10 132 Meeting of the Johnston County Board of Commissioners July 7 , 2014 10 00 am The Johnston County Board of Commissioners met in regular session Monday , July 7 , 2014 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Tony Braswell , Cookie Pope , Allen L Mims , Jr , DeVan Barbour , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney David F Mills , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer Commissioner Allen L Mims , Jr led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – June 2 , 2014 10 00 am and 6 00 pm ; June 9 and 30 , 2014 ; and June 2 , 2014 Finance Corporation Minutes B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Langdon Pointe Drive – Langdon Pointe Subdivision – Cleveland Township Adeliade Drive , Lars Lane , Carson Drive , and Tia Place – Heritage Farms – Cleveland Township Roberts Trail – Roberts Trail – Elevation Township Carriage Creek Drive , Steep Hill Court , and Smithsanders Court – Carriage Creek – Cleveland Township C Adoption of Johnston County Electronic Imaging Policy The Board adopted the following Electronic Imaging Policy for Johnston County ELECTRONIC IMAGING POLICY FOR JOHNSTON COUNTY PURPOSE Records are considered to be the property of Johnston County and maintained for the benefit of agency use in delivering services and in documenting agency operations In keeping with current trends , modern electronic technology is widely used This electronic imaging record policy reflects guidelines set forth in the North Carolina Department of Cultural Resources publication , North Carolina Guidelines for Managing Public Records Produced by Information Technology Systems This is a county - wide policy that must be followed by any department which seeks to destroy a paper record after making a digital image of such record Each department head shall be ultimately responsible for carrying out this policy within his or her department Established guidelines will not only increase the reliability and accuracy of records stored in information technology systems , but also ensures they remain accessible Established guidelines for reproduced records will likewise enhance their admissibility and acceptance by the judicialPage133 July 7 , 2014 – 10 00 am Continued system as being trustworthy Privileged or confidential information will also be protected by this policy This policy will be re - evaluated at least every five years and updated as required DESTRUCTION OF RECORDS A department of Johnston County government seeking to destroy any paper records after scanning them in accordance with this policy must comply with this policy and must first seek the approval of the North Carolina Department of Cultural Resources That approval will be requested and recorded on the “ Request for Disposal of Original Records Duplicated by Electronic Means ” form A department will submit a new form each time it begins to scan a new records series Destruction of the original paper record will be conducted only after imaging and quality control assurance procedures have been completed , all necessary corrections have been made , all auditing procedures have been conducted , and the destruction is approved by the Document Retention Officer Each department shall appoint a Document Retention Officer who shall be the department head or his or her designee The Document Retention Officer shall ensure that this policy is followed before any paper record is destroyed , unless the paper record can be destroyed in the ordinary course prescribed by the Records Retention and Disposition Schedule The paper originals of records series scheduled as “ permanent ” will not be destroyed unless a microfilm preservation duplicate is created prior to destruction Network Attached Storage containing scanned records will be maintained for the specified retention periods according to the Records Retention and Disposition Schedule published by the North Carolina Department of Cultural Resources The original paper record will be shredded on county premises Security backups of all imaged documents will be generated nightly and maintained off - site A listing of all records imaged will be kept in electronic format Any hard copy generated from the official record will be considered a reference or working copy TRAINING The key imaging operators in each department have been provided training in the use of the equipment by IT Subsequent training of departmental staff will be conducted by the key imaging operators and Document Retention Officer , with assistance from IT as needed All applicable departmental staff will be trained in the correct procedures required for imaging and the reproducing of records All applicable departmental staff will be trained in the correct procedures for viewing imaged documents and for reproducing of any imaged document Departmental staff trainers will conduct training AUDITS Department head or their designees “ managerial staff ” will periodically audit imaged records within such department for accuracy , readability , and reproduction capabilities Original paper records will not be destroyed until the managerial staff has audited a sampling of those records for system accuracy An audit report will be prepared indicating the sampling of records produced and what remedial procedures were followed if the expected level of accuracy was not achieved AUDIT TRAILS Documentation of all imaging activities is maintained through audit trails built into the imaging system to protect the agency from potential fraud or any other unauthorized acts , as well as the authenticity of the records Audit trails include Login logout Creating , editing , printing or deleting documents , folders , entries or pages Creating , editing or deleting index templates , fields and annotations Image editing Page inserts Moving documents , pages or folders Printing documents Adding security tags Email Exporting Documents Sending Documents to the recycle bin Modification of repository settings Date and time is captured for all the above audit trail items DOCUMENTATION Procedures Staff trainers for individual units in Johnston County will be responsible for preparing and updating of detailed procedures describing the process to produce and reproduce an automated record Documentation describing the system hardware and software will be the responsibility of IT A current procedural manual will be maintained to assure the most current steps are followed and to assure reliable system documentation will be available for judicial or similar proceedings Page134 July 7 , 2014 – 10 00 am Continued Training Documentation will be maintained for the distribution of written procedures to assist in training new employees and refresher training programs Retention One set of all system documentation , including documentation describing how the system operates from a functional user and data processing point of view , will be maintained permanently in the event a court review is necessary When system documentation changes , old versions will be maintained for 3 years after discontinuance of system and after all data records created by the system has been destroyed or transferred to a new operating environment AVAILABILITY OF SYSTEM FOR OUTSIDE INSPECTION This agency recognizes the fact that the judicial system may request pretrial discovery of computer programs and related materials Agency personnel will honor requests for outside inspection of the system and testing of data by opposing parties and the court It will also honor inspection and copy requests pursuant to Chapter 132 of