Proclamation for National Recovery Month adopted as follows PROCLAMATION National Recovery Month September 2016 WHEREAS , behavioral health is an essential part of health and one’s overall wellness ; and WHEREAS , prevention of mental and or substance use disorders works , treatment is effective , and people recover in our area and around the nation ; and WHEREAS , preventing and overcoming mental and or substance use disorders is essential to achieving healthy lifestyles , both physically and emotionally ; and WHEREAS , we must encourage relatives and friends of people with mental and or substance use disorders to implement preventive measures , recognize the signs of a problem , and guide those in need to appropriate treatment and recovery support services ; and WHEREAS , an SWEEP 2016 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the FALL LITTER SWEEP roadside cleanup encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Public PASSENGER SAFETY WEEK 2016 PROCLAMATION WHEREAS , Children are our country’s most precious resource As parents and caregivers it is our responsibility to keep America’s children safe Every year , thousands of children are tragically injured or killed in motor vehicle traffic crashes For children age 3 and older , it is the leading cause of death It is hard to overstate the toll this takes on families Together we can put an end to this WHEREAS , Today , all 50 States , the District of Columbia , and our Territories have laws requiring the use of child safety seats and seat belts for children traveling in motor vehicles These laws were enacted because of the tremendous safety benefits they provide We know that child safety seats help save lives and reduce injuries We also know that they are most effective when installed and used correctly Sadly , nearly 3 out of 4 child safety seats are not used properly Starting now , working together , we must join forces to prevent these deaths and injuries WHEREAS , Johnston County is committed to working closely with our partners and safety advocates to help reduce the number of young lives lost on our roadways Our goal is to concern for the welfare of others ; and Whereas , firefighters provide valuable services to the citizens of Johnston County , their communities , and the County ; and Whereas , firefighters make sacrifices to protect the lives and financial interests of the citizens of Johnston County ; and Whereas , firefighters respond to emergencies without hesitation when the call of duty arises ; and ” and moved for its adoption Commissioner Ted G Godwin seconded the motion which carried by unanimous vote RESOLUTION IN HONOR Iva Lee Benson Gainey Johnston County’s Last “ Real Daughter of the Confederacy ” WHEREAS , Mr Charles Harvey Benson 1844 – 1929 was a native of Johnston County , the son of William th and Louisa Tyner Benson , who at 19 years old joined North Carolina’s 24 Regiment , Company I , Confederate States of America and served honorably under General Robert E Lee ; andPagePage pageNumber6354 September 6 , 2016 – 10 00 am Continued WHEREAS , Mr Benson served in General Robert E Lee’s tragic , last ditch campaign to defend Petersburg and Richmond and although was wounded on at least two separate occasions , managed to survive the Civil War ; and WHEREAS , Mr Benson was captured by the enemy at Fort Stedman , Virginia , on March 25 , 1865 and was held in a prisoner - of - war camp at Point Lookout , Maryland , for months along with his brother , William Cullen Benson , until they were allowed to return home after taking an oath of allegiance to the United States government ; and WHEREAS , after the War and upon returning home , Mr Benson became a prominent farmer in Johnston County’s Elevation Township and was the father of 14 children , all of whom lived to adulthood ; and WHEREAS , Mrs Iva Lee Benson Gainey , born in 1923 , is the youngest child of Mr Charles Harvey Benson ; and WHEREAS , Mrs Gainey currently lives in the Town of Benson and is known as Johnston County’s last “ Real Daughter of the Confederacy ” ; and WHEREAS , Mrs Gainey is recognized by the United Daughters of the Confederacy as one of only ten Real Daughters in the United States NOW , THEREFORE , BE IT RESOLVED , that the Johnston County Board of Commissioners does hereby honor Mrs Iva Lee Benson Gainey as Johnston County’s last “ Real Daughter of the Confederacy ” th Adopted this the 6 day of September , 2016 Heritage Center Director Todd Johnson stated the Heritage Center is very proud of Mrs Gainey and sincerely appreciates the Board of Commissioners recognizing her with the framed resolution Mr Johnson thanked Mrs Gainey and her family for being a part of the meeting today Mrs Gainey then accepted the framed resolution from Commissioner Barbour The Board of Commissioners took a photo with Mrs Gainey and her family 4 Public Comments A Johnston Community College – Update to Board Johnston Community College