10 259 Meeting of the Johnston County Board of Commissioners February 7 , 2011 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , February 7 , 2011 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Allen L Mims , Jr , Chairman , Jeffrey P Carver , Vice Chairman , Cookie Pope , Wade M Stewart , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present Rick J Hester , County Manager , Paula G Woodard , Clerk to the Board , David F Mills , County Attorney , and Melissa A Daughtry , Paralegal Deputy Clerk Chairman Allen L Mims , Jr called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comments A Concerns Regarding Hwy 70 Corridor Commission Wilson’s Mills Town Councilman Kenneth Jones , 601 Swift Creek Road , Wilson’s Mills , addressed the Board and expressed concerns with the Hwy 70 Corridor Commission’s plans and how those plans would impact not only Wilson’s Mills , but the entire County Mr Jones stated that commercial industrial growth is a major issue for the Town of Wilson’s Mills and he questioned the economical impact that the proposed Hwy 70 Corridor would have on potential future commercial industrial growth for the Town Mr Jones asked for the Board’s help with looking at the current plans of the Commission and coming up with suggestions that would help to eliminate possible impacts on future commercial industrial growth in Wilson’s Mills Mr Jones stated the Town of Wilson’s Mills has scheduled a public forum on the matter for February 22 , 2011 at 4 00 pm in the Fellowship Hall of the New Day At Alpha & Omega Ministries , located at 4423 Wilson’s Mills Road , and he asked for a representative from the Commissioners to attend the forum Commissioner Tony Braswell stated that from his past experience in working with Pine Level on issues regarding the Hwy 70 Corridor Commission’s plans for the Pine Level area , even though the County attended numerous meetings and openly expressed its opposition , at the end of the day , the County learned that the plans by the Hwy 70 Corridor Commission were set in stone for the Pine Level area Commissioner Braswell commended Mr Jones ’ and the Town’s efforts to rally their citizens and give input on how the Corridor Commission’s plans could impact the Town of Wilson’s Mills and stated he planned on attending nd the public forum on February 22 Commissioner Braswell stated that he would support the Town of Wilson’s Mills in its efforts ; however , he cautioned that in the end , the Hwy 70 Corridor Commission may not change their designs Commissioner Braswell reiterated that the County has been on record from the beginning in opposition to the plans by the Hwy 70 Corridor Commission Chairman Allen L Mims , Jr noted that the Town of Princeton had recently been able to reach an agreement with the Hwy 70 Corridor Commission on an alternate plan for the Princeton area that had been approved by the Department of Transportation B Citizen Concerns Regarding Cost of Convenience Center Decals Brenda Liles , 3540 Lizzie Mill Road , Selma , addressed the Board and expressed her concerns with the cost of the convenience center decals Ms Liles shared with the Board her research on surrounding counties and their fees for trash disposal Ms Liles asked , given the current state of the economy , if the Board would consider lowering the cost of the convenience center decals to be more in line with other surrounding counties Following brief discussion by the Board with Ms Liles , Chairman Allen L Mims , Jr stated that the Board would be scheduling an upcoming work session and the matter was a topic that the Board could discuss at the work session Page260 February 7 , 2011 – 6 00 pm Continued 2 Public Hearing Rezoning and Special Use Requests Advertised – In The Smithfield Herald – January 26 and February 2 , 2011 Certified letters were mailed to adjoining property owners on January 24 , 2011 Notices were posted at the locations on November 30 , 2010 for Cases 10 - 28 and 10 - 30 The Chairman opened the Rezoning Hearing for Case 10 - 28 Case 10 - 28 Petition to rezone a 074 acre tract located at 404 Clinton Drive in Cleveland Township from Agricultural Residential AR to Agricultural Residential - Special Use District AR - SUD Tax ID 06E02029W Owner Ray & Diana Jackson Applicant Diana Jackson Planning Director Berry Gray stated the petition is to rezone a 074 acre tract located at 404 Clinton Drive in Cleveland Township from Agricultural Residential to Agricultural Residential - Special Use District Mr Gray noted the special use request associated with the rezoning Mr Gray stated the existing land use is the applicant’s residence and an in - home child daycare Mr Gray explained that the existing home daycare is allowed to have up to 8 children ; however , the applicant wishes to increase the capacity up to 12 children in the daycare which requires rezoning Mr Gray noted the surrounding land use is a subdivision zoned Agricultural Residential therefore , the neighboring properties are residential