Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Tony Braswell , Cookie Pope , Allen L Mims , Jr , DeVan Barbour , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney David F Mills , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer Commissioner Allen L Mims , Jr led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Commissioner Cookie Pope noted Consent Agenda Item E – Resolution Supporting a Parks and Recreation Study and stated she wanted to make sure that the resolution was just supporting a study and not creating a recreation department or allocating funding Chairman Jeffrey P Carver stated it is his understanding that the resolution is only supporting a study Commissioner Tony Braswell noted Consent Agenda Item D – Veterans Day Proclamation for 2013 and invited everyone to attend the Veterans Day Celebration to be held at Smithfield - Selma High School on Monday , November 11 , 2013 at 11 00 am Commissioner Pope called to everyone’s attention Consent Agenda Item C – Proclamation for National Farm City Week 2013 and encouraged everyone to be aware of the farming community and what it provides for the County Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – October 7 , 2013 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the drivers , inspectors , and others who annually contribute more than 38 billion in value - added income in Johnston County WHEREAS , we welcome new opportunities for trade , hard work , and successful cooperation between farmers and city workers to continue to play a vital role in our country’s success and be a critical resource for countless people here and around the nation WHEREAS , Farm - City collaborations help maintain and improve our nation’s food and fiber supply and contribute to a better quality of life for countless citizens We commend the many Johnstonians whose hard work and A M A T I O N V E T E R A N S D A Y - 2013 WHEREAS , for decades America has paused on the 11th of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in Resolution Supporting a Parks & Recreation Study adopted as follows RESOLUTION SUPPORTING A JOHNSTON COUNTY PARKS AND RECREATION STUDY WHEREAS , tourism in Johnston County is a 197 million dollar industry and is vital to small business owners along Interstates 95 and 40 and US Highway 70 , such as , hotels , restaurants , shopping , attractions , and transportation services ; and WHEREAS , tourism in Johnston County provides over 4000 jobs and 29 million in payroll in the County and generates over 15 million in state and local taxes ; and WHEREAS , the Johnston County Sports Council and the Johnston County Tourism Authority recognize the potential for sports and recreation to drive additional tourism dollars to the County ; and WHEREAS , the public uses a master plan to learn about parks and recreation facilities and services , understand benefits of services , learn about park development process and understand the decisions the governing body makes ; and WHEREAS , Parks and Recreation Boards use a master plan as a tool to promote parks and recreation in the area , to advocate for priorities from public surveys , to shape policy framework for board business priorities and the closeness of homes today due to the growth in the County , it is becoming a safety issue He asked if the Board could help with the situation Following discussion with Mr Thompson , Commissioner County Manager Rick Hester stated he would follow up with Mr Thompson on the situation 4 JCATS – Request County Match for Community Transportation Program Grant Funds Neal Davis , Executive Director for Community & Senior Services JCATS , requested the Board to approve a match in the amount of 76,896 for the North Carolina Department of Transportation Community Transportation Program grant for FY 2014 - 2015 The total grant from the DOT is 622,242 and is the major administrative and capital grant with which JCATS operates The grant consists of the following 1 Current Services provided by JCATS 2 Federal State Certifications and Assurances that the system is meeting all regulatory requirements 3 293,376 Administrative expense request - 194,520 JCATS Administrative Staff - 98,856 other required administrative expenses , ie utilities , vehicle insurance , computer support , etc 4 328,866 Capital budget request - 325,320 - 5 replacement vehicles - 3,546 for other capital expenses ie vehicle lettering and logos , anti - virus licenses , etc Mr Davis offered to answer any questions Chairman Jeffrey P Carver stated he recently heard the Capital Area Transit Authority was going to start a park and ride service in Johnston County at the Walmart on NC Hwy 42 and asked Mr Davis if JCATS would be involved in that service Mr Davis stated JCATS is not involved in the new park and ride service the Capital Area Transit Authority will begin offering He explained the service is being created with special funding from the Department of Transportation to be offered during the interstate rebuilding project in Wake County in the hopes to reduce traffic congestion during construction Mr Davis stated he is unsure if the service would continue after construction is complete Commissioner Ted G Godwin commented the park and ride initiative is an opportunity to see how effective the service could be Mr Davis stated it is in their five year plan to monitor local demand and see how JCATS might be able to interface with Triangle Transit and Capital Area Transit going forward Chairman Carver asked Mr Davis to share his information with the Board on the park and ride service Commissioner Cookie Pope moved the Board approve the matching requirement for the NC DOT Community Transportation Program grant for FY 2014 - 2015 for JCATS in the amount of 76,896 Committee , addressed the Board and stated Four Oaks EMS is requesting the following 1 Obtain concurrence to move forward with establishing a holding company to own and manage all real estate property currently owned by Four Oaks EMS and Four Oaks Fire Department ; 2 Obtain concurrence to move forward with the planning phase to build a new joint EMS Fire facility on the property adjacent to the existing Four Oaks Fire Department This includes concurrence to spend up to 30,000 on preliminary plans , inspections , surveys and related items to develop a proposal to present back to the Commissioners for final approval on facility construction ; and 3 Obtain concurrence to spend up to 30,000 if needed to renovate the existing Four Oaks Fire Department to temporarily house Four Oaks – 10 00 am Continued At the inquiry of Commissioner Allen L Mims , Jr , Mr Baker stated the intent of the holding company would be to oversee only the real estate in perpetuity , and would not have anything to do with the daily operations of the EMS Unit or Fire Department Commissioner Chad M Stewart reported the details of the holding company are still being worked out Commissioner Tony Braswell asked the County Attorney if he had been involved in any of the discussions