President Dr David Johnson provided the Board with an update regarding ongoing construction projects at the College Dr Johnson reported the southeast parking lot project is well underway and for the most part is on schedule with possibly a two - week delay due to weather He stated there is a need for more undercutting than was original thought ; however , they anticipate the cost for that additional undercutting should be covered within the contingency Dr Johnson continued the Tart Building and Steam th Building roof contracts are scheduled for pre - bid conferences on September 14 Dr Johnson stated regarding the Tart Building’s complete renovation , the College has selected two designers which are currently under contract negotiation with the Office of State Construction He reported one designer is Boomerang which has the stage contract and is working with a theatrical company for those renovations while the other is HH Architecture for the total building renovation contract Dr Johnson stated in addition to those projects , the College is using some of their capital monies to continue campus beautification which includes power - washing , painting , and sidewalk repair Dr Johnson spoke on the importance of campus beautification as a recruitment tool and stated he will continue to bring updates to the Board as work progresses The Board thanked Dr Johnson for the update B Citizen Comments – Dennis Nielsen Dennis Nielsen , 9485 NC Hwy 39 , addressed the Board and took a moment to compliment County Attorney Jennifer Slusser , Tax Administrator Sheila Garner , County Manager Rick Hester and Commissioner Jeffrey P Carver for their recent assistance to him Mr Nielsen stated Ms Slusser and Ms Garner were able to assist him with a tax matter which was resolved fairly Mr Nielsen thanked the County staff for their willingness to always speak with him Mr Nielsen also Nielsen stated while he has no complaints , he wanted to inform the Board of an issue regarding a recent custody dispute which involved the Johnston County Child Support Department and the Attorney that represents that Department Mr Nielsen expressed his feelings that non - custodial parents should be pursued more aggressively for child support and asked the Board to look into how such cases are handled Mr Nielsen provided the Board with information on a recent specific child support case and how he felt the Child Support Department’s Attorney did not pursue the income of the non - custodial parent in a sufficient manner Mr Nielsen also expressed his concerns that there are signs in the courthouse that say cell phones are not allowed in the courtrooms , yet attorneys continue to have and use their phones in the courtrooms in front of the public Mr Nielsen stated he feels the rules should apply to everyone and should be fair and equal to all Mr Nielsen suggested changing the rules to say “ no cell phone use ” as other counties have done so that people would still be allowed to have their phones with them and could step outside to use them if needed instead of having to walk all the way back to their cars C Neuse Charter School – New Executive Director Neuse Charter School Board Member Chris Johnson introduced Ms Susan Pullium as the Neuse Charter School’s new Executive Director Mr Johnson provided the Board with a background on Ms Pullium noting she earned a Bachelor of Arts Degree in Education from Arizona State University and a Masters in School Administration from East Carolina University Ms Pullium has over two decades of educational and executive service experience in the public sector Mr Johnson reported Neuse Charter currently has 917 students in grades K - 12 with approximately 200 on the waiting list Ms Pullium stated it is a great opportunity for her to be in Johnston County and she looks forward to building strong partnerships D Citizen Comments – Rev Dr Wendy Ella May Rev Dr Wendy Ella May , 1577 Davis Homestead Road , Selma , thanked the Board for adopting a resolution proclaiming September 11 – 17 as Firefighters Week in Johnston County Dr May commended EMS for their response and assistance with two motor vehicle accidents over the weekend in the Micro area noting they operated in a fast and orderly manner Dr May also spoke on the closing of Johnston Ambulance Service and complimented the Commissioners for having the foresight to contract with North State Ambulance several months ago to have another provider in place Dr May also commended law enforcement officers for providing protection to Johnston County stating that law enforcement lives as well as firefighter lives , EMS lives , and citizen lives all matter E Citizen Comments – Janice Gallagher Janis Gallagher , 127 Wilders Woods Grove Lane , Clayton , addressed the Board and spoke on an issue recently where the power was out in her neighborhood She reported that an individual was riding in their neighborhood and shining flashlights into their garages which