the North Carolina General Statutes D Approval of Inter - purpose senior center He stated with that designation comes more funding for the programs Mr Davis introduced and recognized Madison Cauley who is the Community Services Director responsible for the senior center programs at the Harrison Center in Selma , the Clayton Center for Active Aging , as well as the Benson Center for Active Aging Commissioner Ted G Godwin complimented Ms Cauley for the enthusiasm she displays in her job Chairman Jeffrey P Carver recognized Community & Senior Services Board of Directors members George Smith and Bill Wenzel in the audience and thanked them for their service Mr Davis continued his remarks by announcing that for the first time in Johnston County , Community & Senior Services has achieved a designation of “ Senior Center of Excellence ” for the Clayton Center for Active Aging Mr Davis reported the designation is the State’s highest level of certification and is the result of a two year effort by the Clayton Center staff Mr Davis spoke on the process of achieving the certification stating he is very pleased with the staff’s efforts and hard work He noted the Clayton Center has experienced increased growth and the attendance has grown beyond expectations which has created issues with parking and space Mr Davis stated they are looking at other ways to meet the demand and expand their services Mr PagePage pageNumber6137 July 7 , 2014 – 10 00 am Continued Davis introduced the Clayton Center for Active Aging Program Coordinator Selena Royal He thanked Ms Royal and Ms Cauley and stated without their efforts the designation would not have been possible The Board congratulated Community & Senior Services and the Clayton Center for Active Aging for achieving the designation The Board also commended the staff for their hard work and efforts Mr Davis thanked the Board of Commissioners and County Manager Rick Hester for their support He also thanked Commissioner Ted G Godwin who is the Commissioner Representative on the Community & Senior Services Board of Directors for his active participation and interest in their programs 5 Department of Transportation – Request Approval for Relocation of Graves County Attorney David Mills explained the North Carolina Department of Transportation is requesting the Board to adopt a resolution approving the relocation of three graves from the Lula D Driver Heirs Cemetery in Johnston County that are located in the proposed right - of - way of the W - 5107 highway project Mr Mills reported with all grave relocations in North Carolina pursuant to General Statutes , notification must be published in a local newspaper four times He stated the Department of Transportation has confirmed that notice has been published in The Smithfield Herald on June 8 , 15 , 22 , and 29 , 2014 Mr Mills continued the cemetery is family owned and the Department of Transportation has identified and notified the next of kin He stated the three graves are being relocated further back within the same cemetery Upon a question by Commissioner Ted G Godwin , Mr Mills stated he is unsure exactly how old the cemetery is , but he has been assured by the Department of Transportation that the next of kin is aware of the relocation Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board adopted the following resolution approving the relocation of the three graves from the Lula D Driver Heirs Cemetery Johnston County Board of Commissioners RESOLUTION WHEREAS , the North Carolina Department of Transportation is currently engaged in a highway project designated as Project W - 5107 in Johnston County ; and WHEREAS , the North Carolina Department of Transportation has certified to the Board that there are three graves in the Lula D Driver Heirs Cemetery that are located in the proposed right - of - way of the project and that it is reasonably necessary to disinter , remove , and reinter the remains from the three gravesites to a site to be determined in order to carry out the project ; and WHEREAS , North Carolina General Statute § 65 - 106 allows the Department of Transportation , an agency of the State of North Carolina , to effect the disinterment , removal , and reinterment of graves in compliance with said Section NOW , THEREFORE , BE IT RESOLVED , that the request by the North Carolina Department of Transportation is approved and the Department may effect the disinterment , removal , and reinterment of the three graves in the Lula D Driver Heirs cemetery , provided that the Department gives proper notice and follows the procedures required by NC Gen Stat § 65 - 2014 fiscal year , the County received a one - time increase in motor vehicle revenue due to the additional four months of collections attributable to switching to the new system Six months were collected in arrears and ten months were collected at the time of registration Additionally , the County received a distribution of 258,600 from the remaining interest money left over from the implementation of the Tag and Tax program Under the Tag and Tax program , the roll of the tax office is to process and approve the billing file , handle all value appeals , exemptions , releases , proration’s and refunds With this new system , we expect the collection rate of registered motor vehicles to be nearly 100 For the 2013 - 2014 fiscal year , I am very pleased to report that we have achieved an increase in our overall collection rate from 9872 to 9950 As of the January 7 , 2014 delinquency date , almost 90 of taxpayers in Johnston County had paid their real and personal property tax and about 83 had paid their registered motor vehicle tax I would like to commend our collection staff who proactively pursued collection of delinquent taxes ; it is through their efforts that the real and personal collection rate increased to 9971 and the registered motor vehicles increased to 9618 I’d also like to thank the taxpayers who pay their taxes in a timely manner and assure them that our office will do everything legally possible to collect from those who do not pay their tax bills According to the Department of State Treasurer , Johnston County maintained the fourth highest in overall collection rate for fiscal year 2012 - 2013 among counties with a population of greater than 100,000 For real and personal property collection , we ranked second in our population group and fourth in the state For registered motor vehicle collections , we ranked fourth for counties in our population range It takes everyone working together towards the same goal of assessing , defending , and collecting taxes on all taxable property to achieve such a remarkable collection rate I’d like to express my gratitude to the Tax Office staff , I am privileged to work with some of the most knowledgeable and experienced staff that are responsible and take pride in their work We are committed to providing excellent customer service while diligently pursuing a collection rate of 100 ; this vast endeavor aids in the lowest possible tax to all taxpayers in Johnston County I would like to thank each of the County Commissioners who have remained steadfast in their support of me and my staff Your dedication to support the mission of collecting taxes in a fair and equitable manner is evident as the overall collection rate has increased from 9735 to 9950 since 2004 Without your continued support this exceptional achievement would not be possible Page3144 July 7 , 2014 – 10 00 am Continued As required by state law , this is a true and accurate settlement pursuant to NCGS 105 -
