Commissioner Ted G Godwin opened the meeting with a prayer American Legion Post 71 Clayton led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Allen L Mims , Jr seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – October 5 , 2015 Veterans Day Proclamation adopted as follows PROCLAMATION VETERANS DAY - 2015 WHEREAS , for decades America has paused on the 11th of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their Awareness and Caregivers Month WHEREAS , Alzheimer’s disease is a progressive degenerative disease of the brain causing deterioration in memory and thinking , as well as judgment and reasoning ability ; it also affects behavior , emotions and the ability to perform self - care ; and WHEREAS , more than five million Americans are now living with Alzheimer’s disease and over fifteen million are serving as their caregivers ; and WHEREAS , more than half of all Americans know someone who has or had Alzheimer’s ; and WHEREAS , Alzheimer’s disease affects whole families since it is a long term illness that requires long term care ; and WHEREAS , with early detection and diagnosis , individuals and families can gain access to treatment medications , enroll in critical research trails , and Commissioners for their support to the American Cancer Society and Relay for Life B Industry Appreciation Award – NC Sweet Potato Commission , Benson , North Carolina The Board of Commissioners and the Johnston County Economic Development Advisory Board recognized the North Carolina Sweet Potato Commission of Benson as part of the Industry Appreciation Award Program which recognizes an existing Johnston County industry every quarter Economic Development Director Chris Johnson along with Cooperative Extension Director Bryant Spivey presented the award to Executive Director Kelly McIver Both Mr Johnson and Mr Spivey spoke on the importance of recognizing agriculture in the County and provided information on how agriculture contributes to the economy Mr Johnson reported the sweet potato industry is a 35 million industry in Johnston County annually Mr Johnson also noted that Johnston County has more working farms than any other county in the State of North Carolina Ms McIver accepted the award and stated on behalf of the North Carolina Sweet Potato Growers they sincerely appreciate the recognition and support from the County The Board expressed their appreciation to Ms McIver and the North Carolina Sweet Potato Commission C “ Pride of the Wolfpack Award ” – Katie Moore with Cooperative Extension Cooperative Extension Director Bryant Spivey presented the “ Pride of the Wolfpack ” award to Katie Moore with the Johnston County Cooperative Extension Office Mr Spivey reported Ms Moore is the only employee in the Johnston County Cooperative Extension Office to receive the award to date and he is extremely proud of her Mr Spivey praised Ms Moore for her excellent work , commitment , and dedication to the Cooperative Extension Office stating she is the key to making things of Governments To all , be it known that Joan Pellettier , Area Agency on Aging Director for Triangle J Council of Governments TJCOG , has announced her plan to retire , effective November 30 , 2015 Joan has a combined 22 years of service with TJCOG , having served as the Aging Program Administrator from 1980 until 1990 , before rejoining the organization as AAA Director in 2003 Joan currently leads a team of twelve staff members and administers a budget of nearly 9 million For more than 35 years , Joan has served the region as an advocate for older adults , persons with disabilities , and family caregivers In addition to her 22 years with TJCOG , she previously worked with the Durham County Meals on Wheels program and is the former Executive Director of the Council for Senior Citizens , where she was instrumental in leading the planning and development effort for Durham’s first dedicated senior center , the Durham Center for Senior Life Joan is completing her second term as Chairperson of NC4A , the North Carolina Association for Area Agency on Aging Directors , and has served on the North Carolina Consumer Advisory Council on Health Information NC CACHI of the NC Healthcare Information & Communications Alliance , Inc , as well as the North Carolina Coalition on Aging She was also instrumental in the development of three Aging and Disability Resource Centers in NC , known locally as Community Resource Connections CRCs , serving Wake , Durham , Orange and Chatham counties CRCs bring together stakeholders in the communities in order to facilitate consumer access to long term care services and supports , streamlining access through implementation of a seamless , “ no wrong door ” approach In 2010 , North Carolina’s Speaker of the House appointed Joan to serve on the North Carolina Study Commission on Aging , for a two - year term In 2013 , Durham’s AARP chapter recognized Joan for her ongoing commitment to the region’s older adults In 1999 she was presented the first - ever Margaret K Goodwin Service Award , established by Senior PharmAssist in Durham to honor those who provide exemplary service in helping senior adults live healthier lives Under Joan’s leadership at TJCOG , the Area Agency on Aging has continued to move forward the well - being of the Triangle region’s older adults , through ongoing work with county governments and community - based groups to plan and implement supportive services for older adults and family caregivers She has been instrumental in seeking innovative approaches to improve the quality of life for residents of long - term care facilities , such as promoting programs to provide personalized music to residents with dementia and educational efforts aimed at reducing the use of anti - psychotic medications Johnston County has been the beneficiary of Joan’s dedicated service in a number of ways Through the Ombudsman program of the Division of Aging