10 857 Meeting of the Johnston County Board of Commissioners April 7 , 2014 10 00 am The Johnston County Board of Commissioners met in regular session Monday , April 7 , 2014 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Tony Braswell , Cookie Pope , Allen L Mims , Jr , DeVan Barbour , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney David F Mills , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Ted G Godwin opened the meeting with a prayer Commissioner DeVan Barbour led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – March 3 , 2014 10 00 am B Proclamation – National Public Safety Telecommunicator’s Week – April 13 - 19 , 2014 The Board adopted the following proclamation declaring the week of April 13 - 19 , 2014 as National Public Safety Telecommunicator’s Week in Johnston County National Public Safety Telecommunicator’s Week April 13 - 19 , 2014 WHEREAS , emergencies can occur at anytime that require police , fire or emergency medical services ; the E - 911 Communications Center was created to provide a vital contribution to the quality of life enjoyed by citizens and visitors to Johnston County ; and WHEREAS , when an emergency occurs , the access to a 911 center dramatically improves the prompt response of police officers , firefighters and paramedics , is critical to the protection of life and preservation of property ; and WHEREAS , the Telecommunicators are trained , prepared and ready ; the safety of our police officers , firefighters and EMS personnel are dependent upon the quality and accuracy of information obtained from citizens who telephone the Johnston County E - 911 Communications Center ; and WHEREAS , Public Safety Telecommunicators are the first and most critical contact our citizens have with emergency services ; and WHEREAS , Public Safety Telecommunicators are the single vital link for our police officers , firefighters and EMS personnel by monitoring their activities by radio , providing them information and insuring their safety ; and WHEREAS , Public Safety Telecommunicators of the Johnston County E - 911 Communications Center have contributed substantially to the apprehension of criminals , suppression of fires and treatment of patients ; and WHEREAS , each Telecommunicator has exhibited compassion , understanding and professionalism during the performance of their job ; and WHEREAS , National Telecommunicator’s Week will serve to recognize the Telecommunicators of Johnston County who provide a vital public safety service NOW THEREFORE BE IT RESOLVED , that the Board of Commissioners of the County of Johnston , hereby proclaims and declares the week of April 13 - 19 , 2014 as National Telecommunicator’s Week in Johnston County , in honor of the men and women whose diligence and professionalism keep our County and citizens safe th Adopted this the 7 day of April , 2014 Page858 April 7 , 2014 – 10 00 am Continued C Proclamation – Older Americans Month – May 2014 The Board adopted the following proclamation declaring the month of May 2014 as Older Americans Month in Johnston County Proclamation Whereas , Johnston County includes over 17,000 citizens ages 65 and older ; and Whereas , Community and Senior Services of Johnston County is committed to helping all individuals live longer , healthier lives ; and Whereas , the older adults in Johnston County have made countless contributions and sacrifices to ensure a better life for future generations ; and Whereas , we recognize the value of injury prevention and safety awareness in helping older adults remain healthy and active ; and Whereas , our community can provide opportunities to enrich the lives of individuals young and old by ? Emphasizing the need to take action to safeguard themselves from unintentional injuries where they live , work and socialize ? Providing information on avoiding leading causes of injury for older adults – falls , motor vehicle - related incidents , suffocation , medication overdose , and fire burns ? Helping older adults take control of their safety and well being Now Therefore , We , the Johnston County Board of Commissioners do hereby proclaim May 2014 to be Older Americans Month We urge every citizen to take time this month to recognize older adults and the people who serve and support them as powerful and vital citizens who greatly contribute to the community th Adopted this the 7 day of April , 2014 D Proclamation – Litter Sweep Spring 2014 – April 26 , 2014 through May 10 , 2014 The Board adopted the following proclamation supporting the NCDOT 2014 Spring Litter Sweep for April 26 , 2014 through May 10 , 2014 in Johnston County PROCLAMATION SPRING LITTER SWEEP 2014 WHEREAS , the North Carolina Department of Transportation organizes an annual spring statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the spring 2014 LITTER SWEEP roadside cleanup will take place April 26 through May 10 , 2014 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will increase awareness of the need for cleaner roadsides , emphasize the importance of not littering , and encourage recycling of solid wastes ; and th WHEREAS , the 2014 spring cleanup will celebrate the 26 Anniversary of the North Carolina Adopt - 11 , 2014 WHEREAS , each year an estimated 6,000 teens die in car crashes in the United States ; and WHEREAS , Johnston County has seen numerous teen traffic accidents and fatalities which led the Johnston County Board of Commissioners to take action to reduce future tragedies through the creation of the Teen Driving Safety Committee and JoCo Teen Drivers ; and WHEREAS , the purpose of the Teen Driving Safety Committee and JoCo Teen Drivers is to heighten