Applicant Diana Jackson , 404 Clinton Drive , informed the Board that she is a certified teacher and has a licensed operation in her home which is currently rated as a two - star facility Ms Jackson stated she would like to expand the operation by adding 4 spots to accommodate 12 children total Ms Jackson explained that she has a waiting list and some of the families that attend her facility are expecting more children as well as she wishes to grow her own family in the future Ms Jackson stated by expanding the facility , it will also allow for employment opportunities Chairman Allen L Mims , Jr asked how long the facility had been in operation with eight children , what were the current ages of the children enrolled , and is there a need for the use in the area Ms Jackson responded that she has been in operation for two years and the enrollment has not always been at capacity Ms Jackson noted that her own children are counted in the enrollment and she leaves one spot open to accommodate some of the children in the subdivision that are friends of her son that visit her home in the afternoons at no charge Ms Jackson stated that she currently has children enrolled from infant to 12 years old and she would like to expand the operation so that she could employ another teacher and separate the ages of the children Ms Jackson stated there is a need for the daycare in her area because she presently has people on a waiting list to attend her operation Ms Jackson acknowledged that there are other childcare facilities in the area ; however , she believes that her experience and the quality of care in her operation are what people want Lynn McMillan , 230 Devin Drive , addressed the Board and stated he lives in the same subdivision as the applicant Mr McMillan expressed his concerns to the Board regarding traffic in the subdivision and possible safety issues he sees for the children attending the daycare Mr McMillan stated that parents bring their children to the daycare and they often do not stop at the stop signs within the subdivision Mr McMillan stated that there has also been a problem with people speeding through the subdivision and he has witnessed Ms Jackson walking with the children in the subdivision which he feels is a safety matter He asked the Board to consider his concerns Jon Benson , 357 Blair Drive , reported that he lives in the same subdivision as the applicant Mr Benson addressed the Board in opposition to the rezoning and pointed out the petition in opposition to the request that is included in the Board’s agenda packets Henning Hareb , 400 Clinton Drive , addressed the Board and stated she lives next to the applicant Ms Hareb stated that she has a sibling that attends Ms Jackson’s facility and she spoke on the quality of care that the children receive Ms Hareb also reported that most of the children are dropped off at 6 00 am in the morning and picked up at 6 00 pm in the evening Mr Gray reported the Planning Board recommended approval of the rezoning request Commissioner DeVan Barbour pointed out that whether or not the Board chooses to approve the rezoning request , Ms Jackson can still operate her in - home daycare with 8 children , without the Board’s approval There being no further comments , the Chairman recessed the Rezoning Hearing for Case 10 - 28 Page261 February 7 , 2011 – 6 00 pm Continued Decision on Rezoning Case 10 - 28 Case 10 - 28 Petition to rezone a 074 acre tract located at 404 Clinton Drive in Cleveland Township from Agricultural Residential AR to Agricultural Residential - Special Use District AR - SUD Tax ID 06E02029W Owner Ray & Diana Jackson Applicant Diana Jackson Commissioner Wade M Stewart moved the Board approve rezoning case 10 - 28 to rezone a 074 acre tract located at 404 Clinton Drive in Cleveland Township from Agricultural Residential to Agricultural Residential - Special Use District Commissioner Cookie Pope seconded the motion , which carried by unanimous vote The Chairman opened the Special Use Hearing for Case 10 - 28 Case 10 - 28 To allow for the operation of a child care facility and residence Owner Ray & Diana Jackson Applicant Diana Jackson Those wishing to speak on Special Use Case 10 - 28 were sworn in by the Clerk to the Board Planning Director Berry Gray introduced the special use case and stated the request is to allow for the operation of a child care facility and residence Mr Gray introduced the following summary of evidence into the record A pre - application consultation was held with the applicant for Case 10 - 28 on September 30 , 2010 At that time , the applicant was informed of the following • If approved , applicant must provide to the Planning Office a Site Plan for their review and approval • Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board • Applicant will be notified in writing of the Board’s decision • If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners • Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period • When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements • Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On December 21 , 2010 , the Johnston County Planning Board held a public hearing regarding Rezoning Special Use Permit Case 10 - 28 and made the following recommendations Upon a motion by Mr Letchworth to recommend approval , seconded by Mr Gathers , and carried by a unanimous vote of 8 - 0 , the Planning Board recommended approval of Rezoning for Case 10 - 28 at the December 21st , 2010 meeting Upon a motion by Mr Letchworth for approval of the Special Use Conditions with removal of conditions 4 and 8 and reduction of signage seconded by Mr Gathers and carried by a unanimous vote of 8 - 0 , the Planning Board recommended approval of the Special Use for Case 10 - 28 at the December 21st , 2010 meeting based on the findings of fact and special use conditions Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; Applicant We currently operate an in home day care , and would like to expand to 12 children We are located less than a mile from West View Elementary School Rezoning would enhance the community and provide a quality childcare setting Rezoning this property will promote the health , safety , and welfare of more children in the community Staff The proposed facility will provide a needed service to the community The applicant will abide by all state and local laws as they relate to child care facilities This includes maintaining a clean and healthy environment for the children to learn and play in 2 That the use of development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; Applicant Rezoning this property will comply with all required land developments codes by the property continuing to be used as a residence , and allow of home day care to grow in accordance to the regulations of the County and State Page262 February 7 , 2011 – 6 00 pm Continued Staff This development will comply with the use and intensity regulations as set forth in the Land Development Code The Land Development code requires that any child care facility servicing more than eight children shall be rezoned to a district that permits such a business The applicant has requested a Special Use Permit and the business shall be subject to the conditions placed upon it by the Boards 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; Applicant This property is located near an elementary school The property will remain as a dwelling and no physical changes are needed to expand the number of children Staff The facility will provide a needed service to the community The business will only be open during normal hours and will continue to be maintained as a residence This , along with the special use conditions required by the Boards , will maintain the value of contiguous properties 4 That the use or development conforms with general plans for the physical development of the County’s Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners Applicant The use of the development of this property will continue to conform to the countys land development codes , strategic plan , and other development policies by continuing to remain a dwelling and providing quality childcare to the community Staff Applicant’s proposed development will conform to all requirements of the Land Development Code and any conditions as required by the Boards and Federal , State and Local agencies Specific Land Uses APPLICANT Child Care Facility and Residence Special Use Conditions 1 Permitted Uses Child care facility and residence 2 The Special Use Permit shall expire with the violation of any Special Use Condition 3 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 4 Installation of a Class A landscape buffer along all rezoning lines 1 large tree , 1 small tree , and 6 shrubs every one hundred 100 linear feet Landscaping shall be placed on the outside of any fences 5 Number of children to be cared for shall be limited to no more than twelve 12 6 Hours of operation shall be Monday through Friday , 5 30 am until 6 30 pm 7 Signage must comply with the County’s sign code , and limited to less than 4sqft 2sqft 8 Lighting shall be dark sky and engineered so as not to shine onto adjacent properties Strike - through denotes changes Mr Gray listed and reviewed each of the special use conditions with the Board Mr Gray pointed out that the Planning Board recommended the removal of conditions # 4 and # 8 regarding buffers and lighting in that the subject site is located in a residential area and if buffering or lighting was required , the subject site could have more of a business appearance At the inquiry of Commissioner Tony Braswell , Mr Gray reported that the State regulates daycares and in - home daycares are only allowed to care for up to a certain number of children Once the limit has been exceeded , the State prohibits occupants from actually living in the facility Commissioner Jeffrey P Carver asked , if the intent is for the subject site not to appear commercial in