Woodall Chairman Jeffrey P Carver stated Johnston County lost former County Commissioner W Ray Woodall on November 8 , 2014 Chairman Carver spoke on Commissioner Woodall’s many accomplishments noting that he was a Veteran and it is fitting that Commissioner Woodall was buried on Veteran’s Day All present observed a Moment of Silence in remembrance of Commissioner Woodall Commissioner Cookie Pope opened the meeting with a prayer Commissioner Allen L Mims , Jr led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Commissioner Jeffrey P Carver stated he went back and looked at the minutes from when he was first elected Chairman in 2012 and reflected on his remarks at that time Commissioner Carver stated at that meeting he said that he would make mistakes but would ask for and listen to his fellow Commissioners ’ feedback , strive to achieve what is best for the citizens , keep his eyes on the horizon , preserve and protect the assets of the County , and work hard to make Johnston County an even greater place to live , work , and raise a family Commissioner Carver stated those goals have not changed and he hopes that he was true to those goals and objectives Commissioner Carver congratulated Chairman Tony Braswell on becoming Chairman and stated he knows that Chairman Braswell will do a great job Commissioner Ted G Godwin stated he has been impressed with Commissioner Carver’s commitment to the citizens of the County Commissioner Allen L Mims , Jr stated Commissioner Carver did an excellent job as Chairman for the County noting he runs an efficient meeting and was spot - on with everything Commissioner Chad M Stewart stated Commissioner Carver was the first Chairman he served under and he learned a lot from him Commissioners Cookie Pope and DeVan Barbour agreed with all the comments stating they appreciated Commissioner Carver’s service as Chairman County Manager Rick Hester stated on behalf of the staff he appreciates all the time and effort Commissioner Carver put in working with staff Vice Chairman of the Board Chairman Tony Braswell called for nominations for Vice Chairman of the Board Commissioner Cookie Pope nominated Commissioner DeVan Barbour Commissioner Allen L Mims , Jr seconded the nomination There being no further nominations , Chairman Tony Braswell closed the nominations and Commissioner DeVan Barbour was elected by acclamation to serve as Vice Chairman of the Board for a one year term Remarks by Chairman Tony Braswell Chairman Tony Braswell read the following statement I would like to thank my fellow Board Members for their confidence and support It is an honor and privilege to serve in this position for the next year The bar has been set high for this position and I think I should reflect on the previous Chairmen during my tenure on this Board Commissioner Cookie Pope served as my first Chairman for four years She spent a lot of time educating a rookie County Commissioner and trust me , that was not an easy task for her Her commitment and tireless work will forever have a lasting impression on me It is still hard to believe that my next Chairman is not with us anymore Commissioner Wade M Stewart was also a strong leader and his passion for the County will be forever remembered Commissioner Allen L Mims , Jr had a wealth of knowledge and he still amazes me with his understanding of policies and procedures Commissioner Jeffrey P Carver brought his vast amount of experience of business and people skills and his flawless approach to facing issues head - on Furthermore , we are fortunate to have Commissioners DeVan Barbour , Chad M Stewart , and Ted G Godwin With the exception of a two year stint , Commissioner Barbour has been sitting to my right and I am so happy the Board elected him as Vice Chairman I would be remiss if I did not mention my good friend and past Commissioner W Ray Woodall whom I had the pleasure of serving with for eight years In an easy transition Commissioner Godwin took that seat and has brought with that knowledge and has been a great addition Commissioner Stewart’s appointment and subsequent election was bittersweet but again , the citizens are served well with his presence We see the same passion in him which was with his Dad PagePage pageNumber6307 December 1 , 2014 – 10 00 am Continued Not only are all these past Chairmen and Board Members great Commissioners , they are great friends With these remarks I hope all understand that it is about all of us working together and not about me being Chairman Although our task ahead is clear and may be simple or may not be easy , we will continue to work diligently for the citizens of this County and they will surely know that their local government works for them Many thanks to all the County employees who work hard each day and who love and enjoy their job Thank you for making this County customer friendly Time and history will record our achievements during this period But they will not be because of a Chairman , but because of the collective works and strengths of seven Commissioners and the excellent staff that surrounds them As Commissioner Carver stated