public safety awareness to reduce teen driving fatalities by targeting five risk factors including driving at night , speeding , distracted driving , not using safety belts , and the use of alcohol while driving ; and WHEREAS , the Johnston County Board of Education has also partnered with these efforts by allowing eleven high schools in the County to participate in the JoCo Teen Drivers Program as well as supporting the efforts of the Johnston County Board of Commissioners and the Teen Driving Safety Committee Page0866 April 7 , 2014 – 10 00 am Continued NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim the week of April 7 – 11 , 2014 as Teen Driver Safety Week in Johnston County and encourages all citizens to observe the week by promoting the practice of safe driving among the County’s licensed teenage drivers th Adopted this the 7 day of April 2014 7 Nursing Home Adult Care Home Community Advisory Board Update Jimmy Parker , Chairman of the Nursing Home Adult Care Home Community Advisory Committee , provided the Board with an annual update on the Committee’s work Mr Parker stated the mission of the Committee is to serve as grassroots volunteer advocates for residents in long term care in Johnston County Mr Parker stated the Committee’s responsibility is to visit all the long term care facilities in the County and inspect the conditions , assure that the residents ’ Bill of Rights are being upheld , assist residents with any concerns , and educate and inform the community about long term care Mr Parker reported they currently have 20 active Committee Members and are allowed to have up to 25 Mr Parker reported at present , there are 24 long term care facilities in the County with 4 of those being nursing homes , 12 adult care homes , and 8 family care homes The total capacity for residents is approximately 1,200 Mr Parker stated Gabriel Manor Assisted Living opened in Clayton last summer and offers a 75 - bed facility with approximately half devoted to dementia care He also noted Principal Long Term Care is constructing a 100 - bed skilled nursing facility in Clayton Mr Parker informed the Board that the Nursing Home Committee Teams perform quarterly visits to all the nursing homes and adult care homes and annual visits to the family care homes He stated the visiting teams consist of three to five Committee Members and are rotated so they will be exposed to as many of the facilities as possible over time Mr Parker stated during 2013 , teams conducted over 70 facility visits devoting more than 1,350 hours and logging more than 4,800 miles He explained the teams document the visits and file reports with the full Committee for review which are then sent to the Ombudsman and finally placed on the County’s website Mr Parker reported on the strengths and weaknesses with the County’s long term care facilities He stated one of the major weaknesses is staffing turnover due to the difficult working environment and lower pay grade He also noted improvements and renovations are needed at some of the older facilities and the ratio of staff to residents could be improved in many facilities However , Mr Parker stated strengths include most of the facilities having a dedicated and well trained management staff with facilities devoting more beds to dementia care and rehabilitation services Mr Parker reported there is good church and civic group involvement and a number of facilities are working on renovations and improvements Mr Parker stated the majority of residents are expressing satisfaction with the care they are receiving and he added open communication is the key component when resolving most problems Mr Parker reported the reimbursement for personal care and special care services has been reduced which continues to be a concern He noted some of the smaller facilities may have a difficult time maintaining current levels of service with the reimbursement reduction , but as of yet , no facilities have had to close due to financial difficulties Mr Parker stated the Committee members continue to educate the public on the issues of long term care for the elderly by attending festivals to hand out literature and answering questions about long term care He stated Committee members are always available to speak with community groups upon request Mr Parker noted they have Committee Members serving on local , regional , and State level boards in an effort to stay informed of the issues facing the elderly Mr Parker stated gas prices have become an issue for some of the Committee Members since they are not reimbursed for mileage He also noted the Committee does not have funding to cover printing costs for the materials they hand out at community events Mr Parker stated he is pleased to report that the Senior Tarheel Legislature has pushed for several years to have pre - employment and random drug screening for all workers in long term care which finally passed last year Mr Parker stated he believes the Committee’s involvement with the long term care facilities in the County does make a positive difference for the residents Commissioner Chad M Stewart stated he is the Commissioner representative to the Nursing Home Adult Care Home Advisory Committee and he spoke on the Committee Members ’ dedication to their mission Commissioner Stewart stated the Committee is a “ working board ” and he stressed the importance of their presence in the County Mr Parker thanked Commissioner Stewart for his support and representation on the Committee Page1867 April 7 , 2014 – 10 00 am Continued Commissioner Tony Braswell commended Mr Parker for his passion and dedication to the issues facing the elderly