prompted her to call 911 for law enforcement Ms Gallagher stated it took her over two hours to get through to 911 Ms Gallagher stated in two hours , a lot can happen and where they live they do not have municipal representation At the request of Chairman Tony Braswell , 911 - Communications Director Jason Barbour reported that there have been no 911 Center outages ; however , he explained if the power is out in an area , he has seen instances where people who have telephone service via an internet provider or cell phone company are not able to call 911 or any other numbers Mr Barbour stated if the internet telephone providers or cell companies do not have backup generators then he is not surprised that calls are not getting through during power outages At the inquiry of Commissioner DeVan Barbour , Mr Barbour reported not all cell towers have backup generators Mr Barbour offered to speak with Ms Gallagher and look into the situation further to determine what happened during her recent instance F Citizen Comments - Cindy Pittard Cindy Pittard , Attorney in Smithfield , stated in response to earlier comments by Mr Dennis Nielsen regarding cell phone use in the courtrooms by attorneys , because courtroom space is limited , attorneys often tell their clients to stay enough for him to open his windows , but there are nearby residents that openly burn trash which is illegal and creates air quality problems Mr Taylor stated he has tried to work through the Sheriff’s Department as well as the Planning Department to get relief and was finally told to call 911 when the burning takes place Mr Taylor stated he may start calling the Air Quality Division with the State , but it is a problem that needs to be dealt with H Citizen Comments – Lloyd Barnes Lloyd Barnes , Planning Board Member for Wilson’s Mills , stated Wilson’s Mills currently does not have a Town Manager ; however , he asked the Board of Commissioners to make sure that Wilson’s Mills is kept informed regarding matters in the County Mr Barnes spoke on the importance of making sure everyone is involved Chairman Tony Braswell stated he along with the County Manager meets regularly with the Mayors in the County and he encourages that continued participation so everyone can understand each other’s situations 5 Johnston County Schools – Capital Needs Johnston County Schools Superintendent Dr Ross Renfrow presented the following information to the Board regarding capital needs PagePage Operations Officer Patrick Jacobs Upon a question by Commissioner Ted G Godwin , Dr Renfrow stated the multi - purpose buildings identified in the list at Smithfield Selma High School , Clayton High School , and possibly South Johnston High School are the result of a demonstrated need for those structures Dr Renfrow stated the combined cost of the three structures is estimated at 15 million which is the overage amount on the overall projects and the Board of Education felt they needed to contribute that cost Commissioner Allen L Mims , Jr asked if any of the projects on the list included classroom space , noting he saw an article that said the enrollment this year was more than expected Dr Renfrow responded for the first time in school history , enrollment is above 35,000 and if that number holds true for 20 days it will be the first time they have reached that pinnacle Dr Renfrow stated with the multi - purpose buildings at Smithfield Selma High School , Clayton High School , and possibly South Johnston High School there could be designated areas in that square footage for classroom space Commissioner Mims asked if there were any architectural or engineering studies that support the projects on the list Dr Renfrow responded Hite & Associates will be attending the Board of Education meeting next week and presenting a full scale report of findings , but they did help generate this list of most pressing needs Commissioner Mims asked Dr Renfrow to make those reports available to the County Manager to be shared with the Commissioners Commissioner DeVan Barbour stated he appreciates everyone working together on the list and explained that the County has been systematically holding bond referendums since the 1990 ’ s to try and address capital needs Commissioner Barbour continued that the General Assembly has since changed the statute to only allow bond referendums during even - numbered years He stated because another bond referendum cannot be held for two more years as well as adding even more time to account for the actual bond sales , everyone realized there was going to be a gap in capital needs Therefore , this list is the result of everyone being proactive and prioritizing needed projects Commissioner Barbour stated the list has evolved somewhat from initial discussions and he sincerely appreciates all the hard work and cooperativeness County Emergency Services has received approval for a Homeland Security Grant from North Carolina Emergency