10 197 Meeting of the Johnston County Board of Commissioners May 2 , 2016 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , May 2 , 2016 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Tony Braswell , Vice Chairman DeVan Barbour , Cookie Pope , Allen L Mims , Jr , Jeffrey P Carver , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Tony Braswell called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comment A New Director for Harbor Harbor Board of Directors Chair Angie Lock addressed the Commissioners and thanked them for their continued support Ms Lock introduced Ms Kay Johnson as the new Executive Director for Harbor Ms Lock stated that Ms Johnson comes with non - profit experience , is a Johnston County native and a resident of Clayton Ms Johnson stated it is a pleasure to address the Board on behalf of Harbor and she is very excited to be able to serve the families of Johnston County as the new Director for Harbor Ms Johnson noted that within 30 to 45 days they will be moving into the new shelter and the staff is in the process of preparing for that move Ms Johnson stated they are excited about the volunteerism effort they have received on the new shelter She thanked the Board for their continued support The Board welcomed Ms Johnson to her new position B Citizen Concern – Animal Control Ordinance and Animal Care Angela Bryan , 2305 Oak Forest Road , Four Oaks , North Carolina addressed the Board regarding her concerns for animal welfare in Johnston County as well as language in the Johnston County Code of Ordinances as it relates to the care of animals Ms Bryan stated she left documentation with the County staff back in March with regards to changes she would like to see made in the ordinance , but has heard nothing to date Ms Bryan spoke on her concerns with how the ordinance was amended in the past and asked questions as to why certain language was removed in 2010 Ms Bryan stated the summer is coming and she is greatly concerned about animals overheating without proper shade She requested the Board to put a proper definition of “ shade ” in the ordinance so the Animal Control Officers will be able to better enforce the ordinance Ms Bryan also asked the Board to look at the ordinances in Wake County , Sampson County and other areas for suggestions Ms Bryan expressed her frustrations on the amount of time it takes to have the ordinance amended and stated she feels ignored but does not intend to give up on the matter Ms Bryan asked the Commissioners to consider accompanying her around the County to witness the conditions that she sees animals living in Chairman Tony Braswell stated the Board understands what Ms Bryan is asking for , will take the information under advisement , and will have the County staff contact her Chairman Braswell assured Ms Bryan that staff will operate in the most expedient manner possible 2 Public Hearing Rezoning and Special Use Requests Advertised – The Smithfield Herald – April 20 and 27 , 2016 Certified letters were mailed to adjoining property owners on April 18 , 2016 Notices were posted at the locations on March 1 , 2016 for Cases 05 - 30 MOD 4 ; 16 - 05 ; 16 - 07 ; 16 - 09 ; and 16 - 10 The Chairman opened the Special Use Hearing for Case 05 - 30 MOD 4 Case 05 - 30 MOD 4 A request to modify the Special Use Permit Master Plan for a 18783 acre Planned Unit Development called Summerwind Plantation located along Glen Road SR 1547 in Cleveland Township The modification request is to modify a 1009 acrePage198 May 2 , 2016 – 6 00 pm Continued commercial multifamily area south of Glen Road to multifamily and increase the number of multifamily dwelling units The property is zoned AR - SUD for a Planned Development Tax ID 06E02001B Owner Forrest Glen Johnson and Larry Wayne Johnson Applicant Maida Renson , Carolina Community Developers , LLC Those wishing to speak on Special Use Case 05 - 30 MOD 4 were sworn in by the Clerk to the Board Planning Director Berry Gray introduced the special use case and stated the petition is to modify the Special Use Permit Master Plan for a 18783 acre Planned Unit Development called Summerwind Plantation located along Glen Road in Cleveland Township The modification request is to modify a 1009 acre commercial multifamily area south of Glen Road to multifamily and increase the number of multifamily dwelling units Mr Gray entered the fact sheet , supporting documents in the agenda packet , and introduced the following summary of evidence into the record A pre - application consultation was held with the applicant for Case 05 - 30 MOD 4 on February 4 , 2016 At that time , the applicant was informed of the following ? If approved , applicant must provide to the Planning Office a Site Plan for their review and approval ? Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board ? Applicant will be notified in writing of the Board’s decision ? If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners ? Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period ? When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements ? Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On March 15 , 2016 the Johnston County Planning Board held a public hearing regarding Special Use Permit Case 05 - 30 MOD 4 and made the following recommendations Upon a motion by Mr Letchworth to approve the Modification of the Special Use Permit for Case 05 - 30 , seconded by Mr Summerlin , with a unanimous vote of 7 - 0 , Case 05 - 30 Modification was approved at the March 15th , 2016 Planning Board Meeting Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; Applicant This modification is to allow for multi - family development within the allowable density of the Planned Development Code 2 That the use of development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; Applicant This modification is intended to meet the density and intensity regulations of the land development code 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; Applicant This area is designed to limit the number of individual access points onto Glen Rd to prevent traffic congestion at access points 4 That the use or development conforms with general plans for the physical development of the County’s Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners Applicant This is a at 50 build - out Apartments must be designed based on the renderings submitted by the applicant and included in the agenda packet and found on file in the Johnston County Planning Office Mr Gray stated the subject site is surrounded by other multifamily and commercial development He noted the location of the site is on the south side of Glen Road and the north side is also part of Summerwind Plantation which transitions from multifamily and commercial back into townhomes and finally single family homes Mr Gray stated the area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan that denotes an area in which high levels of growth pressures currently exist or are anticipated near term Additionally , this site is located within a “ Regional Center ” Commercial activity node Mr Gray stated the requested change is to adjust the master plan from commercial and multifamily to strictly a multifamily area for this 10 acres which would increase the number of units for Summerwind Plantation by 160 for multifamily thereby increasing multifamily overall from 334 to 494 Mr Gray stated single family would stay at 292 and the new overall residential total , if approved , would increase from 626 to 786 Mr Gray stated with the modification in 2015 when multifamily was requested on the north side of Glen Road , a Traffic Impact Analysis was performed at that time which incorporated the subject site and the potential increase in units Mr Gray stated the applicant is requesting the Board to consider that Traffic Impact Analysis for this case He stated the Traffic Impact Analysis was performed by Wetherill Engineering and representatives are present to answer any questions Mr Gray briefly spoke on the special use conditions submitted for the Board’s review noting condition # 21 was added in accordance with the modification approved in 2015 Page200 May 2 , 2016 – 6 00 pm Continued At the inquiry of Commissioner Allen L Mims , Jr , Mr Gray reported the subject site has been before the Board of Commissioners four times for modification requests Applicant Maida Renson , Carolina Community Developers , LLC , stated they would like to develop additional housing next to Glen Road Ms Renson reported they currently have people on waiting lists for housing at both of their existing apartment complexes and their market study shows a very strong need for the requested housing She stated the amenities would be similar to their other complexes Ms Renson stated the plan would be a nice addition to the neighborhood Upon a question by Commissioner Ted G Godwin , Ms Renson stated they would target families , but they are considering marketing a portion of the development for seniors Ms Renson stated they are planning for one , two , and three bedroom units Frank Price representing Wetherill Engineering who performed the Traffic Impact Analysis for the development addressed the Board Mr Price stated the subject site is in a quickly developing area of the County and there is a continuing need for residential development in and around the interchange Mr Price stated it is no secret that the interchange is over capacity during certain times of the day ; however , the Department of Transportation does have a plan for improvement with a target start date in 2019 Mr Price briefly reviewed his understanding of the alternatives for improvement to the interchange , but noted that the alternatives have not been settled on Chairman Tony Braswell stated it is of concern to him and the other Commissioners that density continues to be added to an already overburdened area Chairman Braswell stated the Board of Commissioners is governing from afar and wishes the area would incorporate in order to control their own destiny noting the Board is often criticized for the decisions they make with regards to the density in the area Chairman Braswell commented that people continue to move into that area of the County even after they see the conditions of the traffic Mr Price stated it is an area where many newcomers want to live with many of those people commuting to Raleigh and the Research Triangle Park to work Commissioner Mims asked why the original master plan has been deviated from so many times Mr Price agreed the master plan has changed a number of times , to which he cannot personally speak to because his job is to evaluate the traffic situation ; however , he stated he believes the development was planned before the recession and market conditions have changed since then There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Gray reported the Planning Board recommended approval of the modification based on the information presented in the fact sheet along with the findings of fact , summary of evidence , and special use conditions There being no further comments , the Chairman recessed the Special Use Hearing for Case 05 - 30 Wake Electric Membership Corp Kelly Fritz Planning Director Berry Gray stated the petition is to rezone 15 acres out of a 50 acre tract located on Wilder Road one - tenth of a mile east of its intersection with NC 39 Hwy in O’Neals Township from Agricultural Residential to Agricultural Residential – Special Use District Mr Gray noted the special use request associated with the rezoning is to allow for an electrical substation The surrounding land uses are zoned Agricultural Residential and used for agricultural and residential purposes The area is located within a designated “ Secondary Growth Area ” on the County’s Comprehensive Land Use Plan which denotes an area in which moderate to low levels of growth pressures are anticipated over the next 20 years Mr Gray reported the site is proposed to relocate a non - conforming use at the intersection of NC 39 Hwy and Wilder Road rather than expand Kelly Fritz , Engineering Supervisor , speaking on behalf of Applicant Wake Electric Membership Corp , stated the rezoning will allow Wake Electric to construct a new breaker station along the existing transmission right - of - way on Wilder Road and improve reliability and resiliency to over 2,500 Wake Electric customers in the area He stated the second phase of the project would involve constructing a new substation on the rezoning site and retire the old substation on Hwy 39 which will free up the space on Hwy 39 for a more appropriate use , provide safer service access for employees , eliminate the risk of a vehicular collision with the station and significantly decrease its visibility Mr Fritz stated Wake Electric feels this change will improve the streetscape along Hwy 39 and provide a much safer place to distribute power At the inquiry of Commissioner WHEREAS , pursuant to NC Gen Stat § 153A - 341 , prior to adopting or rejecting a zoning amendment , the governing board is required to adopt a statement as to whether the amendment is consistent with the comprehensive zoning plan and why the board considers the action taken to be reasonable and in the public interest ; WHEREAS , the County Planning Board has reviewed a proposed amendment to The Official Zoning Maps of Johnston County , for the parcel identified as tax Tag ID 11N01019 located on Wilder Road as shown on the attached Exhibit A , from Agricultural Residential AR to Agricultural Residential Special Use District AR SUD WHEREAS , based on a review of the proposed amendment the Planning Board found that the proposed amendment is consistent with the Johnston County Comprehensive