population Commissioner Braswell asked if there is adequate capacity to care for the increasing dementia population Mr Parker stated he believes the County presently has adequate capacities for dementia care He noted Gabriel Manor in Clayton has actually devoted a little more than half of their beds to dementia care which has helped with the dementia care capacities Mr Parker explained that dementia care is a specialized area and he cautioned that it could be in jeopardy at some point due to the decrease in reimbursements Mr Parker stated currently there is adequate capacity for all care in the County and he noted that the Committee still advocates for people to be able to stay in their homes as long as possible Upon a question by Commissioner Allen L Mims , Jr , Mr Parker reported nursing homes and assisted living homes that care for seven or more residents must obtain a Certificate of Need He stated family care homes with six or fewer residents do not have to obtain the Certificate of Need Commissioner Ted G Godwin stated Mr Parker also serves as Chairman of the Johnston County Community & Senior Services Board of Directors Commissioner Godwin noted the Commissioners often talk about volunteerism in the County and he expressed appreciation for the amount of work that Mr Parker as well as all the Committee members devote to the elderly population in the County 8 Emergency Services – Placement of Selma EMS Peak Ambulance at the Pine Level Fire Dept Johnston County EMS Division Chief Josh Holloman introduced and recognized Selma EMS Chief Bridgette Bass and Board Member Treasurer Tim Peedin , Pine Level Fire Department Assistant Chiefs Paul Allen and Brandon Barbee , and Johnston County EMS Advisory Committee Chairman Rudy Baker Mr Holloman explained the EMS Advisory Committee recently met and discussed creating a new EMS District in the Pine Level area by utilizing an existing Selma EMS unit He stated the Pine Level area is presently served by EMS units stationed from Smithfield , Princeton , Micro , and primarily Selma EMS Mr Holloman reported currently Selma EMS is contracted for two EMT Paramedic units with one operating 24 hours per day and one peak unit operating from 6 am to 6 pm , both located at the Selma EMS station He stated the proposal is to take the Selma peak unit and place it at the Pine Level Fire Department from 9 am to 9 pm Mr Holloman reported the placement would enhance the overall Johnston County EMS System and provide a much needed service in the Pine Level area He stated the placement has been discussed with the Pine Level Fire Department who has agreed to allow the ambulance to be placed at their facility Mr Holloman added the placement would have no additional costs to the County as Selma EMS has agreed to cover the cost of leasing the space from the Pine Level Fire Department and plan to absorb that cost within their existing budget Commissioner Tony Braswell stated the proposal is the result of a yearlong project and he thanked Selma EMS and the Pine Level Fire Department for working together to meet this need for the Pine Level community Commissioner Ted G Godwin asked if the change in the 12 - hour shift from 6 00 am – 6 00 pm to 9 00 am – 9 00 pm would create any logistical problems Mr Holloman stated the data suggests that the 9 00 am – 9 00 pm timeframe will best cover the historical call volume in the Pine Level area and it is the best time to have additional resources available for the EMS system as a whole Commissioner DeVan Barbour asked at what point would staff anticipate needing an additional ambulance or for the 12 - hour unit to become 24 - hours Mr Holloman explained staff has run the data and believes the 12 - hour unit is justified at this point He stated they are uncertain at what point a 24 - hour unit or an additional ambulance would be needed but for now , staff feels the 12 - hour unit from 9 00 am until 9 00 pm will provide good coverage He stated staff will monitor the call volume Commissioner Cookie Pope thanked Selma EMS and the Pine Level Fire Department for working together Page2868 April 7 , 2014 – 10 00 am Continued Commissioner DeVan Barbour moved the Board approve the placement of the Selma EMS peak ambulance at the Pine Level Fire Department from 9 00 am until 9 00 pm Commissioner Cookie Pope seconded the motion which carried unanimously 9 Public Utilities – Requests for Enforcement of Erosion & Sediment Control Ordinance Johnston County Stormwater Administrator Jamie Guerrero explained that since Johnston County’s Erosion and Sediment Control Ordinance became effective on December 1 , 2013 , several towns within the County have expressed interest for the County to enforce the ordinance within their jurisdictions to replace current State enforcement He noted the County has already agreed to enforce the ordinance within the Towns of Clayton and Pine Level The Towns of Benson and Wilson’s Mills have now passed joint Resolutions for Erosion and Sediment Control Enforcement requesting Johnston County to enforce the ordinance within their respective planning jurisdictions Mr Guerrero stated the request from the Towns is for the Board to adopt the joint resolutions for Benson and Wilson’s Mills He offered to answer any questions Commissioner Tony Braswell asked if the requests would necessitate a need for additional staff Mr Guerrero stated staff has been very busy recently , but they have had a lot of success with the program since taking it in - house He noted the Public Utilities Department presently has a vacant position that could be filled if needed to help offset the additional workload Mr Guerrero stated if that