blackmon stated the total 10 match recertification amount would be 29,200 including both the RSA project overrun and the additional clearing project County Manager Rick Hester reminded the Board that the Airport Authority has agreed to loan the County the 10 local matching funds and the additional 29,200 would be included in that loan , if approved Page1554 October 3 , 2011 – 10 00 am Continued Upon a question by Commissioner Tony Braswell , Mr Blackmon stated the NC Department of Transportation Division of Aviation and the project engineer , WK Dickson , has determined that the cost overrun for the additional fill material has been deemed a justifiable overrun and the Division of Aviation has agreed to grant the additional funds needed to complete the project Chairman Allen L Mims , Jr asked if WK Dickson provided the original fill material calculations Mr Blackmon confirmed that WK Dickson provided the original fill material calculations He explained that WK Dickson did the original calculations by using aerial imagery topography and that some of the areas had standing water in them at that time ; which as he understands , is what caused the miscalculation in the amount of fill dirt required Chairman Mims asked if any of the trees in the proposed clearing project are harvestable Mr Blackmon stated some of the trees may be harvestable ; however , much of the area consists of trees that have grown up since the last clearing in 1994 Mr Blackmon confirmed that the areas in the future will be maintained either by mowing or spraying to avoid future clearings Commissioner Wade M Stewart recalled that the Airport Authority came to the Board of Commissioners two months ago stating the RSA project had come in under budget and the Authority requested approval to go forward with a runway lighting system upgrade using the available funds Commissioner Stewart asked how the project overrun in the amount of 84,000 would affect the lighting project Mr Blackmon stated the project overrun will not affect the lighting system upgrade project Commissioner Stewart spoke on his frustration with projects , not only for the Airport Authority , but other County agencies as well , that are estimated to cost a certain amount only to later discover cost overruns Mr Blackmon stated that he understands Commissioner Stewart’s frustrations , adding that when the cost overrun was first brought up , it was difficult in that he knew additional funds would be needed Commissioner Jeffrey P Carver referenced the proposed clearing project and noted that it calls for light poles to be lowered , per height restrictions , on the north side of US Hwy 70 and he asked who would be responsible for the expense of lowering those light poles Mr Blackmon stated the light poles component has not been discussed in that the main focus is clearing the trees He stated the light poles can be addressed in the future because they are not an immediate threat , like the tree growth Chairman Mims referenced the trees identified for possible clearing in the Whitley Heights Subdivision and asked how those trees would be handled Mr Blackmon reported the Airport received a waiver from the FAA for the trees in the Whitley Heights Subdivision and he does not believe they will ever be an issue Commissioner DeVan Barbour moved the Board approve the recertification of the 10 local matching funds for the overrun on the Runway Safety Area Project in the amount of 8,400 and approve the 10 matching funds for the additional tree clearing project in the amount of 20,800 with the total amount of 29,200 to be added to the original Runway Safety Area Project loan from the Johnston County Airport Authority Commissioner W Ray Woodall seconded the motion which carried by unanimous vote 9 Public Utilities – Industrial Drive Force Main Gravity Sewer Improvements Project Modification and Budget Revision Chandra Coats , PE , Engineering and Construction Manager , reported that on August 1 , 2011 , the Board of Commissioners awarded the Industrial Drive Force Main and Gravity Sewer Improvements project to RD Braswell Construction Company , subject to utility easement acquisition , and approved the project budget Ms Coats explained that project construction has not started due to the pending acquisition of one remaining easement In the interim , staff has received a request from the Town of Selma to divert a future average flow of 445,000 gpd into the proposed gravity sewer main Ms Coats stated in order to accommodate the request from the Town of Selma , the 2,268 LF of 10 ” gravity sewer line must be upsized from 10 ” to 12 ” main She notedPage2555 October 3 , 2011 – 10 00 am Continued RD Braswell Construction has provided an estimate to upsize the proposed main and the total additional cost to upsize and re - permit the main would the project modification He stated the modification would help the Selma Crossings Industrial Site which the Town is in the process of having certified by the North Carolina Department of Commerce Mr