when he first became Chairman , I too will make mistakes , but I firmly believe that I am prepared for this task and will work very hard in this position Again , thank you very much for your support Commissioner DeVan Barbour stated no Board can be better than all its members He continued by stating the Commissioners all have roles and being Vice Chairman is just another role Commissioner Barbour stated he and Chairman Tony Braswell have big shoes to fill but he thinks they are up to the challenge and will do everything they can to help concerns regarding Rezoning Case 14 - 23 – Applicant McGee’s Athletic Association Johnson Memorial Church Mr Blackmon stated he is against giving County money to churches and he asked the Board to deny the rezoning request and recover the funds that were spent on the property Commissioner Allen L Mims , Jr noted the Board would be holding a public hearing on Rezoning Case 14 - 23 at the 6 00 pm meeting and he invited Mr Blackmon back to that meeting 6 Public Hearing – Revisions to Fire Service District Boundaries Advertised – The Smithfield Herald – November 19 and 26 , 2014 The Chairman opened the public hearing Assistant Fire Marshal Kevin Hubbard explained that over the last year the Board completed a comprehensive revision of the Johnston County Fire Insurance Districts and Fire Service Districts The purpose of the comprehensive revision was to maximize the five mile coverage from the closest fire station and the resultPagePage pageNumber7308 December 1 , 2014 – 10 00 am Continued has been to save property owners money through a reduction in insurance premiums and to ensure that the fire departments are being compensated for the fire protection services provided within their assigned districts He continued that over the past year , staff has identified a few parcels that would benefit by being moved into other fire insurance and service districts to maintain and maximize the five mile coverage from the closest fire stations The districts affected are 50 - 210 and West Johnston and Beulah Kenly and Boon Hill Princeton Mr Hubbard stated staff proposes to move three parcels from West Johnston to 50 - 210 and one parcel from Boon Hill to Beulah He noted the property owners support the move Mr Hubbard also reported staff proposes to move two parcels from Blackman’s Crossroads Fire Insurance District to Strickland Crossroads Fire Insurance District to align the service district and insurance district maps for those areas He stated this change was already made to the service district maps in April at the request of the property owner and this action would align the insurance maps Mr Hubbard stated the purpose of this public hearing is to hear the views of the citizens regarding the proposed changes to the 50 - 210 and West Johnston Fire Service Districts and the Beulah and Boon Hill Fire Service Districts He noted reports containing detailed information about the proposals were made available to the public on the Johnston County website , in the office of the Clerk to the Board , and in the Fire Marshal’s office Notices of the public hearing were advertised as required by the North Carolina General Statutes The reports , public hearing notice , and proposed resolutions to relocate the boundary lines of the adjoining districts are in the Board’s agenda packet Mr Hubbard stated upon conclusion of the public hearing , there are four resolutions for the Board’s consideration He explained the first resolution will facilitate the service district boundary line changes for 50 - 210 and West Johnston and Beulah Kenly and Boon Hill Princeton The second resolution will facilitate the insurance district boundary line changes for 50 - 210 and West Johnston , Beulah Kenly and Boon Hill Princeton , and Blackman’s Crossroads and Strickland Crossroads The third resolution is for technical revisions to the Claytex and Clayton Fire Service and Fire Insurance District maps to correct a technical mapping issue that involves shading parcels within the designated boundaries The boundaries lines will not change The fourth resolution is a similar request for a technical revision to the Blackman’s Crossroads and Strickland Crossroads Fire Service District maps and just like Claytex and Clayton , the boundary lines will not change He offered to answer any questions Upon a question by Commissioner Ted G Godwin , Fire Marshal Paul Whitehurst stated there will be a tax rate increase for the property owner that will move into the Beulah Fire District , but in that situation that property owner will see a significant decrease in their homeowners insurance At the inquiry of Commissioner Allen L Mims , Jr , Mr Hubbard confirmed staff has spoken with all the affected property owners who support the revisions Chairman Tony Braswell commended the Fire Marshal’s Office staff for their work on these boundary to as “ Fifty - Two Ten Fire Service District ” , Beulah and Kenly Fire Service Districts , Boon Hill and Princeton Fire Service Districts , and West Johnston Fire Service District collectively known as the “ Fire Service Districts ” have