Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Tony Braswell , Cookie Pope , Allen L Mims , Jr , Jeffrey P Carver , Ted G Godwin , and Chad M Stewart Absent Vice Chairman DeVan Barbour Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Tony Braswell called the meeting to order at 10 00 am Commissioner Ted G Godwin opened the meeting with a prayer American Legion Post 132 Smithfield led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – January 4 , 2016 10 00 am and 6 00 pm ; and January 20 , 2016 B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Summer Ridge Court , Baldwin Ridge Court , Clay Hill Court , Pleasant Lane , Jackson Ridge Court , High Ridge Court , N Sunset Ridge Drive , S Sunset Ridge Drive and Sunrise Ridge Drive – Summer Ridge – Pleasant Grove Township C Call for Public Hearing – Code of Ordinances Amendment for Land Development Code The Board scheduled a public hearing for the March 7 , 2016 6 00 PM Board of Commissioners Meeting to allow public comment on an amendment to the Code of Ordinances – Land Development Code as it relates to Minor Subdivisions The current minor subdivision standard only allows for two lots from a parent tract dating back to September 1 , 2000 As such , the Planning Board has heard multiple subdivisions of one lot as a major subdivision ; therefore , staff proposed an update to the standard that would move the date forward , as well as add more lots to the standard to bring it into alignment with the Design Manual standards D Tax Releases & the 911 Center received throughout the weather event and thanked everyone for their assistance Mr Barbour stated the 911 Center along with the Clayton backup center received more calls for assistance and radio transmissions during this event than was received during Hurricanes Fran or Floyd Mr Barbour stated if there are future weather events , he would like to issue Public Service Announcements that if the calls are related to power outages , for people not to call 911 but rather to call their electric service provider instead Chairman Tony Braswell and the Board thanked everyone involved for their work and dedication during the weather event At the inquiry of Commissioner Allen L Mims , Jr regarding all the tree limbs in the right - of - ways as a result of the recent weather , County Industries , Inc JCI President & CEO Bill Sharek asked the Board to consider sending a letter in support of JCI becoming the operating agency of the NC WORKS Career Center serving Johnston County He stated the Capital Area Workforce Development Board is accepting proposals for funding from entities that wish to offerPage149 February 1 , 2016 – 10 00 am Continued these services and JCI would like to operate the program in Johnston County Mr Sharek reported they are the only entity in Johnston County that is submitting a proposal , to the best of his knowledge Mr Sharek provided the Board with detailing upcoming events The Board briefly discussed transportation issues in the area with Mr Stephenson 4 Wake County – Update on Transit Initiatives Wake County Board of Commissioners Vice Chairman Sig Hutchinson addressed the Board and introduced Wake County Manager Jim Hartmann , Wake County Planning Director Tim Maloney , and Wake County Government Affairs and Legislative Liaison Chris Dillon Mr Hutchinson extended greetings to the Board from Wake County Chairman James West and his fellow Commissioners Mr Hutchinson stated they would like to update the Board regarding their transit plan which he believes is really more of a conversation about economic development and job creation Mr Hutchinson continued that Wake County has been involved with transit planning for over a decade but has taken a more serious approach in the last 12 months He stated they have gathered a great deal of public input to develop the plan and have received support from the community and business leaders Mr Hutchinson noted the issue will go before the voters in November for the opportunity to pass a half cent sales tax in order to implement and support the plan Mr Hutchinson stated if passed by the voters , the plan would quadruple their bus capacity helping to take congestion off the highways and hopefully making it easier for citizens in Johnston County to get to Wake County’s urban centers He noted there is also a rail component to the plan consisting of 37 miles of rail with the first phase going from Garner to Durham Mr Hutchinson stated it is their hope to engage Johnston County in a conversation about extending the rail opportunity to Clayton , Smithfield , Selma , and beyond which they feel would have huge benefits for both counties Wake County Planning Director Tim Maloney addressed the Board and reiterated Mr Hutchinson’s previous comment that over the last 12 months they have engaged and educated the public more in the development of the transit proposals and after discussions with the Fire Department concerning their ability to better afford the 20 year period proposal , he recommends the financing with KS Bank at 275 over a 20 year period explained that the Board of Commissioners received an appeal request from Mr Derek Ball regarding a stop work order and subsequent hearing that was held with regards to a barn being constructed without the proper permits The structure in question is located at 250 Wills Run , Garner in Johnston County Ms Slusser stated pursuant to North Carolina General Statute 153A - 370 , an owner who has received a stop work order from the inspector may appeal that order to the Board of Commissioners by giving written notice of the appeal to the Clerk which was done Ms Slusser continued that once the written appeal request is submitted , the Board of Commissioners is then required to hear the appeal within a reasonable time and must affirm , modify and affirm , or revoke the order Ms Slusser advised the Board to hear the appeal as a