24 , 2014 adopted as follows JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK October 20 – October 24 , 2014 WHEREAS , Johnston County employees represent over 1,000 men and women , working in 31 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS , Johnston County employees provide a multitude of services for all the citizens of the County ; and WHEREAS , Johnston County employees are both skilled and efficient in their jobs , making every effort to expend County tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS , Johnston County Government runs smoothly on a day to day basis primarily because of the dedicated employees in each of its departments and agencies NOW , THEREFORE , in appreciation for their dedication to the welfare of the citizens of our County , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS DOES HEREBY PROCLAIM the week of October 20 - H Youth Development and to join us in recognizing the unique partnership between our County and our State University System th Adopted this the 6 day of October 2014 E Resolution Clarifying Effective Date of Taxation for Fire Service Districts adopted as follows RESOLUTION CLARIFYING EFFECTIVE DATE OF TAXATION FOR FIRE SERVICE DISTRICTS WHEREAS , on April 7 , 2014 , the Johnston County Board of Commissioners adopted resolutions providing for the relocation of adjoining boundary lines of the Fire Service Districts of Fifty - Two Ten , Archer Lodge , Banner and Benson , Bentonville , Beulah and Kenly , Blackman’s Crossroads , Boon Hill and Princeton , Brogden , Claytex and Clayton , Corinth - Holder , Elevation , McLemore , Meadow , Micro , Nahunta , Newton Grove , Oakland , O’Neal , Pi - Le and Pine Level , Selma and Selma Rural , Shoe Heel , Smithfield and Smithfield Rural , Stricklands Crossroads , Thanksgiving , West Johnston , Wilson’s Mills , and Wynn and Four Oaks ; as well as for the extension of the boundaries of the Fire Service Districts of Wynn and Four Oaks , Stricklands Crossroads , Bentonville , Brogden , Oakland , and Smithfield and Smithfield Rural Fire Service Districts collectively known as the “ Fire Service Districts ” ; and WHEREAS , the Board adopted the resolutions pursuant to NC General Statutes § 153A - 303 and 153A - 3043 , upon verification from staff that all statutory requirements had been carried out to the best of staff’s knowledge as well as receiving citizen comment at the required public hearings that were held on April 7 , 2014 ; and WHEREAS , the effective date of said resolutions was set for July 1 , 2014 with the intent for taxation of new boundary areas to begin in the Fiscal Year 2015 - Personal Real Property 62094 Tax releases - Personal Real Property 1,89030 Motor Vehicle releases refunds 87224 Recommended by Tax Administrator Sheila Garner Approved by Finance Director J Chad McLamb 3 Public Comments A Industry Appreciation Award – Iowa 80 of Kenly , North Carolina The Board of Commissioners and the Johnston County Economic Development Advisory Board recognized Iowa 80 of Kenly as part of the Industry Appreciation Award Program Director of Economic Development Chris Johnson reported the program recognizes an existing Johnston County industry every quarter Mr Johnson stated Iowa 80 was founded in 1964 by the Moon Family and he spoke on their contributions and commitment to the Kenly and Micro areas of Johnston County Mr Johnson reported in addition to the Kenly location , Iowa 80 is located in Walcott , Iowa and operates three other major truck stop facilities in Iowa and Missouri as well as the world’s largest truck stop facility in Walcott Mr Johnson stated Iowa 80 purchased the Kenly location in 2004 and embarked on a five year plan to expand and upgrade the facilities Mr Johnson noted Iowa 80 has approximately 190 part - time and full - time employees at the Kenly location providing services for an estimated 1 million customers annually General Manager Ernie Brame and Facilities Manager John Keen accepted the award on behalf of the Iowa 80 Kenly location Mr Brame stated the Moon Family sincerely appreciates the recognition Mr Brame reported given the continued growth trends he can easily see Iowa 80 adding a super truck showroom at the Kenly location which would add another 10,000 to 15,000 sq ft to the main building with a possible second story Mr Brame spoke on the ongoing activities at the Kenly location and stated they hope for a future truck bay repair shop expansion which would involve paving and parking lot expansions of another three to four acres Mr Brame stated the best is yet to come and the Moon Family very much believes in the partnership formed by Iowa 80 and Johnston County The Board expressed their