Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Allen L Mims , Jr , Vice Chairman Jeffrey P Carver , with a prayer Commissioner Tony Braswell led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – April 4 , 2011 10 00 am and 6 00 pm B Proclamation – Emergency Medical Services Week – May 15 – 21 , 2011 The Board adopted the following proclamation declaring the week of May 15 - 21 , 2011 as Emergency Medical Services Week in Johnston County Proclamation Emergency Medical Services Week May 15 – 21 , 2011 To designate the Week of May 15 - 21 , 2011 , as Emergency Medical Services Week WHEREAS , emergency medical services is a vital public service ; and WHEREAS , the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day , seven days a week ; and WHEREAS , access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury ; and WHEREAS , the emergency medical services system consists of emergency physicians , emergency nurses , emergency medical technicians , paramedics , firefighters , educators , administrators and others ; and WHEREAS , the members of emergency medical services teams , whether career or volunteer , engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills ; and WHEREAS , it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services Week ; NOW , THEREFORE BE IT RESOLVED , that the Board of Commissioners of Johnston County , Month 2011 A Proclamation Whereas , Johnston County is a community that includes more than 20,000 citizens aged 60 and older ; and Whereas , the older adults in Johnston County are the roots from which our community grows , who bestow gifts of wisdom and insight upon younger generations , and strengthen the bonds between neighbors to create a better place to live ; and Whereas , our society can be enhanced by older adults aging peacefully in their communities ; and Whereas , the older adults in Johnston County should be commended for their role in creating and bolstering the fiber of our community and nation ; and Whereas , our community can provide that recognition and respect by enriching the quality of life for older Americans by Increasing their opportunities to remain in their the North Carolina Foundation NCCF ; and WHEREAS , the Johnston County Community Foundation was established to serve the needs of local nonprofit organizations , donors , and charitable causes ; and WHEREAS , the Johnston County Community Foundation joins other community foundations in transforming our nation and our neighborhoods through the power of philanthropy ; and WHEREAS , the Johnston adopted the following resolution ratifying the Board’s previous approval for the County to submit a Community Development Block Grant application to assist Carolina Community Developers , LLC in the construction of public water and sewer to serve Brookside Landing The Board approved the application submittal at the April 4 , 2011 regular meeting ; however , the adoption of the resolution is a requirement by the Community Development Block Grant Program RESOLUTION FOR THE JOHNSTON COUNTY BOARD OF COMMISSIONERS ’ APPLICATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT HOUSING DEVELOPMENT PROGRAM FOR NCHFA TAX CREDIT RPP APPLICANTS FUNDING WHEREAS , the Johnston County Board of Commissioners has previously indicated its desire to assist in housing development HD efforts within the County ; and WHEREAS , the Board of County Commissioners has held the two public hearings required by the Small Cities Community Development Grant Program with the second public hearing concerning the proposed application for Community Development Block Grant funding to benefit Carolina Community Developers , LLC and Guilford Financial Services , LLC’s Brookside Landing Project ; and ,Page364 May 2 , 2011 – 10 00 am Continued WHEREAS , the Board of County Commissioners wishes the County to pursue a formal application for Community Development Block Grant funding to benefit Carolina Community Developers , in Johnston County Director of Emergency Services Kim Robertson provided the Board with an update on the tornado damage from April 16 , 2011 Ms Robertson stated that the National Weather Service has confirmed the tornado was a category F3 that impacted Johnston County Ms Robertson reported approximately 22,000 homes were without power in Johnston County after the storm Ms Robertson recognized and thanked the following people and agencies for their response and work after the tornado She spoke on the tremendous amount of cooperation and support that each of the groups provided to the County in the storm’s aftermath • David Lasater from Progress Energy for remaining in constant contact with the County staff on the power situation • The Johnston County Emergency Management Personnel that coordinated a response within minutes of the tornado touching the ground , including the activation of the County’s Emergency Operations Center and facilitating the declaration of a “ State of Emergency ” • The Johnston County Emergency Services Staff that worked many long hours providing assistance to the storm victims in the County PagePage pageNumber6367 May 2 , 2011 – 10 00 am Continued • The Johnston County Human Resources Office for providing support and assistance to the Emergency Services Department within one hour of the storm as well as developing and distributing important information to the news media • The Johnston County Sheriff’s Department for providing assistance to citizens as well as security at the