Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Tony Braswell , Vice Chairman DeVan Barbour , Cookie Pope , Allen L Mims , Jr , Jeffrey P Carver , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Tony Braswell called the meeting to order at 10 00 am Moment of Silence In Memory of Former Johnston County Commissioner Thomas M Moore Chairman Tony Braswell asked everyone to observe a moment of silence in memory of former Johnston County Commissioner Thomas M Moore who passed away on December 31 , 2015 Chairman Braswell stated Commissioner Moore was a County Commissioner from 1996 until 2004 and spoke on his military service as well as his tireless work and dedication to Johnston County throughout his life Following the moment of silence , Commissioner Cookie Pope opened the meeting with a prayer The Johnston County Veterans Services Advisory Board led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Commissioner Cookie Pope asked to remove Item D – Memorandum of Understanding between the Public Library of Johnston County and Smithfield , the County of Johnston , and the Town of Smithfield , stating she would like more information Commissioner DeVan Barbour moved the Board approve the consent agenda items removing Item D for separate discussion Commissioner Cookie Pope seconded the motion to approve the consent agenda items as follows , and the vote carried unanimously Chairman Tony Braswell moved Item D to the regular agenda as Item 8A A Approval of Minutes – December 7 , 2015 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Booker , 309 N Second Street , Smithfield , stated she would like to comment on the proposed Public Safety Center that was discussed at the December Board of Commissioners meeting with Moseley Architects Ms Booker stated she understands , as a local attorney , the needs of the jail and the courthouse ; however , she is concerned about a proposed remote location being considered to address those needs Ms Booker stated she is concerned about moving essential government offices out of the County seat of Smithfield and the impact that would have on local businesses Ms Booker stated this issue is on the radar of a lot of citizens in Smithfield and she is meeting with a group on Thursday at the Bistro in Smithfield to discuss such matters Ms Booker stated she would like to know that alternatives are being considered within the Town of Smithfield Ms Booker commended the Board for trying to address the needs of the jail and the courthouse but she does hope they will consider alternatives to keep such offices in the Town of Smithfield Chairman Tony Braswell thanked Ms Booker for her comments and stated the proposals currently being discussed are just that ; they are proposals He noted the Commissioners will be dedicating more time to the discussion at the Board’s March 4 , 2016 Work Session Chairman Braswell stated one of the Board’s charges is to look to the future and he assured everyone that right now the Board is discussing all the possibilities Commissioner Cookie Pope noted the March 4 , 2016 Work Session will be open to the public and anyone can attend to hear the discussion Page010 January 4 , 2016 – 10 00 am Continued Commissioner Ted G Godwin also thanked Ms Booker for her comments , stating he is in favor of looking at all options and alternative proposals B Citizen Inquiry – Public Transportation Wendy Ella May , 1577 Davis Homestead Road , Selma , asked the Board where the County stands regarding public transportation Ms May stated as the County begins to look at expanding and possibly moving services out of the downtown area , it is very important to consider public transportation needs for those that do not have their own cars to get to essential government services Ms May reported when Harnett County moved their Justice Center out of downtown Lillington , it became a real problem for people to get to needed services County Manager Rick Hester stated in response to some of the same concerns the Board received last year from citizens , the Commissioners allocated an additional 25,000 for Fiscal Year 2015 - 2016 to JCATS for general transportation to try and address some of the concerns Mr Hester stated he would have to consult with JCATS Director Neal Davis for an update as to how that is progressing Ms May asked if the County Manager could check with the Department of Transportation as to a study they were conducting relating to public transportation and a possible bus service for Johnston County Ms May spoke on the importance of making sure the citizens on the outskirts of the County can get to Smithfield for government services Ms May stated she would also like to take the opportunity to thank the Fire Departments and the EMS Agencies in the County noting their response times are excellent considering the heavy burdens placed upon them and they need to be recognized Ms May stated Johnston County needs to be thankful for our great Fire Departments and EMS Agencies Ms May also thanked the Sheriff’s Department for their service and asked everyone to keep them in their thoughts Ms May concluded her comments by thanking the Board of Commissioners for their support to the poor and middle class citizens in the County noting she saw many of the Commissioners during the holiday season bringing joy and happiness to others by helping to raise funds for the Salvation Army and other organizations