and Adult Services , Joan has been unwavering in her support of Community Advisory Committees Community Advisory Committee members are volunteer advocates in each county who are appointed by the county commissioners to serve on the nursing and adult care home community advisory committees in each county The primary purposes of the advisory committees are to maintain the intent of the Nursing Home and Adult Care Home Resident Bill of Rights within nursing homes here in Johnston County and to promote community involvement and cooperation with such homes to ensure quality of care for older adults Further , the Johnston County Community Advisory Committee is responsible for advising the county commissioners of the general conditions existing in the long term care facilities within Johnston County The committee fulfills this obligation through formal and informal visits to the facilities In addition , quarterly and annual reports are submitted to the county commissioners and the Regional Ombudsman Joan Pellettier is a longstanding advocate for this important work Joan has been a strong promoter of collaboration as evidenced through her leadership of the Triangle - J Area on Aging Advisory Committee which meets bi - monthly to discuss matters of importance in our region Joan ensures that the Area Agency on Aging maintains and works from a carefully developed Aging Plan that is consistent with North Carolina’s statewide Aging Plan To that end , Joan works tirelessly to ensure that each county also manages a local aging plan PagePage pageNumber6816 November 2 , 2015 – 10 00 am Continued The recent commitment of the Johnston County Board of Commissioners to appoint a committee to develop an Aging Plan for our county underscores the importance of advocacy for our senior citizens We can thank Joan Pellettier for keeping issues like this in the forefront of our efforts here in Johnston County Last but certainly not least , Joan oversees the Home and Community Care Block Grant which is the primary funding source that enables Community and Senior Services of Johnston County to provide a host of services to our senior citizens These include In - Home Aides , Caregiver Support , Home - Delivered and Congregate Meals , Senior Activity Centers , Elderly Housing , Transportation , Information and Referral , Options Counseling , and more One of the primary tenants of this effort is advocacy for the elderly And so , on behalf of our elderly population throughout Johnston County we the undersigned hereby express our heartfelt appreciation to Joan Pellettier We take comfort in knowing that her efforts for over three decades will have a permanent and positive impact on the programs that we are charged with fulfilling Sincerely , Tony Braswell , Chairman Johnston County Board Services of Johnston County , Inc Johnston County Community Advisory Committee Alternate Delegate , Senior Tarheel Legislature E Citizen Concern – Animal Control Ordinance and Animal Care Angela Bryan , 2305 Oak Forest Road , Four Oaks , North Carolina addressed the Board regarding her concerns for animal welfare in Johnston County as well as language in the Johnston County Code of Ordinances as it relates to the care of animals Ms Bryan noted that she attended the Board’s meeting in May requesting changes to the code of ordinances as it relates to “ shade ” for animals and she asked why nothing had been done to amend the ordinance Ms Bryan expressed her frustrations that the process of amending an ordinance takes too long and she requested the Board to bring change to Johnston County for the care of animals Ms Bryan stated there is a lot that needs to be changed in the ordinance to help the animals in the County and she asked for the Board’s help Ms Bryan passed around pictures that she said she took to document conditions in which some of the animals in the County are living in and spoke on some of the situations she has witnessed Note Pictures were not left for the record Ms Bryan noted she has met with the County Attorney and Director of Animal Services ; however , nothing has been done to address her concerns Ms Bryan expressed her concerns that the language in the ordinance is not strong enough to allow the Animal Services Department to enforce proper animal care Chairman Tony Braswell asked for the County Attorney to comment County Attorney Jennifer Slusser confirmed that she has met with Ms Bryan regarding her concerns Ms Slusser stated in looking at Ms Bryan’s concerns , there are two things that must be considered 1 whether it is actually necessary to put that specificity in the ordinance from a legal perspective ; and 2 amending an ordinance is not as simple as changing a sentence or two and anytime an amendment is being considered , the entire ordinance must be reviewed to make sure the proposed changes are consistent throughout from an enforceability perspective Ms Slusser noted that she and Mr Wilkinson recently discussed the ordinance as it relates to shade ; however , Ms Bryan has stated today that other things need to be changed in the ordinance and it would be helpful to staff to have a itemized list of those changes requested by Ms Bryan Ms Slusser stated staff could review the changes submitted by Ms Bryan and then make the appropriate recommendations to the Board Ms Bryan again expressed her concerns and frustrations that it takes too long to amend an ordinance and stated she feels the issue has been pushed under the rug Ms Slusser reported that after speaking with some other counties at a recent animal control conference she learned that it does take time to get an ordinance amended to satisfy all parties She noted one countyPagePage pageNumber7817 November 2 , 2015 – 10 00 am Continued reported it had taken them three years to amend their ordinance because of the varying opinions that were received Chairman Braswell thanked Ms Bryan for her remarks and concerns and