Management in the amount of 13,000 with no local match required He explained the purpose of the grant will be to develop and facilitate an active threat exercise series in coordination with local and State partners The initial step will be a planning conference to provide an opportunity for collaboration among all organizations agencies involved in an active shooter event The second phase will be a tabletop exercise built on the planning conference outcomes and objectives identified in planning meetings in accordance with the Homeland Security Exercise Evaluation Program with tentative scheduling for the full - scale exercise in late fall , early winter 2017 This exercise series will enhance the active threat capabilities in Johnston County and contribute to meeting the legislative goals for the school system for an active shooter exercise Mr Madsen requested the Board to is glad to have him on board Mr Whitehurst stated on May 1 , 2014 , Johnston County and the Town of Zebulon entered into an agreement to provide fire protection services to the Wakelon Fire Insurance District in Johnston County Mr Whitehurst explained the agreement was set to expire two years after the date of adoption He stated staff respectfully requests the Board of Commissioners to approve an amendment to extend the provisions of the Interlocal Agreement to expire on June 30 , 2017 This date will allow for consistency and correspond to the expiration date of all other fire services contracts and agreements in the County All other terms and conditions of the original contract shall remain in effect with the addition of Section 18 to ensure the Town of Zebulon complies with the RESOLUTION BY GOVERNING BODY OF APPLICANTPage8366 September 6 , 2016 – 10 00 am Continued WHEREAS , The Federal Clean Water Act Amendments of 1987 and the North Carolina the Water Infrastructure Act of 2005 NCGS 159G have authorized the making of loans and grants to aid eligible units of government in financing the cost of construction of drinking water distribution system improvements , and WHEREAS , Wilson’s Mills Water District has need for and intends to construct a Wilson’s Mills Water District 2017 Transmission Improvements project described as water transmission main improvements and a new Wilson’s Mills booster pump station , and WHEREAS , Wilson’s Mills Water District intends to request state loan and or grant assistance for the project , NOW THEREFORE BE IT RESOLVED , BY THE BOARD OF WILSON’S MILLS WATER DISTRICT That Wilson’s Mills Water District , the Applicant , will arrange financing for all remaining costs of the project , if approved for a State loan and or grant award That the Applicant will adopt and place into effect on or before completion of the project a schedule of fees and charges and other available funds which will provide adequate funds for proper operation , maintenance , and administration of the system and the repayment of all principal and interest on the debt That the governing body of the Applicant agrees to include in the loan agreement a provision authorizing the State Treasurer , upon failure of Wilson’s Mills Water District to make scheduled repayment of the loan , to withhold from Wilson’s Mills Water Distrct any State funds that would otherwise be distributed to the local government unit in an amount sufficient to pay all sums then due and payable to the State as a repayment of the loan That the Applicant will provide for efficient operation and maintenance of the project on completion of construction thereof That Rick J Hester , Johnston County Manager , the Authorized Official , and successors so titled , is hereby authorized to execute and file an application on behalf of the Applicant with the State of North Carolina for a loan or grant to aid in the construction of the project described above That the Authorized Official , and successors so titled , is hereby authorized and directed to furnish such information as the appropriate State agency may request in connection with such application or the project to make the assurances as contained above ; and to execute such other documents as may be required in connection with the application That the Applicant has substantially complied or will substantially comply with all Federal , State , and local laws , rules , regulations , and ordinances applicable to the project and to Federal and State grants and loans pertaining thereto th Adopted as the Wilson’s Mills Water District Board , and regular session was resumed 13 Public Utilities – Elevation Water District Improvements – Resolution for Grant Loan Funding Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board recessed regular session to sit as the Elevation Water District Board Sitting as the Elevation Water District Board Commissioner DeVan Barbour moved the Board adopt the following resolution authorizing the submittal of loan and grant applications and designating signatory authority to