position has to be filled it could be funded with revenue from the Erosion & Sediment Control Program fees Mr Guerrero noted since the program is now being administered locally they are getting a lot of compliance from developers and are building good relationships within the development community County Manager Rick Hester stated he recently received an e - mail from the Benson Town Manager complimenting Mr Guerrero on his work with the towns Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board adopted the following two joint resolutions with the Town of Benson and the Town of Wilson’s Mills JOINT RESOLUTION OF THE TOWN OF BENSON AND JOHNSTON COUNTY WHEREAS , the Town of Benson has requested that Johnston County exercise and enforce Chapter 14 , Article XII , Erosion and Sediment Control , County of Johnston , North Carolina Code of Ordinances within the corporate limits and extraterritorial jurisdiction of the Town of Benson ; and WHEREAS , Johnston County does hereby agree to this request ; and WHEREAS , pursuant to the execution of this agreement , both the Town of Benson and Johnston County understand this request must be heard by the North Carolina Sediment Control Commission for their endorsement prior to enforcement action of the Erosion Control Ordinance by the County in said jurisdiction ; and WHEREAS , by General Statute , the North Carolina Sediment Control Commission is the controlling authority for approval of such requests as the final action in the condoning process in the matter specific to Chapter 14 , Article XII , Erosion and Sediment Control NOW , THEREFORE , it is hereby resolved by Joint Resolution of the Board of Commissioners of the Town of Benson and the Board of Commissioners of Johnston County , acting in separate regular sessions of each respective body , as follows 1 The Town of Benson relinquishes its jurisdiction within its corporate limits and extraterritorial zoning jurisdiction with regard to local enforcement of the erosion and sediment program pursuant to GS 113A - 60 , and hereby by agreement and resolution , grants to Johnston County jurisdiction within said areas for the purpose of administering a joint program pursuant to such statute as provided in Chapter 14 , Article XII , Erosion and Sediment Control , County of Johnston , North Carolina Code of Ordinances 2 Johnston County Board of Commissioners does agree to exercise jurisdiction to enforce the ordinance identified herein , within the corporate limits and extraterritorial zoning jurisdiction , pursuant to the authority set forth herein st 3 The initial terms of this Agreement shall be for a period of one 1 year , commencing on the 1 day of April , st 2014 , and terminating on the 1 day of April , 2015 Either party may terminate the Agreement at the end of the initial term Thereafter , this Agreement shall automatically renew for a successive one year term at the end of each term unless notice is given by either part at least four 4 months prior to the end of the current one year term that the party wishes to terminate the Agreement at the end of the current term This Agreement may be terminated at any time upon mutual agreement of both parties 4 Should any claims arise out of services provided by Johnston County under this agreement , the Town of Benson agrees to indemnify and hold Johnston County , its employees , agents , and contractors harmless from any and all claims for liability , loss , injury , damages to persons or property , cost or attorney’s fees resulting from any action brought against Johnston County , its employees , agents , contractors and CommissionersPage3869 April 7 , 2014 – 10 00 am Continued arising as a result of these services performed on behalf to the Town of Benson that are the subject matter of this Agreement , except where such claims result from actionable acts of negligence by Johnston County ADOPTED by the Board of Commissioners of the Town of Benson , North Carolina , meeting in regular session on th the 11 day of March , 2014 , and by the Board of Commissioners of Johnston County meeting in regular session on th the 7 day of April , 2014 JOINT RESOLUTION OF THE TOWN OF WILSON’S MILLS AND JOHNSTON COUNTY REGARDING EROSION AND SEDIMENT CONTROL ENFORCEMENT WHEREAS , the Town of Wilson’s Mills has requested that Johnston County exercise and enforce Chapter 14 , Article XII , Erosion and Sediment Control , County of Johnston , North Carolina Code of Ordinances within the corporate limits and extraterritorial jurisdiction of the Town of Wilson’s Mills ; and WHEREAS , Johnston County does hereby agree to this request ; and WHEREAS , pursuant to the execution of this agreement , both the Town of Wilson’s Mills and Johnston County understand this request must be heard by the North Carolina Sediment Control Commission for their endorsement prior to enforcement action of the Erosion Control Ordinance by the County in said jurisdiction ; and WHEREAS , by General Statute , the North Carolina Sediment Control Commission is the controlling authority for approval of such requests as the final action in the condoning process in the matter specific to Chapter 14 , Article XII , Erosion and Sediment Control NOW , THEREFORE , it is hereby resolved by Joint Resolution of the Town Council of the Town of Wilson’s Mills and the Board of Commissioners of Johnston County , acting in separate regular sessions of each respective body , as follows 1 The Town of Wilson’s Mills relinquishes its jurisdiction within its corporate limits and extraterritorial zoning jurisdiction with regard to local enforcement of the erosion and sediment program pursuant to GS 113A -