stated there has not been any intention to sweep the issue under the rug Chairman Braswell noted the Commissioners all care about animals with many of them being pet owners themselves Chairman Braswell asked Ms Bryan to provide the County Manager with a detailed list of the changes that she would like to see made in the ordinance and for the County Manager to review those suggested changes with the County Attorney who in turn would then discuss them with the Board of Commissioners Chairman Braswell reiterated the Board is concerned about the care of animals and is willing to look at the issue ; however , there is a process that must be followed to amend an ordinance F Citizens Concerns – Atlantic Coast Pipeline Project Francine Stephenson , 2012 Raccoon Run , Clayton , addressed the Board regarding her concerns over the Atlantic Coast Pipeline project that is proposed to cross Johnston County At the request of Ms Stephenson , approximately 30 people in the audience raised their hands indicating their concerns and or opposition to the pipeline project Ms Stephenson asked others in the audience to speak first with their concerns Teresa Rhodes , 2009 Devil’s Racetrack Road , Four Oaks , read the following statement Johnson spoke on the need for the pipeline plans to be made available to the individual landowners noting he has not seen anything to date Mr Johnson also spoke on the lack of communication from the pipeline representatives Mr Johnson stated he would like to have a contact person that he could call and get his questions answered Mr Johnson stated he would appreciate anything the Board of Commissioners can do to make sure the landowners are treated fair Mr Johnson also asked how the pipeline would cross the river and what type of construction method would be used since it could impact any Commissioners that had any questions of those that spoke Commissioner Chad M Stewart commented on the large number of people in attendance with concerns over the Atlantic Coast Pipeline project Commissioner Stewart stated he also has property that will be impacted and from what he has learned , this is a Federal project in which the County has very little control Commissioner Stewart noted Commissioner Stewart stated a lot of information has come to light and while he knows that the land being considered for the route is what the pipeline company considers the least valuable , he questioned if existing right - of - ways could possibly be utilized Commissioner Stewart stated there are a lot of concerns and questions and with being a public official , he understands the asset of natural gas to eastern North Carolina ; however , he would like to be assured of the benefits to Johnston County Commissioner Stewart reiterated he understands the concerns of the citizens and would appreciate the pipeline representatives coming to Johnston County and possibly giving a presentation Commissioner Ted G Godwin stated he shares Commissioner Stewart’s concerns and in hearing some of the concerns by the citizens today regarding safety factors , he believes the Board should express a desire for the pipeline to be constructed in the safest manner possible Commissioner Godwin agreed that it would be good to have pipeline representatives come to Johnston County to hear the concerns Commissioner Allen L Mims , Jr stated he can sympathize with the concerned citizens as he has land that is currently being condemned by a local municipality for a sewer line Commissioner Mims stating in going through his own circumstances , he has learned that the Board of Commissioners has no authority to intervene Commissioner Mims informed Mr James Johnson that he can request any public information documents regarding the project under the Freedom of Information Act and if he is refused , he can contact the Attorney General’s Office who will assist in that process Chairman Braswell stated in the County’s letter of support for the project , the Board requested the pipeline company to work with the impacted property owners and to treat them with respect and fairness Chairman Braswell stated because of the unanswered questions and the concerns that have been raised by the citizens , he asked the County Manager to contact representatives with Atlantic Coast Pipeline and work with them to set up a meeting where impacted property owners in Johnston County could have a chance to ask their questions and receive answers to their concerns Chairman Braswell noted a lot of information has been shared today and he reiterated the Board’s desire that the property owners be treated fairly and with respect Commissioner Cookie Pope agreed with Chairman Braswell stating she has also learned new information today and she would like to hear more from the pipeline representatives Commissioner Mims suggested that if a meeting is scheduled , perhaps Ms Stephenson could compile a list of questions in advance that the property owners would like to have answered Larry Capps , Johnston County property owner , stated the pipeline will cross his property Mr Capps stated no one in Johnston County will be allowed to receive natural gas off the pipeline Mr Capps stated his property will be divided and it will greatly impact how he can develop or farm his property in the future Mr Capps stated he is not against progress , but there needs to be some benefit to the citizens Jimmy Casey , Smithfield , stated he leases a farm in Johnston County that was crossed with two pipelines some time ago Mr Casey provided the Board with details on how the farmland has been affected by the pipelines noting it greatly impacted the crop production G Citizen Concern – Commissioner E - mail Accounts Ken Taylor , 1755 Gordon Road , Clayton , reported that he recently sent an e - mail to the County Commissioners and during that process he noticed that the Commissioner e - mail accounts are not through the County’s e - mail server , but