appreciation to Iowa 80 for their continued presence in the County Commissioner Ted G Godwin stated Iowa 80 has been an excellent corporate partner for the Kenly area and hePagePage pageNumber5229 October 6 , 2014 – 10 00 am Continued commended the efforts of both Mr Brame and Mr Keen Chairman Jeffrey P Carver agreed and spoke on the number of services offered and products for sale at the Kenly location B Clayton Fire Department First Responder Unit Fire Marshal Emergency Management Coordinator Paul Whitehurst stated the Clayton Fire Department officially became a Medical First Responder Unit on October 1 , 2014 Mr Whitehurst stated the addition of a first responder unit in Clayton will enhance the overall system He reported Clayton has already responded to a few calls and there have been no issues Mr Whitehurst also noted there have been a number of fire departments recently that have undergone ISO rating inspections and he would like to bring those Chiefs to a future meeting for recognition 4 Public Hearing – JCATS – FY 14 - 15 ROAP Grant Funds Advertised in The Smithfield Herald – September 24 , 2014 Chairman Jeffrey P Carver opened the public hearing for the purposes of allowing public comment on the proposed application to the North Carolina Department of Transportation for a Rural Operating Assistance Program ROAP grant for FY 2014 - 2015 Neal Davis , Executive Director for Community & Senior Services JCATS , presented the FY 2014 - 2015 ROAP Grant and requested its approval Mr Davis stated the purpose of JCATS is to provide specialized transportation for the elderly and disabled to allow people to live at home as long as possible He outlined the program totals of the proposed FY 2014 - 2015 ROAP grant , following PROGRAM TOTAL EDTAP 91,043 EMPL 38,582 RGP 132,487 TOTAL 262,112 EDTAP – Elderly & Disabled Transportation Assistance Program EMPL – Employment Transportation Assistant Program RGP – Rural General Public Program Mr Davis stated he had copies of the “ Voluntary Title VI Public Involvement ” form which collects information on race , color , national origin and gender of the attendees available , if anyone would like to complete the form The funding is determined based on formula allocations summarized below • EDTAP Elderly and Disabled Transportation Assistance Program The following formula was used to determine the county allocation of the funds available 50 divided equally among all counties ; 22 ½ based upon the number of elderly 60 + years residents per county as a percentage of the state’s total elderly population ; 22 ½ based upon the number of disabled residents per county as a percentage of the state’s total disabled population ; and 5 based upon a population density factor that recognizes the higher transportation costs in rural , sparsely populated counties • Work First Employment Transportation Program The following formula was used to determine the county allocation of the funds available 10 divided equally among all counties ; 45 based upon the population of each county as a percentage of the total state population ; and 45 based upon the number of Work First caseloads per county as a percentage of the number of Work First caseloads in the state as of January prior to application distribution Excludes the municipal population for counties with urbanized areas within their boundaries • RGP Rural General Public Transportation Program The following formula was used to determine the county allocation of the funds available 50 divided equally among all eligible counties ; and 50 based upon the rural population of each county as a percentage of the total state rural population Excludes the municipal population for counties with urbanized areas within their boundaries PagePage pageNumber6230 October 6 , 2014 – 10 00 am Continued Mr Davis presented the chart below which summarizes funding allocated to Johnston County and noted the funding continues to decline FY 2011 ROAP FY 2013 ROAP FY 2014 ROAP FY 2015 ROAP Funds Funds Funds Funds 353,993 297,440 316,807 262,112 16 reduction 105 reduction 26 reduction from FY 2011 from FY 2011 from FY 2011 Mr Davis reported the only local match is for the RGP portion which amounts to 14,721 and of that amount , JCATS projects to recover 6,204 from other revenue leaving the County’s local match requirement at 8,517 Mr Davis stated the amount is the same as last year and was included in the FY 2014 - 2015 budget appropriation by the Commissioners ; therefore , no additional funds are being requested Mr Davis requested the Board to approve the application and authorize Community and Senior Services of Johnston County and the CTS Advisory Board of Directors to apply for