nature , then why signage would be needed Mr Gray stated the applicant has requested to put a small sign on her mailbox He noted that there has been no advertisement in the past ; therefore , the Board could remove the condition regarding signage Applicant Diana Jackson , 404 Clinton Drive , stated that she would like to put a small sign under her mailbox with the name of her facility on the sign Upon questions by Commissioner Braswell , Ms Jackson stated that State licensing requirements would not allow for home daycares to have more than 12 fulltime children ; or 15 afterschool children , if the children were in afterschool care only Ms Jackson stated the maximum enrollment would stand at 12 children in her facility , based on teacher ratios and if she wished to expand beyond 12 children , she would need to look for another location Ms Jackson noted that she would like to have open house events twice per year and she asked if those events would be allowed since they would occur after closing hours and she would not charge for attendance at such events Ms Jackson also stated that in the past , she and some of her neighbors have hosted Easter celebrations that were funded by her daycare for the children in the subdivision Chairman Mims stated that since Ms Jackson would not be charging for events such as an Easter Egg Hunt , and also since any of the children in the subdivision could be invited or other residents in the subdivision could hold similar celebrations , he saw no issues with such events Ms Jackson stated the open house events would be business related and she asked if they would be allowed PagePage pageNumber5263 February 7 , 2011 – 6 00 pm Continued Mr Gray stated the Board could add language in the hours of operation condition allowing for a certain number of open house events during the year Chairman Mims noted that the Board heard comments from Mr McMillan during the rezoning hearing that Ms Jackson walks in the subdivision with the children and he asked Ms Jackson for more information Ms Jackson stated she does walk in the subdivision with the children ; however , they walk to the cul - de - sac and the walks are properly managed Ms Jackson stated if a car approaches , all the children hold hands and stay close to her Ms Jackson stated that she has spoken with all of the parents that have children in her operation and has stressed to them to be mindful of the street signs and to watch their speed in the subdivision Ms Jackson noted that some of the parents from her operation have complained to her about other people speeding in the subdivision Ms Jackson stated she has approached some of her neighbors in the subdivision that were speeding and asked them to slow down and watch for children Commissioner Cookie Pope asked if the Board chooses to approve the special use permit , would the addition of language allowing for two open house events per year be sufficient , noting earlier comments by Ms Jackson regarding the Easter celebration Ms Jackson clarified that the Easter event was funded by her operation ; however , it was intended for all the children in the subdivision to enjoy and it was planned jointly with other parents in the subdivision Lynn McMillan , 230 Devin Drive , stated he has lived in the subdivision since the beginning of its development and he is still concerned over cars speeding through the subdivision Mr McMillan stated there should be signs posted in the subdivision letting people know that there is a daycare facility in the subdivision and that children may be playing outside Mr Gray stated the Planning Board recommended approval Commissioner Tony Braswell asked if the subdivision streets are maintained by the Department of Transportation and if so , could “ Slow – Children Playing ” signs be installed Mr McMillan stated that he was told the streets were not State maintained when he inquired if school buses could come into the subdivision to pick up children ; however , he noted that since that time , school buses have started coming into the subdivision Mr Gray reported that if the roads are not State maintained , there should be a road maintenance agreement in place and staff could send a request to the developer of the subdivision asking them to install the signs Otherwise , staff would check with the DOT on the status of the road and installing “ Slow – Children Playing ” signs There being no further comments , the Chairman closed the Special Use Hearing for Case 10 - 28 Decision on Special Use Case 10 - 28 Case 10 - 28 To allow for the operation of a child care facility and residence Owner Ray & Diana Jackson Applicant Diana Jackson Motion Based on the findings of facts and revised special use conditions with revisions allowing for three afterhours events to be held per year , Commissioner Cookie Pope moved the Board authorize the Planning Department to issue a special use permit for Case 10 - 28 to allow for the operation of a child care facility and residence on a 074 acre tract