Ms May stated it is nice to know that our public officials care The Board thanked Ms May for her comments Commissioner Ted G Godwin stated with regards to transportation , the JCATS Advisory Board has an ongoing task of addressing the transportation needs Commissioner Godwin stated the Board allocated the additional funds this fiscal year for general transportation in the hopes that the municipalities would follow in an effort to pool funds to address more of the transportation needs Commissioner Godwin reported that as it currently stands , the County’s density is just not there to have a county - wide bus service without a large tax increase Commissioner Godwin noted JCATS continues to look at ways to offset the needs through doubling up ridership and technology to provide more transportation C Johnston County Cooperative Extension – Grant Opportunity Johnston County Cooperative Extension Director Bryant Spivey reported the North Carolina Cooperative Extension Agency is offering the North Carolina Ag Ventures Grant Program and his staff will be working to assist local farmers with submitting applications Mr Spivey stated the program is an opportunity for individual farmers to receive up to 12,000 to supplement things they are doing on their farms primarily with looking at more diverse and newer agricultural opportunities Mr Spivey stated one of the grants being worked on as a joint effort is a collaboration between Johnston County Cooperative Extension and the Johnston County Cattlemen’s Association Mr Spivey introduced Livestock Extension Agent Dan Wells to provide more information on that opportunity as Mr Wells is taking the lead on the application submittal Mr Wells explained Johnston County Cooperative Extension has been working with the Johnston County Cattlemen’s Association on this joint grant opportunity to hopefully receive funds sufficient to purchase a portable corral , portable chute , and portable scales that could be transported to any pasture in Johnston County for use by cattle farmers Mr Wells stated there are 319 farms in Johnston County that have beef cattle and of those , 296 have less than 50 head of cattle making it cost prohibitive for those smaller operations to purchase this expensive type equipment Mr Wells reported he has been able to obtain 17 letters of support from local Johnston County farmers for this opportunity Mr Wells spoke on the benefits of having this type of portable equipment that smaller operations can rent at a nominal fee to cover the cost of maintenance and upkeep of the equipment Mr Wells also spoke on the benefits the equipment can provide to Johnston County Animal ControlPage111 January 4 , 2016 – 10 00 am Continued and Johnston County Emergency Management due to the amount of livestock being transported across the County Mr Spivey stated they are not asking for any kind of financial support at this time for the grant in that his staff will be providing some of the in - kind services and the Cattlemen’s Association has agreed to provide any other financial support that might be needed Mr Spivey stated he just wanted to make the Board aware of the opportunity and will update them as it progresses Mr Spivey also took the opportunity to announce that at the recent North Carolina Cooperative Extension Conference , Mr Wells received the Lois G Britt Outstanding Extension Agent Award Mr Spivey spoke on the value that Mr Wells brings to the Cooperative Extension Office stating Johnston County is very fortunate to have him here Mr Spivey spoke on the leadership of Mr Wells , stating the Livestock Judging Team , the Youth Livestock Show , and his work with the local livestock producers is outstanding Mr Spivey also spoke on the significance of the Lois G Britt Award and congratulated Mr Wells for receiving this honor The Board congratulated Mr Wells for receiving the Award Chairman Tony Braswell stated Johnston County is fortunate to have Mr Wells , the leadership of Mr Spivey , and the entire staff of the Johnston County Cooperative Extension Office At the inquiry of Commissioner Cookie Pope , Mr Spivey stated Johnston County is presently very much behind on the soybean harvest because of the extremely wet weather conditions as well as the humidity in the air Mr Spivey stated the wet weather prohibits the farmers from being able to harvest the crop and the humidity in the air causes the soybean to begin to decay within the hull He noted that if the damage reaches a certain percentage , the buyers will dock the crop which reduces the income to the farmer Mr Spivey stated he is hopeful the County can have a good week weather - wise to allow five or ten good picking days to harvest the crop soon He stated if not , there will be some major losses , some of which can be covered by crop insurance Commissioner Ted G Godwin stated the grant Mr Spivey and Mr Wells spoke about is a great idea and he asked how the Board could assist in getting those funds Mr Spivey stated the Board’s existing support goes a long way , but a letter of support would certainly help the process and be very much appreciated Commissioner Allen L Mims , Jr thanked Mr Spivey for pursuing the grant funds for the portable equipment noting that everyone does not have the money to purchase this type of equipment It was the unanimous consensus of the Board to send a letter in support of the grant opportunity 