been operating as county service districts providing fire protection services since their creation by the Johnston County Board of Commissioners ; and WHEREAS , the Board has determined that the boundary lines of the Fire Service Districts should be relocated to align the fire service district boundaries with the fire insurance district boundaries and to Trucks NA , LLC Tax Administrator Sheila Garner presented to the Board a request from Daimler Trucks for a refund of property tax pursuant to North Carolina General Statute § 105 - 381 Ms Garner explained that pursuant to North Carolina General Statute § 105 - 381 , “ Action of Governing Body ” provides that “ upon receiving a taxpayer’s written statement of defense and request for a release or refund , the governing body of the taxing unit shall within 90 days after receipt of such request determine whether the taxpayer has a valid defense to the tax imposed or any part thereof and shall either release or refund that portion of the amount that is determined to be in excess of the correct liability or notify the taxpayer in writing that no release or refund will be made ” Ms Garner stated although no public hearing is required , she did notify the taxpayer that the request would be heard at today’s meeting Ms Garner reported in this case , the taxpayer has requested a refund for tax years 2009 - 2013 She stated the taxpayer claimed the assets were removed from Johnston County in 2007 and the taxpayer failed to update the asset schedules She noted denial of this application for refund will result in no reduction in monies from the County and Town of Selma ; however , approval of this request would result in a reduction of monies from the County and Town of Selma for the total of all refund years in the amount of 4,03647 Ms Garner stated she has had the opportunity to review the information submitted by the taxpayer and recommends denial of the request on the basis that the taxpayer has failed to provide sufficient evidence that the tax is an illegal tax or one which was imposed by clerical error on the part of the Tax Office Upon a question by Commissioner DeVan Barbour , Ms Garner confirmed that the tax listing form was submitted and signed off on by the taxpayer as being correct and the taxpayer paid the taxes due according to the listing form Now , the taxpayer is saying that the listing forms they signed off on were incorrect Ms Garner stated the Tax Office looks to see if the equipment was being taxed in another jurisdiction and in this case , sufficient evidence was not provided as to when the equipment was removed Upon questions by Commissioners Ted G Godwin and Cookie Pope , Ms Garner stated that the company reports they own the equipment , but it was moved Ms Garner reported the company has said the equipment was moved out of state Commissioner DeVan Barbour moved the Board accept the Tax Administrator’s recommendation and deny the request from Daimler Trucks for a refund of property tax pursuant to North Carolina General Statute § 105 - 381 Commissioner Allen L Mims , Jr seconded the motion which carried by unanimous imposed by clerical error on the part of the Tax Office Ms Garner stated although no public hearing is required , she did notify the taxpayer that the request would be heard at today’s meeting and noted Mr Gary Lynch is present for Carolina Craftsmen Commissioner DeVan Barbour asked is this instance due to the fact that certain property has been removed or it is just a difference in opinion of the valuation of the property in question Page8319 December 1 , 2014 – 10 00 am Continued Ms Garner responded the taxpayer is stating the assets were removed from his possession She stated the assets were not updated on the listing form , although the taxpayer is stating he had actually disposed of those assets At the inquiry of Commissioner Allen L Mims , Jr , Ms Garner stated with business personal property , the taxpayer lists their assets and gives a total value on the listing form to the Tax Office The Tax Office takes the assets and puts them on the books and over time they depreciate She stated each year the value is depreciated Gary Lynch , Owner of Carolina Craftsmen , stated someone he hired overstated their business personal property on the listing form and when he brought it to the attention of the Tax Office they requested documentation such as bills of sales , federal tax returns , depreciation schedules , etc Mr Lynch stated he supplied the Tax Office with federal tax returns for every year where the disposals were listed He stated the assets were sold due to the economy and were taken off the federal tax returns Mr Lynch stated he provided a bill of sale for the assets that they are asking for a refund on Mr Lynch acknowledged that they did list the assets on the listing form ; however , he stated it was an oversight Upon a question by Commissioner Ted G Godwin , Ms Garner stated the Tax Office tried to come up with the amount based on the documentation provided by Mr Lynch She stated the Tax Office went back and tried to tie the information provided by Mr