quasi - judicial proceeding in which the witnesses provide their testimony under oath Chairman Tony Braswell opened the hearing and those that wished to speak were sworn in by the Clerk to the Board Johnston County Building Inspector Shane Hudson addressed the Board and stated an inspector from the Johnston County Inspections Department visited the site in question on March 17 , 2014 due to a complaint received from a neighboring property owner that Mr Ball was constructing a barn without a permit Mr Hudson stated upon visiting the site , the inspector posted a stop work order on the property and a notification letter was sent to Mr Ball which came back as undeliverable on April 21 , 2014 Mr Hudson stated the Inspections Department then had the Sheriff’s Office deliver a letter to Mr Ball on April 22 , 2014 advising him of the situation and the need to get a permit Mr Hudson reported since that time , numerous letters have been sent to Mr Ball regarding the situation and Mr Ball has yet to obtain the building permit At the inquiry of Chairman Tony Braswell , Mr Hudson stated the subsequent letters mailed to Mr Ball were sent on October Inspections Mr Hudson reported the Inspections Department goes by the North Carolina Residential Building Code due to the size of the barn and he estimates it to be approximately 30 ’ x 40 ’ Commissioner Jeffrey P Carver stated from the photos it appears there is a storage shed inside the barn and he asked when the photos were taken Mr Hudson stated the photos were taken in 2014 , but Inspections has made several site visits since that time and the condition has not changed In response to Commissioner Mims , Mr Hudson stated if the structure is a true farm building on a bonafide farm with a farm number then Mr Ball would be exempt from having a permit but he would still have to meet the setback requirements from the County Derek Ball , 250 Wills Run , Garner , addressed the Board Mr Ball stated the structure was just a barn that he tried to turn into a garage himself on the weekends and after work during the week Mr Ball provided the Board with a description of the barn when he purchased the property noting it was basically a pole style barn with a roof Mr Ball reported he tore off the old roof and replaced it as well as started constructing walls in between the existing posts Mr Ball stated his intentions were to store an old truck that he would like to restore as well as some equipment and his tractor in the barn Mr Ball reported he also had concrete poured for the barn Mr Ball stated he does believe there is an issue with the setback requirements stating he was told the setbacks must be at least 10 feet and to his knowledge they are only 5 feet Mr Ball stated he understands there is a problem ; however , he was just trying to repair a structure that was already there when he purchased the property Mr Ball stated he was also told that an engineer would have to sign off on the construction and he has been in talks with an engineer to get that done Mr Ball stated he is prepared to do whatever he needs to Commissioner Carver stated in looking at the pictures , there appears to be a small shed inside the barn structure and asked if it was there when Mr Ball purchased the property as well as the concrete pad Mr Ball stated the shed was already on the site but he added the concrete pad Mr Ball stated the concrete pad was poured around the original shed Mr Ball stated the posts and a roof were also already on the site as well Commissioner Mims asked Mr Ball if he added onto the structure during his renovations Mr Ball confirmed that he did add a small amount to the front of the structure but that area was not within the area that possibly has setback issues Commissioner Mims stated it sounds to him like the barn is a nonconforming use because of the setback issue and to his knowledge , a nonconforming use may be repaired , but it cannot be enlarged Commissioner Mims asked Mr Ball if the property was a bonafide farm Mr Ball reported he does have horses on the property and another horse barn but he does not have a farm number Mr Ball informed the Board that he has a neighbor that also has a building too close to the property line and he questioned why that neighbor has not received a citation Chairman Braswell stated for the purposes of this hearing , the Board cannot consider what the neighboring properties are doing and must focus on the complaint at hand Commissioner Chad M Stewart asked what Mr Ball could do with the structure or if it had to be torn down because of the setback issue Commissioner Mims stated as he understands , the barn would be grandfathered as a nonconforming use and Mr Ball can make repairs to the structure but he cannot expand it in any way Mr Ball stated he did not expand the structure towards the setback area Page957 February 1 , 2016 – 10 00 am Continued Commissioner Mims clarified that a nonconforming structure cannot be expanded at all Commissioner Mims noted that if Mr Ball has horses and meets the requirements under General Statutes for horse farming , then he could perhaps look into becoming a bonafide farm and getting a farm number At the request of Chairman Braswell , Director of Inspections Dean Barbour stated if Mr Ball had a farm number then there would be no issue Mr Barbour reported the barn has the appearance of a residential garage and because the Inspections Department received a complaint they must investigate it and enforce remedies Mr Barbour stated he is unsure if the building has been enlarged or not and would have to see evidence to verify that information Mr Barbour stated as far as if the barn would meet the residential code in its current condition , they cannot be sure because a permit has not been obtained Mr Barbour stated the setback issue also needs to be addressed through the Planning Department noting Mr Ball could apply for a