disaster sites and shelter locations along with working in the Emergency Operations Center throughout the storm • The local Fire Departments and EMS Agencies that responded to the numerous calls for assistance There were approximately 478 dispatches on April 16 , 2011 from 3 00 pm until Midnight • The Johnston County 911 Communications Center for handling the extreme call volume effectively and efficiently Approximately 1,800 calls were received at the 911 Center in the storm’s aftermath • Johnny Dixon , Micro Fire Chief and Micro Town Councilman , who worked diligently along with Micro Town Clerk Betsy Nicolson to restore order to the Town of Micro • The County Damage Assessment Team Dean Barbour , Russell Reeves , Patrick Johnson , Shane Hudson , and Mike Cook for providing the Emergency Operations Center with valuable information regarding the storm damage This Team was the “ eyes and ears ” for the Emergency Operations Center in that they were in the field providing information back to the EOC on citizens ’ needs for tarps , water , etc • Pastor Tim Stevens and the congregation of The Micro First Baptist Church which served as a distribution point for food , water , and clothing Pastor Stevens and the congregation provided much needed relief to those that suffered major damages by distributing supplies and offering assistance • The North Carolina Baptist Men did an outstanding job of providing assistance with debris removal , installation of tarps on damaged roofs , as well as providing a listening ear to the many storm victims • Pastor Steve Grice of the Cornerstone Baptist Church for providing a supplies staging area at his Church • Earl Lee of Lee Brothers Farms allowed one of his warehouses to be used as a supplies distribution point at the southern end of Johnston County • The Salvation Army for providing oversight of the southern supplies distribution point • The Johnston County Board of Education and in particular , Jake Jacobs , who worked with the Emergency Services Department to provide shelters for the storm victims • Johnston County Public Utilities and the Landfill Staff for extending the landfill hours and working to ensure that the storm related debris was being handled properly • Johnston County Animal Services that provided assistance with stray animals after the storm • Johnston County Commissioner Tony Braswell and his wife , Nobie , for helping to distribute supplies in the affected areas to those that were unable to travel to the distribution points • All the Johnston County Commissioners for their donations of cleaning supplies that were greatly needed for the citizens • Johnston County Manager Rick Hester for supporting the County staff throughout the entire storm event and helping with everything from answering phones in the Emergency Operations Center to bringing in food for the staff Ms Robertson reported that two shelters were opened to house the victims of the tornados , one at the Micro Fire Department which was later moved to the North Johnston Middle School once power was restored and the other at South Johnston High School The County Damage Assessment Teams mobilized within 12 hours of the storm and began assessing the damage She noted that at the last count , 134 structures have beenPagePage pageNumber7368 May 2 , 2011 – 10 00 am Continued destroyed , 104 structures received major damage , and 212 structures received minor damage Ms Robertson stated Johnston County requested and received numerous shipments of tarps and bottled water from the State Emergency Management Office which was distributed throughout the affected areas The County’s Reverse 911 System was utilized numerous times to individually notify over 1,400 homes regarding debris removal guidelines , to seek out unmet needs , and to notify citizens of locations for clothing , food , and supplies Flyers with disaster assistance contact information were developed and distributed in the field that contained information regarding the Disaster Recovery Center , points of distribution for supplies , and other important information Ms Robertson concluded her update by noting that the Federal Emergency Management Agency and the American Red Cross are working in the County to provide individual assistance and meet the needs of the storm victims She reported the Johnston County Landfill will be operating on an extended schedule from 7 30 am until 6 00 pm Monday through Saturday and that over 1,700 tons of debris has been received to date with more anticipated She noted that although the storm has passed , there is much to be done and there are still many Johnston County citizens that will continue to need the County’s support going forward Ms Robertson encouraged everyone to notify the Emergency Services Department of any family or individual that needs assistance in that FEMA cannot share their information with the County once they conclude their operations She noted that to date , FEMA has registered approximately 12 applicants per day with a total of 321 applications received and 97 applicants have applied for housing assistance Ms Robertson introduced Wilhemina Hearne , FEMA Community Relations , who will be working in the Emergency Operations Center for the next 30 days , as well as Frank Davis with the North Carolina Division of Emergency Management Hazard Mitigation Division Ms Robertson asked the Board to adopt a resolution authorizing Emergency Management Coordinator Darrell Alford and her as the