4 “ State of the County ” Address by Chairman Tony Braswell Chairman Tony Braswell presented the following “ State of the County ” address 2016 State of the County Address Johnston County , North Carolina I want to first thank my fellow Commissioners for the opportunity to serve as Chairman for another year It is a privilege and honor to serve as Chairman for this Board As you all know , this is also my last year serving on this Board and I want all of you to know that I will greatly miss serving as a County Commissioner Serving the people of Johnston County as a County Commissioner has been a wonderful experience that will always be with me I think we can all agree that this Board generally deals with the present and future As we work through the opportunities and issues in the County , we don’t tend to look back much ; however , in my opinion , 2015 was a busy year with highlights worth reflecting on In my opinion , the most significant highlight of 2015 was the announcement of the Novo Nordisk expansion in Clayton This historic announcement with an investment of approximately 18 billion and 700Page212 January 4 , 2016 – 10 00 am Continued new jobs at an average annual wage of 68,000 will be the largest bio - pharmaceutical project in the world to date I would like to commend all our partners in Economic Development for working together to make this opportunity a reality in Johnston County The benefits of this project will be felt in Johnston County for many years to come In another major economic development opportunity , the Board of Commissioners publicly supported the Atlantic Coast Pipeline project that is scheduled to cross our County in 5 years The Boards support of the project was with the understanding that Johnston County citizens would be treated fairly and with respect during the land negotiations for the pipeline route and we will continue to voice that request In 2015 , the Board held separate joint meetings with the Johnston County Board of Education and the Johnston Community College Board of Trustees regarding their capital needs planning As always , we are very supportive of Johnston County Schools and Johnston Community College and we look forward to working together to meet some of their challenges in 2016 Johnston County completed the disbursement of the recreation and open space funds to municipal and rural athletic associations to assist with their capital needs I would like to see Johnston County consider placing the second - ever recreation bond referendum on the ballot by 2020 or earlier , as we recognize that recreational opportunities are very important for our citizens In terms of public safety , the County partnered with Johnston Health to start a new community paramedic program which is a proactive step in health care delivery The Board also approved the construction of the new Princeton EMS building and our 911 Communications Center began accepting text messages for emergencies in 2015 Early in 2015 , several County officials met with our judicial and law enforcement partners to begin the process of a space needs study That study was recently completed and presented to the Board and I have asked that this report be further discussed at our annual work session to be held on March 4 , 2016 In closing , 2015 was a great year Johnston County is financially sound and living within its means We stress two numbers in our financial planning 78 cents tax rate and a minimum 15 fund balance That is the template for everything we do financially For 2016 , I would ask that we continue to focus on economic development , our bond ratings , support for our local education partners , and public safety If we can do that , everything else will fall into place and Johnston County Regional Airport Johnston Regional Airport Director Ray Blackmon thanked the Board for the opportunity to spotlight the Johnston Regional Airport Mr Blackmon introduced Airport Authority Vice Chairman Ken Starling in the audience and also recognized Chairman Ray Hales , Secretary Tim Stevens and Members Dwight Lowry and John Bullock for their service on the Authority Mr Blackmon reviewed the Blackmon stated they are at capacity at the present time for hangar space and need to build more Mr Blackmon stated building hangars is expensive ; however , they have identified a 17 acre area they would like to develop for hangars at some point in the future Mr Blackmon stated they estimate it will cost approximately 4 million to prepare the 17 acres for hangar construction which includes land clearing , site work , drainage , and paving Mr Blackmon clarified that 4 million would only prepare the land and does not include actual hangar construction He stated another 100 to 120 aircraft could be placed in the new area if constructed Mr Blackmon noted there is definitely a demand for hangar space At the inquiry of Commissioner Allen L Mims , Jr , Mr Blackmon reported the largest aircraft that could be accommodated at the Johnston Regional Airport is a Gulfstream category aircraft Mr Blackmon stated they hope in the future to expand the runway to 6,000 feet 6 Presentation of Audit Report for Year Ending June 30 , 2015 Alan Thompson , with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2015 Mr Thompson stated his firm issued unmodified reports or “ clean reports ” not only on the financial statements but also on the compliance portions