Lynch to the business personal property listing forms and there were some items that Mr Lynch said he disposed of where no documentation was provided She stated the Tax Office tried to determine the amount of the refund based on the documentation that was provided and backed out amounts for items where documentation was not provided Mr Lynch stated if there are items that have no documentation , he is unaware of those items At the request of Chairman Tony Braswell , County Attorney Jennifer Slusser stated the clerical error has to be on the part of the County Tax Office and not on the part of the taxpayer for it to be considered a clerical error in which a refund or release can be given Ms Slusser advised the Board to keep in mind that if the refund or release for the taxpayer is improperly given , those who vote for that improper refund or release can be held personally liable for the amount which is refunded or released She stated in this particular situation it is very much like the first situation that the Board considered in that it is a valuation issue and the appropriate time in which this should have been considered would have been during the listing appraisal period and not in the refund and release period Upon a question by Commissioner Jeffrey P Carver , Ms Slusser confirmed the five year look back period is for when the Tax Office makes the error Commissioner Mims stated apparently in this case , the taxpayer made the clerical error and did not update the assets on the listing form Mr Lynch stated he is not asking for the refund based on a clerical error , but rather on the basis of it being an illegal tax since he did not own the assets at that time Ms Slusser stated this is a relatively common thing that happens with business personal property and from the Tax Office’s perspective , this is an issue that should have been taken care of in the listing appraisal period Commissioner Carver asked what other appeal processes are available to the taxpayer Ms Slusser reported if the taxpayer is not satisfied with the Board of Commissioners ’ decision , they have 30 days from the date of decision to file a lawsuit Commissioner Allen L Mims , Jr moved the Board accept the Tax Administrator’s recommendation and deny the request from Carolina Craftsmen for a refund of property tax pursuant to North Carolina Education Committee , addressed the Board Mr Craig stated he would like to share a project with the Board that he started a few years ago with the Clayton Middle School as a mentor He stated the mentoring program has expanded over the years ; however , they want to do more Mr Craig continued he began investigating the Communities In Schools program which is a set of processes and support infrastructure that counties around the State have deployed to provide services to students as they are needed Mr Craig stated the initiative has been up and down a couple of times along with the other mentoring programs , but the structure for the program has never taken off Mr Craig stated he began working with the Chamber of Commerce in June 2014 and they decided to move forward with trying to get the Communities In Schools affiliation between the County and the State completed and started up in the next year He stated the process is a little slower than preferred , but they are working along Mr Craig stated they are recruiting board members for the program and then plan to find a funding source for the first three years Mr Craig stated he is not asking the Commissioners for the first three years of funding He stated they are looking to the industries in the County to come together and fund the first three years to get the program going with the hopes for it to be eventually Board thanked Mr Craig for the information 12 Department of Social Services – Additional Child Welfare Funding Request for Positions Director of Social Services Tina Corbett reported the General Assembly provided new funding for Child Welfare in three separate allocations over the past few months She stated the total amount of the new funding for Johnston County for FY 2014 - 2015 is 272,235 Two of the allocations were to replace funding that was lost in prior years and the third and final allocation was specifically earmarked to address a reduction in the Child Protective Services caseload size Ms Corbett stated based on the receipt of this funding , DSS is requesting two additional permanent Social Worker Investigative , Treatment and Assessment SWIA & T positions and one Social Work Supervisor III position for the Child Welfare section She noted the funding is 100 State funding and does not require a county match Ms Corbett stated that gaining these additional social work positions will assist them in lowering their CPS caseloads to put them more in line with the mandatory caseload size of 10 cases per social worker In addition , the staff to supervisor ratio is out of alignment and the additional social work supervisor position will allow DSS to reduce this rate and ensure the CPS cases are being managed effectively and efficiently Ms Corbett requested the Board’s acceptance