primary and secondary agents , respectively , to represent and act for the County regarding the submittal of applications to FEMA for financial relief from the April 16 , 2011 storms in Johnston County She offered to answer any questions Commissioner DeVan Barbour asked for an approximate number of residents that have been displaced by the tornado commenting that he thought after Hurricane Katrina , agencies were supposed to coordinate with each other and share information Wilhemina Hearne , FEMA Community Relations , stated that agencies are supposed to coordinate with each other ; however , she stated at this time , many residents have left their uninhabitable homes to stay with friends and relatives and FEMA is working to determine where those people are and how to help them Ms Robertson stated staff will continue to reach out in the communities to try and help everyone that has been impacted by the storms Upon a question by Commissioner Tony Braswell , Ms Robertson stated that to date , there are no fatalities in Johnston County ; however , there are still victims listed in critical condition in trauma centers County Manager Rick Hester thanked Ms Robertson for her work throughout the storm event , commenting that she did an excellent job along with all others Chairman recognized the Johnston County Teen Driving Safety Chairman Charlie Parrish , Vice Chair Lynda Carroll , and Committee Members Support Staff Lu Hickey , Robin Gurgainus , and Kim Robertson Johnston the Partnership for Children of Johnston County , provided the Board with a background on the Partnership To Build A Miracle Committee Dr Morris stated the effort is a collaboration between the Miracle League of Johnston County , the Partnership for Children of Johnston County , and surrounding communities to build a baseball field for children with special needs and an inclusive outdoor park for children of all abilities in Johnston County Dr Morris introduced Mr Chris Key , Past Chair of the Partnership for Children Dr Morris shared a video of the proposed project with the Board of Commissioners Chris Key , Past Chair of the Partnership for Children , stated that the Partnership To Build A Miracle Committee needs to raise 12 million to construct both the baseball field and the inclusion outdoor park He stated the goal is to provide a play space for all children and noted that there are approximately 3,600 special needs children in Johnston County Mr Key added that another goal of the project is to use the initiative as a learning environment so that surrounding areas can utilize some of the features of the inclusion park to provide a play space for special needs children in their communities Mr Key asked the Board to consider adopting a Proclamation of Support for the project and noted that the Committee will be asking for similar support from all the towns resolution approving the updated 2010 Johnston County Multi - Jurisdictional Hazard Mitigation Plan RESOLUTION OF ADOPTION JOHNSTON COUNTY HAZARD MITIGATION PLAN WHEREAS , the citizens and property within Johnston County are subject to the effects of natural hazards that pose threats to lives and cause damage to property , and with the knowledge and experience that certain areas , ie , flood hazard areas , are particularly vulnerable to flood hazard events ; and WHEREAS , the County desires to seek ways to mitigate the impact of identified hazard risks ; and WHEREAS , the Legislature of the State of North Carolina has in Part 6 , Article 21 of Chapter 143 ; Parts 3 , 5 , and 8 of Article 19 of Chapter 160A ; and Article 8 of Chapter 160A of the North Carolina General Statutes , delegated to local governmental units the responsibility to adopt regulations designed to promote the public health , safety , and general welfare of its citizenry ; and WHEREAS , the Legislature of the State of North Carolina has in Section 1 Part 166A of the North Carolina General Statutes adopted in Session Law 2001 - 214 - - - Senate Bill 300 effective July 1 , 2001 , states therein in Item a Planner Evaluator I , from 60 full time employment FTE to 100 FTE She stated the grant is funded with federal Health Preparedness monies Dr Pearson explained that the State Office of Public Health Preparedness and Response is reorganizing the Public Health Regional Surveillance Teams PHRST Previously , the PHRSTs were aligned into seven teams but the office is now moving to four statewide teams The Johnston County Health Department has been associated with the Cumberland County PHRST team and shared a Preparedness Coordinator with Moore and Wayne Counties through the Cumberland team With the new regionalization , the PHRST team in Cumberland will no longer exist Dr Pearson reported the Johnston County Health Department is now associated with a new region and is working to develop a Memorandum of Understanding with Harnett and Moore Counties to share a Regional Preparedness Coordinator The cost of the position , including salary and benefits , will be covered by the grant funds from the three counties The position is currently in the Health Department’s budget at 60 She asked the Board to consider approving the request so long as the grant funds are available to cover the cost of the position and offered to answer any questions Commissioner Cookie Pope asked Dr Pearson if she felt the grant funds would continue or could they possibly be reduced in the future Dr Pearson Report Tax Administrator Pat Goddard