County Attorney David Mills reported he has not been involved as of yet , but he would be glad to review any agreement language Commissioner Mims stated he would like to make sure that if the County were to one day have to assume the operations of Four Oaks EMS , the County would have a place to operate Mr Mills stated he understood the concerns of Commissioner Mims and he would consider them in his review of any documents Tony Capps , Chairman of the Four Oaks EMS Board of Directors , explained their current building is deteriorating and they began the process of evaluating the situation a long time ago He stated they have been working with the Four Oaks Fire Department to explore opportunities Mr Capps reported the proposed holding company would be a seven member board made up of three Four Oaks EMS Board members , three Four Oaks Fire Department members and one nonaffiliated third party to oversee the real estate in the best interest of Four Oaks Mr Capps stated the intent is to work collaboratively to build a structure that will meet the long term needs of Four Oaks EMS and the Four Oaks Fire Department He stressed there is no intent to put the County in a position where the County would not be able to have a place in Four Oaks to house an EMS truck in the future Mr Capps stated they have a vested interest in Four Oaks and were raised to be strict financial stewards of their funding Mr Capps continued they have separated their funds to show how much money they have from donations , fundraisers , billing , etc versus what is allocated from the County He reported the funding from the County is allocated to their payroll and used only for that purpose He asked the Board of Commissioners to approve their requests so they can begin forming the holding company and start discussions with the County Attorney to make sure the County’s position is protected Mr Capps offered to answer any questions by the Board Commissioner Mims stated he believes Four Oaks EMS is doing is a good thing and that having the nonaffiliated third party on the holding company is a great idea because it will provide for a referee when needed Commissioner Ted G Godwin commented the synergy between the Four Oaks Fire Department and Four Oaks EMS is something that is becoming rare and he Infrastructure Improvements Chandra Coats , PE , Director of Public Utilities , explained the County has been working with the Town of Clayton to transmit and treat high strength wastewater from the East Clayton Industrial Area at the Central Johnston County Regional Wastewater Treatment Facility She reported a forty - five day treatability trial completed last spring confirmed that the County’s facility has adequate capacity to accept and treat the additional flow Initially the County’s facility would treat approximately 500,000 gpd of high strength wastewater , but the proposed agreement would allow up to 900,000 gpd Ms Coats stated the following improvements must be completed in order to transmit and treat the high strength wastewater , 1 modifications to the existing Grifols wastewater pump station ; 2 upgrades to the existing Grifols wastewater pump station ; and 3 chemical feed and monitoring improvements at the wastewater treatment plant Ms Coats stated the total project budget is approximately 750,000 and a potential grant may be available from the Economic Development Administration to fund one half of the capital project costs She reported the local matching funding would be by the County under sewer fund 68 , most likely through a private placement loan and the County would be reimbursed through service charges to Clayton Ms Coats asked the Commissioners to designate the County Manager with signature authority to seek Economic Development Administration grant funding if the proposal is acceptable by the Board Upon a question by Commissioner Ted G Godwin , Ms Coats reported the County’s Grant Consultant feels the County stands a good chance of receiving the grant funding Commissioner Allen L Mims , Jr noted he has been to some of the meetings regarding the project and he asked if the Town of Clayton is in agreement Ms Coats confirmed the Town of Clayton is on board with the project and the current draft agreement calls She reported that as of October 31 , 2013 , the Tax Department has collected 2490 of the real and personal levy for 2013 , and 6631 of the motor vehicle levy Through the NC State Debt Setoff Program , 46 accounts have been paid for a total of 5,33139 as of October 31 , 2013 The next foreclosure sale date is scheduled for November 26 , 2013 Ms Goddard also reported Tag and Tax Together revenue to be she would be retiring effective December 31 , 2013 Ms Goddard stated in her time at Johnston County she has enjoyed working with all the Commissioners , the Administration Staff , and the Johnston County Department Heads along with their staffs Ms Goddard stated she has also enjoyed working with all the citizens in Johnston County and that Johnston County is a great place to work and live Ms Goddard reported during her time with the County , through the Board’s continued support and encouragement , the Tax Office completed two very good revaluations and implemented new software She stated the collections percentage has increased year over year which she credits to the excellent staff in the Tax Office Ms Goddard stated the Board’s leadership for excellent customer service has improved citizens ’ interactions with all County offices and she is proud that the Tax Office staff has followed through with their goals and directives Ms Goddard thanked the Board of Commissioners for the opportunities she has been given at Johnston County and stated she will leave with good memories Ms Goddard stated it has been an honor to serve Chairman Jeffrey P Carver stated on behalf of the good job as well as her staff 12 Manager Reports and Comments A Resolution – Tax Exempt Loan Status for Corinth Holder Fire Department Chairman Jeffrey P Carver requested to abstain from voting on the item and turned the meeting over to Vice Chairman Tony Braswell to lead the discussion , whereupon the Board agreed by consent County Manager Rick Hester reported the Board adopted a resolution granting the Corinth Holder Fire Department tax exempt loan status for the refinancing of their fire station located at 5734 Lake Wendell Road , Zebulon in the amount of 612,13395 at the August 5 , 2013 10 00 am meeting He stated the financing was from First Citizens Bank at an interest rate of 280 over a fourteen year period Mr Hester continued the Fire Department held a public hearing for this refinancing after the Board of Commissioners adopted the resolution granting them tax exempt loan status and First Citizens Bank has requested the Board of Commissioners to adopt another resolution so the date of adoption will be after the fire department’s public hearing date Mr Hester stated the loan amount and terms will remain the same Upon a motion by Commissioner Ted G Godwin , seconded by