a ROAP grant for FY 2014 - 2015 5 JoCo Teen Drivers – National Teen Drivers Safety Week and Celebrate My Drive Campaign Students Robin Braswell of Johnston County Early College Academy and Matthew Cherry of West Johnston High School addressed the Board Miss Braswell explained this month is National Teen Driver Safety Week and it is a time designated by Congress each year to raise awareness of teen driver topics and to encourage safe teen driver and passenger behavior She continued the event is now in its eighth year and takes place this th year the week of October 19 – 25 Miss Braswell reported JoCo Teen Drivers plans to use the national event to reinforce driver and passenger safety at the schools as well as in the community Mr Cherry stated every high school in the County is planning activities for Teen Driver Safety Week such as safety announcements at football games , posting safety banners and reviewing teen driving statistics in the morning announcements , and balloon releases in remembrance of those teens that have passed He stated one new activity called “ Why Buckle Up ” will consist of public service announcements from different clubs and faculty members along with other County and community leaders Mr Cherry stated West Johnston High th School will host a street safe driving event on October 18 from 8 45 am until 1 30 pm at the school which offers students real life demonstrations of distracted and hazardous driving and will include driving simulators Mr Cherry spoke on another campaign known as “ Celebrate My Drive ” which all County high schools plan to participate in He stated “ Celebrate My Drive ” is an opportunity for the students and the community to pledge to be safe drivers Mr Cherry added high schools have the opportunity to win one of 100 grants valued from 25,000 to 100,000 and requested the Board’s assistance getting the word out so people will go online and pledge at wwwCelebrateMyDrivecom Miss Braswell and Mr Cherry passed out “ Celebrate My Drive ” flyers Miss Braswell spoke on some of the different activities being planned for the “ Celebrate My Drive ” campaign Mr Cherry introduced Chad Richards and Kim Conyers of State Farm who is sponsoring the “ Celebrate My Drive ” campaign Commissioner Chad M Stewart expressed his appreciation to the students for their efforts noting he believes it is making a difference Commissioner Ted G Godwin stated the JoCo Teen Drivers program was recognized by the North Carolina Association of County Commissioners in August and he spoke on the efforts of the students asking them to keep up the good work Commissioner Cookie Pope noted she recently called someone’s cell phone and received a response that they do not answer the phone while driving Commissioner Pope thanked the students for their efforts PagePage pageNumber7231 October 6 , 2014 – 10 00 am Continued 6 Micro Volunteer Fire Department – Approval of Tax Exempt Loan Status Assistant County Manager Finance Director Chad McLamb explained the Micro Volunteer Fire Department is requesting the Board to grant them tax exempt loan status so they can borrow up to 250,000 from KS Bank for the refinancing of a rescue fire truck at an interest rate of 235 with a term of 120 months Mr McLamb stated he has reviewed the financing proposals and recommends the financing with KS Bank and monthly payments Mr McLamb introduced Micro Fire Chief Johnny Dixon in the audience Clerk to the Board Paula Woodard stated the truck listed in the agenda packet is incorrect and if the Board approves the request , the resolution would need to be adopted as amended to reflect a 2008 Hackney Spartan Rescue Truck Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Chad M Stewart , and carried by unanimous vote , the Board adopted the following amended resolution granting the Micro Volunteer Fire Department tax exempt loan status NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt financing applicable to the VFD because of Section 150 e 3 and Section 147 f of the Internal Revenue Code of 1986 , as amended , and such approval does not obligate the County or its Board of Commissioners in any way regarding repayment of the debt th Duly certified by the execution hereof and the placement hereon of the seal of said county , this 6 day of October , 2014 7 Economic Development Office – Annual Review Economic Development Director Chris Johnson presented an annual review to the Board Mr Johnson stated on September 23 , 2013 he was given the privilege of representing the Board and the citizens of Johnston County as the Economic Development Director Mr Johnson stated he hopes the annual update will give the Board an idea of what has taken place as well