of the additional Child Welfare funding and approval of the two additional permanent Social Worker Investigative , Treatment and Assessment SWIA & T positions and one Social Work Supervisor III position for the Child Welfare section At the inquiry of Chairman Tony Braswell , Ms Corbett reiterated that the funding is 100 State funding with no County match required Commissioner Chad M Stewart asked what happens when the money runs out Ms Corbett stated the funding is a General Assembly appropriation and like any appropriation by the General Assembly , they could pull that their tireless and hard work for the citizens 13 Emergency Services – Approval and Acceptance of Two Grant Opportunities Federal Assistance to Firefighter’s Grant EMS Division Chief Josh Holloman stated Johnston County EMS has been approved to receive grant funding in the amount of 146,600 from the Federal Assistance to Firefighter’s Grant He stated staff proposes to utilize the funding to purchase personal protective equipment for the EMS employees in the amount of 111,400 and training equipment in the amount of 35,200 Mr Holloman reported Johnston County EMS would be responsible for payment of 10 of the grant which totals 14,660 and proposes to use funds already budgeted for personal protective equipment for the 10 match He requested the Board to approve and accept the grant opportunity North Carolina Emergency Management Grant Fire Marshal Paul Whitehurst explained that Johnston County Emergency Services has been awarded a grant in the amount of 19,250 through North Carolina Emergency Management to conduct a multi - jurisdictional full scale exercise at the Johnston Regional Airport He stated the exercise will test local responders ’ abilities to respond to a multiple patient incident involving an airplane crash with a fire and fuel spill Participants will include local Fire Departments , Emergency Medical Services , Law Enforcement , local Hospitals , Emergency Management , State and Federal Agencies , and Airport Management Mr Whitehurst noted the exercise is tentatively scheduled for April 2015 and will be in compliance with the Homeland Security Exercise Evaluation Program Mr Whitehurst stated this is a 100 grant with no County match required He requested the Board to approve and accept the grant Commissioner Allen L Mims , Jr moved the Board approve and accept the Federal Assistance to Firefighter’s Grant and the North Carolina Emergency Management Grant to be used for the purposes as outlined by staff Commissioner DeVan Barbour seconded the motion which carried by unanimous vote 14 Emergency Services – Medical Transport Franchise Request tabled from last month At the November 3 , 2014 10 00 am meeting the Board heard a request by the EMS Advisory Committee to add an additional medical transport agency to assist with providing convalescent services The Board voted to table the item for 30 days Page3324 December 1 , 2014 – 10 00 am Continued County Manager Rick Hester stated he has met with Johnston Ambulance Service and the County staff to further review the situation and at this time , he recommends the Board table a decision on adding another medical transport agency until the March 2 , 2015 meeting He stated staff is still reviewing the situation and hopes to have better information to share with the Board closer to March At the inquiry of Commissioner Allen L Mims , Jr , Mr Hester confirmed that staff will also be looking at the contract to see if any adjustments are needed Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Chad M Stewart , and carried by unanimous vote , the Board tabled a decision on adding another medical transport agency until the March 2 , 2015 regular meeting 15 Public Utilities – Amendment to MOA with the NC Sedimentation Control Commission Director of Utilities Chandra Coats explained the North Carolina Sedimentation Control Commission SCC has requested an amendment to the “ Memorandum of Agreement between the North Carolina Sedimentation Control Commission and Johnston County , ” which was originally approved in 2013 She reviewed the proposed amendment , as follows D Exclusive Jurisdiction The Parties agree that the Commission shall maintain exclusive jurisdiction to administer the SPCA for all land disturbing activities that 1 Are outlined in North Carolina General Statue § 113A - 56 ; or 2 Relate to oil and gas exploration and development on the well pad site Ms Coats stated item 1 gives exclusive jurisdiction to the SCC for land disturbance conducted by the State , Federal Government , persons with eminent domain other than the local government , the local government , and projects funded by the State or Federal Government The Commission may delegate the jurisdiction conferred in GS 113A - 56 to any State agency that has an approved erosion control program through the SCC The Commission shall also have concurrent jurisdiction with the local government that is administering the erosion control program She reported item 2 gives exclusive jurisdiction to the SCC for land disturbance as it relates to oil and gas exploration and