rather , the Commissioners use private e - mail accounts Mr Taylor expressed concerns that the Commissioners e - mails regarding County business are public records and if a public records request were submitted , it could be difficult for all the e - mails to be produced for the record Mr Taylor questioned why the Commissioners do not use the County’s e - mail server and how e - mails are preserved once Commissioners leave the Board County Attorney Jennifer Slusser advised that an e - mail’s location does not change its status as a public record and each Commissioner is responsible for making sure any County business related e - mails are maintained as a public record in accordance with the Records Retention Policy adopted by the County Ms Slusser stated if the County were to receive a public records request for Commissioner e - mails , staff would ask the Commissioners to provide that documentation for the request Ms Slusser noted that in most cases , many of the Commissioners ’ e - mails involve everything is considered a public record The Board thanked Ms Hickey and the Human Resources Department for their work 5 JCATS – Request for County Match for Community Transportation Grant Funds Neal Davis , Executive Director for Community & Senior Services JCATS presented a request to the Board to approve a match in the amount of 82,560 for the North Carolina Department of Transportation Community Transportation Program grant for Fiscal Year 2016 - 2017 The total grant from the DOT is 650,659 and is the major administrative and capital grant with which JCATS operates The grant consists of the following 1 Current services provided by JCATS 2 Federal State Certifications and Assurances that the system is meeting all regulatory requirements 3 349,859 Administrative expense request - 207,298 JCATS administrative staff - 142,561 other administrative expenses ie utilities , vehicle insurance , computer support , etc - Local match of 52,480 15 included in above 4 300,800 Capital budget request - 292,500 - 5 replacement vehicles - 8,300 for other capital expenses ie vehicle lettering , software , anti - virus licenses , etc - Local match of 30,080 10 included in above Mr Davis recalled that last year , the Board heard from some physically impaired citizens that needed transportation Mr Davis noted that not only did the Board allocate additional administrative funding last yearPage5825 November 2 , 2015 – 10 00 am Continued which allowed JCATS to make up for a shortfall in grant funds , the Board also provided an additional 20,000 towards the funding of a pilot program to help address the transportation needs of the citizens that came to the Board with their concerns Mr Davis expressed his appreciation to the Board for their commitment to the transportation needs in the County as well as for the Board’s support in developing an Aging Plan for Johnston County Mr Davis stated the Board’s commitment has not gone unnoticed at the State and because of that commitment JCATS has finally received a pledge from the State to get a feasibility study which is required in order to receive funding towards building a larger administrative maintenance facility Mr Davis stated JCATS has been trying for three years to get the feasibility study and he is pleased it is becoming a reality Mr Davis stated this only happened because of the commitment and support from the Board of Commissioners Mr Davis asked for the Board to approve the match in the amount of 82,560 for the Fiscal Year 2016 - 2017 Community Transportation Grant He noted that the grant allocation is again less than the amount needed to cover allowable administrative expenses ; therefore , JCATS is requesting the Board to consider discussing an additional allocation of 46,191 during their FY 2016 - 2017 budget deliberations Mr Davis explained the completed grant application will be presented to the Community & Senior Services governing board for approval on November Exercise Grant Assistant Emergency Services Director Paul Whitehurst explained that Johnston County Emergency Services has been awarded a grant in the amount of 19,000 through North Carolina Emergency Management to conduct a multi - jurisdictional severe weather response recovery full - scale exercise Mr Whitehurst stated the objectives of the exercise will include the evaluation of multi - jurisdictional coordination and the activation of Emergency Operations Centers , identification of interoperability challenges with multiagency response during inclement weather , mass patient plan evaluation and the implementation of such policies with fire services , as well as the activation of mass notification systems The direction of the field operations will be focused on response ; whereas , the multiple EOCs will place more emphasis on short - term recovery efforts and planning for long - term recovery Mr Whitehurst reported participants will include local Fire Departments , Emergency Medical Services , Law Enforcement , local Hospitals , Emergency Management , State and Federal Agencies , and Towns He stated the exercise is tentatively scheduled for the spring of 2016 and will be in compliance with the Homeland Security Exercise Evaluation Program Mr Whitehurst requested the Board to formally approve and accept the grant in the amount of 19,000 for the exercise He stated this is a 100 grant with no County match required ; however , the County will have to pay upfront and be reimbursed by the State Commissioner DeVan Barbour moved the Board approve and accept approve for staff to move forward with the Emergency Management Accreditation Program EMAP process Mr Whitehurst explained the EMAP process is a voluntary accreditation which is based on national standards that protects communities and the accreditation is used to prove the capabilities of disaster preparedness and response systems Mr Whitehurst stated this will also strengthen the County’s