as offer a clear idea of the future direction He reported the Strategic Plan has just been completed with Ted Abernathy and they are now using that as a tool to map out the future for the next two to three and then three to five years Mr Johnson began his presentation with the Board , as follows Mr Johnson reviewed the following project statistics noting that fortunately for Johnston County there have been ten client visits which he feels is a good return on investment Mr Johnson stated the “ Projects By Areas ” include areas both inside the municipal limits as well as outside Mr Johnson pointed out that when the Economic Development Office responds to a Request for Information RFI he submits as many sites in the County as possible , given the specific requirements of the project He stated by submitting multiple sites , he hopes that one or more of them will entice a client to visit the County PagePage pageNumber8232 October 6 , 2014 – 10 00 am Continued Mr Johnson stated in his time at the Economic Development Office he has learned that the most requested property by clients are for existing buildings in the 80,000 sq ft range with 28 ft ceilings or higher that are move - in ready Mr Johnson noted the County has 80,000 sq ft existing buildings ; however , the ceiling heights in those structures are prohibitive with most of them being around 15 ft He stated high ceilings are in demand as well as buildings with all utilities including water , sewer , electricity , and natural gas Mr Johnson continued that clients are looking for sites ranging in size from 5 acres to 600 acres , and he has found that 20 acre tracts with utilities are the sites highest in demand Mr Johnson noted certified sites are becoming more and more important and fortunately Johnston County has five certified sites to offer He clarified that even when clients are asking to see certified sites , he submits not only those certified sites but other properties that could also meet the client’s requirements Mr Johnson noted the County is competing with other counties that often offer free land to companies Mr Johnson reviewed an idea with the Board to create “ Johnston County Ready Sites ” PagePage pageNumber9233 October 6 , 2014 – 10 00 am Continued Mr Johnson stated the cost to certify a site can reach upwards of 35,000 and many of the smaller towns do not have those funds in their budgets He stated he would like to create a grant program and possibly look at ways to partner with municipalities to certify sites to attract more client visits and growth He noted there are many facets involved with certifying a site and he would like to look at ways to complete the process at reduced costs if possible Mr Johnson also spoke on a proposal to work with Johnston County developers to build “ Johnston County Ready Buildings ” Mr Johnson stressed this would not be a spec building program , but instead would be a partnership with local developers to encourage them to construct the types of buildings that are most in demand Mr Johnson stated he would propose to use funds from the Economic Development Corporation’s revolving loan fund to loan money to a developer once a building has been built to cover debt service for a certain period of time or when the building is leased or purchased , whichever comes first He stated once the building is purchased or leased , the funds from the revolving loan fund would then be reimbursed to the Corporation Mr Johnson concluded his presentation by reviewing recent locations and expansions in the last 18 months , as follows Mr Johnson shared with the Board a video of one of the existing buildings in Johnston County that is for sale and or lease He stated the office is hoping to create similar videos for other available properties ,Page0234 October 6 , 2014 – 10 00 am Continued including buildings and land , and post those videos on the website so clients can view a flyover of the property on - line in the hopes of generating interest and a site visit Mr Johnson thanked the Board for their support At the inquiry of Commissioner Cookie Pope , Mr Johnson stated the office is working with and meeting with Duke Energy , Dominion , and Piedmont Natural Gas regarding the Atlantic Coast Pipeline natural gas project to make sure the County’s best interests are being met Mr Johnson stated he has sent maps to those companies of the County’s available sites along the Interstate 95 corridor in an effort to plan for the future Mr Johnson noted with that said , the natural gas industry is very heavily regulated by the Utilities Commission and the Utilities Commission will not allow speculative type construction and there has to be an end - user being