located at 404 Clinton Drive in Cleveland Township Discussion , Amendment to Motion and Second Commissioner Tony Braswell indicated that he would be willing to second the motion by Commissioner Pope if she would amend the motion to also eliminate signage due to the residential nature of the subdivision Commissioner Cookie Pope amended her motion as follows PagePage pageNumber6264 February 7 , 2011 – 6 00 pm Continued Based on the findings of facts and revised special use conditions with revisions allowing for three afterhours events to be held per year and the elimination of the condition regarding signage , Commissioner Cookie Pope moved the Board authorize the Planning Department to issue a special use permit for Case 10 - 28 to allow for the operation of a child care facility and residence on a 074 acre tract located at 404 Clinton Drive in Cleveland Township Commissioner Tony Braswell seconded the motion Further Discussion Chairman Allen L Mims , Jr asked if the motion included any language requiring “ Slow – Children Playing ” signs to be installed along the streets near the operation Commissioner Braswell stated that he was unsure as to exactly how much authority the Board had in requiring “ Slow – Children Playing ” signs Commissioner DeVan Barbour stated that he believed the issue of installing “ Slow – Children Playing ” signs is a separate matter from the requirements in the special conditions Planning Director Berry Gray reported staff could research the matter and determine who is responsible for maintaining the road and request that entity to install the signs Chairman Mims stated if the road is not State maintained , then a condition could be added requiring the applicant to install “ Slow – Children Playing ” signs County Attorney David Mills advised that the Board could add a condition requiring the applicant to install a “ Slow – Children Playing ” sign on her property only Commissioners Pope and Braswell indicated that they did not wish to add a condition in the motion requiring the applicant to install a “ Slow – Children Playing ” sign on her property Vote The motion carried by unanimous vote Findings of Fact for the Special Use Permit The Board of Commissioners adopts the findings of facts as set in Staff’s recommendation in the above summary of evidence , as its own Special Use Conditions 1 Permitted Uses Child care facility and residence 2 The Special Use Permit shall expire with the violation of any Special Use Condition 3 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 4 Number of children to be cared for shall be limited to no more than twelve 12 5 Hours of operation shall be Monday through Friday , 5 30 am until 6 30 pm , with the exception of three afterhours events that may be held during the year The Chairman reopened the Rezoning Hearing for Case 10 - 30 Case 10 - 30 Petition to rezone a 4827 acre tract located at 6129 NC 42 West in Cleveland Township from Agricultural Residential AR to General Business GB Tax ID 06D01009H Owner Patricia and Donald Maynard Applicant John M Strasser Properties , LLC Planning Director Berry Gray stated the petition is to rezone a 4827 acre tract located at 6129 NC 42 West in Cleveland Township from Agricultural Residential to General Business Mr Gray stated the existing land use is zoned Agricultural Residential and is vacant The surrounding land uses are zoned Agricultural Residential and used for residential purposes ; General Business and used for a commercial business park ; General Business – Special Use District and used for an auto parts store ; Interstate Highway District and used for a variety of commercial uses ; and Mixed - Use Planned Development The area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan which denotes an area in which high levels of growth pressures currently exist or are anticipated near term Additionally , the site is located between a “ Community Centers ” and “ Regional Centers ” activity node PagePage pageNumber7265 February 7 , 2011 – 6 00 pm Continued Will Marshburn , of Bobbit Design Build , 308 Village Orchard Road , representing the applicant , stated the applicant is interested in building a veterinary facility on the subject site and he currently operates multiple veterinary clinics in Wake County Mr Marshburn recalled that Mr Wayne Lewter had spoken at the Planning Board meeting and since that time , the applicant has met with Mr Lewter to explain his intentions for the site and they believe that Mr Lewter is now comfortable with the plans for the site Mr Gray reported the Planning Board recommended approval of the rezoning request There being no further comments , the Chairman closed the Rezoning Hearing for Case 10 - 30 Decision on Rezoning Case 10 - 30 Case 10 - 30 Petition to rezone a 4827 acre tract located at 6129 NC 42 West in Cleveland Township from Agricultural Residential AR to General Business GB Tax ID 06D01009H Owner Patricia and Donald Maynard Applicant John M Strasser Properties , LLC