Mr Thompson stated there were no significant audit findings He continued that no difficulties were encountered while performing the audit , there were no disagreements with management , management did provide a representation letter , and management did not consult with any outside auditors Mr Thompson complimented the County on the excellent tax collection rate as well as the fund balance percentage Mr Thompson also commended the Johnston County citizens for Financing for P - 25 Repeater System Equipment Purchase Chairman Tony Braswell accepted a request from Commissioner Jeffrey P Carver to abstain from discussion and voting on the item , and the Board agreed by consent County Manager Rick Hester recalled that at the December 7 , 2015 meeting , the Board approved the purchase of the P - 25 Repeater System Equipment needed for the P - 25 Conversion Project with financing proposals to come back to the Board at a later date Mr Hester stated staff had a financing proposal in December ; however , decided to send the financing out to the local banks for them to submit proposals Mr Hester stated two banks submitted proposals for the financing and after review , staff requests the Board to approve the financing of this equipment with First Citizens Bank in the amount of 1,285,65300 at an interest rate of 148 for a term of three years Commissioner Chad M Stewart moved the Board approve the financing of the P - 25 Repeater System Equipment with Jeffrey P Carver abstaining 8A Memorandum of Understanding County Manager Rick Hester explained that the Public Library’s funding is shared between the County and the Town of Smithfield on a 60 40 percentage basis with some State funds helping to support the operations Mr Hester reported over time there have been situations involving major repairs and there has never been a formal document in place that covered how to address such repairs Mr Hester stated the Memorandum of Understanding states that once a major repair is identified and agreed upon by all parties , the Library would be responsible for the first 4,000 of that repair where after the County and the Town would pay the remaining cost on the 60 40 percentage split He stated in the case of an emergency , the repair would be made immediately and the cost covered in the same manner after the repair has been made Mr Hester also noted the Memorandum of Understanding stipulates that the Library must maintain insurance and if the Library Board of Trustees decided on voluntary upgrades , then the Library would pay for those upgrades at 100 Mr Hester stated the Library Board of Trustees and the Smithfield Town Council Johnston County and Smithfield , County of Johnston and Town of Smithfield This Memorandum of Understanding is hereby made between the Public Library of Johnston County and Smithfield hereinafter referred to as “ Public Library ” , County of Johnston hereinafter referred to as “ County ” and Town of Smithfield hereinafter referred to as “ Town ” and collectively referred to together as the “ Parties ” WHEREAS , the collaboration between the Parties allows the Public Library to provide necessary library programs and services to citizens of County and Town ; WHEREAS , the collaboration between the Parties includes sharing financial responsibility for the costs of non - budgeted necessary facility maintenance and repair projects for that certain portion of property occupied by the Public Library located at 305 and 309 E Market Street , Smithfield , North Carolina “ the Property ” ; WHEREAS , the Parties desire to memorialize their understanding and agreement regarding the payment of the costs of necessary facility maintenance and repair projects for the Property ; NOW , THEREFORE , the Parties agree as follows 1 The Public Library agrees to pay for each individual maintenance and repair project for the Property in an amount not to exceed 4,00000 The Johnston County Building and Grounds Manager will take the lead role in coordinating repair projects 2 If a proposed maintenance and repair project exceeds 4,00000 , the Public Library will present the proposed maintenance and repair project to County and Town , and the Parties will evaluate the project for need Once the project is evaluated for need and all Parties agree that the project is necessary and should be completed , the costs of the maintenance and repair project shall be divided as follows The Public Library shall pay the first 4,00000 of the costs of the maintenance and repair project ; The County and Town shall divide the remaining costs of the maintenance and repair project over and above 4,00000 with the County paying 60 of the costs of the maintenance and repair project over and above 4,00000 and the Town paying 40 of the costs of the maintenance and repair project over and above 4,00000 3 In the event of an emergency repair that is necessary to protect the life , safety , and health of patrons , citizens , and employees , the County agrees to immediately coordinate with event the Public Library elects to do a voluntary facility upgrade project for the Property , the Public Library shall pay 100 of the facility upgrade 5 The Public Library shall continuously maintain comprehensive commercial insurance covering the replacement cost of the Property for loss or damage The Parties understand that certain property damage losses may be eligible for coverage under the