proposed 8 Alliance Behavioral Healthcare – Update to the Board Mental Health Director Dr Janis Nutt read the following statement As you may recall , in 2011 , a bill was passed to bring all Medicaid and state funding for Mental Health , Substance Abuse and Developmental Disabilities services in the State under a capitated system Local Management Entities , like the Johnston Mental Health Center , were mandated to join together into Managed Care Organizations or MCO’s to gain economies of scale in both general population and Medicaid covered lives to make this system viable We chose to join 3 other “ single County ” LME’s Durham , Cumberland and Wake , to form Alliance Behavioral Healthcare In 2012 and 2013 , ten of these MCO’s , including Alliance , became fully operational , basically , as insurance companies However , in this publically managed version of managed care , there are some distinct differences and benefits for us locally With the focus on preserving the local presence that this MCO model supports , the Johnston County Mental Health Center has maintained an active and viable role as a County agency We have been able to continue our long - standing liaison relationships with our fellow agencies like the Department of Social Services , Johnston County Schools , Juvenile Justice and the Court system to coordinate services We continue local initiatives and projects such as our diversion program with the Johnston County Jail , Crisis Intervention Training programs for local law enforcement and EMS , our geriatric services and participation with JCATS and local housing programs , just to name a few We continue to provide guidance and intervention for those in the County who have special needs in the area of behavioral healthcare We continue to work closely in support of local behavioral health providers , and to maintain our unique partnerships with the Johnston Health Department - Behavioral Health Division and Johnston Health I would like to take this opportunity to thank you all for your unfailing support of our agency over all the changes that have come about in the past few years It’s why we’re still here And in the upcoming session of the legislature , as management strategies for Medicaid are inevitably debated , hopefully , you and other Boards of County Commissioners statewide will support the public management of Medicaid funds for mental health , substance abuse , and intellectual developmental disabilities in their legislative agendas Dr Nutt introduced Alliance CEO Rob Robinson who provided the Board with an update Alliance CEO Rob Robinson addressed the Board and introduced Bill Stanford of Wake County , the Chair of the Alliance Board , and Vicki Shore representing Johnston County on the Alliance Board of Directors Mr Robinson thanked Ms Shore and Dr Nutt for their participation and leadership representing the needs of the citizens of Johnston County Mr Robinson presented the following information to the Board Page1235 October 6 , 2014 – 10 00 am ContinuedPage2236 October 6 , 2014 – 10 00 am Continued Mr Robinson noted the issue of Medicaid Reform will continue to be a topic of discussion in the legislature and stated this is not unique to North Carolina He asked the Board to consider , in the upcoming legislative session , to support the work of Alliance and the Johnston County Mental Health Center by speaking to the legislative delegation on the benefits being provided to the citizens He noted Wake , Cumberland , and Durham Counties have adopted legislative goals to help maintain the MCO model Mr Robinson offered to answer any questions At the inquiry of Commissioner Tony Braswell , Mr Robinson stated Alliance is reaching out to the legislators to talk about their services and the MCO model He stated any help or guidance from the Board of Commissioners would be appreciated Commissioner Braswell stated he is aware of ongoing discussions with Senator Brent Jackson who represents Johnston County Rudy Baker , Chairman of the Johnston County Veterans Services Advisory Board , spoke in support of behavioral health care for veterans and asked Mr Robinson to reach out to the Durham VA Suicide Prevention Officer as well as to work with the Crisis Intervention Team Dr Nutt noted the Johnston County Veterans Services Director is a part of the Johnston County Crisis Intervention Team Commissioner DeVan Barbour stated he has been involved with mental health issues for about 10 years and in that time there have been a lot of changes Commissioner Barbour expressed his feelings that at times he has felt Johnston County has not received the support and response from Alliance that it should have Commissioner Barbour