Commissioner Cookie Pope moved the Board approve rezoning case 10 - 30 to rezone a 4827 acre tract located at 6129 NC 42 West in Cleveland Township from Agricultural Residential to General Business Commissioner Tony Braswell seconded the motion , which carried by unanimous vote 3 Second Vote Ordinance Amendment - § 14 - 75 Open Space Fee In Lieu Chairman Allen L Mims , Jr noted that at the January 3 , 2011 meeting of the Johnston County Board of Commissioners , the vote to approve an amendment to the Code of Ordinances as it relates to Section 14 - 75 – Open Space Fee In Lieu was not unanimous by the Board Pursuant to NCGS § 153A - 45 , the Board must take a second vote on the matter Chairman Mims asked Planning Director Berry Gray to briefly review the proposed amendment for the record Planning Director Berry Gray explained that currently the County gives developers an option to either designate acreage for open space or pay the open space fee - in - lieu when developing subdivisions The current open space fee - in - lieu is 400 per lot Mr Gray reported the current code states that the fee can be used by the County for the acquisition or development of open space ; however , North Carolina General Statute 153A - 331 only allows a county to use open space funds for the acquisition of land within the immediate area in which it was collected , unlike municipalities which can use their funds for acquisition or development anywhere within their boundaries Mr Gray stated the proposed amendment is to adjust the ordinance language to mirror that of the State Statute At the inquiry of Chairman Mims , Mr Gray stated that the term “ immediate area ” is not defined in the General Statute ; therefore , the Board could interpret “ immediate area ” as townships Commissioner W Ray Woodall noted that he has open space and he asked should he abstain from voting on the amendment At the inquiry of Chairman Mims , County Attorney David Mills advised that the Commissioners are required to vote on a matter unless it directly financially impacts them resulting in a conflict of interest Chairman Mims stated the ordinance amendment under consideration pertains to how the County can spend open space fee - in - lieu funds that have already been collected Mr Mills agreed and stated the ordinance amendment has nothing to do with the collection or charging of the fee , but rather the amendment would make the County’s ordinance compliant with the General Statute Commissioner Jeffrey P Carver moved the Board approve the amendment to the Code of Ordinances as presented and following , seconded by Commissioner Tony Braswell , and carried by the following vote Ayes Commissioners Allen L Mims , Jr , Jeffrey P Carver , W Ray Woodall , DeVan Barbour , and Tony Braswell Nays Commissioners Wade M Stewart and Cookie Pope Section 14 - in - lieu shall be required The county shall use such payment only for the acquisition or development of open space , recreation , or park sites to serve residents of the county more than one subdivision or development within the immediate area The amount of the payment shall be the product of the total number of dwelling units recorded multiplied by the fee established in the countys annual schedule of fees The developer shall make the payment before approval of a final plat , however , the planning director may allow phasing of payments consistent with the approved phasing of the subdivision 4 Manager Reports and Comments A Request to Surplus Mental Health Vehicle At the request of the County Manager , upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board declared a 1995 Dodge Ram Van , VIN # 2B5WB35Z0SK554100 , with approximately 128,462 miles , as surplus and granted Mental Health Director Dr Janis Nutt the authority to dispose of the vehicle 5 Board Reports and Comments A Good Neighbor Firearms Ordinance Workgroup Meeting and Public Hearing Chairman Allen L Mims , Jr reminded everyone that the Good Neighbor Firearms Ordinance Workgroup would be meeting on February 8 , 2011 at 6 00 pm in the Emergency Operations Center Chairman Mims also noted that at the 10 00 am meeting , he scheduled a public hearing to be held at the March 7 , 2011 6 00 pm Board of Commissioners meeting on the proposed firearms ordinance B Board Work Session Scheduled Following discussion , the Board scheduled Friday , March 11 , 2011 at 8 30 am for the annual 2011 Board Work Session , to be held at the Workforce Development Center in Clayton 6 NC Stop Torture Now Quaker House Chuck Fager , 223 Hillside Avenue , Fayetteville , North Carolina , presented the Board with updated information regarding the accountability of those that NC Stop Torture Now alleges kidnap and abuse detainees There being no further business , Commissioner Tony Braswell moved the Board adjourn Commissioner Jeffrey P Carver seconded the motion , which carried by unanimous vote The meeting adjourned at 7 10 pm Allen L Mims , Jr , Chairman Paula G Woodard , Clerk to the BoardPage