reported on the collection of delinquent taxes for the month of April 2011 She noted in addition to garnishments and bank attachments , two foreclosure complaints were filed resulting in a collection of 10,04908 As of April 29 , 2011 , the Tax Department has collected 9814 of the real and personal levy for 2010 , and 8443 of the motor vehicle levy Through the NC State Debt Setoff Program , 1,312 accounts have been paid for a total of 122,33142 as of April 29 , 2011 The next foreclosure sale date is May 25 , 2011 Ms Goddard reported the Board of Equalization and Review convened for the 2011 Real Estate Appeals on April 18 , 2011 and the last day to appeal is May 13 , 2011 Compliment for the Tax Office Commissioner Wade M Stewart reported that he received a call recently from a citizen that was very complimentary over the services that they had received at the Tax Office from Ms Ashley Heath Commissioner Stewart stated that Ms Heath went above her job requirements recently to help a citizen regarding a lost title to a mobile home that was damaged in the April 16 , 2011 tornado Commissioner Stewart asked Ms Goddard to express his appreciation to Ms Heath 15 Manager Reports and Comments A Animal Services Award County Manager Rick Hester reported that Johnston County Animal Services was awarded the “ Shelters We Love ” Award on April 12 , 2011 at the North Carolina General Assembly He stated the award was presented on behalf of the North Carolina Voters for Animal Welfare , ASPCA , and the Humane Society Mr Hester noted that he along with Commissioner Tony Braswell attended the award presentation and he called on Director of Animal Services Ernie Wilkinson to share more information Page6377 May 2 , 2011 – 10 00 am Continued Mr Wilkinson provided the Board with a background on the award and he commended his staff for their work at the Animal Shelter He introduced employees Lisa Carlson and Roger Davis in the The Gap Mr Wilkinson added that The Gap Foundation matched dollar for dollar the amount of funds raised at the recent fundraiser held in April He stated all the funds collected will be used for education and animal care Chairman Allen L Mims , Jr congratulated Animal Services on the award and he thanked Mr Wilkinson for his leadership at the Animal Shelter Commissioner Cookie Pope expressed her appreciation to Animal Services for their recent assistance with a resident in her area that passed away and had many animals that required care B Request for Closed Session County Manager Rick Hester requested a closed session - NCGS § 143 - 31811 a 3 – Attorney Client Privilege 16 Board Reports and Comments A Update on Johnston Health by Commissioner Tony Braswell Commissioner Tony Braswell gave a report to the Board on various matters related to Johnston Health , as follows Commissioner Braswell spoke on the Hospital’s response to the victims of the April 16 , 2011 tornado He reported that the Hospital did a great job dealing with the many victims that needed care Commissioner Braswell stated the Hospital called in additional doctors and opened the same - day surgery area as an additional Emergency Room to accommodate more patients The Hospital also created a triage center at the backdoor as patients were being brought in by the EMS agencies Commissioner Braswell noted that there has been information circulating with regards to the Hospital Board requesting local legislation to be filed asking for Johnston Health to be removed from the State Employees Retirement Plan He stated a local bill was filed and there has since been a lot of concern raised by the Hospital employees Commissioner Braswell indicated many , including him , were unaware of the legislation being filed He reported that at the last meeting of the Hospital Board , the Board voted to ask for a local bill to amend the original legislation so that the legislation would only affect new hires and would not affect the retirement plan of existing employees Commissioner Braswell stated the vote to ask for the new amending bill passed 9 - 1 with him dissenting because he felt that he did not have enough information submitted to him prior to the meeting in order to make an informed decision on the issue Commissioner Braswell reminded everyone that the legislation has not yet passed in the General Assembly Commissioner Braswell also updated the Board on mental health matters at Johnston Health He reported that Johnston Health had sent out a Request for Proposals for the management of their Behavior Health Unit and there were some concerns that the County’s Mental Health Department was not involved in the process to the extent that they should have been Commissioner Braswell stated that Board of Commissioners Chairman Allen L Mims , Jr has asked for a meeting to be held on the matter with all appropriate parties including the Hospital , Mental Health , and the Sheriff’s Office He stated it is his understanding that the meeting is being scheduled Commissioner Braswell stated Johnston Health continues to struggle financially with only 41 days of cash on hand at the present time He stated Johnston Health is seeking additional avenues of revenue and spoke on how the Health Care Act and Medicare is impacting health care services and the challenges going forward Commissioner Braswell stated he would keep the Board informed B Lunch and Tour of Hanson Quarry Canceled Chairman Allen L Mims , Jr announced that the previously scheduled lunch and tour of the