stressed he would like to see more consistency from Alliance with their support and responsiveness Commissioner Barbour stated behavioral health care is very important to Johnston County and Johnston County wants to provide services for its citizens so they do not have to travel out - of - county for care 9 Public Utilities – Request for Enforcement of Erosion and Sediment Control Ordinance Director of Utilities Chandra Coats introduced new Stormwater Administrator Carlos Bagley to the Board Mr Bagley stated he has lived in Johnston County all his life and knows it well He stated he is glad to be working for the County Mr Bagley presented the request to the Board He explained the Johnston County Erosion and Sediment Control Ordinance became effective on December 1 , 2013 and since that time , several towns within the County have requested the County to enforce the ordinance within their jurisdictions to replace the current State enforcement Mr Bagley continued the Town of Archer Lodge passed a Joint Resolution for Erosion and Sediment Control Enforcement on September 8 , 2014 at their Town Council meeting requesting Johnston County to enforce the ordinance within their planning jurisdiction He stated staff respectfully requests the Board of Commissioners to consider adopting the joint resolution Upon a question by Commissioner Tony Braswell , Mr Bagley stated at the present time , there is sufficient staff to handle the additional work Page3237 October 6 , 2014 – 10 00 am Continued County Manager Rick Hester stated he has received good feedback from Mr Bagley’s work so far with the County Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board adopted the following joint resolution JOINT RESOLUTION THE TOWN OF ARCHER LODGE AND JOHNSTON COUNTY WHEREAS , the Town of Archer Lodge has requested that Johnston County exercise and enforce Chapter 14 , Article XII , Erosion and Sediment Control , County of Johnston , North Carolina Code of Ordinances within the corporate limits and extraterritorial jurisdiction of the Town of Archer Lodge ; and WHEREAS , Johnston County does hereby agree to this request ; and WHEREAS , pursuant to the execution of this agreement , both the Town of Archer Lodge and Johnston County understand this request must be heard by the North Carolina Sediment Control Commission for their endorsement prior to enforcement action of the Erosion Control Ordinance by the County in said jurisdiction ; and WHEREAS , by General Statute , the North Carolina Sediment Control Commission is the controlling authority for approval of such requests as the final action in the condoning process in the matter specific to Chapter 14 , Article XII , Erosion and Sediment Control NOW , THEREFORE , it is hereby resolved by Joint Resolution of the Town Council of the Town of Archer Lodge and the Board of Commissioners of Johnston County , acting in separate regular sessions of each respective body , as follows 1 The Town of Archer Lodge relinquishes its jurisdiction within its corporate limits and extraterritorial zoning jurisdiction with regard to local enforcement of the erosion and sediment program pursuant to GS 113A - 60 , and hereby by agreement and resolution , grants to Johnston County jurisdiction within said areas for the purpose of administering a joint program pursuant to such statute as provided in Chapter 14 , Article XII , Erosion and Sediment Control , County of Johnston , North Carolina Code of Ordinances 2 Johnston County Board of Commissioners does agree to exercise jurisdiction to enforce the ordinance identified herein , within the corporate limits and extraterritorial zoning jurisdiction , pursuant to the authority set forth herein st 3 The initial terms of this Agreement shall be for a period of one 1 year , commencing on the 1 day of st October , 2014 , and terminating on the 1 day of October , 2015 Either party may terminate the Agreement at the end of the initial term Thereafter , this Agreement shall automatically renew for a successive one year term at the end of each term unless notice is given by either part at least four 4 months prior to the end of the current one year term that the party wishes to terminate the Agreement at the end of the current term This Agreement may be terminated at any time upon mutual agreement of both parties 4 Should any claims arise out of services provided by Johnston County under this agreement , the Town of Archer Lodge agrees to indemnify and hold Johnston County , its employees , agents , and contractors harmless from any and all claims for liability , loss , injury , damages to persons or property , cost or attorney’s fees resulting from any action brought against Johnston County , its employees , agents , contractors and Commissioners arising as a result of these services performed on behalf to the Town of Archer Lodge that are the subject matter of this Agreement , except where such claims result from actionable acts of negligence by Johnston County ADOPTED by the Town Council of the Town of Archer Lodge , North Carolina , meeting in regular session on the 8th day of September 2014 , and by the Board of Commissioners of Johnston County meeting in regular session on the 6th day of October , 2014 10 Public Utilities – Interlocal Agreement for Joint Water Supply Planning Director of Utilities Chandra Coats reported the State requires water providers to plan for future water supply needs over a 50 year period She stated the County has plans for a future water intake along the Neuse River near Richardson Bridge Road ; however , a new water treatment plant and intake location will require a very large capital expenditure Therefore , staff continues to evaluate all options to ensure a reliable supply and reasonable user rates Ms Coats explained the City of Raleigh is also evaluating options for future water supply and both the City and County expect some or all of the new water supplies to be developed within the Neuse River Basin She stated the City and County could benefit from joint planning efforts to eliminate duplicate planning efforts and conceivably leverage greater rate payer benefit Ms Coats requested the Board’s consideration of an “ Interlocal Agreement for Joint Water Supply Planning Between Johnston County and the City of Raleigh ” to jointly utilize a Water Resources Planning Consultant that will complete preliminary hydrological modeling to evaluate and identify feasible future water supply options She offered to answer any questions Page4238 October 6 , 2014 – 10 00 am Continued Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the interlocal agreement for joint water supply planning , as follows INTERLOCAL AGREEMENT FOR JOINT WATER SUPPLY PLANNING BETWEEN JOHNSTON COUNTY AND THE CITY OF RALEIGH THIS AGREEMENT this “ Agreement ” or this “ Interlocal Agreement ” made and entered into this ____ day of _______________ , 2014 , by and between the City of Raleigh the “ City ” and Johnston County the “ County ” WITNESSETH WHEREAS , both the County and the City provide potable water to their respective customer service areas , and WHEREAS , both the County and the City reside in and utilize water resources from the Neuse River Basin , and WHEREAS , the State of North Carolina requires municipal potable water providers to prudently plan for future water resource utilization needs over a 50 - year period , and WHEREAS , both the County and the City project significant population increases and subsequent new water resource needs within that 50 - year period , and WHEREAS , both the County and the City expect some or all of those new water resources to be developed from and within the Neuse River Basin , and WHEREAS , both the County and the City could conceivably leverage greater rate payer benefit from joint planning efforts that eliminate duplicate planning efforts , and WHEREAS , the County and the City desire to enter into an agreement to set forth those certain terms and conditions relating to the study of new water resource options , and WHEREAS , this Agreement is entered into pursuant to North Carolina General Statutes , Article 20 , Part 1 of Chapter 160A NOW , THEREFORE , in consideration of the mutual covenants and promises contained herein , the sufficiency of which is hereby acknowledged , the parties hereto agree as follows 1 The City will engage its current 50 - year period water resources planning consultant , Hazen & Sawyer , to complete hydrological modeling in support of joint planning efforts under the terms and conditions of the Scope of Services listed as Attachment 1 of this Agreement 2 The County will reimburse the City for half of the estimated cost of 20,000 , after completion and presentation of work , for the aforementioned consultant services 3 This Interlocal Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties 4 This Agreement shall not relieve the County from the requirements of any statute , ordinance , or regulation 5 It is specifically agreed , as part of the consideration of the signing of this Agreement , that the parties hereto , their agents , officials , employees will not discriminate in any manner on the basis of race , color , creed , or national origin with reference to the subject matter of this Agreement , no matter how remote The parties hereto further agree in all respects to conform with the provisions and intent of Ordinance No 1969 -
